Proceedings of the Board of Commissioners of the West Ouachita Sewerage District No. 5, Ouachita Parish, Louisiana. Taken at the office of the district, 327 Wallace Road, West Monroe, Louisiana. Monday, October 8, 2012 (regular meeting)

The first item on the agenda was the proposed Westwood duplexes on Wallace Dean Road to consist of 7 buildings(14 individual dwellings). Mr. Lazenby presented the plans for the duplexes and a brief discussion followed. Commissioner Owens made a motion to accept the duplexes upon completion and inspection of the constructed lines and Commissioner Leach seconded the motion. The motion passed by a unanimous voice vote.
Next, was the new office and shop for Volvo Rents an New Natchitoches Road. The plans originally presented have been revised to correct items found to be deficient. Mr. Lazenby presented the revised plans and all agreed the plans are satisfactory. Commissioner Leach made a motion to accept the construction upon satisfactory completion and inspection of the project. Commissioner Owens seconded the motion. The motion passed by a unanimous voice vote.
The next item was the Wallace Dean Duplex Development. Mr. Lazenby presented the revised plans for the duplexes that had previously been tentatively approved. On October 3, 2012, the engineer of record was made aware that the sewer was not installed according to approved plans. Commissioner Leach made a motion to accept the revised sewer plans for the duplexes and Commissioner Leach seconded the motion. The motion passed by a unanimous voice vote.
Next, was a discussion concerning the increased treatment plant costs. Mr. Lazenby presented some preliminary figures and a discussion followed. No action was necessary and none was taken.
The final item was cash disbursements. Mr. Cox presented the disbursements for the month and a brief discussion followed. Commissioner Leach made a motion to accept them as reasonable and necessary and Commissioner Leach seconded the motion. The motion passed by a unanimous voice vote.
No further business being presented, the meeting adjourned at 12:05 p.m.

During the reporting period of September 1, 2012 through September 30, 2012 the West Monroe Water System violated the maximum contaminate level of coliform bacteria as set forth in the State and Federal Primary Drinking Water Regulations [part XII of the Louisiana State sanitary Code (LAC 51:XII)]. Corrective action has been taken to ensure that there is no contamination in the system. This is not an emergency. If it had been, you would have been notified immediately. Total coliform bacteria are generally not harmful themselves. Coliforms are bacteria that are naturally present in the environment and are used as an indicator that other, potentially harmful bacteria may be present. Coliforms were found in more samples than allowed and this was a warning of potential problems. Usually, coliforms are a sign that there could be a problem with the treatment or distribution system (pipes). Whenever we detect coliform bacteria in any sample, we do immediate, extensive follow-up testing of the particular sight, as well as upstream, downstream and every source well to see if other bacteria of greater concern, such as fecal coliform or E. coli are present. We did not find any of these bacteria in our subsequent samples. If we had, we would have notified you immediately. Because all subsequent samples were negative and there was no major line break or loss of pressure, we believe that the source of contamination occurred as a result of outside contamination on the sample tap itself or the sample container and no further corrective action was necessary. You do not need to boil your water or take other corrective actions. However, if you have specific health concerns, consult your doctor. People with severely compromised immune systems, infants and some elderly may be at increased risk. These people should seek advice from their health care providers. General guidelines on ways to lessen the risk of infection from microbes are available from EPA’s Safe Drinking Water Hotline at 1-800-426-4791. We would like to assure you that City is dedicated to providing our customers with a safe and dependable source of water. A resolution ordering and calling a special election to be held in the Town of Sterlington, Parish of Ouachita, State of Louisiana, to dedicate the revenues derived from a special tax therein; making application to the State Bond Commission in connection therewith and providing for other matters in connection therewith.
BE IT RESOLVED by the Mayor and Town Council of the Town of Sterlington, Parish of Ouachita, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Town of Sterlington, Parish of Ouachita, State of Louisiana (the “Town”), that:
SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Section 29(B) of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5, Chapter 6-A and Chapter 6-B of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the Town on April 6, 2013, between the hours of six o’clock (6:00) a.m., and eight o’clock (8:00) p.m., in accordance with the provisions of La. SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in The Ouachita Citizen, a newspaper of general circulation within the Town and Ouachita Parish, published in West Monroe, Louisiana, and being the official journal of the Governing Authority, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more than ninety (90) days prior to the date fixed for the election, which Notice shall be substantially in the form attached hereto as Exhibit A and incorporated herein by reference the same as if it were set forth herein in full.
SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, Town Hall, 503 Highway 2, Sterlington, Louisiana, on April 9, 2013, at SIX THIRTY O’CLOCK (6:30) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the results of the said election.
SECTION 4. Polling Places. The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.
SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on April 9, 2013, as provided in Section 3 hereof. All registered voters in the Town are entitled to vote at said special election and voting machines shall be used.
SECTION 6. Authorization of Officers. The Clerk of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the Mayor and Clerk of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election, including but not limited to, appropriate submission to he Federal Department of Justice under Section 5 of the Federal Voting Rights Act of 1965, as amended.
SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this Resolution shall be forwarded to the Secretary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines in and for the Parish of Ouachita, State of Louisiana, and the Registrar of Voters in and for said Parish, as notification of the special election herein called in order that each may prepare for said election and perform their respective functions as required by law.
SECTION 8. Employment of Counsel. It is recognized, found and determined that a real necessity exists for the employment of Legal Counsel in connection with the election; accordingly, Breithaupt, Dunn, DuBos, Shafto & Wolleson, LLC, Monroe, Louisiana, is hereby employed as legal counsel to perform comprehensive, legal and coordinate professional work with respect to the election. Counsel shall (i) prepare and submit to the Governing Authority for adoption all proceedings incidental to the election; (ii) advise the Governing Authority with respect to the election; and (iii) in the event said election carries, to serve as Bond Counsel in connection with the funding of proceeds of the Tax into Bonds. The fee to be paid Bond Counsel shall be an amount less than the Attorney General's then current Bond Counsel Fee Schedule and other guidelines for comprehensive, legal and coordinate professional work, together with reimbursement of out-of-pocket expenses incurred and advanced in connection with the election, said fee to be payable by the Governing Authority subject to the Attorney General's written approval of said employment and fee.
SECTION 9. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event that election carries for further consent and authority to dedicate the proceeds of the tax, and a certified copy of this Resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.
