Advertising Package
The Monroe-West Monroe Convention & Visitors Bureau is accepting proposals for an out-of-state advertising package for the 2010 Christmas on the River and the 2011 Twin Cities’ Krewe of Janus Mardi Gras Parade in accordance with the provisions of LSA-R.S.38:2211 et seq. Sealed bid proposals will be accepted in the office of Alana Cooper, Executive Director, Monroe-West Monroe Convention and Visitors Bureau, 601 Constitution Drive, West Monroe, LA 71292, no later than 10:00 a.m. on September 17, 2010.
The proposal will be for the maximum amount of advertisement of any configuration at the bidder’s discretion in the out-of-state regional markets of Mississippi and Arkansas plus development of the advertisement from previous footage for a total sum of $45,000 (Forty-five Thousand Dollars) for Christmas on the River (COTR) and $20,000 (Twenty Thousand Dollars) for the Twin Cities’ Krewe of Janus Mardi Gras Parade. The total sum of the advertising package is $65,000 (Sixty-five Thousand Dollars).
Christmas on the River advertising will run in two segments. The first segment will run during the weeks of November 15-December 4 and will promote the events scheduled for November 27 – December 4. This segment will comprise approximately 75% of the total COTR advertising budget. The second segment will run during the weeks of December 5- December 18. This segment will comprise approximately 25% of the total COTR advertising budget. Any agency and/or productions costs are to be billed in addition to the $45,000 advertising spend. A portion of this project is funded through a Cooperative Marketing Program with the Louisiana Office of Tourism (LOT). All materials, i.e. print ads, television spots, and radio spots, must include their logo and receive approval from their office. Therefore, all production must be completed by October 25, 2010, in order to receive approval from LOT. Logos will be provided.
Twin Cities Krewe of Mardi Gras Parade will run during the weeks of January 18, 2010 through February 5, 2010. Any agency and/or production costs should be included in the $20,000.

