NOTICE
The Ouachita Parish School Board met in special session on Tuesday, September 27, 2011 at twelve (12:00) o’clock noon at its regular meeting place, the Ouachita Parish School Board office.
The roll was called and the following members were present: Bill Norris, Scott Robinson, A. R. Sims, Jerry R. Hicks, John Russell, Carey Walker and Susan Spence. There were none absent.
The Pledge to the Flag was led by Board member Carey Walker.
The Invocation was given by Board member Reverend John Russell.
On motion by Susan Spence, seconded by A. R. Sims, the Board unanimously approved the Minutes of September 13, 2011 as written.
On motion by A. R. Sims, seconded by Carey Walker, the Board unanimously approved the revised Agenda as presented.
Susan Spence moved, seconded by A. R. Sims, that the Board approve the amended Personnel Agenda as submitted, including the changes since mail-out. Motion carried unanimously.
Special Projects/Safety Coordinator Kenneth Slusher reported that he is expecting a shipment of 1500 vials of flu vaccine today that had been pre-ordered a year ago for our employees. However, due to the financial restraints this year, it has been suggested that employees pick up a portion of the expenses and pay $5.00 toward the cost of their shots. The Board will pay the remaining balance of $6.00 per shot for a total of $9,000 rather than $16,500 for the whole batch (each shot costs $11). Slusher also remarked that any left over shots would be offered to our retirees for the same price. According to Slusher, the Nurses Program will administer the shots, as well as, pick up the tab for related supplies. Dr. Webber agreed with Mr. Slusher’s suggestion and also recommended that the Board pay all but $5.00 per shot because of the declining budget this year, representing an example of our attempt to cut back on expenses. Whereby, John Russell moved, seconded by Susan Spence, that the Board authorize our school nurses to administer the flu vaccine to approximately 1500 employees (subs/part-time workers included) at their work sites, charging them $5.00 per shot for a total cost to the Board of $9,000 (or $6.00 per shot) with the cost for supplies used to administer the flu shots paid with funds from the Nursing Program. Motion carried unanimously.
Business Manager Juanita Duke presented a proposal from the West Monroe High School Foundation and West Monroe High School asking the Board for their help with a portion of the cost of purchasing property near West Monroe High School that includes an existing burned house structure located on 401 Slack Street in West Monroe. According to Mrs. Duke, the WMHS Foundation has asked the Ouachita Parish School Board to be responsible for the demolition cost of approximately $7,000 for the removal of the house in addition to paying $1,000 toward the purchase price of $12,000. Elmer Noah advised the Board to give much thought in preparation of the land/home acquisition and not put stipulations and conditions in the deed, but rather produce a letter-agreement with the foundation, that upon acquisition, the Board will agree to use the property for use and benefit of West Monroe High School only. Scott Robinson commented that the “foundation” was set up for a specific purpose and whatever funds they expend will be for WMHS and he wants to make sure the wording in the documents will be acceptable. Whereby, Scott Robinson moved, seconded by John Russell, that the Board grant permission to pursue the acquisition of the burnt-out home and property located on 401 Slack Street near West Monroe High School for $12,000 once the details identifying its use and funding source are worked out between the foundation and West Monroe High School. If an agreement is reached to purchase the property, it will be presented to the Board for consideration. Motion carried unanimously.
Purchasing Agent Bobby Jones presented his findings on the sale of the surplus portable buildings. The Ideal Portable Building representative suggested reducing the price $2,000 on each to compete with the used FEMA trailers on the market. However, Mr. Jones does not think this option would work in our favor since it would reduce the minimum bids from $6-10 thousand to $4-8 thousand each for the ten (10) buildings. Therefore, he recommends that we take two buildings that are in the worst condition and move them to two schools that have requested them for storage and move the rest (8) to the district maintenance facility where it is more secure and store them for future use. The Board agreed with Mr. Jone’s recommendation.
Special Projects/Safety Coordinator Kenneth Slusher reported that we have ongoing projects at Riverbend and Crosley, and have problems with the contractor. Two classrooms at Riverbend have flooded three times when it rains. Slusher met with contractors, principals and architects yesterday to try and resolve construction issues. Due to the exposed existing roof, Riverbend suffered approximately $12,000-$13,000 in water damages to classrooms, computers and other equipment from the rain. The contractors agreed to fix these damages through builders risk insurance at no cost to the school board. Mr. Slusher concluded his report with an announcement that bids will be opened next Tuesday at 10:00 a.m. on Sterlington Middle School.
On the recommendation of Business Manager Juanita Duke, Scott Robinson moved, seconded by A. R. Sims, that the Board grant permission to bid the Sale of Surplus (Cafeteria) Equipment. Proceeds will go back to the Child Nutrition Program. Motion carried unanimously.
On the recommendation of Special Projects/Safety Coordinator Kenneth Slusher, Mr. Sims moved, seconded by Bill Norris, that the Board accept the low bid meeting specs from Mann’s Construction in the amount of $210,000 for a new parent pickup & drop-off driveway and front entrance awning at Central Elementary School [Bid No. 29-12] to be paid from the 2008 West Ouachita Bond funds. Motion carried unanimously.
The next meeting will be held on Tuesday, October 4 at 12:00 noon and the following meeting was set for Tuesday, October 18 at 6:00 P.M.
There being no further business to be brought before the Board, Mr. Sims moved, seconded by Scott Robinson, that the meeting adjourn. Motion carried unanimously.

