Following discussion and review of the Tobacco Settlement Agreement Resolution, Bill Norris suggested that a correction be made in the last sentence of the Resolution referring to the source of funds as being derived from accrued interest, which is incorrect, and asked the Board to consider changing the wording to reflect that the funds are withdrawn from the investment (Millennium Trust) account balance. Following the revision to the EEF Resolution and recommendation of Business Manager Juanita Duke, Bill Norris moved, seconded by Susan Spence, that the Board adopt the amended Educational Excellence Fund (EEF) Resolution relative to Louisiana R.S. 39:99 and Louisiana R.S. 39:98.3, which were consequences of the Tobacco Settlement Agreement and the resulting Constitutional Millennium Trust that includes the Educational Excellence Fund authorizing the Superintendent to grant permission to withdraw these funds from the investment account balance of $1,706,905.26 as of December 31, 2011 in the amount of $180,217.13 for specific purposes, i.e., remedial programs, more fully explained in the Plan which has already received approval from both the State Department of Education and Louisiana House of Representatives Committees. Motion carried unanimously. On the recommendation of Business Manager Juanita Duke, A. R. Sims moved, seconded by Scott Robinson, that the Board grant the matching funds request of Pinecrest School up to the maximum amount allowed of $4,950.00 as they have met all requirements set by the Board to receive matching funds for capital projects at their school. Motion carried unanimously. On the recommendation of Business Manager Juanita Duke, Susan Spence moved, seconded by Carey Walker, that the Board grant the matching funds request of Jack Hayes Elementary School in the amount of $1,420.00 as they have met all requirements set by the Board to receive matching funds for capital projects at their school. Motion carried unanimously. Out of concern for the financial impact the governor’s proposed education reform plan and budget cuts will have on school districts, Business Manager Juanita Duke presented the following recommendations from the Finance Committee for the Board’s consideration: Recommendation #2 To not purchase textbooks from the 2011-12 textbook adoption for the 2012-13 school year. Recommendation #3 Freeze funding of School Board’s School Matching Fund Policy effective February 10, 2012 and for the remainder of the 2011-12 fiscal year and in 2012-13 and 2013-14, and to reconsider the policy annually thereafter. Recommendation #4 To freeze all out-of-state travel funded by General Fund or local funding sources, except when deemed to be necessary by the Superintendent, effective February 10, 2012 and for the remainder of the 2011-12 fiscal year and for the next two years. Recommendation #5 To suspend new applications for all personnel, except for certified teachers and bus drivers for the remainder of the 2011-12 fiscal year. (*Recommendation #1- approved in the meeting of January 12, 2012) On motion by Carey Walker, seconded by Scott Robinson, the Board adopted the Finance Committee’s Recommendation #2 to suspend the purchase of textbooks from the 2011-12 textbook adoption for the 2012-13 school year. Motion carried unanimously. On motion by Scott Robinson, seconded by Bill Norris, the Board adopted the Finance Committee’s Recommendation #3 to freeze funding of the School Board’s School Matching Funds Request Policy effective February 10, 2012 and for the remainder of the 2011-12 fiscal year, in 2012-13 and 2013-14, and to reconsider the policy annually thereafter. Motion carried, with Mr. Sims casting the only “no” vote. On motion by Bill Norris, seconded by Carey Walker, the Board adopted the Finance Committee’s Recommendation #4 to freeze all out-of-state travel funded by General Fund or local funding sources, except when deemed necessary by the Superintendent, effective February 10, 2012 and for the remainder of the 2011-12 fiscal year and for the next two years. Bill Norris amended his motion to include additional language in the content of his motion, seconded by Carey Walker, as follows: That the Board adopt the Finance Committee’s Recommendation #4 to freeze all out-of-state travel funded by the General Fund or local funding sources, except when deemed necessary and “more cost effective” by the Superintendent, effective February 10, 2012 and for the remainder of the 2011-12 fiscal year and for the next two years. Motion carried unanimously. On motion by Bill Norris, seconded by Scott Robinson, the Board adopted the Finance Committee’s Recommendation #5 to suspend the acceptance of new applications for all personnel, except for certified teachers and bus drivers for the remainder of the 2011-12 fiscal year. This is mainly due to the cost of accepting applications and having to perform background checks on the applicant. The cost to provide those background checks is about $46.25 per person. The