U-20181 AND APPROVAL OF METHOD FOR RECOVERY OF ACCRUED EXPENSE AND CHANGE IN RATES Atmos Energy Corporation has filed a petition with the Louisiana Public Service Commission for an exception to LPSC Order No.U-20181 requiring a utility to book post-retirement benefits other than pensions on a pay-as-you-go basis and has requested approval of a method to recover the accrued expense resulting from the gap between accounting for post-retirement benefits other than pensions on a pay-as-you-go basis as compared to an accrual basis as required by FAS 106. Atmos Energy Corporation has proposed three options for recovery of the accrued expense and the approval of any of the three options will result in an increase in the rates paid by customers of both, Trans Louisiana Gas and Louisiana Gas Service, regulatory divisions of Atmos Energy Corporation in 49 parishes in Louisiana, including the parish in which this notice is published. APPROVAL OF MINUTES OF DISTRICT BOARD MEETING OF MAY 15, 2012 After review of the minutes of the District’s May 15, 2012 Board meeting, a motion was made by Mr. Spencer and seconded by Mr. Mulhearn to adopt the minutes as presented and the motion was unanimously approved. EXECUTIVE SESSION FOR PURPOSES OF STRATEGIC PLANNING, INCLUDING WITH RESPECT TO THE FUTURE OF THE WELLNESS CENTER AND RELATIONS WITH GRMC, GLENWOOD RESOLUTION AUTHORITY, INC., AND THE LIVING WELL FOUNDATION A motion was made by Mr. Spencer, seconded by Mr. Gilley, and unanimously approved for the Board of Commissioners to go into executive session for the purposes of strategic planning, including reviewing the Wellness Center monthly financial statements. Mrs. Culp, Executive Director of the Wellness Center, presented the Wellness Center monthly financial statements and her management report. Mr. Mulhearn motioned, Mr. Spencer seconded, and the Commissioners present approved the motion to go back into public session. REVIEW OF CURRENT FINANCIALS OF DISTRICT (OTHER THAN THE WELLNESS CENTER) Mr. Hall presented the monthly financials of the District (other than the Wellness Center) ending May 31, 2012. ANNUAL AUDITOR’S EXIT INTERVIEW David Soignier, CPA of the firm Luffey, Huffman, Ragsdale & Soignier, APAC, was in attendance to give the Louisiana Legislative Audit report for 2011. After due discussion, Mr. Mulhearn proposed, Mr. Gilley seconded, and the Board of Commissioners unanimously adopted the following resolution: WHEREAS, the Board of Commissioners has reviewed the District's Audited Financial Statements for 2011 and discussed the same with David Soignier, CPA, of the firm of Luffey, Huffman, Ragsdale & Soignier, the District's auditor; RESOLVED, the Board approves the District's Audited Financial Statements for 2011 as presented at the meeting, with such further changes as may be approved by the Chairman, and their immediate transmission thereafter to the Legislative Auditor. ANNUAL REVIEW AND PUBLICATION OF THE DISTRICT’S AUDITED FINANCIAL STATEMENTS Further discussion regarding publication of the District’s audited Financial Statements was deferred to the July meeting. UPDATE ON RE-APPOINTMENT OF COMMISSIONER The District continues to follow up on the pending re-appointment of Patrick L. Spencer by the Ouachita Parish Police Jury. APPOINTMENT OF COMMISSIONER TO REPLACE VIOLET LINER Mr. Hall noted that Mrs. Susan Hoffmann was officially appointed as a Commissioner to the Hospital Service District No. 1 by the Ouachita Parish Police Jury on May 21, 2012 and the Oath of Office is to be administered. DISCUSSION/SELECTION OF COMMISSIONER TO ATTEND LIVING WELL FOUNDATION MEETINGS Upon a request for a Commissioner to periodically attend the Foundation’s meetings, Mr. Gilley agreed to do so. ANNUAL SELECTION OF OFFICIAL JOURNAL The following resolution was offered by Mr. Spencer seconded by Mr. Gilley, and unanimously approved by the Board of Commissioners: RESOLVED that the Hospital Service District shall continue to have the