A regular meeting of the Board of Commissioners, Hospital Service District No. 1 of the Parish of Ouachita, State of Louisiana was called to order at 11:45 A.M. at the Wellness Center, 3215 Cypress Street, West Monroe, Louisiana, by Steve Hall, Chairman of the Board of Commissioners. EXECUTIVE SESSION FOR PURPOSES OF STRATEGIC PLANNING, INCLUDING WITH RESPECT TO THE FUTURE OF THE WELLNESS CENTER AND RELATIONS WITH GRMC, GLENWOOD RESOLUTION AUTHORITY, INC., AND THE LIVING WELL FOUNDATION
A motion was made by Mr. Gilley seconded by Mr. Spencer and unanimously approved for the Board of Commissioners to go into executive session for the purposes of strategic planning, including reviewing the Wellness Center monthly financial statements.
Mr. Spencer presented the Wellness Center monthly financial statements since Debbie Takewell and Karen Hanna, the CPAs, were out of town.
Betsy Culp, Executive Director of the Wellness Center, attended the executive session for review of the Wellness Center financials and to present her management report.
Ms. Liner motioned, Mr. Spencer seconded, and the Commissioners present approved the motion to go back into public session.
ANNUAL REVIEW OF WELLNESS CENTER EMPLOYEE HANDBOOK
Mr. Landry referred to the revised Employee Handbook and noted that the most recent addition was the Extended Sick Leave Policy that was approved in July. Mrs. Culp and the Commissioners will continue to review the handbook for any additional changes.
REVIEW OF CURRENT FINANCIALS OF DISTRICT (OTHER THAN THE WELLNESS CENTER)
Mr. Spencer presented the monthly financials of the District (other than the Wellness Center) ending August 31, 2011.
UPDATE ON ANNUAL REVIEW OF COORDINATION AGREEMENT WITH THE OUACHITA PARISH POLICE JURY
Ms. Liner recently attended a Living Well Foundation meeting and reported that the state funding for the School Based Health Clinic has not been awarded yet and there is a possibility that this project may be extended for another year.
APPROVAL OF AMENDMENTS TO REAL ESTATE AGREEMENTS WITH IASIS TO PERMIT PARKING
After due discussion, Ms. Liner proposed, Mr. Spencer seconded, and the Board of Commissioners unanimously adopted the following resolution:
WHEREAS, on January 31, 2007, at the time of the sale and/or lease of the GRMC hospital real estate by the Hospital Service District No. 1 of the Parish of Ouachita, State of Louisiana (the "District") to IASIS Glenwood Regional Medical Center, LP ("IASIS"), the District and IASIS entered into a lease of the lots bearing the walking track from IASIS to the District (the "Walking Track Lease") and a reciprocal servitude agreement by which, among other things, IASIS permitted the District the right to use a driveway extending from the Wellness Center to Circle Drive (the "Reciprocal Servitude Agreement");
WHEREAS, the District and IASIS intend to (i) amend the Walking Track Lease in order to permit the District to use a portion of the northern walking track lot for parking and (ii) amend the Reciprocal Servitude Agreement in order to permit the District to use a portion of Lot 14 for parking;
RESOLVED, that the following agreements and documents between IASIS and the District, each in the form presented to this meeting, as shall be conclusively evidenced by the signature of the Chairman of the District thereon, are hereby approved in all respects:
1. Amendment to Lease (Walking Track)
2. Amendment to Notice of Lease (Walking Track)
3. Second Amendment to Reciprocal Servitude Agreement
RESOLVED, that the Chairman of the District is hereby authorized to date and execute, in the name and on behalf of the District, the foregoing agreements and documents; to cause the same to be delivered; and, after obtaining execution by IASIS, to cause the Notice of Amendment of Walking Track Lease and the Second Amendment of Reciprocal Servitude Agreement to be filed in the appropriate public records; and to execute and deliver all such further agreements and documents and to take all such further actions as the Chairman may deem necessary or advisable to effectuate the intent of these resolutions.
ANNUAL REVIEW OF LONG TERM STRATEGIC PLANS OF THE DISTRICT
Mr. Hall discussed some possibilities for future consideration regarding the District’s endeavors and asked that the members give them some thought. Further discussions will be held in the near future.

The Board of Commissioners reviewed the Foundation’s minutes of the August 18, 2011 Executive Committee meeting. The minutes of the September 13, 2011 Board of Directors meeting were not available.

The president asked if there were any additions to tonight’s agenda. The president stated that he would like to add a resolution reappointing members to the East Ouachita Recreational District whose terms have expired. The president stated that the reappointments were needed so that the district could have a quorum at their next meeting. Motion offered by Mr. Smiley, seconded by Mr. Caldwell to add the resolution to the agenda. Motion passed without opposition.
The president asked if there were any other amendments. There were none. Motion offered by Mr. Jackson, seconded by Mr. Calhoun to approve the agenda with the additions. Motion passed without opposition.
PUBLIC COMMENT PERIOD:
The president spoke regarding the public comment period. No one appeared or came forth during this point in the meeting.
Mr. Mitchell spoke at length regarding the proposed ordinance establishing a minimum elevation for structures built in locations subject to flooding within the parish. Mr. Mitchell stated that he had been working with the Homebuilders Association during the past three weeks to accomplish this task. Mr. Mitchell explained to the jury the changes in the ordinances. Discussion ensued. No action was taken at this time.

