APPROVAL OF MINUTES OF DISTRICT BOARD MEETING OF DECEMBER 20, 2011 After review of the minutes of the District’s December 20, 2011 Board meeting, a motion was made by Mr. Mulhearn and seconded by Mr. Gilley to adopt the minutes as presented and the motion was unanimously approved. QUARTERLY UPDATE OF JPMORGAN CHASE INVESTMENTS Jay High, JPMorgan Chase Vice President Investment Advisor, was unable to attend the District’s meeting; however, the JPMorgan Chase quarterly performance report for the period ending December 31, 2011 was reviewed and discussed by the Commissioners. EXECUTIVE SESSION FOR PURPOSES OF STRATEGIC PLANNING, INCLUDING WITH RESPECT TO THE FUTURE OF THE WELLNESS CENTER AND RELATIONS WITH GRMC, GLENWOOD RESOLUTION AUTHORITY, INC., AND THE LIVING WELL FOUNDATION A motion was made by Mr. Mulhearn seconded by Mr. Gilley and unanimously approved for the Board of Commissioners to go into executive session for the purposes of strategic planning, including reviewing the Wellness Center monthly financial statements. SELECTION OF DISTRICT-DESIGNATED MEMBERS OF GRMC’S BOARD OF TRUSTEES Ms. Liner moved to consider the following resolution: WHEREAS, Schedule 7.1(c) of the Asset Purchase Agreement among the District, IASIS Glenwood Regional Medical Center, LP (IASIS), and others provides that at all times during IASIS' ownership of Glenwood Regional Medical Center, the District shall have the right to designate fifty percent (50%) of the hospital's Board of Trustees, which shall be composed of IASIS's chief executive officer, members of the hospital's medical staff, and non-physician community leaders; WHEREAS, the hospital's Board of Trustees is composed of ten members, whose terms are staggered; the terms of two members designated by the District (Mr. Wade Bishop and Mr. Whitty Hood) expire in early 2014; the terms of two members designated by the District (Ms. Pam Accardo and Todd Colvin) expire in early 2013; the term of one member designated by the District (Mr. Jerry Lazenby) expires now in early 2012; and the District has the right at this time to designate one member to replace him, which member is to serve for a three year term expiring in early 2015; RESOLVED, that the Board of Commissioners hereby designates Jerry Lazenby to serve as a District-designated member of the hospital's Board of Trustees for a 3 year term expiring in early 2015. After due discussion, Mr. Mulhearn seconded the motion, the Board proceeded to a vote, and the motion passed with the unanimous approval of the Commissioners present. DISCUSSION OF AIA CONTRACT REGARDING THE HIRING OF AN ARCHITECT FOR THE POSSIBLE EXPANSION OF THE WELLNESS CENTER Mr. Hall advised that possible changes to the AIA contract with Fuqua & Partners Architects are being made. Joe Fuqua will be in town for other business on Friday, January 20th, and plans to tour the Wellness Center with Mr. Hall and Mrs. Culp. REVIEW AND APPROVAL OF LIVING WELL FOUNDATION’S PROPOSED 2012 BUDGET The Commissioners reviewed the Foundation’s Proposed 2012 Budget, but due to an error in the Net Assets Ending, Ms. Liner made a motion to table the Foundation’s Proposed 2012 Budget until a correction is made. Mr. Gilley seconded the motion and the Commissioners unanimously approved. REVIEW AND APPROVAL OF LIVING WELL FOUNDATION’S APPOINTMENT OF AUDITOR Ms. Liner offered the following resolution: WHEREAS, Section 2.B(7)(c) of the Cooperative Endeavor Agreement between the Foundation and the District provides that appointment of the Foundation's auditor requires, among other things, the approval of the Board of Commissioners of the District; RESOLVED, that the Foundation's re-appointment of Luffey, Huffman, Ragsdale & Soignier is approved. Upon Mr. Mulhearn’s second, the Commissioners approved the resolution by the unanimous vote of those present. APROVAL OF CALENDAR YEAR 2011 RECONCILIATION AGREEMENT WITH LIVING WELL FOUNDATION After due discussion, Mr. Mulhearn proposed, Mr. Gilley seconded, and the Board of Commissioners unanimously adopted the following resolution: RESOLVED, that the Calendar Year 2011 Reconciliation Agreement with the Foundation is approved, in substantially the form presented to this meeting, and