Sealed Bids will be received by Primary Health Services Center, Administrative Office, 2913 Betin Avenue, Monroe, Louisiana 71201 until 2:00 p.m., Thursday, July 15, 2010, at which time and place all bids will be publicly opened and read aloud.

They may be obtained without charge and without deposit from www.aeplans.com.
Printed copies are not available from the Primary Health Services Center, but arrangements can be made to obtain them through reprographic firms, i.e. Data Bank IMX. Plan holders are responsible for their own reproduction cost. Taylor-Wallace Designs, Inc., 441 Point Place Road, Downsville, La, phone 318-396-2197 can furnish a set of documents. The deposit is fully refundable upon return of the documents, in good condition, no later then ten (10) days after receipt of bids.
All bids must be accompanied by bid security equal to five (5%) of the base bid, and must be in the form of a certified check, cashier's check or bid bond written by a company licensed to do business in Louisiana, countersigned by a person who is under contract with the surety company or bond issuer as a licensed agent in this state and who is residing in the state.
No Bid Bond indicating an obligation of less than (5%) by any method is acceptable.
The successful Bidder will be required to furnish a performance and payment bond written by a company licensed to do business in Louisiana, and shall be countersigned by a person who is contracted with surety company or bond issuer as agent of the company or issuer, and who is licensed as an insurance agent in this State, and who is residing in this state, in an amount equal to the 100% of the contract amount.
Bids shall be accepted from Contractors who are licensed under LA R.S. 37:2150-2173 for the classification of Building Construction. No bid may be withdrawn for a period of thirty (30) days after receipt of bids, except under the provisions of Act 111 of 1983.
The owner reserves the right to reject any and all bids.

PROCLAMATION NO. 35 BJ 2010
SPECIAL ELECTION - JUDGE - PARISH OF OUACHITA
WHEREAS, a vacancy exists in the office of Judge, City Court, Division B, City of Monroe, Parish of Ouachita, due to the resignation of the honorable Judge Frederick C. Amman, III, effective March 19, 2010
WHEREAS, R.S. 18:621(A) mandates the governor to call a special election to fill the vacancy in an existing judgeship when more than twelve (12) months of the term remain unexpired, in accordance with the provisions of R.S. 18:621(A)(3) and/or the dates for elections set forth in R.S. 18:402;
NOW THEREFORE, I, BOBBY JINDAL, Governor of the State of Louisiana, by virtue of the authority vested by the Constitution and the laws of the State of Louisiana, do hereby order and direct as follows:
SECTION 1: A special primary and a special general election shall be held throughout the jurisdiction of the City of Monroe, Parish of Ouachita, for the purpose of electing a judge to fill the vacancy in the office.
SECTION 2: Any qualified person desiring to become a candidate for said office shall file a notice of candidacy, accompanied either by a qualifying fee or a nominating petition, as required or authorized by law, with the appropriate election official in the manner and form, and under the procedures and conditions, provided by R.S. 18:461, et seq., and all other applicable provisions of the Louisiana Election Code, R.S. 18:1, et seq., during the period commencing on Wednesday, July 7, 2010, and ending at 5:00 p.m. on Friday, July 9, 2010.
SECTION 3: The special elections shall be held and conducted under the applicable provisions of the Louisiana Election Code, R.S. 18:1, et seq.
SECTION 4: The primary election shall be held on Saturday, October 2, 2010, and the general election shall be held on Tuesday, November 2, 2010, at the times and places, and in the manner, prescribed by law.
SECTION 5: The Secretary of State, Commissioner of Elections, Parish Board of Supervisors, Clerk of Court, Registrar of Voters, and all other persons charged with any power, function, right, duty or responsibility in conducting elections in the jurisdiction of the City Court, Division B, City of Monroe, Parish of Ouachita, are hereby authorized, requested, directed and empowered to exercise every lawful function and to do every act necessary to conduct said special elections, to cause the returns thereof to be made, to canvass and promulgate the results thereof, and to perform all related and incidental functions thereto.

PROCEEDINGS OF THE POLICE JURY, PARISH OF OUACHITA, STATE OF LOUISIANA, TAKEN AT A REGULAR MEETING HELD ON, MONDAY, MARCH 15, 2010 AT 5:31 P.M.
The Police Jury of the Parish of Ouachita, State of Louisiana met in a regular session in the Ouachita Parish Police Jury Meeting Room, Courthouse Building, Monroe, Louisiana on Monday, March 15, 2010 at 5:31 p.m., and was duly convened by Mr. Shane Smiley, President, who stated that the Police Jury was ready for the transaction of business.

The invocation was given by Mr. Jackson. Mr. Jackson led the Pledge of Allegiance to the flag.
VISITORS:
The president noted the large number of visitors present at the meeting. The president asked his fellow jurors would it be okay to address a matter on Mr. Jackson’s agenda at this time. No one objected to taking up the matter at this time. Mr. Jackson, seconded by Mr. Calhoun offered the following resolution for adoption:
RESOLUTION NO. 10-07
A MEMORIAL RESOLUTION IN HONOR OF CORPORAL J.R. SEARCY, OUACHITA PARISH SHERIFF’S OFFICE.
WHEREAS, on March 4, 2010, Corporal J.R. Searcy of the Ouachita Parish Sheriff’s Office, suffered a mortal gunshot wound in the line of duty;
WHEREAS, at the time of this tragic incident Corporal Searcy had completed his assigned shift but had volunteered to assist a fellow deputy, an embodiment of the loyalty and dedication to duty typical of not only Corporal Searcy but of our local law enforcement community;
WHEREAS, Corporal Searcy, by his actions embodied the very highest standards of his profession and earned the lasting respect and gratitude of the citizens of Ouachita Parish;
THEREFORE,
BE IT RESOLVED that the Ouachita Parish Police Jury hereby commends the memory of Corporal J. R. Searcy of the Ouachita Parish Sheriff’s Office for his heroism and courage in the line of duty and his invaluable sacrifice made in service of the people of Ouachita Parish; and,
BE IT FURTHER RESOLVED that the Ouachita Parish Police Jury hereby formally expresses condolences to the family of Corporal Searcy on behalf of the citizens of Ouachita Parish.
BE IT FURTHER RESOLVED that the Ouachita parish Police Jury hereby evidences its support of the initiative to memorialize Corporal Searcy in the naming of the new library branch presently under construction on La. Hwy 34, and respectfully requests that the Board of Control of the Ouachita Parish Public Library give consideration thereto.
The above resolution was passed this 15th day of March 2010.