NOTICE
The Ouachita Parish School Board met in regular session on Tuesday, August 10, 2010 at six (6:00) o’clock P.M. at its regular meeting place, the Ouachita Parish School Board office.
The following members were present: Jack White, Scott Robinson, A. R. Sims, Jerry R. Hicks, John Russell, Carey Walker and Susan Spence. There were none absent.
The Pledge to the flag was led by Board member Carey Walker.
The Invocation was given by Board member Susan Spence.
On motion by Jerry Hicks, seconded by A. R. Sims, the Board unanimously approved the Minutes of July 15, 2010 as written.
On motion by Susan Spence, seconded by A. R. Sims, the Board approved the revised Agenda as presented. Motion carried unanimously.
On motion by A. R. Sims, seconded by Carey Walker, the Board approved the amended Personnel Agenda as submitted, including the changes since its mailing. Motion carried unanimously.
On the recommendation of the Superintendent, A. R. Sims moved, seconded by Scott Robinson, that the Board appoint Don Tumey Assistant Principal of West Ouachita Parish High School, effective August 1, 2010. Motion carried unanimously.
Upon motion by A. R. Sims, seconded by Scott Robinson, the Board appointed Connie Carlisle to the position of Assistant Principal of Central Elementary School, effective August 1, 2010, as recommended by the Superintendent. Motion carried unanimously.
The Superintendent requested permission to open two new assistant principal positions at Ouachita and West Ouachita High Schools for application. Whereby, Susan Spence moved, seconded by John Russell, that the Board grant the Superintendent permission to open two assistant principal positions for application, one at Ouachita Parish High School and one at West Ouachita High School. Motion carried unanimously.
The special recognition ceremony was postponed until the next meeting.
Jack W. Clampit, a local business owner of Executive Business Products, addressed the Board with concerns regarding the way money is being spent over the internet. He is seeing more changes in the way everybody is doing business today. Not just the private sector, but also the public sector and more out of state vendors winning bids in Ouachita Parish. The problem is with the economy and how it is affected with out of state commerce and internet purchases. Mr. Clampit asked the School Board to buy more products from local businesses as he pointed out that local businesses support schools with their taxes while internet purchases do not. Sixty-eight per cent of each dollar spent in Ouachita Parish stays here. In conclusion, Mr. Clampit asked the Board to find a way to support the local businesses. Superintendent Webber told Mr. Clampit that he has instructed his principals and school personnel to buy locally if at all possible and in accordance with the law. Dr. Webber will also have Purchasing Agent Bobby Jones send him the state purchasing guidelines so he will have a better understanding of the financial operations of the Board.
Reverend Russell asked that his request to collaborate with the Ouachita Parish Police Jury in securing funds for road improvements in his district be delayed until more information can be obtained.
On the recommendation of Personnel Director Dr. Don Coker, Jerry Hicks moved, seconded by Susan Spence, that the Board adopt the amended 2010-11 Pupil Progression Plan as presented. Motion carried unanimously.
Dr. Webber encouraged Board members to read the packet of materials left with them containing the state mandated changes to the School Lunch Program and to expect some parent calls.
Transportation Supervisor Skeeter Boyd presented a transportation update regarding the recent fire tragedy in the destruction of 7 buses. Before the fire, Transportation had 21 activity buses they could use if needed and felt that school could open with these, even though it would be very tight for a while, and that eight buses will have to be removed in December due to their age. Mr. Boyd stated, “We just thought we had a problem before the fire occurred.” Plans are on the Agenda tonight to discuss leasing 8 buses for one semester until 7 more can be purchased, which will not be ready until November or December. Mr. Boyd stressed that 7 buses will not be sufficient to run the system. If only 7 buses are purchased, it will be a washout because this only replaces the seven that burned in the fire. According to Mr. Boyd, the state requires buses to be removed from service at 25 years of age and 8 of the older buses have reached the age limit and are scheduled to be pulled in December 2010 and that is only 4 months away. When the lease is up, that leaves him with only 14 activity buses. These activity buses are also used for breakdowns and do not just sit on the lot waiting for ballgames. There are 8 or 10 breakdowns per day in our system and it is virtually impossible to operate without reserve buses for maintenance purposes. Next year we are facing another dilemma in that 10 more buses will have to be removed as they age out of service. Mr. Boyd recommended that the Board purchase 12 buses at this time. Dr. Webber commented that the cause of the July bus fire is still under investigation. Its origin has not been determined and he does not expect the district’s insurance policy to provide much money toward the purchase of new buses regardless of the investigator’s findings. The Purchasing Agent estimates that the Board will receive approximately $132,000 for the claim after the $100,000 deductible is subtracted.
In order to make more room at their facility, Transportation Supervisor Skeeter Boyd requested the Board’s permission to sale the (17) retired/surplus buses and tires through the bid process.
On the recommendation of Transportation Supervisor Skeeter Boyd, Jerry Hicks moved, seconded by Carey Walker, to grant permission to bid 12 conventional type buses: (10) 66 passenger & (2) 80+ passenger) buses; (7) to replace those that burned and (5) to replace those aging out in December 2010. Purchasing Agent Bobby Jones will change the budget amount posted on the Agenda for seven (7) buses to $930,000 in the bid specifications. Motion carried unanimously.
Susan Spence suggested that the Board consider the possibility of partnering with other area school districts to buy buses in volume, perhaps reducing the cost.
On the request and recommendation of Transportation Supervisor Skeeter Boyd, A. R. Sims moved, seconded by John Russell, that the Board install security cameras, lights, motion detectors and alarms at both bus barns including the areas surrounding the facilities and their parking lots at both the Monroe and West Monroe garages. Motion carried unanimously.
Following much discussion, Jerry Hicks moved, seconded by Scott Robinson, that the Board amend the Agenda to add item No. 7 Sale of Surplus Equipment under XI. Permission to Bid. Motion carried unanimously.
On motion by Scott Robinson, seconded by Jerry Hicks, the Board granted permission to Purchasing Agent Bobby Jones to advertise the Sale of Surplus Equipment. Motion carried unanimously.
Purchasing Agent Bobby Jones reviewed various leasing options with the Board regarding temporary rental of eight buses. Whereby, Scott Robinson moved, seconded by A. R. Sims, that the Board grant permission to the Superintendent and/or Purchasing Agent Bobby Jones to enter into a lease agreement contract for the rental of eight (8) buses for a period beginning with the arrival of the leased buses and ending on January 11, 2011. The daily rate will be $75.00 per day per bus and the Board will be charged only for the days school is in session. The buses can only be used for daily routes or activity trips but not both activity trips and routes. However, Mr. Jones may be able to work out accommodations with the owner. Buses can be used in emergency situations such as breakdowns. The total cost to the system will be not more than $54,000 for use of these buses. Motion carried unanimously.
Purchasing Agent Bobby Jones informed the Board that the Board’s insurance will be coming up for renewal December 31. About two years ago the Board obtained insurance bids, but is not something the Board is required to do. He thinks it is in the Board’s best interest that quotes are obtained for all insurance needs of the system and will be sending packets to agencies that may be interested in offering a quote. Even though Mr. Jones is not required to do so, he plans to advertise for quotes to make sure everyone is contacted.
Special Projects/Safety Coordinator Kenneth Slusher reported on the meeting he had this morning with the engineer from Baton Rouge (hired to inspect possibly defective stadium light poles) and Board attorney Elmer Noah on the inspection of the stadium light poles in question at all four sites (Richwood, Sterlington, Good Hope and West Ridge). During his inspection, he did not find any visual evidence of defective poles at any of the sites. Mr. Slusher was asked to provide him with all the specifications; the weight of the lights, the dimensions, etc. that he would need to compile an inspection report. After the evaluations are complete, he will send his written recommendations within a week to 10 days giving instructions on how he wants the poles tested. If he finds it necessary, he will provide guidance for a quick fix to get us through the football season until a permanent fix can be applied to remedy any dangerous situation. In other business, Mr. Slusher announced that all the projects in West Monroe are in progress. A monthly construction meeting will be held at Sterlington tomorrow morning at 9:00 and anyone interested in attending is invited. The west side monthly construction meetings are Thursday as follows: OPAC 10:00, Lenwil at 11:00, and West Ridge at 1:00 P.M.
On the recommendation of Purchasing Agent Bobby Jones, Mr. Sims moved, seconded by Carey Walker, that the Board accept the low bids meeting specifications from Delta Fuel, Hill Oil, Rachel Oil and Central Oil for oil and grease products [Bid No. 52-10] and accept the low bid meeting specifications in the amount of $93,972 from Video Link for security cameras [Bid No. 15-11]. Motion carried unanimously.
On the recommendation of Special Projects/Safety Coordinator Kenneth Slusher, Scott Robinson moved, seconded by Jerry Hicks, that the Board grant permission to bid Softball Renovations at West Monroe High School with a budget amount of $200,000 [Bid No. 20-11] and Press Box Football [Bid No. 21-11] at West Monroe High School with a budget amount of $60,000. Motion carried unanimously.
On the recommendation of Purchasing Agent Bobby Jones, A. R. Sims moved, seconded by Scott Robinson, that the Board grant permission to bid the following items: (4) Copy Paper [Bid No. 22-11]; (5) Library Furniture at Sterlington Elementary & Richwood Middle [Bid No. 23-11]; and (6) PE Equipment for Ouachita Parish [Bid No. 24-11]. Motion carried unanimously.
The next meeting will be held on Tuesday, August 24, 2010 at 12:00 noon. At this writing, it has been changed to 6:00 P.M.