proceedings of its Board of Commissioners and notice of the availability of such financial statements as are required by and furnished to the Legislative Auditor published in the Ouachita Citizen. DISCUSSION REGARDING THE ANNUAL PAYMENT TO THE OUACHITA PARISH SCHOOL BOARD RELATED TO THE COOPERATIVE ENDEAVOR AGREEMENT The third payment by the District under the Cooperative Endeavor Agreement with the Ouachita Parish School Board is due by July 1, 2012. The Commissioners agreed to proceed and look forward to the next update from the School Board. APPROVAL OF REVISIONS TO LIVING WELL FOUNDATION’S INVESTMENT POLICY AND INVESTMENT MANAGEMEN AGREEMENT WITH JPMORGAN INVESTMENT MANAGEMENT, INC. Mr. Spencer moved to consider the following resolution: WHEREAS, Section 2.B(7) of the Cooperative Endeavor Agreement between the District and the Foundation and Section 2.10 of the Bylaws of the Foundation provide that the Foundation shall not take certain actions, including any transaction involving $1 million or more, without (i) the approval of the Board of Directors of the Foundation by the affirmative vote of two-thirds of the directors then in office, and (ii) the approval of the Board of Commissioners of the District; WHEREAS, the Foundation desires to amend Sections VIII.1 and VIII.2 of its Investment Policy, which sections relate to diversification and maximum maturities, and to make corresponding amendments to its investment management agreement with JPMorgan Investment Management, Inc. RESOLVED, that the Foundation's proposed amendments to Sections VIII.1. and VIII.2. of its Investment Policy, in the form presented to this meeting, are approved. FURTHER RESOLVED, that the making of corresponding amendments to the Investment Management Agreement dated as of July 2, 2007, by and between JPMorgan Investment Management, Inc. and the Foundation, as amended to date, is approved Mr. Gilley seconded the motion. The Board proceeded to a vote, and the motion passed with the unanimous approval of the Commissioners present. REVIEW OF LIVING WELL FOUNDATION’S EXECUTIVE COMMITTEE MINUTES OF JUNE 5, 2012 The Board of Commissioners reviewed the Foundation’s minutes of the June 5, 2012 Executive Committee meeting. OPENING OF BIDS FOR THE EXPANSION OF THE WELLNESS CENTER The opening of bids for the expansion of the Wellness Center was extended until June 26, 2012 at 11:30 a.m. at the Wellness Center. Upon presentation of the bids at that meeting, all bids will be taken under advisement before being rewarded. APPROVAL/AWARDING OF BID FOR THE EXPANSION OF THE WELLNESS CENTER With the extension of the opening of bids, awarding of the bid is also extended. REPORTS ALDERMEN REPORTS Alderwoman Lucy Holtzclaw announce an EORD Meeting is scheduled for May 21st at 6:30 p.m. at the Sterlington Recreation Center, so we can voice Sterlington's side. Also the girls high school softball team is going undefeated to the state championship this weekend. STUDENT CITIZEN AWARDS Alderwoman Lucy Holtzclaw presented the Student Citizen Awards to Kaitlynn Harrison a Sterlington High School Student, Garrett Dolecheck a Sterlington Jr. High School Student, and Nathanael Holtzclaw a Sterlington Elementary School Student. PUBLIC PARTICIPATION Mayor Pro Tem Caesar Velasquez read all of the items listed under the public participation and advised everyone that they may ask questions or discuss any item on the agenda. There were no discussions. UNFINISHED BUSINESS ATMOS FRANCHISE AGREEMENT M/S/C (Ron Hill, Lucy Holtzclaw) to table the Atmos Franchise Agreement until the May 8th meeting. ADOPT ORDINANCE ALLOWING GOVERNMENT ENTITIES TO TAP ONTO SEWER SYSTEM M/S/C (Miranda Russ, Lucy Holtzclaw) to adopt the proposed ordinance as Ordinance Number 2012-23 (SED) which allows government entities to tap onto the Town of Sterlington Sewer System. NEW BUSINESS EXECUTIVE SESSION - HIRING NEW POLICE OFFICER M/S/C (Ron Hill, Lucy Holtzclaw) to enter into executive session at 6:50 