the Chairman of the District is authorized to execute such agreement on behalf of the District, with any changes thereto as the Chairman of the District may approve, such approval to be conclusively evidenced by his signature. REVIEW OF LIVING WELL FOUNDATION’S BOARD OF DIRECTORS’ MINUTES OF JANUARY 10, 2012 Draft minutes of the Foundation’s January 10, 2012 meeting were not available for review. QUARTERLY RECEIPT OF GRA UNAUDITED QUARTERLY FINANCIAL STATEMENTS Glenwood Resolution Authority’s Unaudited Quarterly Financial Statements for November 30, 2011 were presented for review and discussion. ANNUAL REVIEW OF GRA’S AUDITED FINANCIAL STATEMENTS AND ANNUAL REPORT Annual review of GRA’s audited financial statements and annual report were tabled until the February District meeting. SEMI-ANNUAL PROOF OF INVESTMENTS TO IASIS Mr. Hall referred to a letter and schedule of assets that was sent to IASIS Healthcare on January 16, 2012, as required by the Asset Purchase Agreement to provide proof of investments. Mr. Hall commented that with January 31, 2012 being the five-year anniversary of the sale of Glenwood Regional Medical Center, this requirement will cease. PUBLIC HEARING: The president convened a Public Hearing on Ordinance No. 8997- An ordinance amending the compiled ordinances of Ouachita Parish, Louisiana, Section 2-24 governing “proximity to churches, libraries, schools, playgrounds”; and, further providing with respect thereto. Rev. Bill Foster with the Claiborne United Methodist Church asked for the rationale behind the ordinance. Mr. Mitchell stated that this ordinance would make the parish and the cities use equal measurements in determining if an alcohol license can be issued. Currently, the cities use a 300 feet measurement and the general state law is 300 feet, but the parish uses 500 feet. This has caused some issues in areas of the parish near the city limits. Mr. Mitchell stated that the measurement will be taken in the same manner; however, under the new ordinance the distance will now be 300 feet. Motion offered by Mr. Caldwell, seconded by Ms. Moore to close the Public Hearing. Motion passed without opposition. VISITORS: The president recognized Wanda Seward, 5607 Whites Ferry Road, West Monroe. Ms. Seward spoke regarding the two buildings at G. B. Cooley set for demolition. Ms. Seward stated that the buildings should not be torn down and that someone from the Louisiana Historical Society would be visiting the buildings on Tuesday to make an assessment. Discussion ensued. No action was taken on this matter. The president recognized Pam Barton with the Ouachita Parish School Board. Ms. Barton spoke regarding the Safe Routes to School Grant process. Ms. Barton stated that the application for Jack Hayes Elementary could be resubmitted. Ms. Barton also stated that they have looked at several other schools for the project. The schools for consideration are Riser Elementary and Middle School and Swartz Upper and Lower Elementary. Discussion ensued. Motion offered by Mr. Smiley, seconded by Ms. Moore to submit applications for Jack Hayes Elementary and Swartz Upper and Lower Elementary. Motion passed without opposition. The president recognized Ralph Karst, 116 Sparks Drive, Monroe. Mr. Karst stated that the residents on Sparks Drive signed a petition asking the jury to repair the street. Mr. Karst also stated that the street has not been repaired in several years and there are sink holes on the street. Mr. Smiley stated that he would talk to the public works department and have them look at the road. No action was taken on this matter. The president recognized Sophie Brice, 127 Oak Circle, Monroe. Ms. Brice spoke regarding drainage issues on Oak Circle located in Town and Country. Ms. Brice stated that water stands in the middle of street after it rains and the residents are not able to get in or out of their neighborhood. Discussion ensued. Mr. Holtzclaw stated that he and the public works department have looked at the problem and are working on the drainage issues and road repairs. No action was taken on this matter. The president recognized Frank Thrash, Kathy Lane, Monroe. Mr. Thrash asked about drainage and new construction done