AN ORDINANCE TO ENLARGE THE CORPORATE LIMITS OF THE TOWN OF STERLINGTON, LOUISIANA PURSUANT TO L.R.S. 33:171 ET SEQ., AND PARTICULARLY R.S. 33:180, BY ANNEXING TERRITORY BELONGING TO THE PARISH OF OUACHITA, LOUISIANA, SAID PROPERTY BEING ADJACENT AND CONTIGUOUS TO THE EXISTING BOUNDARIES OF THE TOWN OF STERLINGTON, LOUISIANA, AND OTHERWISE PROVIDING WITH RESPECT THERETO;
WHEREAS, Louisiana Revised Statutes of 1950, Title 33, Section 171 et seq., as amended, provides for the procedure for annexation of territory into the corporate limits of a municipality; and
WHEREAS, there has been compliance with the procedure required by L.R.S. 33:171 et seq., as amended, including but not limited to the following:
A petition (see Exhibit “1”) has been presented to the Mayor and Board of Aldermen of the Town of Sterlington by each nonresident property owner of the areas to be included in the corporate limits, requesting that property owned by petitioners and contiguous to existing boundaries of the Town of Sterlington, and being more particularly shown by vicinity map attached hereto as Exhibit “2”, more particularly described in Exhibit “3”, be annexed in the corporate limits of the Town of Sterlington, Louisiana;
A certificate of the Ouachita Parish Assessor is attached hereto as Exhibit “4” certifying that according to assessment for property taxes for 2009 the property described in Exhibit “3” is owned by the resident property owners who have petitioned for annexation, and the total property tax assessment for parish taxes for 2009 is in the amount of $6,018.00, and that full amount represents the value of property owned by the persons signing the petition for annexation;
As reflected by Exhibit “5”, according to the records of the Registrar of Voters, there are two registered voters residing within the territory described in Exhibit “3”; and
Proof of publication of the filing of the petition, as required by L.R.S. 33:172B, and of notice of a public hearing concerning the annexation is attached hereto as Exhibit “6”;
Pursuant to the notice as evidenced by Exhibit “6” the Sterlington Board of Aldermen on the 24th day of August, 2010, and hereto held a public hearing regarding said petition for annexation.
WHEREAS, following said hearing by the Mayor and Board of Aldermen and after careful consideration of all recommendations, comments and objections made at said hearing the Mayor and Sterlington Board of Aldermen declare that it is in the best interest of the Town of Sterlington to annex into the corporate limits of the Town of Sterlington the property described in Exhibit “3”.
NOW THEREFORE,
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the Town of Sterlington, Louisiana, in legal session convened, that the property owned by LAD Rentals, LLC and contiguous to the existing boundaries of the corporate limits and located in the vicinity as shown by the map attached hereto and Exhibit “2” and more particularly described in Exhibit “3” be annexed into the corporate limits of the Town of Sterlington, Louisiana.
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and the Board of Aldermen of the Town of Sterlington, Louisiana, in legal session convened, that the Mayor of the Town of Sterlington, Louisiana or his designee, be and they shall hereby be authorized to take all further actions and execute all further documents, resolutions and/or certifications as are required under L.R.S. 33:171, et seq. or other applicable law, as are necessary, proper or desirable, particularly including but not limited to the filing of the entire boundary of the municipality as changed in including but not limited to the filing of the entire boundary of the municipality as changed in order that the annexation of property set forth above be effected at the earliest possible date.
SECTION 3. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the Town of Sterlington, Louisiana, in legal session convened, that all Ordinances or parts of Ordinances in conflict herewith are repealed, but this repeal shall be only insofar as such Ordinances conflict and/or are inconsistent with this Ordinance; and all Ordinances or parts of Ordinances not inconsistent herewith shall continue in full force and effect.
SECTION 4. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the Town of Sterlington, Louisiana, in legal session convened, that the articles, paragraphs, sentences, clauses, and phrases of this Ordinance are deemed to be severable, and if any article, paragraph, sentence, clause, or phrase of this Ordinance shall be declared to be unconstitutional and/or invalid, such unconstitutionality and/or invalidity shall not affect any of the remaining articles, sentences, paragraphs, clauses, or phrases which can be given effect without the unconstitutional and/or invalid provision(s).