p.m. to discuss personnel matters. Reconvened meeting at 7:32 p.m. M/S/C (Ron Hill, Miranda Russ) based on the Chief's recommendation to hire David Elahi as a police officer on a 180 day probationary training period, plus send him to the POST academy. MINUTES M/S/C (Bonnie Dilmore, Miranda Russ) to approve the minutes for March 13, 2012 with minor corrections. M/S/C (Bonnie Dilmore, Miranda Russ) to approve the minutes for March 27, 2012. Lucy Holtzclaw abstains. MONTHLY EXPENDITURES M/S/C (Ron Hill, Miranda Russ) to approve the monthly expenditures as of March 28 through April 24th. BUDGETS Alderman Ron Hill questioned the new line item named Collection Cost. The Town Clerk looked it up and reported it was the Sheriff's Office property tax collection fee. Aldermen present: Bonnie Dilmore, Lucy Holtzclaw, Ron Hill. INVOCATION AND PLEDGE OF ALLEGIANCE Ron Hill gave the invocation and led the group in the Pledge of Allegiance. GUESTS In attendance were Kim Velasquez, Antonio Velasquez, Carmen Velasquez, Sarah Carmichael, and Sonny Meriwether. Town Personnel in attendance were Laura Yeates, Barry Bonner. REPORTS ALDERMEN REPORTS Alderman Ron Hill mentioned in his personal investigation of the speed limit from Fairway to Ouachita City Road that a safe speed limit should be 30 mph and 25 mph in the curves. He believes although the ordinance was passed we should consider reopening it. Mayor Pro Tem Caesar Velasquez stated after discussing the situation with the mayor, the mayor suggested leaving the 35 mph speed zone all the way through and put the yellow 25 mph DOT suggested speed signs at the curves. Alderman Bonnie Dilmore suggested putting reflector signs in the curves so it could be more visible. Lucy Holtzclaw stated that the next scheduled meeting would be the last Student Citizen of the month until school resumes in August. Mayor Pro Tem Caesar Velasquez also added that we did have the Cleanest City judging last week and stated we should be hearing about the results on the 11th. Alderman Ron Hill said that sometime in June he would like to honor public works for all their hard work preparing for the Cleanest City judging. PUBLIC PARTICIPATION Mayor Pro Tem Caesar Velasquez read items under the public participation and advised everyone that they may ask questions or discuss any items on the agenda. Sarah Carmichael asked what is the Taylor Street Drainage Project . Mayor Pro Tem Caesar Velasquez explained that the village area has had a tremendous problem with flooding until the town began doing some work on it within the last year or so. He stated that the ditches were re-leveled and culverts were replaced. Ron Hill mentioned it has even caused problems with residents sewer. Alderman Ron Hill stated he had a few things to say about the business regarding the amendment of the Ordinance 2011-02 (OTG). He is opposed to making the change because a month between meetings is too much of a time lapse and two meetings was one of the rationales for increasing the aldermens pay. Mayor Pro Tem Caesar Velasquez explained that all this is, is to allow an option on the first meeting of every month. Now or in the future, if there are no important agenda items that the meeting could be called off. It would only be a temporary change, and we would still have two meetings a month unless we deem differently. NEW BUSINESS COMMUNITY DEVELOPMENT BLOCK GRANT DISASTER RECOVERY INFRASTRUCTURE PROGRAM RESOLUTION Mayor Pro Tem Velasquez stated according to the mayor, our cost right now is $38,000. Ron Hill stated this is a resolution in support of a grant that we are committing $28,900 and if we need another 10-12 thousand we will be given that from the grant, which means we will try to get the other $10,000 back basically. (The actual amount is $26,950). (MOVED, SECONDED, AND CARRIED) (Ron Hill, Lucy Holtzclaw) to adopt the Resolution for the Community Development Block Grant Disaster Recovery Infrastructure program with the Urban Housing