AN ORDINANCE TO ENLARGE THE CORPORATE LIMITS OF THE TOWN OF STERLINGTON, LOUISIANA PURSUANT TO L.R.S. 33:171 ET SEQ., AND PARTICULARLY R.S. 33:180, BY ANNEXING TERRITORY BELONGING TO THE PARISH OF OUACHITA, LOUISIANA, SAID PROPERTY BEING ADJACENT AND CONTIGUOUS TO THE EXISTING BOUNDARIES OF THE TOWN OF STERLINGTON, LOUISIANA, AND OTHERWISE PROVIDING WITH RESPECT THERETO;
WHEREAS, Louisiana Revised Statutes of 1950, Title 33, Section 171 et seq., as amended, provides for the procedure for annexation of territory into the corporate limits of a municipality; and
WHEREAS, there has been compliance with the procedure required by L.R.S. 33:171 et seq., as amended, including but not limited to the following:
A petition (see Exhibit “1”) has been presented to the Mayor and Board of Aldermen of the Town of Sterlington by each nonresident property owner of the areas to be included in the corporate limits, requesting that property owned by petitioners and contiguous to existing boundaries of the Town of Sterlington, and being more particularly shown by vicinity map attached hereto as Exhibit “2”, more particularly described in Exhibit “3”, be annexed in the corporate limits of the Town of Sterlington, Louisiana;
A certificate of the Ouachita Parish Assessor is attached hereto as Exhibit “4” certifying that according to assessment for property taxes for 2013 the property described in Exhibit “3” is owned by the resident property owners who have petitioned for annexation, and the total property tax assessment for parish taxes for 2013 is in the amount of $10,025.00 assessed value (use value), and that full amount represents the value of property owned by the persons signing the petition for annexation;
As reflected by Exhibit “5”, according to the records of the Registrar of Voters, there are no registered voters residing within the territory described in Exhibit “3”; and
Proof of publication of the filing of the petition, as required by L.R.S. 33:172B, and of notice of a public hearing concerning the annexation is attached hereto as Exhibit “6”;
Pursuant to the notice as evidenced by Exhibit “6” the Sterlington Board of Aldermen on the 27th day of November, 2012, and hereto held a public hearing regarding said petition for annexation.
WHEREAS, following said hearing by the Mayor and Board of Aldermen and after careful consideration of all recommendations, comments and objections made at said hearing the Mayor and Sterlington Board of Aldermen declare that it is in the best interest of the Town of Sterlington to annex into the corporate limits of the Town of Sterlington the property described in Exhibit “3”.
NOW THEREFORE,
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the Town of Sterlington, Louisiana, in legal session convened, that the property owned by J. BISHOP JOHNSTON, III and contiguous to the existing boundaries of the corporate limits and located in the vicinity as shown by the map attached hereto and Exhibit “2” and more particularly described in Exhibit “3” be annexed into the corporate limits of the Town of Sterlington, Louisiana.
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and the Board of Aldermen of the Town of Sterlington, Louisiana, in legal session convened, that the Mayor of the Town of Sterlington, Louisiana or his designee, be and they shall hereby be authorized to take all further actions and execute all further documents, resolutions and/or certifications as are required under L.R.S. 33:171, et seq. or other applicable law, as are necessary, proper or desirable, particularly including but not limited to the filing of the entire boundary of the municipality as changed in including but not limited to the filing of the entire boundary of the municipality as changed in order that the annexation of property set forth above be effected at the earliest possible date.
SECTION 3. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the Town of Sterlington, Louisiana, in legal session convened, that all Ordinances or parts of Ordinances in conflict herewith are repealed, but this repeal shall be only insofar as such Ordinances conflict and/or are inconsistent with this Ordinance; and all Ordinances or parts of Ordinances not inconsistent herewith shall continue in full force and effect.