PUBLIC HEARINGS:
The president convened a Public Hearing on Ordinance No. 8985 – An Ordinance Amending Certain Provisions of the Compiled Ordinances of Ouachita Parish to Establish a Standard Minimum Elevation for Structures built in locations subject to flooding within the Unincorporated Areas of Ouachita Parish, Louisiana; and further providing with respect thereto. Mr. Mitchell noted that he had spoken on the matter earlier during the public comment period. No one appeared to speak in favor of or against this ordinance. Motion offered by Mr. Jackson, seconded by Ms. Moore to close the hearing. Motion passed without opposition.
The president convened a Public Hearing on Ordinance No. 8988 – An Ordinance to Automatically Establish a Temporary Ban on the Open-Air Burning of Trash, Garbage, Leaves, Limbs, Branches, and Debris of Any Kind during times when the Louisiana State Fire Marshall and/or the Secretary of the Louisiana Department of Agriculture and Forestry has ordered a “Burn Ban” that includes all or part of Ouachita Parish; and further providing with respect thereto. Mr. Mitchell spoke briefly regarding the matter. Mr. Mitchell noted that the ordinance contained two changes. The first change would exclude fireworks and the second would allow burning when permits are issued by the Louisiana Department of Agriculture and Forestry, DEQ or the Fire Chief. No one appeared to speak in favor of or against the ordinance. Motion offered by Ms. Moore, seconded by Mr. Calhoun to close the public hearing. Motion passed without opposition.
The president convened a Public Hearing on Ordinance No. 8989 – An Ordinance Supplementing and Amending Chapter 15, of the Compiled Ordinances of Ouachita Parish Governing “Offenses-Miscellaneous” to prohibit the sale or transfer of animals in certain restricted places in the unincorporated areas of Ouachita Parish, Louisiana; and further providing with respect thereto. Mr. Mitchell stated that an exception had been added to the ordinance to exclude the sale of animals from local hardware stores. The president noted that there were 4 persons present in favor of the ordinance. Motion offered by Ms. Moore, seconded by Mr. Caldwell to close the public hearing. Motion passed without opposition.
VISITORS:
The president recognized visitor Pat Regan of 119 Gretchen Walk, West Monroe. Mr. Regan spoke as the representative for Ouachita Council on Aging. Mr. Regan asked that the jury assist in funding the various outreach programs to assist senior citizens.
Harry Rusty Woods III, of 306 Cadeville Cutoff Rd, West Monroe spoke regarding the need for the programs provided by the Ouachita Council on Aging. Mr. Woods asked that the jury considered providing some funding for the various programs. Mr. Woods thanked the jury for their time. No action was taken on this matter.
Motion offered by Mr. Caldwell, seconded by Dr. Reddix to recess the regular meeting and convene as the Finance Committee. Motion passed without opposition.

FINANCE COMMITTEE MEETING
The chairman, Mr. Jackson called the Finance Committee meeting to order at 5:58 p.m. The chairman recognized Mr. Cammack. Mr. Cammack presented the claims statement for the period of June 17, 2011 through July 14, 2011 and recommended approval. Motion offered by Mr. Caldwell, seconded by Dr. Reddix to approve the claims as presented. Motion passed without opposition.
Mr. Cammack presented an update on the Ouachita Correctional Center. Mr. Cammack stated that the net increase for the reminder of the year will be around $100,000. Mr. Cammack noted that this increase is due to the increase of DOC prisoners and the increase in the population of the jail. Mr. Cammack stated that we will still have a deficit in the budget at year’s end. Discussion ensued.
Mr. Cammack presented the proposed budget calendar for the year. Mr. Jackson stated that he would like to continue to have the budget meetings on Tuesdays if possible. No action was taken on this matter.
Mr. Cammack spoke regarding the Community Service Detail costs. Mr. Cammack stated that the Sheriff’s office had requested some information and offered some assistance in defraying the costs. Discussion ensued. No action was taken on this matter.
Mr. Cammack asked Mr. Mitchell to speak regarding the relocation of the Registrar of Voters’ Office. Mr. Mitchell stated that the state is selling the building where the registrar’s office is housed. Mr. Mitchell stated that it would probably be a year before the Registrar would have to move.
The chairman recognized Chief Pat Hemphill. Chief Hemphill spoke regarding the additions to the mechanic shop and recommended hiring Herbert Land Architect for the project. Motion offered by Mr. Caldwell, seconded by Mr. Calhoun to approve the hiring of Herbert Land Architect for the shop additions at the fire department. Motion passed without opposition.
Chief Hemphill spoke regarding the travel request for the arson investigators. Chief Hemphill requested permission for Curt Meachum and Greg Thompson to attend the Vehicle Fire Investigator’s Conference in Lexington, KY. Motion offered by Mr. Calhoun, seconded by Dr. Reddix to approve the travel request as recommended. Motion passed without opposition.