The president recognized Daris Warren, President of the Library Board of Control. Mr. Warren stated that a special meeting had been called to address the matter concerning the renaming of the Southwest Branch of the library.
The president recognized Mr. Will Brady of 5320 Hwy 546. Mr. Brady stated that he had started the petition to rename the library and asked that each juror sign the petition. The jury agreed.
The president recognized Paul West of NOVA Workforce Institute. Mr. West along with a member of his staff, a board member, a participant and two members from the interfaith community spoke at length about the benefits and the impact that NOVA has had on the parish. Mr. West asked that the jury consider supporting its endeavors in the parish. No other action was taken on this matter.
The president recognized Cheryl Slavant of Ouachita Riverkeepers. Ms. Slavant spoke about the impact of the effluent from Georgia Pacific Corporation on the Ouachita River. Ms. Slavent stated that the permit for the company was up for renewal and asked that the jury consider offering a letter of support or resolution to the Arkansas DEQ to clean up the river in Arkansas. The president stated that this matter was on his agenda, and he would address it at this time if there were no objections. There were none. Discussion ensued. Motion offered by Mr. Smiley, seconded by Mr. Jackson to give a letter of support to the Ms. Slavant to present to the Arkansas Department of Environmental Quality. Motion passes without opposition.
The president recognized Gary Fontana of GNF Management. The president stated that the two matters were on Ms. Moore agenda and if no one objected they would be addressed at this time. No one objected. Mr. Cammack stated that there was an additional item, a resolution regarding the funding proposal for the Gustav/Ike Disaster Recovery Program. Mr. Cammack stated that the jury would have to amend the agenda to take up the third matter which was necessary to meet the state deadline. Motion offered by Mr. Caldwell, seconded by Ms. Moore to amend the agenda for consideration of adopting the resolution regarding LRA funding for the Gustav/Ike Disaster Recovery Program. Motion passed without opposition.
Mr. Fontana stated that the resolution was authorizing the president to sign the application for the funding. Discussion ensued.
Mr. Caldwell, seconded by Mr. Jackson offered the following resolution for adoption:
RESOLUTION NO. 10-08
A RESOLUTION ADOPTING THE OUACHITA PARISH HURRICANES GUSTA/IKE RECOVERY PROPOSAL AND AUTHORIZING THE PARISH PRESIDENT TO SUBMIT THE PROPOSAL TO THE LOUISIANA RECOVERY AUTHORITY FOR FINAL APPROVAL AND AUTHORIZATION TO PROCEED IN THE IMPLEMENTATION OF THE OUACHITA PARISH HURRICANES GUSTA/IKE DISASTER RECOVERY PROGRAM.
WHEREAS, the Consolidated Security, Disaster Assistance, and Continuing Appropriations Act, 2009 (Pub. Law 110-329), enacted on September 30, 2008, appropriated $6.1 billion through the Community Development Block Grant (CDBG) Program for “necessary expenses related to disaster relief, long-term recovery, and restoration of infrastructure, housing, and economic revitalization in areas affected by hurricanes, floods, and other natural disasters occurring during 2008 for which the president declared a major disaster …,” and
WHEREAS, of the total monies awarded to the State of Louisiana, Ouachita Parish Police Jury has been allocated a total of $3,709, 564.00 in Hurricanes Gustav/Ike CDBG-Disaster Recovery funding; and
WHEREAS, utilization of the funding requires the Ouachita Parish Police Jury to adopt a “Recovery Proposal” that has been developed in collaboration with the citizenry of the Parish and details the project(s) needed to assist the Parish in recovering from the devastating effects of the storms of 2008; and
WHEREAS, after public hearings conducted on August 20, 2009, and on March 3, 2010, along with numerous meetings with parish agencies which function to provide public services to persons of low/moderate income, the Parish developed its “Ouachita Parish Police Jury Hurricanes Gustav/Ike Disaster Recovery Proposal” for formal submission to the Louisiana Recovery Authority.
NOW, THEREFORE,
BE IT RESOLVED by the Ouachita Parish Police Jury, on behalf of the Ouachita Parish Police Jury, that the “Ouachita Parish Police Jury Hurricanes Gustav/Ike Disaster Recovery Proposal,” attached hereto as Exhibit A, be hereby adopted; and
BE IT FURTHER RESOLVED that the Parish President, Mr. Shane Smiley, is hereby authorized to sign the proposal to the Louisiana Recovery Authority for final approval and authorization to begin the implementation of the Ouachita Parish Police Jury Hurricanes Gustav/Ike Disaster Recovery Program.
This resolution is hereby submitted and declared adopted by the votes recorded as follows on this 15th day of March 2010.