ALDERMEN REPORTS
Alderman Ladd Williams reported under House Bill 2 the town has been appropriated $900,000 (Nine Hundred Thousand Dollars) for the sewer system, along with the town’s match of one million dollars that he understand we had to prove we’ve spent. Mr. Williams also reports that we also got another Fifteen Thousand Dollars for a Welcome to Sterlington Sign on Highway 165 coming from Bastrop or the South bound lane. He also mentioned we have been awarded One Hundred Thousand Dollars through Delta Regional Authority to help with the cost for the waste water treatment facility.
Alderman Williams feels we should complement the Mayor for working with our Legislators in getting this funding for our area.
UNFINISHED BUSINESS
BLACK DURANGO ENGINE REPLACEMENT
Alderman Velasquez states the Black Durango is going to need some extensive repairs to the motor and he was thinking that Chief Bonner received a quote of $2,500 for repairs. Alderman Velasquez went searching online to see what it would cost to replace the engine. He has furnished five estimates. The one that stood out to him was Accurate Engines in Michigan, because they specialize in the 4.7 liter Dodge engines. It comes with a three year warranty with unlimited mileage. The engine is $1995 with $300 freight charge and a $300 refundable core charge. Once they receive the old block and repair it they will refund us the three hundred dollars ($300). The total cost for a new engine is $2594.
Caesar Velasquez makes the recommendation to purchase this motor from Accurate Engines and put the Durango back into service. Alderman Williams asked how much was it going to cost to pull the old engine and put the new one in. Mayor Breland mentioned Stuart’s hasn’t given us a quote on that yet. Someone attending the meeting stated he replaced his engine in his truck and it cost $600 to pull the old one and to put in the new one.
M/S/C (Ron Hill, Ladd Williams) to purchase the new engine from Accurate Engines and assuming the labor won’t be over $1,000 (one thousand dollars).
AMEND YARD MAINTENANCE ORDINANCE
M/S/C (Ladd Williams, Bonnie Dilmore) to adopt the proposed ordinance as Ordinance Number 2010-04 (MOP) amending Ordinance #2008-04 (MOP) by adding to Section 5. The Equipment Rental Rates as follows:
MOWING AND WEEDEATING RATES:
Riding Mower $150 per yard
Push Mower $50 per yard
Weed eating $50 per yard
Tractor $200 4 hour minimum
$75 hourly over 4 hours
Bush Hog $150 hourly per parcel
This Ordinance takes effect July 14, 2010.
ORDINANCE ON ALDERMEN’S COMPENSATION
M./S/C (Ladd Williams, Jayne bullock) to adopt the proposed ordinance as Ordinance Number 2010-05 (OTG) increasing the compensation for the Board of Aldermen from $175 to $250 monthly with the Mayor Pro Tempore’s compensation increasing to $350 monthly with an effective date of January 1, 2011. There were four yea votes and one nay vote.

Ladd Williams asked if one of the businesses that stores your data off-site if that was what we needed. Ron Hill stated this was for internal functioning and some backing up, but we do need to check on the off-site storage also.

REPORTS
ALDERMEN REPORTS
Ladd Williams gave an update on the upcoming chamber events. The Chamber of Commerce will be having the River Cruise on September 9, 2010. On September 20, 2010, the local candidates will be invited to a political forum, which the location and the time are undetermined at this time.
ECONOMIC DEVELOPMENT
Charles McDonald gave an update on the grants that have been awarded to the Town; $100,000 from the Delta Rural Authority and $15,000 from the Legislature a House Bill Grant. The $100,000 grant will be used for sewer and the $15,000 grant will be used for a “Welcome to Sterlington” Sign on the north end of Highway 165. Mr. McDonald also stated that we have secured a $675,000 loan at 1% interest that Lazenby & Associates applied for which is to be used for sewer.
Mr. McDonald reported that he is still working with businesses to come to our community. He is still working on getting a Hotel in our town. A local family has asked Mr. McDonald to hold off until about August or September to talk about a local Hardware Store.
AUDIT REPORT
Francis Huffman from Luffey, Huffman, Ragsdale and Soignier CPA Firm presented the audit report for yearend 2009 and went over it in detail. He explained the comments in the management letter do not warrant a “finding”. The items found in the management letter are no I-9s, W-4s or L-4s found in some of the personnel files. He stated overall the Town had a good audit.
BLACK DURANGO ENGINE
Chief Barry Bonner stated that the engine is here and Stuart’s has started installing it. He said it will be a few days before we get it back.
GIS UPDATE
Will Merritt explains that GIS can give lots of different information that can be used for economic development. Mr. Merritt states that it can be used for household income, how far you drive according to your address, traffic counting data, and etc. He stated restaurants use the GIS system to find good areas to build their franchises. He has given the police officers a map of Sterlington and public works a map of the water lines, sewer lines, man holes, and right of ways. He has also compiled a map for planning and zoning. His next project will be to put all the ditch work in and establish how the water flows so we can find clogged areas easier.

NEW RIDING LAWN MOWER

ROOF REPAIR QUOTE
Mayor Vern Breland stated that we have a quote for our leaking roof. He advised that the roof only leaks when we get a major rain. The bid is $5,087.00 from Roofing Contractors, Inc. The Council wants Mayor Breland to get two or three more quotes for the next meeting.
RANDY HALL POLICE DEPARTMENT PART-TIME EMPLOYMENT
Chief Barry Bonner gave the council a letter regarding Officer Randy Hall. Ron Hill wanted to review the latest budget reports before making a decision to employ him part-time.

The recess was taken at 7:21 p.m. The meeting was called back to order by Mayor Vern Breland at 7:24 p.m. Chief Bonner stated the only thing that will change is the workman’s compensation. Alderman Williams asked if Randy Hall has passed all of his tests and if he is post certified. Chief Barry Bonner answered that he has passed everything and is post certified. Jayne Bullock asked about his previous employment.
M/S/C (Ladd Williams, Ron Hill) to hire Randy Hall as part-time Police Officer at an hourly pay rate of $10.50 as recommended by Chief Bonner.
FOOTBALL SPONSORSHIPS, MAGIC 97 AND FEED THE PANTHER FOOTBALL PLAYERS
Mayor Vern Breland discussed the different levels of sponsorship. The Council agreed to sponsor “Wear that Panther Pride” at $375 (three hundred seventy-five dollars).
DITCHING AT MEDIC PHARMACY
Mayor Vern Breland discussed the possibility to help Medic Pharmacy through the TIF Project. Medic Pharmacy wants to put a parking lot in for the new Sterlington Flooring business. He stated that he explained to Mr. Albritton that we cannot put parking lots in, but we can do any of the infrastructures that deal with drainage. The site has been surveyed by our engineer. Mayor Breland has the plans from the engineer and a quote from Roger Robinson in the amount of $3,000 for the dirt work and installing the pipe. There will be an estimate of 100 feet of 15 inch uncorrelated pipe with two catch basins.
M/S/C (Ron Hill, Ladd Williams) to use the TIF District money to fund the Medic Pharmacy drainage project.
Mayor Breland said that he will try to have all of the figures and necessary information at the August 10th meeting.
INTRODUCTION OF THE ANNEXATION OF ERIC LIEW’S PROPERTY ON 165
Mayor Vern Breland discussed the location of Eric Liew’s property and that he and Charles McDonald met with Mr. Liew. Matilda Parker asked what Mr. Liew will be doing with the property. Mayor Vern Breland answered that Mr. Liew has it broken up into 5 different lots that will be sold as commercial lots, not residential.
M/S/C (Ladd Williams, Caesar Velasquez) to introduce an ordinance annexing Eric Liew’s property on Highway 165. Ron Hill abstained.