from Oak Circle to Finks Hideaway Road. Discussion ensued. No action was taken on this matter. Mr. Smiley asked to take up Ms. Moore’s items before Mr. Holtzclaw had to leave. Ms. Moore asked that the matter concerning Harmon Johnson Road be deferred. Ms. Moore asked Mr. Holtzclaw for an update on the Tanglewood Raccoon Bayou Project. Mr. Holtzclaw stated that they are trying to wrap up the project and they are going to submit it to the state in order to get comments back. No action was taken on this matter. Ms. Moore asked for an update on the Dellwood Drive modification. Mr. Holtzclaw stated that he has contacted Amethyst Construction and that the project is on their list. No action was taken on this matter. Ms. Moore asked that the matter concerning Auto Shred/Mush Water and Nutland Road Canals be deferred. Ms. Moore asked for an update on the Comprehensive Drainage Plan. Mr. Holtzclaw stated that he is wrapping it up and will give it to the jury in February. No action was taken on this matter. SCOTTY ROBINSON, DISTRICT A: Mr. Robinson did not have any items. The president recognized Mr. Calhoun, District B. MR. MACK CALHOUN, DISTRICT B: Mr. Calhoun, seconded by Mr. Caldwell offered the following resolution for adoption: RESOLUTION NO. 12-05 A RESOLUTION CHANGING THE NAME OF “OLD JONESBORO ROAD” TO “JIMMY GRAHAM LOOP”; AND FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, there presently exists in Ward 7 of Ouachita Parish a public road named “Old Jonesboro Road”; WHEREAS, citizens living on said road have reported instances in which first responders have had difficulty locating their homes due to confusion between the name of their road and Louisiana Highway 34 which is often referred to as “Jonesboro Road.”; WHEREAS, a significant majority of the citizens residing on “Old Jonesboro Road” have petitioned to have the name of said road changed to a name that would not be confused with La. Hwy. 34; WHEREAS, the Ouachita Parish Communications District has confirmed that “Jimmy Graham Loop” would be an acceptable new named for said road; and, WHEREAS, the Ouachita Parish Police Jury finds that a change of the name of “Old Jonesboro Road to “Jimmy Graham Loop” would serve the public interest by reducing the risk of confusion in the dispatch of emergency responders; NOW, THEREFORE: BE IT RESOLVED by the Ouachita Parish Police Jury in regular and legal session that the parish road presently known as “Old Jonesboro Road” be, and is hereby, changed to “Jimmy Graham Loop”; BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the Ouachita Parish Communications District, the Ouachita Parish Fire Department, and the Ouachita Parish Sheriff’s Office. The above Resolution was adopted on the 23rd day of January, 2012. Mr. Calhoun, seconded by Dr. Reddix offered the following resolution for adoption: RESOLUTION NO. 12-06 A RESOLUTION NAMING A CERTAIN CANAL IN THE VICINITY OF VERNON STREET IN DISTRICT “B” THE “VERNON STREET CANAL”; AND FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, there presently exists a certain parish-maintained ditch or canal in the area of Vernon Street in District “B”, said canal running from West Olive Street to Cheniere Lake; WHEREAS, said canal is designated as Channel W-1B on the parish drainage maps but does not presently have a specific name that would otherwise make it more easily and readily identifiable; NOW, THEREFORE: BE IT RESOLVED by the Ouachita Parish Police Jury in regular and legal session that the certain parish-maintained ditch or canal in the area of Vernon Street in District “B” running from West Olive Street to Cheniere Lake and designated as Channel W-1B on the parish drainage maps be, and is hereby, further named the “Vernon Street Canal”; The above Resolution was adopted on the 23rd day of January, 2012. * * * Mr. Calhoun asked Mr. Cammack to speak regarding the amendment of the LGAP 2009-2010 Generator Grant. Mr. Cammack stated that there will not be enough time to use the $5,800 for the generator. The state recommended trying to use the funds for something else that fits the LGAP guidelines. Motion offered by Mr. Calhoun, seconded by Dr. Reddix to approve the amendment of the LGAP 2009-2010 Grant