Mr. Fontana spoke regarding the Louisiana Recovery Authority $10 Million Comprehensive Resiliency Program in Parishes affected by Hurricanes Gustav and Ike. Mr. Fontana stated that the application for possible funding in the amount of $130,000 was due on March 17th. Mr. Fontana indicated that the application did not guarantee funding, but was an instrument to prepare a plan to identify drainage problems, prioritize them, and implement ways to alleviate problems. Discussion ensued. Motion offered by Ms. Moore, seconded by Mr. Caldwell to authorized Mr. Fontana to submit the application on behalf of the Ouachita Parish Police Jury for the LRA $10 Million Comprehensive Resiliency Program. Motion passed without opposition.
Mr. Fontana asked that the jury authorize the president to sign a letter in support of the application in lieu of a resolution. Discussion ensued again. Motion offered by Mr. Caldwell, seconded by Mr. Calhoun to authorize the president to sign a letter in support of the grant and the submission thereof. Motion passed without opposition.
Ms. Moore spoke regarding the consulting fees associated with the grant application. Mr. Fontana expressed to the jury that there were no professional fees included in the grant. Discussion ensued. Motion offered by Mr. Jackson, seconded by Mr. Caldwell to authorize an amount not to exceed $1000 to be paid for through the drainage fund for professional services performed by GNF Management. Motion passed without opposition.
Ms. Moore asked Mr. Cammack to address the jury on the matter of the protocol for the Physical Accessibility Application. Mr. Cammack indicated that GNF Management had been hired to prepare the application but not submit it. Discussion ensued. Ms. Moore stated that the application had been submitted. Mr. Mitchell indicated that if the jury has not ratified the application then the jury has no obligation to accept the award. Discussion ensued again. Mr. Mitchell stated that if the jury is awarded the grant, the jury is not obligated to accept the grant. Mr. Mitchell also stated that the jury could take action to withdraw the application submitted by Mr. Fontana by acting on the matter tonight. Mr. Jackson spoke extensively about the administrative fees associated with the grant. Discussion ensued again. No action was taken on this matter.
The president recognized Martha Hudson 114 Roosevelt Circle located in Fair Oaks Subdivision. The president indicated that the matter was on Dr. Reddix’s agenda and asked the jury to address the matter at this time. No one objected to taking up the matter at this time. Ms. Hudson spoke regarding the inability to use the restroom facilities in her home when it rains. Ms. Hudson stated that the problem was throughout the subdivision and asked the jury for assistance in addressing the matter. Discussion ensued. The jury asked that Mr. Mitchell look into the matter and get back with Ms. Hudson.
The president asked for a motion to recess the regular meeting in favor of the Finance Committee. Motion offered by Mr. Caldwell, seconded by Mr. Calhoun to recess the regular meeting and reconvene as the Finance Committee. Motion passed without opposition.
FINANCE COMMITTEE MEETING
The chairman, Mr. Jackson called the Finance Committee meeting to order at 6:54 p.m.
Mr. Jackson recognized Mr. Cammack. Mr. Cammack spoke regarding the claims statement for the period of February 16, 2010 through March 11, 2010, recommended approval. Motion offered by Mr. Caldwell, seconded by Dr. Reddix to approve the claims as recommended. Motion passed without opposition.
Mr. Cammack stated that he did not have anything new to present on the operations of the jail, but had discussed with Mr. Mitchell the election dates for the millage renewal. Mr. Cammack added that the jury needed to consider when they would like to put the matter on the ballot. Discussion ensued. No action was taken on this matter.
Mr. Cammack stated that a fund balance update was sent out in the packets and noted that the library was the only fund that had a balance from the previous year. No action was taken on this matter.
Mr. Cammack spoke regarding the recent change in the law that requires self-insured companies to have an impress fund. Mr. Cammack stated that a deposit of $124,000 would be set aside for the purpose of paying claims through our provider Crawford & Company. Discussion ensued. Motion offered by Mr. Caldwell, seconded by Mr. Smiley to set up an impress fund for Workmen’s Comp and General Liability in the amount of $124,000 subject to the approval of the Treasurer and the Legal Department. Motion passed without opposition.
The chairman recognized Mr. Beckham, Office of Homeland Security. Mr. Beckham spoke regarding the bid for generators and transfer switches. The bids were opened on March 2, 2010. Mr. Cammack stated that the bids were opened and that questions came up during the process concerning the specifications for these items and their installation. In view of these issues, Mr. Cammack suggested that the jury consider rejecting all bids and hire an electrical engineer or contractor to put the bid specs together, determine and recommend the lowest conforming bid, oversee the installation process and approve the invoices for payment. Discussion ensued. Mr. Cammack recommended that the jury reject all bids. Motion offered by Mr. Caldwell, seconded by Dr. Reddix to reject all bids. Motion passed without opposition. Discussion ensued again. No other action was taken on the matter.
The chairman noted correspondence from the Firefighter’s Retirement System and the District Attorney’s Retirement System. No action was taken on the matter.

Mr. Jackson asked Mr. Cammack to speak regarding the Energy Efficiency Grant. Mr. Cammack stated that he would be competitively advertising this week for a mechanical engineer for the project. A brief discussion ensued. No other action was taken on this matter.
Mr. Jackson asked that the matter regarding the Green Springs Flood Project be placed on the April 5th agenda as well as Cheyenne Drive.

