NOTICE
The Ouachita Parish School Board met in regular session on Thursday, December 13, 2012 at six (6:00) o’clock p.m. at its regular meeting place, the Ouachita Parish School Board office.
The meeting was called to order by President Hicks as he welcomed the guests to the meeting.
Business Director Juanita Duke called the roll and the following members were present: Bill Norris, Scott Robinson, A. R. Sims, Jerry R. Hicks, John Russell, Carey Walker and Susan Spence. There were none absent.
The Pledge of Allegiance to the American Flag was led by Carey Walker.
The Invocation was given by Purchasing Agent Bobby Jones.
On motion by A. R. Sims, seconded by Susan Spence, the Board unanimously approved the November 8, 2012 Board Minutes as presented.
Susan Spence moved, seconded by Bill Norris to approve the additions and deletions placed on the Agenda since mail-out. Motion carried unanimously.
Susan Spence moved, seconded by Bill Norris to adopt the revised Agenda. Motion carried unanimously.
Superintendent Webber appointed Angela Crumpton to the position of Pupil Appraisal Facilitator, effective January 7, 2012. Ms. Crumpton is presently the assistant principal at Ouachita High School. The position was left vacant upon the recent retirement of Sharon Roth.
On motion by Bill Norris, seconded by Carey Walker, the Board granted permission to the Superintendent to open the positions of Principal of Swayze Elementary School, now being served by an interim administrator, and Assistant Principal of Ouachita High School for application through the interview process. The position at OPHS will be left vacant when Ms. Crumpton accepts her new assignment as Pupil Appraisal Facilitator. Motion carried unanimously.
On the recommendation of the Director of Special Education, Brenda Adams, Susan Spence moved, seconded by Carey Walker, that the Board adopt the “new” Service Animals Policy (File: IDDFA) as presented. Motion carried unanimously.
David Creed with North Delta Regional Planning & Development presented the three most popular reapportionment plans to the Board for consideration, one of which included the “benchmark” plan in addition to plans 5-A and 5-2. The reapportionment was made necessary by population shifts revealed in the 2010 U.S. Census. Board attorney Elmer Noah commented that once a plan is selected, it will be submitted to the federal Justice Department for final approval. Mr. Noah advised the Board that it would be in their best interest to submit a plan by December 31, 2012. Whereby, a public hearing was called by President Hicks to be held at 5:00 p.m. on December 27, 2012 to allow the public an opportunity to view the plans before the Board meets at 6:00 p.m. to adopt a new reapportionment plan.
Business Director Juanita Duke presented a recommendation from the Finance Committee to the Board for consideration for Playground Equipment Safety – Fall Zones. Whereby, Susan Spence moved, seconded by Carey Walker, to accept the Finance Committee’s recommendation to go forward with playground maintenance presented as follows:
Playground Equipment Safety – Fall Zones:
To purchase surface material and boarders and issue contracts
through General Fund for limited labor to bring the fall zones of existing playground equipment at elementary schools, for areas where the platform height is taller than 4-feet, within the requirements of state law, and
To require administrative procedures to be established to review in
advance the purchase and installation of new playground equipment for safety compliance and to provide for the ongoing maintenance of existing playground fall zones.
State law now requires the Department of Health and Safety to inspect all playgrounds to ensure compliance with state laws regarding safety fall zones. The Ouachita Parish School Board has received citations for 18 elementary schools to bring playground fall zones into compliance with state law immediately.

Total estimated cost of project $293,000
Subsidized funding could possibly come through the Hospital Service District No. 1 appropriated funds, if funds are available, to help offset the cost. Otherwise, the cost will be added to the General Fund budget. Procedures to establish playground fall zones maintenance through routine safety inspections are being formalized to review playground equipment purchases and installation, regardless of the funding source, to ensure compliance with state laws, national playground safety standards, and installation by an insured, certified playground equipment installer.
Motion carried, with Mr. Sims opposing.
Transportation Director Skeeter Boyd discussed the need to purchase a 3500 one-ton, diesel, heavy duty truck for the Transportation Department at a cost of $40,470.00. This vehicle is currently on the Louisiana State Contract and can be purchased without going through the bid process. Funding would come from within the General Fund’s transportation budget. Following discussion, Carey Walker moved, seconded by John Russell, to allow the purchase of a heavy duty truck for use by the Transportation Department. Its main purpose is to provide maintenance service to stranded buses that experience minor breakdowns while in route. Motion carried unanimously.
Special Projects/Safety Coordinator Kenneth Slusher reported that there are no west side projects currently under construction. The east side construction projects continue with five schools that include Ouachita Junior, Swayze, Swartz Upper, Shady Grove and Robinson. The Lakeshore multi-purpose building will be completed in January 2013 and the Jack Hayes project will be ready for bid the first of March.