for the public works department to use the $5,800 to purchase gravel for the roads in Ouachita Parish. Motion passed without opposition. The president recognized Mr. Caldwell, District C. MR. WALT CALDWELL, DISTRICT C: Mr. Caldwell, seconded by Dr. Reddix offered the following resolution for adoption: RESOLUTION NO. 12-02 A RESOLUTION APPOINTING MR. KERRY ELEE TO THE BOARD OF COMMISSIONERS OF EAST OUACHITA RECREATION DISTRICT NO. 1; AND FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, a vacancy exists on the Board of Commissioners of East Ouachita Recreation District No. 1; and WHEREAS, Kerry Elee, 200 Sharp Lane, Sterlington, Louisiana 71280 has expressed a desire to serve on said Board; NOW THEREFORE: BE IT RESOLVED by the Ouachita Parish Police Jury in legal and regular session that Kerry Elee be, and hereby is, appointed to the Board of Commissioners of East Ouachita Recreation District No. 1 for a term of five (5) years commencing January 23, 2012 and ending January 22, 2017. The above Resolution was adopted on the 23rd day of January 2012. * * * Mr. Caldwell, seconded by Mr. Calhoun offered the following resolution for adoption: RESOLUTION NO. 12-03 RESOLUTION APPOINTING RONNIE SHARP TO THE BAYOU DESIARD-BAYOU BARTHOLOMEW CUT-OFF LOOP CONSERVATION WATER BOARD, REPLACING JOHN BROWN; AND FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, La. R.S. 38:2755 requires that the Ouachita Parish Police Jury appoint one (1) member of the Bayou DeSiard-Bayou Bartholomew Cutoff Loop Conservation Water Board from a list of three (3) names, all legal residents of the Town, submitted by the Town of Sterlington; WHEREAS, the term of the present appointee from the “Sterlington List”, John Brown, has expired; WHEREAS, in accordance with the above-cited statute the Town has submitted a list of three names and requested that the Ouachita Parish Police Jury make an appointment therefrom; NOW, THEREFORE: BE IT RESOLVED by the Ouachita Parish Police Jury in legal and regular session that Ronnie Sharp, 306 Sharp Lane, Sterlington, Louisiana 71280, be, and hereby is, appointed to the Bayou DeSiard-Bayou Bartholomew Cutoff Loop Conservation Water Board replacing John Brown. The above Resolution was adopted on the 23rd day of January 2012. Mr. Caldwell, seconded by Mr. Robinson offered the following resolution for adoption: RESOLUTION NO. 12-04 RESOLUTION SUPPORTING THE COMPLIANCE QUESTIONNAIRE REQUIRED BY THE STATE OF LOUISIANA LEGISLATIVE AUDITOR AND THE AUDITING FIRM OF LUFFEY, HUFFMAN, RAGSDALE & SOIGNIER APAC; AND FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, the Ouachita Parish Police Jury has engaged the auditing firm of Luffey, Huffman, Ragsdale & Soignier APAC, Certified Public Accountants, to perform the annual audit of the financial records, practices, and systems of the Ouachita Parish Police Jury for the year ended December 31, 2011; and WHEREAS, the Ouachita Parish Police Jury members recognize the role of the annual audit in contributing to the development of sound and efficient financial and managerial practices; and WHEREAS, the Ouachita Parish Police Jury members and staff agree to provide all financial records, board minutes and documents required by the auditing firm, and their pledge not to knowingly withhold any financial records or related data that in its judgment would be relevant to the audit; WHEREAS, in conjunction with the annual audit, the Legislative Auditor requires the auditing firm to obtain a completed Compliance Questionnaire, indicating financial and legal compliance with the laws of the state of Louisiana and pertinent accounting regulatory bodies; NOW THEREFORE: BE IT RESOLVED that the Ouachita Parish Police Jury confirms cooperation with the audit process and its report on status of observance of the laws of the state of Louisiana through its completion of the Louisiana Legislative Auditor Compliance Questionnaire attached herein as part of the Board proceedings. The above Resolution was adopted on the 23rd day of January 2012. * * * The president recognized Dr. Reddix, District D. DR. OLLIBETH REDDIX, DISTRICT D: Dr. Reddix stated that several tons of tires have been removed from the Thelma Drive site but