AN ORDINANCE REQUIRING THE PAYMENT OF PUBLIC, EDUCATIONAL, GOVERNMENTAL ACCESS PROGRAMMING SUPPORT TO THE PARISH OF OUACHITA BY CABLE OR VIDEO SERVICES PROVIDERS OPERATING WITHIN THE PARISH’S UNINCORPORATED LIMITS UNDER A STATE-ISSUED CERTIFICATE OF FRANCHISE AUTHORITY AND OTHERWISE PROVIDING WITH RESPECT THERETO:
WHEREAS, pursuant to the provisions of the Consumer Choice for Television Act of 2008, codified at LSA-RS.45:1361 et seq, any person or entity desiring to provide cable or video services within the Parish of Ouachita may do so by obtaining a state-issued certificate of franchise authority;
WHEREAS, the Parish of Ouachita has requested those entities providing cable or video services within the unincorporated limits of the Parish of Ouachita to provide public, educational, and governmental access programming, streams, or channels (“PEG”) and desires to collect PEG access support from these cable or video service providers pursuant to the provisions of LSA-R.S.45:1370
BE IT THEREFORE ordained by the Police Jury of the Parish of Ouachita, State of Louisiana, that pursuant to the provisions of LSA-R.S.45:1361 et seq, providers of cable or video services holding a state issued certificate of franchise authority as provided in LSA-R.S.45:1361 et seq, and operating within the Parish’s municipal limits shall pay to the Parish of Ouachita an amount equal to one half percent of the gross revenues, as that term is defined by the “Consumer Choice for Television Act of 2008,” derived from operations within the Parish’s unincorporated limits.

Mr. Calhoun asked Mr. Holtzclaw to update the jury on the road list for the entire parish. Mr. Holtzclaw stated that he was working with Public Works to update the road list for the entire parish. Mr. Holtzclaw indicated that he would present the updated list sometime in April.
Mr. Calhoun spoke briefly regarding the redistricting of the parish and encouraged each juror to visit North Delta to provide input for the new map. No action was taken on this matter
Mr. Calhoun asked Mr. Holtzclaw to update the jury on the Cheniere Lake Bathroom Project. Mr. Holtzclaw stated that he had been in contact with the contractor and that the problems with the fire marshal had been worked out. Mr. Holtzclaw indicated that the project was back on track and progressing. Mr. Calhoun added that an additional 100,000 fingerlings would be added to the lake this year. No other action was taken on this matter.
Mr. Calhoun spoke briefly regarding the Sparta Aquifer. Mr. Calhoun indicated that the commission had applied for non-profit status to apply for grant funds and had established an office at Louisiana Tech. No action was taken on this matter.

MR. WALT CALDWELL, DISTRICT C:
Mr. Caldwell asked that the matter regarding Skate Lane be deferred to the next meeting of the jury.
Mr. Caldwell asked Mr. Holtzclaw to update the jury on the Bayou Desiard Restoration Project. Mr. Holtzclaw stated that he had spoken with officials from the City of Monroe and the Corps of Engineer. Mr. Holtzclaw indicated that he was still waiting on a letter from the city addressing the proposed drawdown of the bayou. No other action was taken on this matter.
Mr. Caldwell stated that he would address the matter concerning drainage issues within the Treasure Island Subdivision with the public works director and the engineer later.
Mr. Caldwell asked that the matters regarding debris cleanup and the ULM/Comcast Government Access Channel be deferred to the next meeting. Mr. Caldwell asked that Lonewa Road be added to the next agenda.

Dr. Reddix thanked the jury for their support in applying for and submitting the Care Grant Application. Dr. Reddix asked Mr. Holtzclaw to speak regarding the J. S. Clark Cemetery. Mr. Holtzclaw presented the proposed scope of work for engineering services to develop the cemetery improvement project. Discussion ensued. MR. SHANE SMILEY, DISTRICT E:
The president spoke regarding the extension of the quiet zone along the KCS Railway. Motion offered by Mr. Smiley, seconded by Ms. Moore to enter into a Cooperative Endeavor Agreement with the City of Monroe to extend the quiet zone along KCS Railways as far as Delta Community College. Ms. Moore spoke briefly regarding the position of a Grant Writer for Ouachita Parish. Ms. Moore asked that the department heads provide input regarding the position. Mr. Cammack, Ms. Bennett and Mr. Murray provided useful information to the jury. Discussion ensued. Ms. Moore asked that the matter be placed on the April 5th meeting on the jury.
Ms. Moore spoke regarding the Hi-Speed Broadband for Communities. Mr. Cammack stated that he had gone to the website for additional information and recommended that the jury consider the proposal. Discussion ensued. Motion offered by Ms. Moore, seconded by Mr. Caldwell to authorize the Treasurer to request the information to show the jury’s interest in the Hi-Speed Broadband for Communities. Motion passed without opposition.
Ms. Moore spoke regarding the Smart Growth Implementation Assistance-2010 Request for Letters of Interest. Discussion ensued. Motion offered by Ms. Moore, seconded by Mr. Calhoun to submit a 2010 Request for Letters of Interest for a Neighborhood Master Plan for the Unincorporated Areas of District D and F. Discussion ensued again. Ms. Moore withdrew her motion. A motion was offered by Dr. Reddix, seconded by Ms. Moore to pass a resolution to submit a 2010 Request for Letters of Interest for the unincorporated areas east of the river including the municipal limits. Motion passed without opposition.
Ms. Moore, seconded by Mr. Jackson asked the jury to amend the agenda to take up the matter of approving Ouachita Parish Police Jury participation in the Out for Life Task Force Forum. Ms. Moore stated that the reason for the waiver was due to time. The flyer needed to be mailed out this week. Motion passed without opposition. Motion offered by Ms. Moore, seconded by Mr. Jackson to use the name of the police jury as a host on the flyer in support of the Out for Life Task Force Forum to be held on April 22, 2010. The Police Jury of the Parish of Ouachita, State of Louisiana met in a regular session in the Ouachita Parish Police Jury Meeting Room, Courthouse Building, Monroe, Louisiana on Monday, April 19, 2010 at 5:35 p.m., and was duly convened by Mr. Shane Smiley, President, who stated that the Police Jury was ready for the transaction of business.

