RESOLUTION NO. 12-31 A RESOLUTION AUTHORIZING ACTION TO INITIATE THE IMPROVEMENT AND ACCEPTANCE OF A PORTION OF CHEYENNE DRIVE PURSUANT TO LA. R. S. 33:3681, ET SEQ.; AND, FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, La. R. S. 33:3681, et seq. establishes a process whereby a police jury may be required to improve a roadway upon the petition of the landowners representing more than fifty percent of the frontage abutting the road, with the cost of such road improvements to be borne by the property owners abutting the road; WHEREAS, the Ouachita Parish Police Jury has received a Petition signed by the landowners representing more than 50% of the frontage abutting the northern portion of Cheyenne Drive requesting that the Ouachita Parish Police Jury accept this portion of Cheyenne Drive as a public road and make improvements thereto through the process established by La. R. S. 33:3681, et seq.; and, WHEREAS, in accordance with La. Atty. Gen. Op. No. 11-0018 the said petition imposes a mandatory duty upon the Ouachita Parish Police Jury to make improvements to this roadway; accept into the public road system; and, assess the costs of said improvements against the owners of the abutting properties, with said obligation to be secured by paving liens against the properties; NOW, THEREFORE: BE IT RESOLVED by the Ouachita Parish Police Jury in legal and regular session that in accordance with La. R. S. 33:3681, et seq. and La. Atty. Gen. Op. No. 11-0018 the statutory “paving lien” process be initiated for the purpose of making necessary improvements to the northern portion of Cheyenne Drive; accepting said road as a public road; and, assessing the cost of said improvements against the properties abutting the roadway; BE IT FURTHER RESOLVED that the Parish Engineer be, and hereby is, authorized to prepare plans and specifications for the improvement of the subject portion Cheyenne Drive and to advertise said project for bids in accordance with the Public Bid Law; BE IT FURTHER RESOLVED that any implied dedication of the right-of-way of Cheyenne Drive made by the submission of the Petition described above be deemed to be accepted by the Ouachita Parish Police Jury upon the issuance of a Notice to Proceed to the contractor awarded the project for the improvements to Cheyenne Drive and that the Parish Attorney and Public Works Department be, and hereby is, authorized to obtain any additional rights-of-way necessary for the improvement and acceptance of Cheyenne Drive as a parish road; and, BE IT FURTHER RESOLVED that all reasonable and necessary steps be taken such that this project can be completed in accordance with La. REPORTS ALDERMEN REPORTS Alderman Caesar Velasquez stated the town website was getting up to date and they are making many good adjustments. It will continue to be improved and pictures will be needed by the next meeting so they can be posted to the web page. Alderman Ron Hill stated that there was a speed limit sign missing on Old Sterlington Road. When coming from Bartholomew Drive, traveling towards Bayou Point Apartments, there is not a 25 mph posted speed limit sign. Chief Bonner stated that it would be good to have two signs posted. One that says speed zone ahead and a 25mph sign to avoid the “speed trap” controversy. Mayor Breland said he would have Pat McDonald order the necessary signs. AUDIT REPORT Francis Huffman briefly went over the towns audit and findings with the council. He answered a couple of questions the Aldermen had. PUBLIC PARTICIPATION Mayor Vern Breland read items under the public participation and advised everyone that they may ask questions or discuss any items on the agenda. No one had any questions or comments. UNFINISHED BUSINESS ADOPT ORDINANCE FOR DUMPSTERS AND ENCLOSURES Ron Hill stated he thought Lucy Holtzclaw had a question on the proposed ordinance concerning restaurant or medical waste. Bryan Racer stated he talked to her before the meeting and explained that state law supersedes town laws. Mayor Breland stated if you have a dumpster, in most dumpster ordinances you had to have a sewer connection to that dumpster for it to drain into. Most of the places in Sterlington where dumpsters are already placed, there is no sewer readily available; in those locations thus, no requirement was included in the ordinance. Alderman Ron Hill had questions about the existing platform systems in place and future dumpster pads. All new dumpsters are to be placed on a poured concrete pad. (MOVED, SECONDED, AND CARRIED) (Lucy Holtzclaw, Caesar Velasquez) to adopt the Ordinance #2012-26 (BCO) for dumpsters and enclosures. SHS FOOTBALL SCOREBOARD LOGO The section on the sign to put the town logo will be 3 x 10 feet and will consist of the town seal and the choice of two logos. The choice was made by the council to go with the town seal and logo of Faith, Family, and Friends. NEW BUSINESS ANNEX TREY JAY PROPERTY 2.816 ACRES Larry Culp addressed the council by stating he was planning to build another upscale duplex community called Jackson Square. It will have approximately 32 units, and will be patterned after the south. The units will consist of gas lights and balconies. They will be a lot more spacious with more grass and parking. M/S/C (Ron Hill, Miranda Russ) to introduce the annexation of the 2.816 acre plot adjacent to Cliff Bullock Drive and across from Cassie Drive. 2012-13 LGAP GRANT Mayor Breland asked the council to give their ideas to him within the next week on what they would like him to submit. He has several options he is looking at, but waiting to see if their ideas correlate with his. It has to be submitted by September 14th. ROAD AND DRIVEWAY REPAIRS Mayor Breland stated that the driveways for 500, 504, and 508 Davis Avenue where the culverts have been replaced need to be repaired. In addition to that, the cut that was made at La 2 and Fairway also needs to be repaired. He has been holding off till there was enough work because they would charge us a mobilization fee. Pat McDonald sketched it out and has turned it into the engineer for review. The engineer will get in touch with Mayor Breland and tell him what the estimated price will be in order to get the three bids submitted to get the job done. REPLACING SECURITY CAMERAS FOR O.P. SHERIFF’S TAX OFFICE Mayor Breland received a letter from Brad Cammack requesting assistance in purchasing replacement security cameras for the Ouachita Parish Sheriff’s Tax Office. The high estimate is $22,500. Our jurisdiction would pay a prorated portion of this in the amount of twenty dollars. M/S/C (Ron Hill, Lucy Holtzclaw) to pay the prorated share of twenty dollars to O. BE IT ORDAINED THAT THE MAYOR AND BOARD OF ALDERMEN OF THE TOWN OF STERLINGTON, hereby wants to improve the quality of life and enhance the aesthetics in the Town of Sterlington, by providing disposal of appliances at the homeowners request. The Sterlington Public Works Department will provide pickup of appliances to be disposed of from Sterlington residences on the first full week of the month, if weather permits. Pickups will be made between the hours of 8:00 am and 2:00 pm. SECTION 1. SCHEDULING A PICKUP To request an appliance pickup, residents must contact town hall to provide name, phone number, and address. An appliance pickup fee of $5.00 per appliance shall be paid at the town hall prior to the pickup. The homeowner may in person request the fee(s) to be added to the monthly sewer bill. SECTION 2. ITEMS ELIGIBLE FOR PICKUP • Stoves • Refrigerators (must have doors removed) • Freezers (must have doors removed) • Water Heaters • Air Conditioners (window and central) • Washers • Dryers • Dishwashers SECTION 3. PREPARATION FOR PICKUP All appliances must be disconnected from electrical, gas, and water sources. For safety purposes doors on refrigerators and freezers must be removed from the hinges. All appliances must be located outside of the residence in an area where the Sterlington Public Works Department employees can drive up to for loading. Public Works employees will not enter homes or building to remove appliances. All appliances must be clean and empty of its contents. Appliances containing paint, fuel, hazardous chemicals and or materials will not be picked up. Any questions concerning appliance pickup can be made to the town hall.