AN ORDINANCE SUPPLEMENTING AND AMENDING CHAPTER 15, OF THE COMPILED ORDINANCES OF OUACHITA PARISH GOVERNING “OFFENSES -- MISCELLANEOUS” TO PROHIBIT THE SALE OR TRANSFER OF ANIMALS IN CERTAIN RESTRICTED PLACES IN THE UNINCORPORATED AREAS OF OUACHITA PARISH, LOUISIANA; AND, FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, Acts 2011 No. 306, effective June 28, 2011, enacted La. R.S. 33:1236(66) authorizing the Ouachita Parish Police Jury to enact ordinances prohibiting the sale of certain animals along roadsides, in parking lots, and in other outdoor locations in the unincorporated areas of Ouachita Parish;
WHEREAS, the Ouachita Parish Police Jury finds that the sale of animals by peddlers from temporary locations along roadsides and in parking lots is contrary to the public interest because, inter alia, the animals sold by such peddlers are sometimes bred and raised in untenable conditions; said animals are sometimes plagued by disease or congenital weaknesses; and, the itinerant nature of some such peddlers leaves buyers with little recourse in the event of latent defects in the animal purchased; and,
WHEREAS, ordinances limiting such animal sales are presently in place within incorporated areas of Ouachita Parish, many of which areas are immediately adjacent to and not readily distinguishable from adjacent unincorporated areas of said parish; and,
NOW, THEREFORE:
BE IT ORDAINED by the Ouachita Parish Police Jury in legal and regular session that Chapter 15 of the Compiled Ordinances of Ouachita Parish, Louisiana governing “Offenses -- Miscellaneous” be, and hereby is, supplemented and amended to add Section 15-21 to provide as follows:
“Sec. 15-2. Prohibition on the sale or other transfer of animals in certain restricted areas, exceptions, penalty.
Prohibition.  No person shall sell, exchange, barter, trade, lease, rent, give away, display or transfer any animal on any roadside, public right-of-way, parkway, median, park, playground, flea market, commercial or retail parking lot, or property adjacent to such locations, that is generally accessible to the public, regardless of whether such access is authorized or not. 
Exceptions.  This section shall not apply to bona fide humane societies, animal welfare groups, animal control agencies, or other non-profit organizations sponsoring animal adoption events, or to sales or other transfers from a personal residence.
Further, this section shall not apply to outdoor sales of livestock, poultry, fowl, or rabbits by licensed retailers on such retailer’s premises. (e.g. sidewalk sales of chicks by licensed hardware or feed stores)
(c)   Penalty.  Whoever commits a violation of this section shall be guilty of a misdemeanor and shall be punished by a fine of not less than $100 nor more than $500.00 or imprisonment for a term not exceeding six months, or both such fine and imprisonment.” 
BE IT FURTHER ORDAINED that Notice of the introduction of this Ordinance and of a public hearing to be held on July 18, 2011, at 5:30 p.m. in the Police Jury Meeting Room on the 2nd Floor of the Ouachita Parish Courthouse prior to the consideration of this Ordinance for adoption be published in the Official Journal on July 14, 2011.

Mr. Calhoun asked for an update on the T1-A Canal. Mr. Cammack stated that he had met with Gary Fontana and the engineers for the project. Mr. Cammack stated that specifications are being prepared for all three canals (which include projects in the Town of Richwood and Sterlington); and that the pre-application is being prepared for submission at the end of the month. Mr. Cammack stated that once the pre-app is approved, then a formal application will be submitted by October. No other action was taken on the matter.
Mr. Calhoun stated that the matter concerning funding for The Council on Aging had been addressed earlier in the meeting.

AN ORDINANCE AMENDING CERTAIN PROVISIONS OF THE COMPILED ORDINANCES OF OUACHITA PARISH TO ESTABLISH A STANDARD MINIMUM ELEVATION FOR STRUCTURES BUILT IN LOCATIONS SUBJECT TO FLOODING WITHIN THE UNINCORPORATED AREAS OF OUACHITA PARISH, LOUISIANA; AND FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, the flooding of homes and other structures is a source of great difficulty and expense to not only the owners and occupants directly affected thereby but also to the resources of the community and government agencies;
WHEREAS, in conjunction with the National Flood Insurance Program certain areas of Ouachita Parish have been identified as “special flood hazard areas” or “flood zones” subject to varying degrees of flooding or inundation;
WHEREAS, in order to reduce the impact of flooding the Ouachita Parish Police Jury has adopt certain regulations governing construction in the unincorporated areas of Ouachita Parish;
WHEREAS, an essential element of such regulations is the requirement that buildings constructed in flood zones have their lowest finished elevation a minimum height above the base flood elevation established for that location; and,
WHEREAS, the Ouachita Parish Police Jury finds that establishing a uniform standard for the minimum elevation required by such regulations will serve the public interest by facilitating both compliance and enforcement;
NOW, THEREFORE:
BE IT ORDAINED by the Ouachita Parish Police Jury in legal and regular session that the following provisions of the Compiled Ordinances of Ouachita Parish, Louisiana be and hereby are supplemented and amended as set forth below:
Section I.
“Sec. 3 ½-59. Land use restrictions.
…(b) Flood prone areas: Construction may be permitted providing the lowest ground level of the building is flood proofed by elevating to an elevation at least one foot above the 100 year base flood elevation, and attendant utilities and sanitary facilities are constructed in such a manner to minimize or eliminate flood damage.”
Section II.
“Sec. 19 ½-152. Flood control in hazard areas.
…(3) Whenever an application is submitted for property located in a special flood hazard area or an area which is subject to flooding, the design engineer shall indicate on the site plan the base flood elevation for the site and the minimum finished floor elevation for all structures. The lowest floor of all buildings shall be elevated to an elevation at least one foot above the 100 year base flood elevation.”
Section III.
“Sec.21-117. Specific standards for types of construction.
In all areas of special flood hazard as set forth in Section 21-76, the following standards are required:
Minimum building elevations. The lowest floor, including basement, of all new residential or non-residential structures, or the substantial improvement of all residential or non-residential structures, shall meet or exceed the following requirements:
Structures located within unprotected areas of any special flood hazard area shall have a lowest floor elevation at least one foot above the 100 year base flood elevation, or at least one foot above the record inundation, whichever is higher. …”
Section IV.
The provisions of this Ordinance shall become effective July 20, 2011.

