BILINGUAL Whenever a significant number of persons and/or residents of blighted neighborhoods communicate with a primary language other than English attend public hearings, the Town will provide an interpreter for dissemination of information to them, providing the Town is given at least three days notice. TECHNICAL ASSISTANCE Technical assistance may be provided directly by the Town to any citizen, particularly to low and moderate income persons, residents of blighted neighborhoods and minorities, which request assistance in development of proposals and statement of views concerning the LCDBG Program. The local officials, administrator and engineer will conduct informational meetings with the residents of the low to moderate income areas if a written request is received by the Town with at least one week notification. The persons who conduct the technical assistance meetings will disseminate information on the program and answer all pertinent questions. TIMELY ACCESS AND ADEQUATE INFORMATION The Town shall provide timely disclosure of records, information and documents related to LCDBG program activities. Documents will be made available for copying upon request at the Town Hall, Monday, through Friday, 8:30 a.m. to 12:00 noon. Such documents may include the following: 1) All meetings and promotional materials. 2) Records of hearings and meetings. 3) All key documents, including prior applications, letters, grant agreements, citizen participation plans, and proposed applications. 4) Copies of the regulations (final statements) concerning the program. 5) Documents regarding other important requirements, such as Procurement Procedures, Fair Housing, Equal Employment Opportunity, Uniform Act, Labor Provisions and Environmental Procedures. CITIZEN COMPLAINT PROCEDURE SECTION 1 It is the policy of the Town of Sterlington to review all complaints when requested by anyone concerning actions of the Town. SECTION 2 The following procedures will be followed on all complaints received by the Town of Sterlington: 1. The complainant shall notify the Town Clerk of the complaint. The initial complaint may be orally or written correspondence. 2. The Town Clerk will notify the Mayor or designated representative of the complaint within five (5) days. 3. The Mayor or designated representative will investigate the complaint and will report his findings to the Town Clerk within five (5) days. 4. The Town Clerk will notify the complainant of the findings of the Mayor or designated representative in writing or telephonically within five (5) days. 5. If the complainant is aggrieved by the decision, he must forward the complaint in writing (if previously submitted orally) to the Town Clerk who will forward the complaint along with actions taken by the Mayor or designated representative to the appropriate committee for their review. This will be accomplished within seven (7) days of receipt of written complaint. 6. The Town's Council will have seven (7) days to review the complaint and will forward their decision to the complainant in writing. 7. STATE OF LOUISIANA DIVISION OF ADMINISTRATION FACILITY PLANNING AND CONTROL JOHN DAVIS, DIRECTOR 4/21,4/28,5/5 _____________________________________________________________ PRAIRIE ROAD WATER DISTRICT NOTICE TO WATER CUSTOMERS PRAIRIE ROAD WATER SUPPLY 04-20-2011 PWS ID No LA 1073040 The Prairie Road Water District is currently in violation of the maximum contaminant level for total trihalomethanes (TTHMs) as set forth by the States (Part XII of the Louisiana State Sanitary Code) and the Federal Primary Water Regulations (40 CFR Part 141). Although this incident is not an emergency, as our customers, you have the right to know what happened and what we are doing to correct this situation. The United States Environmental Protection Agency (EPA) and the Louisiana Department of Health and Hospitals (LDHH) set drinking water standards and require the disinfection of drinking water. Where disinfection is used in the treatment of drinking water, disinfectants combine with naturally occurring organic and inorganic matter present in water to form chemicals called disinfection byproducts (DBPs). The EPA and LDHH set standards for controlling the levels of disinfectants and DBPs in drinking water, including trialmethanes (THMs) Some people who drink water containing THMs in excess of the MCL over MANY YEARS may experience problems with liver, kidneys, or central nervous systems, and may have an increased risk of cancer. In December 1998, EPA set enforceable drinking water standard for TTHMs at 80 parts per billion (ppb) to reduce the risk of cancer or other adverse health effects. Compliance with the TTHM standard for all public ground water systems serving less than 10,000.00 individuals initially became effective and enforceable on January 1, 2004. Compliance with the TTHMs standard is determined by calculations a running annual average (RAA) of quarterly TTHMs sample results. Compliance calculations performed during the first calendar quarter of 2011 show that the system’s current TTHMs running annual average is 146 ppb thus, the system is currently in violation of the TTHMs standard. Please share this information with all the other people who drink this water, especially those who may not have received this notice directly (for example, people in apartments, nursing homes, schools, and businesses). You can do this by posting this notice in a public place or distributing copies by hand or mail. THIS IS NOT AN EMERGENCY if it had been, you would have been notified immediately. EPA and LDHH do not consider this violation to have any serious adverse health effects on human health as a