estimated savings are approximately $5-7,000 for the remainder of this school year. Motion carried unanimously. Dr. Webber discussed the seriousness of the expected budget cuts coming from the state and how hard it is for the Board to make these tough decisions that affect our system. Special Projects/Safety Coordinator Kenneth Slusher reported that all the contracts are signed to begin construction on the WMHS STEM building very soon. On February 21st bids will be opened for construction of eastside OPHS bathrooms and bids will open for the construction of the Lakeshore Elementary multi-purpose building on February 23. President Jerry Hicks admitted that he was worried with concerns about our future funding and budget cuts, and after reviewing the Governor’s plans for education reform, he is very guarded on his position as to how it will impact our district. He emphasized the need to prepare to work together to prevent cutting personnel except through attrition. The next Board meeting will be held on February 23rd at 6:00 P.M. She said the person she talked to is interested in bringing a water skiing championship to Monroe. She stated that they require $25,000.00 in cash and $25,000.00 in media and PR value. The host is to also provide a Saturday night function for about 300 athletes. She reported that she has spoken with ULM ski director concerning the use of ULM facilities. She reported that she will have more information at the November board meeting. Alana Cooper reported that she was approached by Bassmaster to host a tournament the 1st week in June of 2012. She said the tournament is four (4) days with about 200 fishermen. She requested board approval to host the tournament and dedicate funds to help defray the cost. She stated that she recommend funds of $2,500.00 for this size tournament if the Convention and Visitors Bureau is the successful bidder. Mr. Cammack stated that this matter was time sensitive for the employee to be registered for the upcoming semester. Mr. Cammack stated that he had an item to add to the agenda regarding the hiring of an engineer for the Capital Outlay Applications. Mr. Cammack stated that there was an item under Ms. Moore’s name for the Capital Outlay requests but it was not specific enough to hire an engineer for the project. PUBLIC COMMENT PERIOD: The president spoke regarding the public comment period. No one appeared or came forth to speak during this time. PUBLIC WORKS James Purdy – 25 Years Melinda Kiper – 15 Years 911 OFFICE Shantrail Scott – 15 Years VISITORS: The President recognized Paul Farr with the Clerk of Court’s Office. Mr. Farr spoke regarding parking spaces at the courthouse. Mr. Caldwell stated that they have been looking for additional spaces and there should be space available when the state employees move. Mr. Mitchell stated that construction on the River Market project is blocking spots and some of those will be permanently lost. Mr. Mitchell also stated that the police jury is in the process of acquiring a lot that could be for additional parking. No action was taken on this matter. The President recognized Judy Bell with The Wellspring and asked to take up the matter under his name concerning the U.S. Department of Justice Family Justice Center Grant. Ms. Bell stated that the funding would be in an amount of $400,000. Ms. Bell also stated that this authorization would allow The Wellspring to continue as the managing agency and would allow Mr. Smiley to sign necessary documents. Motion offered by Mr. Smiley, seconded by Mr. Caldwell to authorize the request for the U.S. Department of Justice Family Justice Center Grant. Motion passed without opposition. The President recognized Bill Roark. Mr. Roark stated that he is working on two additional signatures on the Raccoon Bayou project. Mr. Roark stated there are four signatures needed for the first phase of the L6 and L8 ditches. Mr. Roark has stated that he has one signature and will be getting another this week. No action was taken on this matter. Mr. Calhoun asked to take up the matter concerning the Vernon Street Canal right-of-way. Mr. Calhoun stated that he would like Mr. Roark to determine the current right-of-way. Mr. Mitchell stated that Mr. Roark’s role was typically right-of-way acquisition and the preliminary abstract work could be done in-house to determine the current right-of-way. No action was taken on this matter. DEPARTMENT HEAD REPORTS The following department heads presented monthly reports. CODE ENFORCEMENT: Deputy Wayne Heckford Deputy Heckford stated that he did not have any items to add to his written report. FIRE DEPARTMENT: Chief Patrick Hemphill Chief Hemphill stated that they will be hiring new firefighters this year. He will continue to process the list of candidates and the list should be ready next month. GREEN OAKS: Mr. Mike Rhodes, Director Mr. Rhodes stated that the construction on the classroom building has started. HOMELAND SECURITY & EMERGENCY PREPAREDNESS AGENCY: Mr. Tracy Hilburn, Director