On the recommendation of Special Projects/Safety Coordinator Kenneth Slusher, John Russell moved, seconded by Susan Spence, to accept the low base bid of Don M. Barron Contractor, Inc. in the amount of $2,051,000 (excludes cost of architect fees, testing and technology infrastructure wiring) for the combined construction projects involving the new weight room at Richwood Middle School and the new technology building and field house renovations at Richwood High School [Bid No. 26-13]. Upon realizing that the base bid excluded Add Alternates No. 1, 2, & 3, Reverend Russell withdrew his motion, seconded by Susan Spence. Reverend Russell felt that at least one of the alternates should be considered and questioned why none were included. Mr. Slusher said that the reason they were excluded was due to budget restraints. A total of $2,327,000 is the budget for the Richwood High and Middle School projects. Including all of the alternates would add an additional $172,000 to the construction cost bringing the total cost of construction to $2,223,000. After considering approximately $305,100 needed for architect fees, testing fees, technology infrastructure and furnishings, $37,892 previously approved by the board for drainage work, and the approximate overage of $91,259 on the turf field, the projects would exceed the available budget of $2,327,000 by approximately $330,251. The architect for the project, Cedric Hemphill, was present and explained in detail what each alternate included. After discussing ways to possibly fund the alternates, Reverend Russell moved, seconded by Susan Spence, to table acceptance of Bid No. 26-13 for the Richwood Middle and High School construction projects until further review of available funding. Motion carried unanimously.
On the recommendation of Special Projects/Safety Coordinator Kenneth Slusher, Susan Spence moved, seconded by Bill Norris, that the Board accept the low base bid from Ouachita Builders in the amount of $543,500 (with a budget of $600,000) for the construction of 2 new classrooms/labs at Sterlington High School [Bid No. 31-13]. Motion carried unanimously.
On the recommendation of Purchasing Agent Bobby Jones, Susan Spence moved, seconded by Scott Robinson, that the Board accept the low bids meeting specifications for chillers from the following two companies: Storer Equipment for (Item One) in the amount of $61,595 and (Item Two) in the amount of $62,470 and accept the low bid from McQuay for (Item Three) in the amount of $92,351 [Bid No. 37-13]. The following bids did not receive any responsive bidders: [Bid No. 29-13] X-Box Systems; [Bid No. 29-13] Surplus Equipment (items will be sold based on the minimum price previously set); [Bid No. 30-13] Lease of Old Swartz School, and [Bid No. 34-13] Air Filters. Motion carried with six “yes” votes and Mr. Sims casting the only “no” vote.
On the recommendation of Purchasing Agent Bobby Jones, Susan Spence moved, seconded by John Russell, that the Board grant permission to bid the following items: (1) Rebid X-Box Systems [Bid No. 38-13]; (2) Copy Paper [Bid No. 39-13]; (3) Sale of Timber on Prairie Road [Bid No. 40-13]; and (4) Air Filters [Bid No. 41-13]. Motion carried with six “yes” votes and Mr. Sims casting the only “no” vote.
Motion by Carey Walker, seconded by Susan Spence, that the Board dedicate the proceeds from the sale of timber on Prairie Road to the additional construction projects selected for Richwood middle and high schools. Motion carried unanimously.
Dr. Webber stated for the record that immediately preceding this board meeting members of the board received one (1) hour of board member training on the new teacher salary schedule mandate under Act 1 of the 2012 Legislative Session, presented by Director of Business Juanita Duke (documentation on file).
There being no further business to discuss, Mr. Sims moved, seconded by Carey Walker that the meeting adjourn. Motion carried unanimously.

TOWN HALL COUNCIL ROOM
CALL TO ORDER/ROLL CALL
Mayor Vern Breland called the meeting to order. A quorum was present and acting. Aldermen present: Caesar Velasquez, Lucy Holtzclaw, Miranda Russ, and Bonnie Dilmore. Alderman Ron Hill was absent.
INVOCATION AND PLEDGE OF ALLEGIANCE
Mayor Breland gave the invocation and led the group in the Pledge of Allegiance.
GUESTS
Attending the meeting were Sunny Meriwether with the Ouachita Citizen, Kimberly Velasquez, Whitley Velasquez, David Elahi, Joyce Hurst and Liam, Chelsey Hurst, and Troy Hibbard.
Town Personnel in attendance were Chief Barry Bonner, Officer Jerre Hurst, Officer Daniel Smith, Reserve Officer Robert George, and Marilyn Dilmore.