BE IT RESOLVED that pursuant to a public notice, a regularly scheduled meeting of the Ouachita Parish Police Jury was held on the 18th day of July, 2011 at 5:30 p.m. at Ouachita Parish Courthouse, where the following resolution, upon motion duly seconded and passed was adopted, to wit:
BE IT RESOLVED that the Ouachita Parish Police Jury has determined that it is the owner of mineral interests in and under immovable property described in Exhibit “A”, attached hereto and made a part hereof;
BE IT FURTHER RESOLVED that the Ouachita Parish Police Jury has determined that it desires to take advantage of LSA R.S. 30:152 (A), et seq, to authorize the Louisiana State Mineral and Energy Board to nominate the property described in Exhibit “A” for state agency mineral lease;

MR. WALT CALDWELL, DISTRICT C:
Mr. Caldwell asked Mr. Murray to speak regarding the Hannah’s Run Control Structure and Fortune Drive Project. Mr. Murray stated that he had spoken with Mr. Hilburn of Homeland Security. Mr. Hilburn indicated to Mr. Murray that the project could possibly be funded with Hazard Mitigation Funds. Mr. Murray stated that Mr. Hilburn was waiting to get confirmation in writing from GOSEP. No other action was taken on this matter.
Mr. Caldwell asked Mr. Murray to speak regarding Power and Solvent Avenue. Mr. Murray stated that he had spoken with Marshall Hill of DOTD, and that negotiations were ongoing for the project. No other action was taken on the matter.
Mr. Murray also spoke regarding the Hwy143 at Union Street Drainage Project. Mr. Murray stated Mr. Hill had indicated that the state was trying to secure funding for the Hwy 143 Drainage at Union Street Project for the possibility of an additional culvert under the street. No action was taken on the matter.

DR. OLLIBETH REDDIX, DISTRICT D:
Dr. Reddix asked Mr. Murray to speak regarding the drainage project at J. S. Clark Cemetery. Mr. Murray stated that he had placed before each juror a copy of a substantial completion certificate for the project. Mr. Murray stated that Mr. Holtzclaw had recommended approval of the certificate. Discussion ensued. Motion offered by Dr. Reddix, seconded by Mr. Caldwell to approve the project as substantially complete as recommended by the parish engineer subject to using the balance of the state funds before using funds from the General Fund. WHEREAS, state law further authorizes the Louisiana Fire Marshall; the Secretary of the Louisiana Department of Agriculture and Forestry; and/or the Governor to institute burn bans encompassing the entire State of Louisiana or portions thereof;
WHEREAS conditions that warrant the imposition of a burn ban by state officials that includes Ouachita Parish will also warrant a local burn ban that may be effectively enforced by local officials;
WHEREAS, when conditions warrant a state burn ban that includes Ouachita Parish the need for an effective local burn ban is immediate and should not be delayed until the next meeting of the Ouachita Parish Police Jury ; and,
WHEREAS, the Ouachita Parish Police Jury finds that having a temporary local ban on outdoor burning that become effective immediately upon the adoption of a burn ban by state officials serves the interests of the citizens of Ouachita Parish by helping to reduce the risk that wildfires pose to lives and property and enhances the ability of local authorities to carry out the goals of the action taken by the state officials;
NOW, THEREFORE:
BE IT ORDAINED by the Ouachita Parish Police Jury in a legally called and assembled Regular Meeting held on July 18 , 2011, that:
In the unincorporated areas of Ouachita Parish no person shall conduct the open air burning of any trash, garbage, leaves, limbs and branches, or debris of any kind when such burning is prohibited by a burn ban ordered by the Louisiana Fire Marshall; the Secretary of the Louisiana Department of Agriculture and Forestry; and/or, the Governor.
2. A burn ban affected by this Ordinance shall not apply to any person conducting open air burning pursuant to a license or permit issued by the Louisiana Department of Agriculture and Forestry; the Louisiana Department of Environmental Quality; or, the Fire Chief of Ouachita Parish Fire Protection District No. 1.
3. A burn ban affected by this Ordinance shall not apply to the discharge of fireworks.
4. Any person violating the provisions of this Ordinance shall be punished by a fine of not more than Five Hundred ($500.00) Dollars or imprisoned for a term of not more than thirty (30) days.
As an alternative to any other available enforcement mechanism or procedure, this Ordinance may be enforced through an administrative adjudication by the Ouachita Parish Administrative Hearing Officer pursuant to La. R.S. 13:2575(B) and Ouachita Parish Police Jury Ordinance No. 8786 (Compiled Ordinances of Ouachita Parish, Section 1-26);