A motion to adopt the Minutes of the Regular Police Jury Meeting including the Committee Meetings held on April 5, 2010, was offered by Mr. Caldwell, seconded by Ms. Moore with corrections to page 3 to read “First African American Public Health Nurse”. Motion passed without any opposition.
APPROVAL OF AGENDA:
The president asked whether or not there were any changes or additions to the agenda at this time. Dr. Reddix stated that Mayor Steve Hunter had asked to address the jury. The president stated that he would allow Mayor Hunter to speak as a visitor when he arrives. Mr. Mitchell noted that an item regarding a letter of support for West Ouachita Sewer District #16 had been added to Mr. Jackson’s agenda on Friday, April 16th, after the agendas were delivered. Mr. Mitchell stated that the revised agenda had been posted in compliance with the law and no “amendment” was needed for that item. Mr. Cammack spoke regarding the claims statement for the period of March 21, 2010 through April 15, 2010, and recommended approval. Motion offered by Mr. Calhoun, seconded by Mr. Caldwell to approve the claims statement as recommended. Motion passed without opposition.
Mr. Cammack spoke regarding the operations at the jail. Mr. Cammack informed the jury that the millage for the jail would expire at the end of 2011. Mr. Mitchell spoke regarding the matter and the timetable for forthcoming elections. Mr. Mitchell stated that all matters for millages ending in the near future could be placed on the October 2, 2010 election ballot. No action was taken on this matter.
Mr. Cammack spoke regarding the purchase of a car and mini-van for the Correctional Center. Mr. Cammack stated that the purchase price of the car is $21,732.50 and the price of the minivan is $19,130.00. Both vehicles will be purchased off state contract. Discussion ensued. Motion offered by Mr. Caldwell, seconded by Mr. Calhoun to approve the purchase of the two vehicles as presented. Motion passed without opposition.
Mr. Cammack spoke regarding the mechanical engineering services for the Energy Efficiency Grant. Mr. Cammack recommended that the jury contract with T. Hardy Hayes as the Mechanical Engineer for the design and implementation of the retrofits as specified in the grant. Mr. Cammack noted that all payments for engineering services will be taken from the grant funds. Motion offered by Ms. Moore, seconded by Mr. Calhoun to approve the recommendation of the treasurer. Motion passed without opposition.
Mr. Cammack spoke regarding the Electrical engineering services for the HMGP Generator Initiative and recommended James M. Standard & Associates. Discussion ensued. Motion offered by Mr. Caldwell, seconded by Mr. Calhoun to approve the recommendation of the Treasurer subject to the costs being taken out of grant funds. Motion passed without opposition.
Mr. Cammack spoke regarding Civil Engineering services for the GOHSEP/LRA Drainage Improvements for Oak Circle. Mr. Cammack recommended Holtzclaw Engineering for the project. Motion offered by Mr. Calhoun, seconded by Ms. Moore to approve the recommendation of the Treasurer subject to the costs to be paid from grant funds. Motion passed without opposition.
The chair recognized Chief Hemphill. The chief spoke regarding the purchase of two replacement fire trucks from Ferrara Fire Apparatus. A brief discussion ensued. Motion offered by Mr. Caldwell, seconded by Mr. Calhoun to purchase two fire trucks. Motion passed without opposition.
Discussion ensued regarding the capital outlay funds for the fire department. No action was taken on this matter.
The chair recognized Mr. Murray. Mr. Murray spoke regarding the bid tabulation for an asphalt paver and excavator. Mr. Murray recommended that the jury accept the lowest conforming bid from LA Machinery for the asphalt paver in the amount of $147,105.00 and the excavator in the amount of $128,378.00. Motion offered by Mr. Calhoun, seconded by Mr. Caldwell to approve the recommendation for the purchase of the asphalt paver and excavator. Motion passed without opposition.
Mr. Cammack spoke briefly regarding the funds expended for the operating of the river pump stations during the high-water period from October 2009 through February 2010. Discussion ensued. No action was taken on this matter.

WHEREAS, by a plat filed in the conveyance records of Ouachita Parish at Plat Book 21, Page 184, the developer of Arbor Cove Subdivision dedicated a certain 15’ wide drainage servitude running northerly from Arbor Cove Circle along the boundary of Lots 9 and 10 of said subdivision and easterly along the northern portion of Lot 9, all of which is shown more particularly on the plat of record as identified above;
WHEREAS, given the course of the development of Arbor Cove Subdivision, a re-alignment of drainage channels is needed and the present owners of Lots 8 & 9 of said subdivision have agreed to dedicate to the public a drainage servitude across their properties to take the place of the above-described drainage servitude on Lots 9 & 10; and,
WHEREAS, there no longer exists a public purpose for the 15’ wide drainage servitude on Lots 9 & 10 of Arbor Cove Subdivision as dedicated by and shown on the plat of said subdivision on file in Plat Book 21, Page 184;
NOW THEREFORE:

WHEREAS, that portion of Bayou Darbonne extending from a point 500 feet above the La. Hwy 143 bridge to the Ouachita River is also subject to a significant volume of boat traffic
WHEREAS, residents and property owners along the above-identified portion of Bayou Darbonne have asked the Ouachita Parish Police Jury to regulate the speed of boat traffic in this area in order to increase safety and minimize the damage to boats, docks, piers, etc. as well the banks of said Bayou; and,
WHEREAS, the Ouachita Parish Police Jury finds that the establishment of a speed limit and “no wake zone” in above-described portion of Bayou Darbonne offers an opportunity to increase safety, reduce property damage, and reduce bank erosion to while imposing a relatively light burden on the boating public, given that responsible boaters are already observing voluntary “no wake zone(s)” in this area;
NOW, THEREFORE:
BE IT ORDAINED by the Ouachita Parish Police Jury in legal and regular session that all watercraft utilizing Bayou Darbonne from a point 500 feet above the La. Highway 143 Bridge to the Ouachita River shall be prohibited from traveling faster than bare steerage speed. “Bare steerage speed,” as defined by La. R.S. 34:851.27(C), shall mean the slowest speed the vessel can travel while allowing the operator to maintain directional control of the vessel to produce the minimum water surface turbulence;
BE IT FURTHER ORDAINED that this Ordinance shall not apply to watercraft operated by emergency personnel in their official capacity, including law enforcement officers and employees of the Louisiana Department of Wildlife and Fisheries;
BE IT FURTHER ORDAINED that violations of this Ordinance shall be punished by a fine of not less than more than One Hundred and No/100 Dollars ($100.00);
BE IT FURTHER ORDAINED that the Ouachita Parish Public Works Department be, and hereby is, authorized to post signs for the “No Wake Zone” created hereby in accordance with LAC, Title 76, Part XI, Section 303, with the cost of erecting and maintaining such signage to be paid from the parish’s General Fund;
BE IT FURTHER ORDAINED that all prior ordinances enacting temporary speed limits on or about that portion of Bayou Darbonne are hereby revoked.

The president spoke regarding a Letter of Support for a Cooperative Endeavor Project on behalf of West Ouachita Sewerage #16. Mr. Mitchell spoke regarding the matter and recommended that the jury authorize the president to sign a letter in support of the project as requested by the project engineer. Motion offered by Mr. Caldwell, seconded by Mr. Calhoun to authorize the president to sign a letter of support for the cooperative endeavor on the project. Motion passed without opposition.

Mr. Calhoun asked Mr. Holtzclaw to speak regarding the Road List for Ouachita Parish. Mr. Holtzclaw presented the 2010 Road Improvement and Maintenance Program. Discussion ensued with Mr. Smiley asking that Clayton Drive be looked at again. Motion offered by Mr. Calhoun, seconded by Mr. Caldwell to approve the road list as presented by the engineer with the exception of Clayton Drive. Motion passed without opposition.
Mr. Holtzclaw spoke regarding the 2010 Road Striping Program and recommended approval. Discussion ensued about LoneWa Road. Motion offered by Mr. Calhoun, seconded by Mr. Caldwell to approve the 2010 Road Striping Program as presented by the parish engineer. Motion passed without opposition.
Mr. Calhoun spoke regarding the construction of the bathrooms at Cheniere Lake Area 3. Mr. Calhoun stated that the project was coming along and would be of great benefit to the parish once completed.
Mr. Calhoun spoke briefly regarding the Sparta Aquifer expressing the need for potable water in the district. Mr. Calhoun stated that the commission expressed thanks to the jury for their support in their efforts.
Mr. Calhoun spoke regarding the Annual MDA Poker Run and asked that the jury grant permission for the Northeast LA Motorcyclists for Kids be allowed to use Area 8 of Cheniere Lake Park during June 11-13, 2010. Motion offered by Mr. Calhoun, seconded by Mr. Caldwell to approve the use of Area 8 of Cheniere Lake for the Annual MDA Poker Run.

MR. WALT CALDWELL, DISTRICT C:
Mr. Caldwell spoke regarding the drainage issues within Treasure Island Subdivision. Mr. Caldwell asked that the parish engineer look into the cost and design of a permanent structure to address the drainage issues within the subdivision and bring that information back to the jury. No other action was taken on this matter.
Mr. Caldwell stated that the matter regarding LoneWa Road had been discussed already.
Mr. Caldwell asked Mr. Holtzclaw to speak regarding the FEMA Flood Map Update. Mr. Holtzclaw indicated that he had reviewed the maps and had documented some discrepancies. Mr. Holtzclaw stated that he had a meeting scheduled with the permit office and would get back to the jury with his recommendations at the next meeting.
Mr. Caldwell asked Mr. Mitchell or Mr. Holtclaw to speak regarding the status of Skate Lane. Mr. Holtzclaw updated the jury on Skate Lane and stated that cost estimates would be done and presented to the jury at its next meeting.
Mr. Caldwell asked Mr. Holtzclaw to speak regarding the Bayou Desiard Restoration Project. Mr. Holtzclaw indicated that he had been in contact with the Corps of Engineer and the city of Monroe. Discussion ensued. Mr. Holtzclaw stated that he would continue to work on the matter to speed up the project.
Mr. Caldwell asked that all matters on his agenda be carried forth to the next meeting.

Dr. Reddix asked Mr. Holtzclaw to speak regarding the J. S. Clark Cemetery. Mr. Holtzclaw indicated that he had done some preliminary work on the cemetery and additional work will be done. Discussion ensued. Dr. Reddix stated that there was an open well on the property that should be addressed. Discussion ensued again. Motion offered by Mr. Caldwell, seconded by Dr. Reddix to purchase a cover for the open well located on the cemetery property. Motion passed without opposition.
Dr. Reddix spoke regarding the need for recycling in the parish and asked that the jury consider it as an alternative to litter control. No other action was taken on this matter.