AGENDA MODIFICATIONS
There were two items that were left off the agenda by mistake. One is Police Car Repairs, second is Alcohol Permits for the Mobil Super Mart and Southern Meat Market. M/S/C (MOVED, SECONDED, AND CARRIED) (Caesar Velasquez, Miranda Russ) to add the two items under new business.

ALDERMEN REPORTS
There were no reports made by the Aldermen.
PUBLIC PARTICIPATION
Mayor Breland read all of the items listed under the public participation and advised everyone that they may ask questions or discuss any item on the agenda at this time.
There were no discussions, so the Mayor closed public participation.
UNFINISHED BUSINESS
ADOPT ORDINANCE ANNEXING BISHOP JOHNSTON'S 30 +/- ACRES ADJACENT TO STERLINGTON HIGH SCHOOL
M/S/C (Caesar Velasquez, Lucy Holtzclaw) to adopt the proposed ordinance annexing 30 +/- acres adjacent to the Sterlington High School belonging to Bishop Johnston as Ordinance Number 2012-32 (OTG). The vote was 4 ayes and 1 absent, the ordinance is adopted.
ADOPT ORDINANCE AMENDING AND UPDATING THE CRIMINAL STATUES
M/S/C (Miranda Russ, Caesar Velasquez) to adopt the proposed ordinance as Ordinance #2012-33 (VAM) which is amending Ordinance #2000-03 (VAM) its Criminal Statutes to include and encompass the La RS Title 32, in its entirety, including any future amendments and/or enactments and La RS Title 14, in its entirety, including any future amendments and/or enactments to the extent that it does not conflict with Ordinance 93-01. If any conflict exists between the Town's Statutes and those in Title 32 or Title 14, the latter shall be the authority used and applied by the Court. The vote was 4 ayes and 1 absent, the ordinance is adopted.
NEW BUSINESS
INTRODUCTION OF THE 2012 BUDGET AMENDMENTS AND THE 2013 BUDGET ORDINANCES
M/S/C (Caesar Velasquez, Miranda Russ) to introduce the proposed ordinance for the 2012 Budget Amendments and the 2013 Budget. Adoption of the ordinances will take place at the next scheduled meeting on December 11, 2012 at 6:30 p.m. here at the Town Hall.
RE-HIRE DAVID ELAHI AS A POLICE OFFICER
Chief Bonner stated David Elahi left to go to Union Parish Sheriff's Office and wasn't quite happy there and wants to come back to the Sterlington Police Department. M/S/C (Bonnie Dilmore, Lucy Holtzclaw) to table since Alderman Hill was not here, because he has some questions. Miranda Russ and Caesar Velasquez voted nay to table discussion. Mayor Breland stated he spoke to Alderman Hill just before the meeting and he is in favor of the re-hire.
M/S/C (Lucy Holtzclaw, Bonnie Dilmore) to take a five minute recess at 7:44 p.m.
Meeting reconvened at 7:58 p.m.
M/S/C (Caesar Velasquez, Miranda Russ) to accept Chief Bonner's recommendation and rehire David Elahi as a full-time police officer starting January 1, 2013 at the pay rate of $25,000 annual salary. Bonnie Dilmore and Lucy Holtzclaw voted nay. Mayor Breland broke the tie vote with a yes to hire.
POLICE CAR REPAIRS
Chief Bonner reports the Charger has problems with both heads are bad. Interstate Dodge said it will cost between $2,200 - $2,800 to repair.
Discussion led to get Bryan Racer to send a letter concerning the lemon law. It seems as though this vehicle has been in the shop ever since we have had it.
ALCOHOL PERMITS FOR 2013
The Mobil Super Mart and the Southern Meat Market both have applied for Class B Alcohol Permits at $500 each. M/S/C (Miranda Russ, Caesar Velasquez) to renew the Class B permits for both.
MINUTES
August 28, 2012 minutes were approved by Caesar Velasquez and Lucy Holtzclaw with minor corrections.
September 25, 2012 minutes were approved by Miranda Russ and Caesar Velasquez.
November 13, 2012 minutes were approved by Miranda Russ and Lucy Holtzclaw with corrections.
October 23, 2012 minutes were approved by Caesar Velasquez and Lucy Holtzclaw with corrections.
MONTHLY EXPENDITURES
M/S/C (Caesar Velasquez, Lucy Holtzclaw) to approve the monthly expenditures as of November 26, 2012.
BUDGETS
M/S/C (Miranda Russ, Caesar Velasquez) to approve the budgets as of November 26, 2012.
ADJOURN
There were no more items for discussion, a motion was made, seconded (Lucy Holtzclaw, Caesar Velasquez) and carried to adjourn.