DISCUSSION ON BANNING OR RESTRICTING PAY DAY LOANS, PAWN SHOPS AND TATOO PARLORS
Ladd Williams talked about the reasons for restricting pay day loans, pawn shops, and tattoo parlors within our town limits. Matilda Parker asked if there are any other kinds of businesses that should be restricted. Alderman Williams asked her to let him know if she thinks of anything. Mayor Breland asked Town Attorney Bryan Racer if the Town would be able to hold a public meeting for planning and zoning in conjunction with the ordinance. Bryan Racer advised that it can be done in conjunction as long as it is introduced and published. Mr. Bruce Bonner asked why the council doesn’t keep businesses who sell alcohol out of the town limits. One Alderman answered with a lot of restaurants count on selling alcohol with food, because one ordered drink just about pays for one whole bottle of alcohol.

Mayor Breland asked if anyone had anything to discuss or talk about. Chief Bonner talked about pawn shops providing a valuable service to the community. Ron Hill stated that if anyone would like to express their opinion to him about pawn shops, pay day loans, tattoo parlors, and adult shops, he would be happy to accept that input.

(4) Effective April 1, 2012, the provisions of this Subparagraph shall be implemented if and when the last official forecast of revenues adopted for a fiscal year before the start of that fiscal year contains an estimate of severance tax revenues derived from natural resources other than sulphur, lignite, or timber in an amount which exceeds the actual severance tax revenues from such natural resources collected in Fiscal Year 2008-2009. Upon the adoption of such official forecast, the Revenue Estimating Conference shall certify that the requirements for the implementation of the provisions contained in this Subparagraph have been met. In such event, the following distributions and allocations of severance tax revenues and other revenues provided in this Subparagraph shall be effective and implemented for the fiscal year for which the official forecast was adopted, and each year thereafter. The legislature shall provide by law for the administrative procedures necessary to change the severance tax allocation to parishes from a calendar year basis to a fiscal year basis.
(a) Remittance to parishes.
(i) In the first fiscal year of implementation of this Subparagraph, the maximum amount of severance tax on all natural resources other than sulphur, lignite, or timber which is remitted to the parish in which severance or production occurs shall not exceed one million eight hundred fifty thousand dollars. For all subsequent fiscal years, the maximum amount remitted to a parish shall not exceed two million eight hundred fifty thousand dollars.
(ii) On July first of each year the maximum amount remitted to the parish in which severance or production occurs, as provided in Item (i) of this Subsubparagraph, shall be increased by an amount equal to the average annual increase in the Consumer Price Index for all urban consumers for the previous calendar year, as published by the United States Department of Labor, which amount shall be as calculated and adopted by the Revenue Estimating Conference.
(iii) Of the total amount of severance tax revenues remitted in a fiscal year to a parish governing authority pursuant to the provisions of this Subparagraph, any portion which is in excess of the amount of such tax revenues remitted to that parish in Fiscal Year 2011-2012 shall be known as "excess severance tax". At least fifty percent of the excess severance tax received by a parish governing authority in a fiscal year shall be expended within the parish in the same manner and for the same purposes as monies received by the parish from the Parish Transportation Fund.
(b) Deposit into the Atchafalaya Basin Conservation Fund.
(i) Notwithstanding any other provision of this constitution to the contrary, after allocation of money to the Bond Security and Redemption Fund as provided in Article VII, Section 9(B) of this constitution, and after satisfying the required allocations in Subsubparagraph (a) of this Subparagraph, Paragraph (E) of this Section, and Article VII, Sections 10-A and 10.2 of this constitution, an amount equal to fifty percent of the revenues received from severance taxes and royalties on state lands in the Atchafalaya Basin, but not to exceed ten million dollars each fiscal year, shall be deposited by the treasurer into the Atchafalaya Basin Conservation Fund, hereinafter referred to as the "fund", which is hereby created as a special fund in the state treasury. The monies in the fund shall be invested by the treasurer in the manner provided by law, and interest earned on the investment of these monies shall be deposited in and credited to the fund. All unexpended or unencumbered monies remaining in the fund at the end of the fiscal year shall remain in the fund.
(ii) The monies in the fund shall be used exclusively for projects contained in the state or federal Basin master plans or an annual Basin plan developed and approved by the advisory or approval board created by law specifically for that purpose, or to provide match for the Atchafalaya Basin Floodway System, Louisiana Project. Each year's plan for the expenditure of monies appropriated from the fund shall be subject to the approval of the appropriate subject matter committees of the legislature.
(iii) Of the monies appropriated in any fiscal year, eighty-five percent shall be used for water management, water quality, or access projects, and the remaining fifteen percent may be used to complete ongoing projects and for projects that are in accordance with the mission statement of the state master plan. However, no more than five percent of the monies appropriated in any fiscal year may be used for the operational costs of the program or the department.