Development committing local funds of $28,900 for the Highland Subdivision Drainage Project, which we commonly refer to as Taylor Street Drainage Project. US DEPARTMENT OF COMMERCE LETTER (WINROCK) Mayor Pro Tem Velasquez stated he spoke to Mayor Breland and he is not sure what they are wanting. We need more information as to what kind of support they are requesting. M/S/C (Ron Hill, Lucy Holtzclaw) to table pending further information and input from the Mayor. STATUS OF OFFICER JACOB GREER Mayor Pro Tem Velasquez stated he talked to the chief and there were some misunderstandings on when Jacob Greer would actually be leaving. He is still active duty until next week at the latest pending his physical with Ouachita Parish Sheriffs Office (O.P.S.O.). At this point, we are just waiting until the end of next week when he completely separates from the Sterlington Police Department. Chief Bonner stated that he is not actively working right now due to his vacation time and days off. He has also turned in his ticket book and pending his physical and anything short of a defect or physical deformity, he is hired with OPSO. Chief Bonner stated stranger things have happened and given that, his recommendation would be to put David Elahi on a reserve status until Jacob Greer leaves. The consensus of the Council did not want to see Officer David Elahi put on reserve status. LMA WEBINAR Mayor Pro Tem Caesar Velasquez stated that he took the webinar and said he thought it was very informative. In the sake of getting more participation from the council, he asked the mayor to allow him to ask the council members to take the webinar. It’s only a 30-45 minute webinar and thought everyone would get something out of it. The submission deadline for the Community Achievement Award is June 15, 2012. This would be for improvement of the council to give them a better idea of how it works. TOWN MEETING DATES Discussion was at length on changing the first meeting date of the month to an optional meeting if it was needed. M/S/C (Lucy Holtzclaw, Bonnie Dilmore) to introduce an amendment of Ordinance No. 2011-02 (OTG) to make the 1st meeting on the 2nd Tuesday of the month an optional meeting (if needed). REPORTS ALDERMEN REPORTS Ron Hill asked Mayor Breland to have public works to get the speed limit signs for Old Sterlington Road to reflect what our new ordinance states. Mayor Breland reported the State of Town Address was today and there were approximately fifty people there. Mayor Breland stated we won the Cleanest City Contest in our District and the plaque presentation should be sometime the first week of June. Mayor Breland stated the LMA District C Meeting is scheduled for June 11th in Rayville and he will need a count of who will be attending. STUDENT CITIZEN AWARDS Alderwoman Lucy Holtzclaw stated this will be the last presentation of awards until school starts again. She presented the Student Citizen Awards to Cason Handy a Sterlington High School Student, Emma Beth Wactor a Sterlington Jr. High School Student, and Braeden Bonner a Sterlington Elementary School Student. There were no discussions. Mayor Breland went to New Business Item number 3 Cooperative Endeavor Agreement with Larry Culp first. NEW BUSINESS COOPERATIVE ENDEAVOR AGREEMENT WITH LARRY CULP Alderman Ron Hill asked to table this, since the attorney sent this today and he didn't get a chance to look at it until meeting time. Mayor Breland asked Mr. Culp if that would hold him up if we put it off this meeting? Mayor Breland stated we could call a special meeting for next week. Mr. Culp answered that was fine with him. A couple of Aldermen had some questions for Mr. Culp to answer concerning the construction of more duplexes. M/S/C (Bonnie Dilmore, Ron Hill) to table discussion and call a special meeting for May 29th at 6:30 p.m. here at the Town Hall. ENERVEST Ricky Collins was here and explained the trouble they have with people constructing or moving a home within a few feet