Mr. Mitchell spoke regarding the Developmental Plan-Bayou Shores at Hwy 139. Mr. Mitchell recommended approval of the developmental plan subject to the comments of the parish engineer, legal department, and upon the condition that there is no opposition from the LA Department of Transportation. Motion offered by Mr. Caldwell, seconded by Ms. Moore to approve the developmental plan for Bayou Shores at Hwy 139 as presented. Motion passed without opposition.
Mr. Mitchell spoke regarding the agreement for the Right-of-Way for Hadley Street Bridge Project. Mr. Mitchell recommended approval of the Cooperative Endeavor Agreement for the project. Motion offered by Dr. Reddix, seconded by Ms. Moore to approve the CEA for the Hadley Street Bridge Project. Motion passed without opposition.
Mr. Mitchell informed the jury that Gerald York, Constable for Ward 1 had passed away over the weekend. Mr. Mitchell stated that the jury would have to appoint someone as interim and call for a special election within 10 days of the vacancy created upon Mr. York’s death.

Mr. Murray spoke regarding the preliminary subdivision approval for Bethel Heights Subdivision located in District B and recommended approval. Motion offered by Mr. Calhoun, seconded by Mr. Caldwell to approve the preliminary subdivision of Bethel Heights Subdivision subject to comments from public works and the parish engineer. Motion passed without opposition.
The president noted the absence of the parish engineer.

OTHER BUSINESS:
Mr. Mitchell informed the jury that this would be the last meeting that Robbie Evans of the News Star would be covering the jury, as Mr. Evans was taking a teaching job at Sterlington Middle School. The President recognized Mr. Evans and extended the jury’s well wishes.
Mr. Murray informed the jury that Mr. Holtzclaw has sent an email and asked that he inform the jury of the local road improvement projects. Mr. Murray stated that the following roads were up improvement; Greenbriar Drive, Lakewood Drive and Teakwood Drive.
Mr. Murray informed the jury that the second phase of Green Springs will be advertised as well.

PROCEEDINGS OF THE POLICE JURY, PARISH OF OUACHITA, STATE OF LOUISIANA, TAKEN AT A REGULAR MEETING HELD ON, MONDAY, AUGUST 1, 2011 AT 5:33 P.M.
The Police Jury of the Parish of Ouachita, State of Louisiana met in a regular session in the Ouachita Parish Police Jury Meeting Room, Courthouse Building, Monroe, Louisiana on Monday, August 1, 2011 at 5:33 p.m., and was duly convened by Mr. Shane Smiley, President, who stated that the Police Jury was ready for the transaction of business.
Members Present (5): Charles Jackson, District A; Mack Calhoun, District B; Walt Caldwell, District C; Shane Smiley, District E; Pat Moore, District F
Members Absent (1) : Ollibeth Reddix District D
The invocation was given by the president. The Pledge of Allegiance to the flag was led by the president.
APPROVAL OF AGENDA:
The president asked if there were any additions or amendments to the agenda. There were none. Motion offered by Mr. Caldwell, seconded by Mr. Calhoun to approve the agenda as presented. Motion passed without opposition.
PUBLIC COMMENT PERIOD:
The president spoke regarding the public comment period. No one came forth or appeared at this point in the meeting.
A motion to adopt the minutes of the Regular Police Jury Meeting including the Committee Meetings held on July 18, 2011 and the Special Meeting held on July 25, 2011, was offered by Mr. Caldwell, seconded by Ms. Moore. Motion passed without opposition.
PUBLIC HEARING:
The president convened a Public Hearing on Ordinance No. 8990 – An Ordinance Providing for traffic controls on temporary rights of way established to detour traffic from parish roads; providing penalties for the failure to comply with such traffic controls; and further providing with respect thereto. No one appeared to speak in favor of or against said ordinance. Motion to close the public hearing was offered by Mr. Jackson, seconded by Mr. Caldwell. Motion passed without opposition.
VISITORS:
Mr. Cammack asked that Stephanie Smith and Morgan Herring from the Tax Assessor’s Office be recognized as visitors. Mr. Cammack stated that there was an item on his agenda that he would like to address at this time. No one objected to taking up the matter at this time. Mr. Cammack spoke regarding the request from the assessor’s office to purchase three (3) table computers and docking stations in the amount of $7450.09. Discussion ensued. After discussion, motion offered by Mr. Caldwell, seconded by Mr. Calhoun to approve the purchase of the computers for the Assessor’s Office. Motion passed without opposition.
DEPARTMENT HEAD REPORTS
The following department heads presented reports for the month.
CODE ENFORCEMENT: Deputy Wayne Heckford
Deputy Heckford stated that he had included in the packets information regarding the tire cleanup on Thelma Drive. Ms. Moore asked that the matter be placed on Dr. Reddix’s agenda for the next meeting.
HOMELAND SECURITY & EMERGENCY PREPAREDNESS AGENCY:
Mr.Tracy Hilburn, Director
Mr. Hilburn informed the jury that the Hazard Mitigation Plan will be updated and ready for submission before the deadline.
LIBRARY: Ms. Robin Toms, Director
Ms. Toms informed the jury that during the recent parish wide read-a-thon event, 32,096 pages had been read in a 2 hour period. The goal was to read 20,000 pages in two (2) hours.
WORKFORCE INVESTMENT: Ms. Doretha Bennett, Director
Ms. Bennett thanked the jury for their patience and support during the allocation of funding for her office.