Section 2. Be it further resolved that the provisions of this amendment shall become effective on April 1, 2012.
Section 3. Be it further resolved that this proposed amendment shall be submitted to the electors of the state of Louisiana at the statewide election to be held on November 2, 2010.
Section 4. Be it further resolved that on the official ballot to be used at said election there shall be printed a proposition, upon which the electors of the state shall be permitted to vote FOR or AGAINST, to amend the Constitution of Louisiana, which proposition shall read as follows:
To decrease the amount of taxes retained by the state on the severance of natural resources, other than sulphur, lignite, and timber, and to increase the maximum amount of such revenues which are remitted to the parish governing authority from where the severance occurs, to be implemented in the event that the official forecast of severance tax revenues for any fiscal year includes an estimate for severance tax collections which will exceed that actually collected by the state in Fiscal Year 2008-2009; to change the annual maximum amount to be remitted to a parish governing authority from eight hundred fifty thousand dollars to one million eight hundred fifty thousand for the first fiscal year of implementation, which amount would increase to two million eight hundred fifty thousand dollars for the following and subsequent fiscal years; to provide for annual adjustment of the maximum amounts in accordance with the consumer price index; to require that of the revenues received by a parish governing authority under these provisions, that portion which is in excess of the amount of such revenues received in Fiscal Year 2011-2012 be used within the parish for the same purposes as monies received from the Parish Transportation Fund; to require that of the severance taxes and royalty revenues retained by the state from activity on state lands within the Atchafalaya Basin, up to ten million dollars per year be deposited into a special fund created in the state treasury to be known as the Atchafalaya Basin Conservation Fund; to provide that monies in this fund be used exclusively for conservation, improvement, and management of the Atchafalaya Basin in accordance with formal state and federal plans; to require legislative approval for and specific limitations on the use of monies appropriated from the fund. Proposing to add Article VII, Section 21(K) of the Constitution of Louisiana, relative to ad valorem property tax exemptions; to provide an exemption for certain property owned by certain disabled veterans and their spouses; to provide for the amount of the exemption; to prohibit the loss of revenue associated with this exemption from impacting the calculation of millage rates by taxing authorities; to require taxing authorities to absorb the loss of revenue as a result of this exemption; to prohibit the reappraisal and valuation of property for purposes of millage adjustment under certain circumstances; to require a local election called by resolution or ordinance by the local governing authority for the establishment of the exemption; to provide for submission of the proposed amendment to the electors; to provide for an effective date; and to provide for related matters.
Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members elected to each house concurring, that there shall be submitted to the electors of the state of Louisiana, for their approval or rejection in the manner provided by law, a proposal to add Article VII, Section 21(K) of the Constitution of Louisiana, to read as follows:
§21. Other Property Exemptions
Section 21. In addition to the homestead exemption provided for in Section 20 of this Article, the following property and no other shall be exempt from ad valorem taxation:

(K)(1) In addition to the homestead exemption authorized under the provisions of Article VII, Section 20 of this constitution, which applies to the first seven thousand five hundred dollars of the assessed valuation of property, the next seven thousand five hundred dollars of the assessed valuation of property receiving the homestead exemption which is owned and occupied by a veteran with a service-connected disability rating of one hundred percent by the United States Department of Veterans Affairs shall be exempt from ad valorem taxation. The surviving spouse of a deceased veteran with a service-connected disability rating of one hundred percent shall be eligible for this exemption if the exemption was in effect on the property prior to the death of the veteran and the surviving spouse remains the owner of the property. If property eligible for the exemption provided for in this Paragraph has an assessed value in excess of fifteen thousand dollars, ad valorem property taxes shall apply to the assessment in excess of fifteen thousand dollars.
(2) Notwithstanding any provision of this constitution to the contrary, the property assessment of a property for which this exemption has been claimed, to the extent of seven thousand five hundred dollars, shall not be treated as taxable property for purposes of any subsequent appraisals and valuation for millage adjustment purposes under Article VII, Section 23(B) of this Constitution. The decrease in the total amount of ad valorem tax collected by a taxing authority as a result of the exemption shall be absorbed by the taxing authority and shall not create any additional tax liability for other taxpayers in the taxing district as a result of any subsequent reappraisal and valuation or millage adjustment. Implementation of the exemption authorized in this Paragraph shall neither trigger nor be cause for a_
reappraisal of property or an adjustment of millages pursuant to the provisions of Article VII, Section 23(B) of this constitution.
(3) The exemption provided for in this Paragraph shall only extend and apply in a parish if it is established through an election which shall be called by either an ordinance or a resolution from the parish governing authority. The proposition shall state that the exemption shall extend and apply in the parish and become effective only after the question of its adoption has been approved by a majority of the registered voters of the parish voting in an election held for that purpose.
Section 2. Be it further resolved that this proposed amendment shall be submitted to the electors of the state of Louisiana at the statewide election to be held on November 2, 2010.
Section 3. Be it further resolved that, after approval by the electors of this state, this proposed amendment shall become effective January 1, 2011.
Section 4. Be it further resolved that on the official ballot to be used at said election there shall be printed a proposition, upon which the electors of the state shall be permitted to vote FOR or AGAINST, to amend the Constitution of Louisiana, which proposition shall read as follows:
To exempt from ad valorem tax, in addition to the homestead exemption, the next seventy-five thousand dollars of value of property which is owned and occupied by a veteran with a service-connected disability rating of one hundred percent; to authorize the exemption to apply to the surviving spouse of a deceased veteran if the exemption was in effect on the property prior to the death of the veteran and the surviving spouse remains the owner of the property; to require the taxing authority to absorb any decrease in the total amount of ad valorem taxes collected as a result of this exemption; to prohibit the exemption from creating any additional tax liability for other property taxpayers; to prohibit implementation of the exemption from triggering reappraisal of property or adjustment of millages; provides that the exemption shall only extend and apply if established through an election called by the local governing authority and approved by a majority of the registered voters in an election held for that purpose. Nothing herein shall prohibit a taxing authority from collecting, in the year in which Sections 18 and 20 of this Article are implemented or in any subsequent year, a larger dollar amount of ad valorem taxes by (1) levying additional or increased millages as provided by law or (2) placing additional property on the tax rolls. Increases
(1) Subject to the limitations provided in Subparagraph (2) of this Paragraph, increases in the millage rate in excess of the rates established as provided by Paragraph (B) above of this Section, but not in excess of the prior year's maximum authorized millage rate, may be levied by two-thirds vote of the total membership of a taxing authority without further voter approval but only after a public hearing held in accordance with the open meetings law; however, in addition to any other requirements of the open meetings law, public notice of the time, place, and subject matter of such hearing shall be published on two separate days no less than thirty days before the public hearing. Such public notice shall be published in the official journal of the taxing authority, and another newspaper with a larger circulation within the taxing authority than the official journal of the taxing authority, if there is one.
(2)(a) A taxing authority with a governing authority membership which is not composed entirely of persons who were elected by the voters for participation on that governing authority may increase a millage rate in accordance with the provisions of Subparagraph (1) of this Paragraph; however, the amount of increase in any taxable year shall not increase the ad valorem tax collections of the taxing authority by more than two and one-half percent of such collections for the immediately preceding calendar year.
(b) The provisions of this Subparagraph shall not apply to taxing authorities which are special fire protection or fire department districts or ports, port harbor, and terminal districts, nor shall they affect the provisions of Article VI, Section 39(A) of this constitution.