Mr. Hilburn stated that Herbert Land Architects will be designing a storage facility for storage of trailers and equipment. HOUSING: Ms. Peggy Steele, Director Ms. Steele stated that she did not have any items to add to her written report. WORKFORCE INVESTMENT: Ms. Doretha Bennett, Director Ms. Bennett advised that the state was in their office last week and they have been selected for a Pilot Program for re-employment for people seeking unemployment. Ms. Bennett spoke regarding a travel request for two employees to attend the National Association of Workforce Development Professionals in Las Vegas, NV on May 7-9. LSU EXTENSION SERVICE: Mr. Richard Letlow Mr. Letlow stated that he had a cooperative endeavor agreement that needed to be renewed and asked for approval for the President to sign the agreement. PUBLIC WORKS COMMITTEE MEETING The chairman, Mack Calhoun, called the Public Works Committee meeting to order at 6:11 p.m. The chairman recognized Dr. Reddix, District A. Dr. Reddix requested to hire Lazenby and Associates to research the acceptance of concrete streets. Mr. Caldwell asked that Lazenby and Associates submit an estimate for the project. Discussion ensued. No action was taken on this matter. Mr. Cammack spoke regarding the change orders for the ARRA Road Projects for Good Hope Road and Louisiana Avenue and recommended approval. Mr. Robinson questioned the cost and Mr. Cammack explained that the tuition for the course was a significant portion of the total expense. Perpetual Care Endowment Trust (hereinafter the “Trust”) to the Ouachita Parish Police Jury on August 31, 1998; NOW THEREFORE: BE IT RESOLVED that the aforementioned Board Members have unanimously authorized and empowered the personnel whose names are listed below to do and perform any and all official acts on behalf of the Ouachita Parish Police Jury, as it pertains to the Trust, including, but not limited to: a) Executing, signing, and/or acknowledging any trust agreements, official trust documents, or any other written instruments that are deemed to be necessary in order to carry out the official business of the trust; and b) Granting investment authority to Regions Bank (“Regions”) as the trustee of the Trust. This investment authority includes, but is not limited to, the authority to invest and reinvest Trust assets in such manner and in suck investments as Regions deems appropriate per state law and subject to the Ouachita Parish Police Jury’s written investment objectives, policies, guidelines, and restrictions, as may be amended form time to time by the Ouachita Parish Police Jury. Motion offered by Dr. Reddix, seconded by Ms. Moore to approve up to $10,000 from the general fund to complete the tire removal. Mr. Cammack stated that his office had received $7,144 from the U.S. Department of Interior revenue sharing that could be used toward the project. Substitute motion was offered by Mr. Caldwell, seconded by Mr. Smiley to spend up to $7,144 from the general fund on the project. Discussion ensued. Substitute motion failed with Dr. Reddix, Mr. Robinson, Ms. Moore and Mr. Calhoun opposing. Main motion passed with Mr. Smiley and Mr. Caldwell opposing. MR. PAT MOORE, DISTRICT F: Ms. Moore asked for an update on the Huntington Park Subdivision. Mr. Cobb stated that Public Works has not received anything from Mr. Holtzclaw. No action was taken on this matter. Ms. Moore asked Mr. Cammack to speak about vehicle decals. Mr. Cammack stated that state law requires that all public vehicles have to be identified with emblems or markings. Mr. Cammack recommended that further identification be included on the decals for outside districts and internal departments. Mr. Robinson recommended against incurring the unnecessary costs associated with removing the existing decals. Motion offered by Mr. Caldwell, seconded by Ms. Moore to mandate outside district and internal departments to issue their own decals to further identity their vehicles. Motion passed without opposition. Ms. Moore spoke regarding the State Capital Outlay request. Ms. Moore stated that the Southeast Industrial Park needs to be removed due to now having a certified industrial site in Southeast Ouachita Parish. Ms. Moore asked to resubmit for East Ouachita Comprehensive Sewerage Plan and to resubmit for the Ouachita Parish Courthouse parking garage. Mr. Cammack stated that applications for the I-20 Frontage Road West and the East Ouachita Industrial District have previously been submitted, but he would see if an application could be substituted. Mr. Caldwell asked that Mr. Cammack contact Mr. Robbie George with S. E. Huey to get an estimate for the project. No action was taken on this matter. * * * ADMINISTRATIVE REPORTS: The president recognized Mr. Cammack, Treasurer. FISCAL: Mr. Brad Cammack, Treasurer Mr. Cammack spoke regarding a change order to the telephone system agreement to add door security features since the existing door security system had just broken and recommended approval.