A motion was offered by Mr. Caldwell, seconded by Mr. Smiley to recess the regular meeting in favor of the Personnel Committee meeting. Motion passed without opposition.
PERSONNEL COMMITTEE MEETING
The Personnel Committee Meeting was called to order at 5:45 by chairperson, Pat Moore. Ms. Moore recognized Mr. Cammack, Treasurer.
Mr. Cammack spoke regarding the donation of sick leave and recommended approval. Motion offered by Mr. Jackson, seconded by Mr. Smiley to approve the donation of 47 hours of sick leave from Catherine Newton to Leslie Jones. Motion passed without opposition.
The chair recognized Chief Hemphill, Fire Department. Chief Hemphill recommended the following personnel actions for approval.

PUBLIC WORKS COMMITTEE MEETING
A motion to convene as the Public Works Committee was offered by Mr. Caldwell, seconded by Ms. Moore. Motion passed without opposition.
The chairman, Mr. Calhoun called the committee meeting to order at 6:49 p.m. Mr. Calhoun recognized Mr. Murray, Public Works Director.
Mr. Murray spoke regarding the request for a variance in Bethel Heights Subdivision (District B) and recommended approval. Discussion ensued. Motion offered by Mr. Caldwell, seconded by Mr. Jackson to approve the variance as recommended. Motion passed without opposition.
There being no other business to come before this committee, a motion to adjourn was offered by Mr. Calhoun, seconded by Mr. Caldwell. The committee meeting was adjourned at 6:51 p.m.

MR. CHARLES JACKSON, DISTRICT A:
Mr. Jackson, seconded by Mr. Calhoun offered the following ordinance for final adoption.
ORDINANCE NO. 8990
(FINAL)
AN ORDINANCE PROVIDING FOR TRAFFIC CONTROLS ON TEMPORARY RIGHTS OF WAY ESTABLISHED TO DETOUR TRAFFIC FROM PARISH ROADS; PROVIDING PENALITIES FOR THE FAILURE TO COMPLY WITH SUCH TRAFFIC CONTROLS; AND FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, circumstances such as construction, flooding, and accidents sometimes require the establishment of temporary routes detouring traffic from parish roads through and across private property over which the Ouachita Parish Police Jury has acquired temporary permission to establish such detour; and,
WHEREAS, in such events the interest of public safety and the reduction of the impact of on the private property affected by the public detour sometimes calls for the establishment of certain traffic controls along the detour route;
NOW, THEREFORE:
BE IT ORDAINED by the Ouachita Parish Police Jury in legal and regular session that:
The Director of Public Works be, and hereby is, authorized to establish such traffic controls as necessary along temporary routes used to detour traffic from parish roads and to erect appropriate signage or other devises along such routes to implement said traffic controls;
That motorists and others using temporary routes established to detour traffic from parish roads shall obey all road signs or other traffic control devices erected along such routes; and.
That persons failing to obey signs or other traffic control devices erected along temporary routes used to detour traffic from parish roads shall be guilty of a misdemeanor and shall be punished by a fine of not more than $500.00, imprisonment of not more than 30 days, or both.
The above Ordinance was introduced on the 5th day of July 2011.
The Ordinance was submitted to a roll call vote and the vote thereon was as follows:

Mr. Jackson asked Mr. Holtzclaw to update the jury on the Green Spring Drainage Project. Mr. Holtzclaw presented an in-depth report on the status of the proposed project. Mr. Holtzclaw stated that the information will be submitted for review to the state for comments. No action was taken on the matter.
The president recognized Mr. Calhoun, District B.
MR. MACK CALHOUN, DISTRICT B:
Mr. Calhoun asked Mr. Mitchell to speak regarding the T-1 A Canal. Mr. Mitchell stated that he had nothing new to report. Mr. Mitchell stated that the state has established a timeline for the project, and that the project was moving along as planned. No action was taken on this matter.
Mr. Calhoun asked Mr. Holtzclaw to update the jury on the Slocum Road Improvement Project. Mr. Holtzclaw stated that the project was 95% complete. Mr. Holtzclaw stated that this road was included in the 2010 Road Striping Program and would be striped once the construction is completed. No other action was taken on this matter.
Mr. Calhoun asked Mr. Holtzclaw to speak regarding the repairs to the roads damage by the pipeline construction. Mr. Holtzclaw stated that he would be meeting with public works in the next week to determine how to best use the monies, and would report back to the jury at its next meeting.
The president recognized Mr. Caldwell, District C.
MR. WALT CALDWELL, DISTRICT C:
Mr. Caldwell asked Mr. Holtzclaw to speak regarding Keystone Road. Mr. Holtzclaw stated that the road was high on the list of roads to be repaired. Discussion ensued. Mr. Holtzclaw indicated that he would look into getting the road into the urban systems and possibly include it in the 2012 Road Program. No other action was taken on the matter.
DR. OLLIBETH REDDIX, DISTRICT D:
Dr. Reddix was not present at the meeting.
MR. SHANE SMILEY, DISTRICT E:
Mr. Smiley, seconded by Mr. Calhoun offered the following resolution for adoption.
RESOLUTION NO. 11-42
A RESOLUTION AUTHORIZING THE ACQUISITION RIGHT-OF-WAY PARCEL NO. 7-2 FOR THE FINKS HIDEAWAY ROAD PROJECT; AND, FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, by Resolution No. 10-39 adopted August 16, 2010, the Ouachita Parish Police Jury has authorized the acquisition of the necessary Rights-of-Way for the Finks Hideaway Road Project (State Project No. 742-06-0101)(F.A.P. No. 3706(512);
WHEREAS, the Ouachita Parish Police Jury’s consultant(s) and appraiser(s) have completed the evaluation of a parcel of commercial property needed as Right-of-Way for this project and identified as Parcel No. 7-2 in the project’s plans and specifications;
WHEREAS, the just compensation has been determined by the Ouachita Parish Police Jury’s consultants to be $775,000.00; and
WHEREAS, the acquisition of Parcel No. 7-2 is necessary for the completion of this important public project.
NOW THEREFORE:
BE IT RESOLVED that the Ouachita Parish Police Jury does hereby authorize the acquisition of Parcel No. 7-2 as identified in the plans and specifications for the Finks Hideaway Project;
BE IT FURTHER RESOLVED that the Ouachita Parish Police Jury authorizes its President to execute such documents as are required for the acquisition of the Right-of-Way parcel described above and authorizes its Treasurer to pay the owner thereof the just compensation set forth hereinabove.
The above resolution was adopted the 1st day of August, 2011. No opposition.

The president recognized Ms. Moore, District F.
MS. PAT MOORE, DISTRICT F:
Ms. Moore spoke regarding the Comprehensive Drainage Plan. Mr. Holtzclaw stated to update the plan would require a 1-2-3 process which includes an evaluation of the projects that are in process, incorporating new projects, and evaluating all the projects and addressing available funding for them. Discussion ensued. After discussion, Ms. Moore asked that the matter be placed back on the agenda for the next meeting.
Ms. Moore spoke regarding the Harmon Johnson Road. Discussion ensued. Mr. Caldwell suggested that Mr. Holtzclaw would ask if Caples Rd, Keystone Rd, and Harmon Johnson Rd could be incorporated into the Urban Systems or Transportation Fund. Mr. Holtzclaw stated that he would report back to the jury at its next meeting.
Ms. Moore spoke regarding the driveway modification on Dellwood Drive. Mr. Holtzclaw asked that Public Works be allowed to look at it and get back to the jury at its next meeting.

ADMINISTRATIVE REPORTS:

FISCAL: Mr. Brad Cammack, Treasurer
Mr. Cammack spoke regarding the bid tabulation for uniforms. Mr. Cammack recommended Guidry’s Uniform for the Fire Department and KMS Uniforms for the other departments. Motion offered by Mr. Jackson, seconded by Mr. Caldwell to accept Guidry’s Uniforms and KMS Uniforms as the lowest conforming bids subject to review by legal counsel. Motion passed without opposition.
The president recognized Chief Hemphill, Fire Department.
FIRE: Chief Pat Hemphill, Fire Department
Chief Hemphill stated that he had no additional items.
The president recognized Mr. Mitchell, Assistant District Attorney.
LEGAL: Mr. Jay B. Mitchell, Assist. Dist. Attorney
Mr. Mitchell spoke regarding a cooperative endeavor agreement for the transfer of computer equipment from OPFD to OPPJ, and recommended approval. Motion offered by Mr. Jackson, seconded by Mr. Caldwell to approve the cooperative endeavor agreement as presented. Motion passed without opposition.
The president recognized Mr. Murray, Director of Public Works.
PUBLIC WORKS: Mr. John Tom Murray, Director
Mr. Murray stated that he had no additional items.
The president recognized Mr. Holtzclaw, Parish Engineer.
ROADS & DRAINAGE: Mr. Tom Holtzclaw, Engineer
Mr. Holtzclaw provided an update to the jury on the OCC Sanitary Sewer Improvement Project. Mr. Holtzclaw stated that the project should be completed within the next month or so. A brief discussion ensued. No action was taken on this matter.
BEER AND WHISKEY APPLICATIONS:
Mr. Mitchell spoke regarding the beer and whiskey application and recommended approval. Motion offered by Mr. Calhoun, seconded by Mr. Caldwell to approve the application as presented. Motion passed without opposition.