(G)(1) Special Assessment Level.

(5)(a) Any owner entitled to the special assessment level set forth in this Paragraph who is unable to occupy the homestead on or before December thirty-first of a future calendar year due to damage or destruction of the homestead caused by a disaster or emergency declared by the governor shall be entitled to keep the special assessment level of the homestead prior to its damage or destruction on the repaired or rebuilt homestead provided the repaired or rebuilt homestead is reoccupied by the owner within five years from December thirty-first of the year following the disaster. The assessed value of the land and buildings on which the homestead was located prior to its damage shall not be increased above its assessed value immediately prior to the damage or destruction described in this Subsubparagraph. If the property owner receives a homestead exemption on another homestead during the same five-year period, the damaged or destroyed property shall not be entitled to keep the special assessment level, and the land and buildings shall be assessed in that year at the percentage of fair market value set forth in this constitution. In addition, the owner must shall also maintain the homestead exemption set forth in Article VII, Section 20(A)(10) to qualify for the special assessment level in this Subsubparagraph.
(b) Any owner entitled to the special assessment level set forth in Subsubparagraph (a) of this Subparagraph who is unable to reoccupy his homestead within five years from December thirty-first of the year following the disaster shall be eligible for an extension of the special assessment level on the homestead for a period not to exceed two years. A homeowner shall be eligible for this extension only if the homeowner's damage claim is filed and pending in a formal appeal process with any federal, state, or local government agency or program offering grants or assistance for repairing or rebuilding damaged or destroyed homes as a result of the disaster, or if a homeowner has a damage claim filed and pending against the insurer of the property. The homeowner shall apply for this extension of the special assessment level with the assessor of the parish in which the homestead is located. The assessor shall require the homeowner to provide official documentation from the government agency or program evidencing the homeowner's participation in the formal appeal process or official documentation evidencing the homeowner has a damage claim filed and pending against the insurer of the damaged property, as provided by law.
(c) After expiration of the extension authorized in Subsubparagraph (b) of this Subparagraph, an assessor shall have the authority to grant on a case-by case basis up to three additional one-year extensions of the special assessment level as prescribed by law.

§20. Homestead Exemption
Section 20.(A) * * *

(10)(a) Any homestead receiving the homestead exemption that is damaged or destroyed during a disaster or emergency declared by the governor whose owner is unable to occupy the homestead on or before December thirty-first of a calendar year due to such damage or destruction shall be entitled to claim and keep the exemption by filing an annual affidavit of intent to return and reoccupy the homestead within five years from December thirty-first of the year following the disaster with the assessor within the parish or district where such homestead is situated prior to December thirty-first of the year in which the exemption is claimed. In no event shall more than one homestead exemption extend or apply to any person in this state.
(b) For homesteads qualifying for the homestead exemption under the provisions of Subsubparagraph (a) of this Subparagraph, after expiration of the five-year period, the owner of a homestead shall be entitled to claim and keep the exemption for a period not to exceed two additional years by filing an annual affidavit of intent to return and reoccupy the homestead with the assessor within the parish where the homestead is located prior to December thirty-first of the year in which the exemption is claimed. A homeowner shall be eligible for this extension only if the homeowner's damage claim to repair or rebuild the damaged or destroyed homestead is filed and pending in a formal appeal process with any federal, state, or local government agency or program offering grants or assistance for repairing or rebuilding damaged or destroyed homes as a result of the disaster, or if a homeowner has a damage claim filed and pending against the insurer of the property. The accrued benefits of members of any state or statewide public retirement system shall not be diminished or impaired.
(b)(F) Benefit Provisions; Legislative Enactment. Future benefit Benefit provisions for members of the state and statewide public retirement systems any public retirement system, plan, or fund that is subject to legislative authority shall be altered only by legislative enactment;. No such benefit provisions having an actuarial cost shall be enacted unless approved by two-thirds of the elected members of each house of the legislature. however, Furthermore, no such benefit provision for any member of a state retirement system having an actuarial cost shall be approved by the legislature unless a funding source providing new or additional funds sufficient to pay all such actuarial cost within ten years of the effective date of the benefit provision is identified in such enactment. This Subsubparagraph Paragraph shall be implemented as provided by law.