AN ORDINANCE AUTHORIZING THE EXCHANGE OF LOT 2 OF STUBBS-MCCORMICK PLACE AND THE 2002 MOBILE HOME LOCATED THEREON FOR AND IN THE CONSIDERATION OF A PARCEL IMMEDIATELY NORTH OF LOT 1, SQUARE 1, UNIT 1 OF NEW FRONTIER ADDITION PURSUANT TO THE PROVISIONS OF LA R.S.33: 4711, ET SEQ.; AND FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, the “Acquisition/Elevation Projects” undertaken by the Ouachita Parish Police Jury several years ago involved the relocation of residents from flood-prone homes in New Frontier Subdivision to mobile homes on lots in Stubbs-McCormick Place Subdivision that are not subject to flooding;
WHEREAS, these relocations were to be accomplished primarily through the exchange of the participants’ flood-prone property in New Frontier Subdivision for the lots and mobile homes owned by the OPPJ in Stubbs-McCormick Place Subdivision;
WHEREAS, this acquisition project was effected in 2000 – 2002 with the participants moving from their flood-prone homes in New Frontier Subdivision, which were demolished, to the lots and mobile homes in Stubbs-McCormick Place Subdivision;
WHEREAS, a review of property titles in the affected area reveals that certain acts of conveyance necessary to transfer title to the properties described above were not completed; and,
WHEREAS, the completion of these conveyances is necessary in order to provide the affected participants proper title to their homes in Stubbs-McCormick Place Subdivision and to properly transfer to the Ouachita parish Police Jury title to the flood-prone properties in New Frontier Subdivision;
NOW, THEREORE:
BE IT ORDAINED that the Ouachita Parish Police Jury does hereby authorize its President to execute the Acts of Exchange, and related documents prepared by counsel, necessary to complete the exchanges of property described above and cure the titles thereto;

A RESOLUTION AUTHORIZING THE EXECUTION OF AN AMENDMENT TO A COOPERATIVE ENDEAVOR AGREEMENT WITH THE LOUISIANA OFFICE OF COMMUNITY DEVELOPMENT – DISASTER RECOVERY UNIT; AND, FURTHER PROVIDING WITH RESPECT THERETO
WHEREAS, the Ouachita Parish Police Jury (“OPPJ”) entered into a Cooperative Endeavor Agreement with the Louisiana Office of Community Development (“OCD”) effective March 19, 2009, which made available certain funds for the OPPJ’s activities under the Parish-Implemented Recovery Program;
WHEREAS, OCD has advised that additional funding is now available to further activities under the Parish-Implemented Recovery Program and has submitted to the OPPJ a “First Amendment” to the above-described Cooperative Endeavor Agreement for the purpose of increasing the allocation of such funds to the OPPJ;
WHEREAS, the Ouachita Parish Police Jury finds that the proposed First Amendment and the benefits to be derived there from further the interests of the citizens of Ouachita Parish;
NOW, THEREFORE:
BE IT FURTHER RESOLVED that the Ouachita Parish Police Jury hereby accepts the proposed “First Amendment to the Cooperative Endeavor Agreement Implementing Grant Under the Community Development Block Grant Disaster Recovery Program Through the Parish-Implemented Recovery Program” and authorizes its President, Shane Smiley, and to execute said First Amendment together with such other instruments or correspondence as are reasonable and necessary to give effect to this Resolution.

WHEREAS, the Ouachita Parish Police Jury created Road Lighting District No. 25 of the Parish of Ouachita, State of Louisiana by Ordinance No. 8434 adopted August 15, 1996;
WHEREAS, said District was created to operate and maintain a system of road lighting along Raymond Drive, Old Sterlington Road and Finks Hide-A-Way Road;
WHEREAS, said system of road lighting was never fully established and existed primarily along Raymond Drive;
WHEREAS, the voters of said District have not authorize the District to continue to levy an annual service charge to fund its operations;
WHEREAS, said District presently has no funds and is not operating;
WHEREAS, the Ouachita Parish Police Jury proposes to create a new road lighting district to more closely match the system of road lighting in place along Raymond Drive; and,
WHEREAS, the Road Lighting District No. 25 of the Parish of Ouachita, State of Louisiana has no outstanding indebtedness.
NOW THEREFORE:
BE IT ORDAINED by the Ouachita Parish Police Jury that pursuant to the authority granted by La. Const. Art. 6, Section 15, the Road Lighting District No. 25 of the Parish of Ouachita, State of Louisiana be, and hereby is, abolished;

Ms. Moore spoke regarding Harmon Johnson Road and the geotechnical evaluation and investigation of the road. Mr. Holtzclaw stated that he had contacted several contractors and had gotten an estimate of less than $4,000 for the project. Discussion ensued. Motion offered by Ms. Moore to authorize Mr. Holtzclaw to contract with a geotechnical firm to evaluate Harmon Johnson Road with funding coming out of the General Fund. Mr. Calhoun spoke regarding Caples Road. Discussion ensued. Mr. Calhoun asked that Ms. Moore motion be amended to include Caples Road at a cost not to exceed $10,000, seconded by Dr. Reddix. For clarification, the president stated that Ms. Moore asked that Mr. Holtzclaw to contract with a geotechnical firm to evaluate Harmon Johnson Road and Caples Road, at a cost not to exceed $10,000 with payment for services coming from the General Fund. Discussion ensued again. Motion passed without opposition.
Ms. Moore asked Mr. Mitchell to speak regarding the Tanglewood Flood Control Project. Mr. Mitchell stated that Mr. Richard Moore was actively working on the appraisals on the right-of-ways and that the project was on track. Ms. Moore asked that the matter be placed back on the agenda for the next meeting.

Mr. Murray spoke regarding the preliminary subdivision approval for Versailles Estates located in District A. Mr. Holtzclaw spoke briefly regarding the Finks Hideaway Road Project and the Shamblin Street Lift Station at the Correctional Center. No action was taking on these matters.