result of short-term exposure; however, continued long-term exposure to TTHMs levels above the standard (e.g., 20 years of exposure) has the potential to have serious adverse effects on human health. EXECUTIVE SESSION FOR PURPOSES OF STRATEGIC PLANNING, INCLUDING WITH RESPECT TO THE FUTURE OF THE WELLNESS CENTER AND RELATIONS WITH GRMC, GLENWOOD RESOLUTION AUTHORITY, INC., AND THE LIVING WELL FOUNDATION A motion was made by Mr. Spencer seconded by Mr. Gilley and unanimously approved for the Board of Commissioners to go into executive session for the purposes of strategic planning, including reviewing the Wellness Center monthly financial statements. David Soignier, a representative of Luffey, Huffman, Ragsdale & Soignier, APAC, was in attendance to present a draft Louisiana Legislative Audit report for 2010. Debbie Takewell and Karen Hanna were in attendance for Mr. Soignier’s report, as well as to present the Wellness Center monthly financial statements. Amanda Adcock, Executive Director of the Wellness Center, also attended the executive session for review of the Wellness Center financials and to present her management report. Mr. Mulhearn motioned, Mr. Spencer seconded, and the Commissioners present approved the motion to go back into public session. REVIEW OF CURRENT FINANCIALS OF DISTRICT (OTHER THAN THE WELLNESS CENTER) Mr. Hall, Mrs. Takewell, and Mrs. Hanna presented the monthly financials of the District (other than the Wellness Center) ending February 28, 2011. DISCUSSION OF APPROVED 2011 COOPERATIVE ENDEAVOR AGREEMENT WITH LIVING WELL FOUNDATION The Living Well Foundation reviewed and approved the 2011 Cooperative Endeavor Agreement at its March 1, 2011 Board of Directors meeting. A fully executed copy was presented and Mr. Mulhearn was asked to arrange for an electronic transfer of $2 million of District funds to the Foundation in accordance with the agreement. REVIEW OF REVISED FIRST INTERIM REPORT FROM THE OUACHITA PARISH SCHOOL BOARD UNDER THE HSD-OPSB COOPERATIVE ENDEAVOR AGREEMENT In February, the Commissioners reviewed the first interim report from the Ouachita Parish School Board under the HSD-OPSB Cooperative Endeavor Agreement that was prepared by Ms. Pam Barton, Supervisor of the Competitive Grant Department. It was recognized at that time that the report should have been accompanied by certain further supporting information and a letter signed by an authorized representative, which should have been Bob Webber, the Superintendent. The further supporting information and signed letter that were subsequently received were reviewed. APPROVAL OF MINUTES OF DISTRICT BOARD MEETING OF FEBRUARY 15, 2011 After review of the District’s February 15, 2011 Board meeting minutes, a motion was made by Mr. Gilley and seconded by Ms. Liner to adopt the minutes as presented and the motion was unanimously approved. APPROVAL OF RAISES FOR EMPLOYEES OF LIVING WELL FOUNDATION After due discussion, Ms. Liner proposed, Mr. Hall seconded, and the Board of Commissioners unanimously adopted the following resolution: WHEREAS, Section 2.B(7)(b) of the 2007 Cooperative Endeavor Agreement between the District and the Foundation provides that the Foundation shall not amend the employment terms of the five highest-paid employees of the Foundation without (i) the approval of the Board of Directors of the Foundation by the affirmative vote of two-thirds of the directors then in office and (ii) the approval of the Board of Commissioners of the District; WHEREAS, Section 2.B.(13)(a) and Section 2.B.(14)(c) of the 2007 Cooperative Endeavor Agreement between the District and the Foundation provide that the Foundation will comply with Article 7, Section 14 of the Louisiana Constitution to the same extent as if it were a hospital service district; WHEREAS, in addition, Section 2.B(1) of the 2011 Cooperative Endeavor Agreement between the District and the Foundation provides that the Foundation will adhere to the provisions of Section 2.B of the 2007 Cooperative Endeavor Agreement, as amended from time to time; WHEREAS, the Board of Directors of the Foundation, at its recent meeting on March 1, 2011, after discussion and with the affected employees absent, unanimously approved by a vote of 10-0 in each instance a salary increase of 5% for Dr. Jan Corder Pyzner, the Foundation's President/CEO, and a salary increase of 5% for Tracey Linson, the Foundation's Grants Manager, in each case with an effective date of January 1, 2011; WHEREAS, the Board of Commissioners of the Foundation agrees with the appropriateness of granting raises to each of the two employees and with the amounts involved, but is concerned that the retroactive nature of the proposed raises may not be consistent with Article 7, Section 14 of the Louisiana Constitution as applied to a hospital service district; RESOLVED, that the Board of Commissioners approves the salary increases of 5% for each of Dr. Pyzner and Ms. Linson, but prospectively only, i.e., effective today, March 15, 2011, and not retroactively effective back to January 1, 2011. RESOLVED, that the Board of Commissioners requests the Foundation to ensure that the ultimate terms determined by the Board of Directors shall be memorialized in a written amendment or addendum or restatement of the employment terms of each of the two employees, which documentation shall state the actual dollar figures of the salaries, and that copies of the signed documents shall be provided to the District for its records. REPORT OF LIVING WELL FOUNDATION’S DECEMBER 2010 UNAUDITED FINANCIAL STATEMENTS The Foundation’s unaudited financial statements for December 31, 2010 were presented for review and discussion.