SECTION 4. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the Town of Sterlington, Louisiana, in legal session convened, that the articles, paragraphs, sentences, clauses, and phrases of this Ordinance are deemed to be severable, and if any article, paragraph, sentence, clause, or phrase of this Ordinance shall be declared to be unconstitutional and/or invalid, such unconstitutionality and/or invalidity shall not affect any of the remaining articles, sentences, paragraphs, clauses, or phrases which can be given effect without the unconstitutional and/or invalid provision(s).
The above Ordinance was read and considered by Sections at a public meeting of the Mayor and Board of Aldermen, in regular and legal session convened, voted on by yea and nay vote, passed and adopted this 27th day of November, 2012, with the final vote being as follows:

We are required to monitor your drinking water for specific contaminants on a regular basis. Results of regular monitoring is an indicator of whether or not your drinking water meets health standards. During the reporting period of October 2, 2012, and October 31, 2012, the Westen Utilities, Inc. was required to pull five (5) water samples for testing. Through an oversight in our office, only one (1) sample was pulled. Even though the one (1) sample passed the health standard tests, the Western Utilities, Inc. is still in violation for failure to complete all monitoring all coliform bacteria as set forth in the State and Federal Primary Drinking Water Regulations (Part XII of the La. State Sanitary Code). Therefore the Western Utilities, Inc. cannot be sure of the quality of your drinking water during that time. There is nothing you need to do at this time. We have reviewed the La. Total Coliform Rule & Federal Groundwater Rule requirements to insure that all required monthly monitoring is complete. We will also collect and submit samples to the Shreveport Regional Laboratory in accordance with their weekly schedule for sample submission. Please share this information will all other people who drink this waster, especially those who may not have received this notice directly (for example, people in apartments, nursing homes, schools, and businesses). You can do this by posting this notice in a public place or distributing copies by hand or mail. Should you have any questions, please call Tom Owens at (318) 397-9336. CALL TO ORDER
A regular meeting of the Board of Commissioners, Hospital Service District No. 1 of the Parish of Ouachita, State of Louisiana was called to order at 11:35 A.M. at the Wellness Center, 3215 Cypress Street, West Monroe, Louisiana, by Steve Hall, Chairman of the Board of Commissioners. All references to the “District” refer to the Hospital Service District No. 1 of the Parish of Ouachita, State of Louisiana. All references to the “Foundation” refer to the Living Well Foundation.

Mr. Hall welcomed the District’s new Commissioner, Jeri Beth Watson. Mr. Hall stated that the Wellness Center expansion was going well and appears to be on schedule.

APPROVAL OF MINUTES OF DISTRICT BOARD MEETING OF SEPTEMBER 18, 2012
After review of the minutes of the District’s September 18, 2012 Board meeting, a motion was made by Mr. Mulhearn and seconded by Mr. Gilley to adopt the minutes as presented and the motion was unanimously approved.
QUARTERLY UPDATE OF JPMORGAN CHASE INVESTMENTS
The JPMorgan Chase quarterly investment performance report for the period ending September 30, 2012 was reviewed and discussed by the Commissioners. A decision was made to liquidate some of the investments in this account to meet some upcoming expenses.
EXECUTIVE SESSION FOR PURPOSES OF STRATEGIC PLANNING, INCLUDING WITH RESPECT TO THE FUTURE OF THE WELLNESS CENTER AND RELATIONS WITH GRMC, GLENWOOD RESOLUTION AUTHORITY, INC., AND THE LIVING WELL FOUNDATION
A motion was made by Mr. Gilley, seconded by Mr. Mulhearn, and unanimously approved for the Board of Commissioners to go into executive session for the purposes of strategic planning, including reviewing the Wellness Center monthly financial statements.
Mrs. Culp, Executive Director of the Wellness Center, presented the Wellness Center monthly financial statements and her management report.
Mr. Gilley motioned, Mr. Mulhearn seconded, and the Commissioners present approved the motion to go back into public session.