The sources of drinking water (both tap water and bottled water) include rivers, lakes, streams, ponds, reservoirs, springs, and wells. As water travels over the surface of land or through the ground, it dissolves naturally-occurring minerals and, in some cases, radioactive material, and can pick up substances resulting from the presence of animals or from human activity. Contaminants that may be present in source water include:
Microbial Contaminants - such as viruses and bacteria, which may come from sewage treatment plants, septic systems, agricultural livestock operations, and wildlife.
Inorganic Contaminants - such as salts and metals, which can be naturally-occurring or result from urban stormwater runoff, industrial, or domestic wastewater discharges, oil and gas production, mining, or farming.
Pesticides and Herbicides - which may come from a variety of sources such as agriculture, urban stormwater runoff, and residential uses.
Organic Chemical Contaminants – including synthetic and volatile organic chemicals, which are by-products of industrial processes and petroleum production, and can also come from gas stations, urban stormwater runoff, and septic systems.
Radioactive Contaminants – which can be naturally-occurring or be the result of oil and gas production and mining activities.
A Source Water Assessment Plan (SWAP) is now available from our office. This plan is an assessment of a delineated area around our listed sources through which contaminants, if present, could migrate and reach our source water. It also includes an inventory of potential sources of contamination within the delineated area, and a determination of the water supply's susceptibility to contamination by the identified potential sources. According to the Source Water Assessment Plan, our water system had a susceptibility rating of 'MEDIUM'. If you would like to review the Source Water Assessment Plan, please feel free to contact our office at the number provided in the following paragraph.
If present, elevated levels of lead can cause serious health problems, especially for pregnant women and young children. Lead in drinking water is primarily from materials and components associated with service lines and home plumbing. Huntington Park W.S.Gowc is responsible for providing high quality drinking water, but cannot control the variety of materials used in plumbing components. When your water has been sitting for several hours, you can minimize the potential for lead exposure by flushing your tap for 30 seconds to 2 minutes before using water for drinking or cooking. If you are concerned about lead in your water, you may wish to have your water tested. Information on lead in drinking water, testing methods, and steps you can take to minimize exposure is available from the Safe Drinking Water Hotline or at http://www.epa.gov/safewater/lead.
In order to ensure that tap water is safe to drink, EPA prescribes regulations which limit the amount of certain contaminants in water provided by public water systems. Food and Drug Administration regulations establish limits for contaminants in bottled water which must provide the same protection for public health. The Louisiana Department of Health and Hospitals - Office of Public Health routinely monitors for constituents in your drinking water according to Federal and State laws. The tables that follow show the results of our monitoring during the period of January 1st to December 31st, 2009. Drinking water, including bottled water, may reasonably be expected to contain at least small amounts of some contaminants. The presence of contaminants does not necessarily indicate that water poses a health risk.
In the tables below, you will find many terms and abbreviations you might not be familiar with. To help you better understand these terms, we’ve provided the following definitions:
Non-Detects (ND) – laboratory analysis indicates that the constituent is not present.
Parts per million (ppm) or Milligrams per liter (mg/L) – one part per million corresponds to one minute in two years or a single penny in $10,000.
Parts per billion (ppb) or Micrograms per liter (ug/L) – one part per billion corresponds to one minute in 2,000 years, or a single penny in $10,000,000.
Parts per trillion (ppt) or Nanograms per liter (ng/L) – one part per trillion corresponds to one minute in 2,000,000 years, or a single penny in $10,000,000,000.
Parts per quadrillion (ppq) or Picograms per liter (pg/L) – one part per quadrillion corresponds to one minute in 2,000,000,000 years or one penny in $10,000,000,000,000.
Picocuries per liter (pCi/L) – picocuries per liter is a measure of the radioactivity in water.
Millirems per year (mrem/yr) – measure of radiation absorbed by the body.
Million fibers per liter (MFL) – million fibers per liter is a measure of the presence of asbestos fibers that are longer than 10 micrometers.
Nephelometric Turbidity Unit (NTU) – nephelometric turbidity unit is a measure of the clarity of water. Turbidity in excess of 5 NTU is just noticeable to the average person.
Variances & Exemptions (V&E) – State or EPA permission not to meet MCL or a treatment technique under certain conditions.
Action level (AL) – the concentration of a contaminant that, if exceeded, triggers treatment or other requirements that a water system must follow.
Treatment technique (TT) – a treatment technique is a required process intended to reduce the level of a contaminant in drinking water.
Maximum contaminant level (MCL) – the “Maximum Allowed” MCL is the highest level of a contaminant that is allowed in drinking water. MCL’s are set as close to the MCLG’s as feasible using the best available treatment technology.
Maximum contaminant level goal (MCLG) – the “Goal” is the level of a contaminant in drinking water below which there is no known or expected risk to human health. MCLG’s allow for a margin of safety.
Maximum residual disinfectant level (MRDL) – The highest level of a disinfectant allowed in drinking water. There is convincing evidence that addition of a disinfectant is necessary for control of microbial contaminants.
Maximum residual disinfectant level goal (MRDLG) – The level of a drinking water disinfectant below which there is no known or expected risk to health. MRDLGs do not reflect the benefits of the use of disinfectants to control microbial contaminants.
During the period covered by this report we had below noted violations of drinking water regulations.

Some people may be more vulnerable to contaminants in drinking water than the general population. Immuno-compromised persons such as persons with cancer undergoing chemotherapy, persons who have undergone organ transplants, people with HIV/AIDS or other immune system disorders, some elderly, and infants can be particularly at risk from infections. These people should seek advice about drinking water from their health care providers. EPA/CDC guidelines on appropriate means to lessen the risk of infection by Cryptosporidium and other microbial contaminants are available from the Safe Drinking Water Hotline (800-426-4791).
Additional Required Health Effects Language:
Some people who drink water containing trihalomethanes in excess of the MCL over many years may experience problems with their liver, kidneys, or central nervous systems, and may have an increased risk of getting cancer.
Some people who drink water containing haloacetic acids in excess of the MCL over many years may have an increased risk of getting cancer.
There are no additional required health effects violation notices.
