By virtue of a WRIT OF FIERI FACIAS issued from the Honorable Fourth Judicial District Court in and for the Parish of Ouachita, State of Louisiana, in the above entitled and numbered cause to me directed I have seized and taken into my possession and will offer for sale at the Ouachita Parish Courthouse in the City of Monroe, Louisiana, between the legal hours of sale on Wednesday, December 19, 2012, beginning at 10:00 A.M., the following described property, to wit:
Plaintiff is only seizing the interests belonging to the Unopened Succession of John E. Smith, which is a 1/8th undivided interest in each of the following Tracts:
Tract 1
A certain tract or parcel of ground in Lot 1 of Phillips Subdivision in SW-1/4 of SW-1/4, Section 4, Township 17 North, Range 3 East, as per plat on file in Plat Book 12, Page 5, records of Ouachita Parish, Louisiana, more particularly described as follows: FROM the Southeast corner of said Lot 1, run West along the South line of said Lot 1 a distance of 75 feet to the POINT OF BEGINNING; thence from said Point of Beginning run North 00 degrees 58.50 minutes West a distance of 180 feet, more or less, to the North line of said Lot 1; thence run West along the North line of said Lot 1 a distance of 38.1 feet to the Northwest corner of said Lot 1; thence run South along the West line of said Lot 1, a distance of 180.1 feet to the Southwest corner of said Lot 1; thence run Easterly along the South line of said Lot 1 a distance of 52 feet to the Point of Beginning.

Tract 2
Lot 6 and the West 19 feet of Lot 5 of Phillips Subdivision as per plat on file in Plat Book 12, Page 5, Public Records of Ouachita Parish, Louisiana. Said parcel being all of Lot 6; and the West 19 feet of Lot 5 is more particularly described as: FROM the Northeast corner of Lot 5, run West along the North line of Lot 5, 31 feet to the POINT OF BEGINNING; thence run south on a line parallel to the East line of Lot 3, a distance of 162 feet, more or less, to the North line of Wisteria Street; thence run West along the South line of Lot 5 to the Southwest corner of Lot 5, thence run North along the West line of Lot 5 to the Northwest corner of Lot 5; thence run East along the North line of Lot 5, 19 feet to the POINT OF BEGINNING.

A certain lot or parcel of ground situated in the SE-1/4 of the SW-1/4 of Section 4, Township 17 North, Range 3 East, more particularly described as follows: From the northwest corner of the SE-1/4 of SW-1/4 of Section 4, measure south 89º 24.13’ east along the North line of said SE-1/4 of SW-1/4 a distance of 530 feet for the Point of Beginning; thence continue South 89º 24.13’ east along the North line of said SE-1/4 of SW-1/4, a distance of 50 feet; thence running back south 4º, 27.06’ west between parallel lines, parallel to the west line of said SE-1/4 of SW-1/4, a depth of 230.07 feet, LESS AND EXCEPT a strip of 30 feet wide off the north end of the above described tract, being the S-1/2 of a 60 foot wide dedicated roadway, known as Smith Street.

Start at the NE corner of SE-1/4 of SW-1/4 of Section 4, Township 17 North, Range 3 East, thence go West along the North line of said fourth 415 feet to the point of Beginning Proper; thence continue West along the same line of distance of 40 ft.; thence back south between parallel lines a distance of 230 feet, the said parallel lines a distance of 230 feet, the said parallel lines being 40 feet apart.

LESS AND EXCEPT: A parcel of land located in Lots 29 & 20 of Block 1 of Highland Park Subdivision of Lots 4 & 5 of the Keller Estate in Section 4, Township 17 North, Range 3 East, as per plat on file and of record in the Clerk’s office of Ouachita Parish, Louisiana, more particularly described as follows: Beginning at the S/E corner of Lot 29 proceed Northerly along the East line of Lots 29 & 30 a distance of 125 feet; thence running back in a westerly direction between parallel lines, one of which is the south line of said Lot 29 a distance and depth of 175 feet.