§25. Tax Sales
Section 25.(A) Tax Sales. (1) There shall be no forfeiture of property for nonpayment of taxes. However, at the expiration of the year in which the taxes are due, the collector, without suit, and after giving notice to the delinquent in the manner provided by law, shall advertise for sale the property on which the taxes are due. The advertisement shall be published in the official journal of the parish or municipality, or, if there is no official journal, as provided by law for sheriffs' sales, in the manner provided for judicial sales. On the day of sale, the collector shall sell the portion of the property which the debtor points out. If the debtor does not point out sufficient property, the collector shall sell immediately the least quantity of property which any bidder will buy for the amount of the taxes, interest, penalties, and costs. If authorized by the state or local tax collector, any bidder may elect to bid down the five percent penalty, as provided in Subparagraph (B)(1) of this Section, in increments of one-tenth of one percent. The sale shall be without appraisement. A tax deed by a tax collector shall be prima facie evidence that a valid sale was made.

(E) Movables; Tax Sales. When taxes on movables are delinquent, the tax collector shall seize and sell sufficient movable property of the delinquent taxpayer to pay the tax, interest, penalties, and costs, whether or not the property seized is property which was assessed. Sale of the property shall be at public auction, without appraisement, after ten days advertisement, published within ten days after date of seizure. It shall be absolute and without redemption.
If the tax collector can find no corporeal movables of the delinquent to seize, he may levy on incorporeal rights, by notifying the debtor thereof, or he may proceed by summary rule in the courts to compel the delinquent to deliver for sale property in his possession or under his control.

Section 2. Be it further resolved that this proposed amendment shall be submitted to the electors of the state of Louisiana at the statewide election to be held on November 2, 2010.
Section 3. Be it further resolved that on the official ballot to be used at said election there shall be printed a proposition, upon which the electors of the state shall be permitted to vote FOR or AGAINST, to amend the Constitution of Louisiana, which proposition shall read as follows:
To provide relative to the bidding process for ad valorem property tax sales by authorizing a bidder at a tax sale to bid down the existing five percent penalty in increments of one-tenth of one percent; to require the payment of penalties by a bidder at ad valorem property tax sales; to require the payment of interest, penalties, and costs by a taxpayer who is delinquent on the payment of taxes on movables. (Amends Article VII, Section 25(A)(1) and (E))

Proposing to amend Article I, Section 4(H)(1) of the
Constitution of Louisiana, to provide relative to the sale of certain expropriated property; to provide an exception for the sale of property expropriated for the removal of a threat to public health or safety; to provide for submission of the proposed amendment to the electors; and to provide for related matters.

Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members elected to each house concurring, that there shall be submitted to the electors of the state of Louisiana, for their approval or rejection in the manner provided by law, a proposal to amend Article I, Section 4(H)(1) of the Constitution of Louisiana, to read as follows:
§4. Right to Property

(H)(1) Except for the removal of a threat to public health or safety caused by the existing use or disuse of the property, and except for leases or operation agreements for port facilities, highways, qualified transportation facilities or airports, the state or its political subdivisions shall not sell or lease property which has been expropriated and held for not more than thirty years without first offering the property to the original owner or his heir, or, if there is no heir, to the successor in title to the owner at the time of expropriation at the current fair market value, after which the property can only be transferred be transferred only by competitive bid open to the general public. After thirty years have passed from the date the property was expropriated, the state or political subdivision may sell or otherwise transfer the property as provided by law.

Section 2. Be it further resolved that this proposed amendment shall be submitted to the electors of the state of Louisiana at the statewide election to be held on November 2, 2010.
Section 3. Be it further resolved that on the official ballot to be used at said election there shall be printed a proposition, upon which the electors of the state shall be permitted to vote FOR or AGAINST, to amend the Constitution of Louisiana, which proposition shall read as follows:
Provides that property expropriated for the public purpose of removing a threat to public health or safety caused by the existing use or disuse of the property shall not be subject to the requirement of offering the property back to the original owner who allowed the property to become a threat to public health or safety or to the requirement of public sale. Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members elected to each house concurring, that there shall be submitted to the electors of the state of Louisiana, for their approval or rejection in the manner provided by law, a proposal to amend Article I, Section 17(A) of the Constitution of Louisiana, to read as follows:
§17. Jury Trial in Criminal Cases; Joinder of Felonies; Mode of Trial
Section 17.(A) Jury Trial in Criminal Cases. A criminal case in which the punishment may be capital shall be tried before a jury of twelve persons, all of whom must concur to render a verdict. A case in which the punishment is necessarily confinement at hard labor shall be tried before a jury of twelve persons, ten of whom must concur to render a verdict. A case in which the punishment may be confinement at hard labor or confinement without hard labor for more than six months shall be tried before a jury of six persons, all of whom must concur to render a verdict. The accused shall have a right to full voir dire examination of prospective jurors and to challenge jurors peremptorily. The number of challenges shall be fixed by law. Except in capital cases, a defendant may knowingly and intelligently waive his right to a trial by jury but no later than forty-five days prior to the trial date and the waiver shall be irrevocable.