of a gas well. He stated there are no state laws, but for safety reasons the company is requesting an ordinance stating no buildings or structures shall be constructed within a 100-foot radius of any oil or natural gas well; plus no building permits will be issued to anyone with a gas well on their property unless the company has been notified and is in agreement of construction. Mayor Breland wants this to be inserted in the Planning and Zoning Code. M/S/C (Ron Hill, Lucy Holtzclaw) to introduce the language into an ordinance and the Planning and Zoning Code. Mayor Breland asked Attorney Katy Balsamo to get with him on putting this in the right place in the Planning and Zoning code. UNFINISHED BUSINESS ATMOS FRANCHISE AGREEMENT Mayor Breland stated there is a bill in the legislature requiring a cap on franchise fees. He suggested tabling this until after the LMA meeting in August to see what the legislature does. M/S/C (Ron Hill, Miranda Russ) to table the Atmos Franchise Agreement until after the LMA Meeting in August. ADOPT TOWN MEETING DATES ORDINANCE M/S/C (Lucy Holtzclaw, Caesar Velasquez) to table until the following meeting. Discussion led to the canceling of the June 12th town meeting, since there will not be a quorum present. Ron Hill made that motion, with Miranda Russ seconding the motion. US DEPARTMENT OF COMMERCE (WINROCK) Alderman Caesar Velasquez stated this would not be beneficial for the town in the long run, he made a motion to remove this item from the agenda, with Lucy Holtzclaw seconding the motion. LMA COMMUNITY AWARDS Alderman Velasquez suggested everyone take the webinar on the LMA Website to see how to prepare for participating for the award. He sent the Aldermen an email for the short cut to the webinar. Mayor Breland stated it looks like Economic Development will be the way we need to go. He did not realize how much publicity we had in our area. He will send everything he has been looking at to the Aldermen to help him get something prepared. BACK TO NEW BUSINESS DUMPSTER ENCLOSURES Mayor Breland mentioned we have provisions in the planning and zoning code requiring an enclosure for dumpsters. The problem is the existing businesses and apartments that were here before our Planning and Zoning Code went into effect. During the cleanest city contest there was one business in particular, that we had to talk to every day about picking up their trash. Their dumpster is not enclosed and when it is full the lid does not close all the way and trash flies out when the wind blows. Mayor Breland asked our town attorney Katy Balsamo to prepare an ordinance for this. There was not a motion for introduction of the ordinance. DECLARING TWO LAWN MOWERS AS SURPLUS PROPERTY Mayor Breland informs we have a Ferris mower that has over 900 hours on it and an Ex-Mark that has over 1,000 hours on it. He would like to see these two declared as surplus property, since the repair cost is so high and purchase two new mowers. He also mentioned earlier this year we purchased a Gravely mower at state contract pricing for $9,450 from Twin City Outdoors. We would get the two new ones at the same state contract price of $9,450 each. M/S/C (Caesar Velasquez, Lucy Holtzclaw) to declare the Ferris and the Ex-Mark as surplus property and advertise for bids and purchase two new Gravely mowers from Twin City Outdoor for $9,450 each which is state contract pricing. MINUTES M/S/C (Ron Hill, Lucy Holtzclaw) to table the approval of the May 8th minutes to listen to the recording for some corrections to what is typed. MONTHLY EXPENDITURES M/S/C (Miranda Russ, Caesar Velasquez) to approve the monthly expenditures with the correction of the Moore and Patron bill for $552 on Public Works should be on Police Department. BUDGETS There were some questions on the General Government Budget under item Drainage/Road Expenditures $128, wondering if this should be on Drainage Budget and then Electricity and Gas $147.78 should be under utilities.