dumping continues at that location. Deputy Heckford stated that the surveillance cameras are in place. There is also a working agreement with Richwood Police Department. Discussion ensued. Motion offered by Dr. Reddix, seconded by Ms. Moore to amend the agenda to add an item to address funding for the tire clean up at Thelma Drive due to there being a concern with drainage and public health issues. Motion failed with Mr. Caldwell opposing. MR. SHANE SMILEY, DISTRICT E: Mr. Smiley did not have any items. The president recognized Ms. Moore, District F. MS. PAT MOORE, DISTRICT F: Ms. Moore asked that the matter concerning the surveillance cameras be deferred until the first meeting in March. Ms. Moore spoke regarding the illegal dumping and litter in the parish. Ms. Moore stated that she has called the local DEQ Office and asked them to investigate the dumping issue at Young’s Bayou. No action was taken on this matter. Ms. Moore also spoke about working with various agencies in the parish to make recommendations on how to proceed with the trash problem. ADMINISTRATIVE REPORTS: The president recognized Mr. Cammack, Treasurer. FISCAL: Mr. Brad Cammack, Treasurer Mr. Cammack recommended hiring William Jones for the position of Computer Technician. Motion offered by Mr. Calhoun, seconded by Dr. Reddix to approve the recommendation. Motion passed without opposition. Mr. Cammack reminded the jurors about the luncheon on Thursday with Governor Jindal. The president recognized Mr. Mitchell, Assistant District Attorney. LEGAL: Mr. Jay B. Mitchell, Assist. Dist. Attorney Mr. Caldwell, seconded by Mr. Robinson offered the following ordinance for adoption: ORDINANCE NO. 8997 AN ORDINANCE AMENDING THE COMPILED ORDINANCES OF OUACHITA PARISH, LOUISIANA, SECTION 2-24 GOVERNING “PROXIMITY TO CHURCHES, LIBRARIES, SCHOOLS, PLAYGROUNDS”; AND, FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, presently the Compiled Ordinances of Ouachita Parish, Louisiana, Section 2-24, governing the unincorporated area of Ouachita Parish, establishes a minimum distance of five-hundred feet (500’) between the premises of any business possessing an alcoholic beverage “dealer” permit and any public playground or building used exclusively as a church or synagogue, public library, or school; WHEREAS, similar Ordinances in effect in the municipalities of Ouachita Parish establish a minimum distance of three hundred feet (300’) between such permitted businesses and playgrounds, schools, and churches; WHEREAS, the inconsistency between the parish and city standards in this area of regulation presents uncertainty for businesses, property owners, and administrators, particularly in those areas of the parish in which the incorporated and unincorporated areas are contiguous, intermingled, and/or practically indistinguishable; WHEREAS, pursuant to La. R.S. 23: 281 and La. R.S. 23:81 the Ouachita Parish Police Jury is authorized to employ the three hundred feet (300’) minimum distance in effect in the City of Monroe, City of West Monroe, Town of Sterlington, and Town of Richwood; and, WHEREAS, the Ouachita Parish Police Jury finds that in this particular instance the benefits of uniform regulation warrant an amendment of the Parish Ordinance. NOW, THEREFORE: BE IT ORDAINED by the Ouachita Parish Police Jury in legal and Regular Session that the Compiled Ordinances of Ouachita Parish, Louisiana, Section 2-24 governing “Proximity to Churches, Libraries, Schools, Playgrounds” be and is hereby amended to change the minimum distance set forth therein from “five hundred feet (500’)” to “three hundred feet (300’)”; BE IT FURTHER ORDAINED that except as set forth above Compiled Ordinances of Ouachita Parish, Louisiana, Section 2-24 shall otherwise remain in full force and effect. The above ordinance was introduced the 19th day of December 2011. Mr. Murray stated that he received responses from Mr. Holtzclaw tonight on the preliminary subdivision approval for Elsinore Estates and that this approval was past the 15 day limit and asked the jury to amend the agenda to take this matter up. Motion offered by Dr. Reddix, seconded by Ms. Moore to amend the agenda to add the item. Motion passed without opposition.