UPDATE ON ANNUAL REVIEW OF WELLNESS CENTER EMPLOYEE HANDBOOK
After review and discussion regarding additional revisions to the Wellness Center’s Employee Handbook, Mr. Mulhearn proposed, Mrs. Watson seconded, and the Board of Commissioners unanimously adopted the following resolution:
WHEREAS, the Board of Commissioners considers it to be in the best interests of the District that certain clarifying revisions be made to the Wellness Center Employee Handbook regarding a new policy in the case of inclement weather, effective immediately.
RESOLVED, that the Board of Commissioners approves the adoption of the revised Wellness Center Employee Handbook, as presented at this meeting, effective immediately.
RESOLVED, that the Executive Director continues to be authorized to make such further nonmaterial changes to the Wellness Center Employee Handbook as he or she may deem appropriate or desirable from time to time.
REVIEW OF CURRENT FINANCIALS OF DISTRICT (OTHER THAN THE WELLNESS CENTER)
Mr. Hall presented the monthly financials of the District (other than the Wellness Center) ending September 30, 2012.
ANNUAL PREPARATION OF PROPOSED BUDGET AND RATES
Debbie Takewell and Karen Hanna, the District’s CPAs, were in attendance to present a draft of the District’s proposed budget for its 2013 fiscal year, beginning January 1, 2013. After discussion, a few changes were considered desirable, and the final proposed budget was expected to be submitted in time for approval at the District’s November meeting.
UPDATE ON APPOINTMENT OF A COMMISSIONER TO REPLACE VIOLET LINER
Mr. Hall noted that Mrs. Jeri Beth Watson was officially appointed as a member of the Board of Commissioners to the Hospital Service District No. 1 by the Ouachita Parish Police Jury on October 1, 2012 to serve the unexpired term of Violet Liner, said term of office to end on October 6, 2015. The Oath of Office was administered on October 12, 2012.
REVIEW OF UNAUDITED QUARTERLY FINANCIALS OF GLENWOOD RESOLUTION AUTHORITY, INC.
Glenwood Resolution Authority’s Unaudited Quarterly Financial Statements for August 31, 2012 were presented for review and discussion.
REVIEW AND APPROVAL OF RAISES FOR FOUNDATION PERSONNEL
Mr. Mulhearn moved to consider the following resolution:
WHEREAS, Section 2.B(7)(b) of the Cooperative Endeavor Agreement dated January 31, 2007 between the District and the Foundation provides, among other things, that the amendment of the employment terms of the five highest-paid employees of the Foundation are subject to the approval of the District;
WHEREAS, the Foundation desires to increase the salary of Lori Pearce, effective January 1, 2013, as Treasurer/Chief Financial Officer and Secretary of the Foundation;
RESOLVED, that the amendment of the terms of employment of Lori Pearce, as set forth in the written employment letter agreement presented to this meeting, dated October ___, 2012, with terms to be effective January 1, 2013 (which amends her written employment letter agreement dated January 31, 2011, as supplemented by her written employment letter agreement dated November 1, 2011), is approved, confirmed, and ratified.
WHEREAS, the Foundation desires to increase the salary of Tracey Linson, effective January 1, 2013, as Grants Manager of the Foundation;
RESOLVED, that the amendment of the terms of employment of Tracey Linson, as set forth in the written employment letter agreement presented to this meeting, dated October ___, 2012, with terms to be effective January 1, 2013 (which amends her written employment letter agreement dated July 19, 2011), is approved, confirmed, and ratified.
Mr. Gilley seconded the motion. The Board proceeded to a vote, and the motion passed with the unanimous approval of the Commissioners present.
REVIEW OF LIVING WELL FOUNDATION’S EXECUTIVE COMMITTEE MINUTES OF SEPTEMBER 11, 2012 AND OCTOBER 2, 2012
Minutes of the Foundation’s September 11, 2012 Executive Committee meeting were reviewed. A draft of the Foundation’s Executive Committee minutes for October 2, 2012 was unavailable, but a briefing provided by Doug Caldwell, the Foundation’s attorney, was provided for review.
