PUBLIC NOTICE January 28, 2010 During the reporting period of December 1, 2009 through December 31, 2009 the Kiroli - Darbonne water system violated the maximum contaminate level of coliform bacteria as set forth in the State and Federal Primary Drinking Water Regulations [Part XII of the Louisiana State Sanitary Code (LAC 51:XII)]. Action has been taken to eliminate the contamination. The Kiroli – Darbonne water system is required to take seven bacteriological samples monthly and during the current reporting period two of these samples failed the tests. Sampling error is suspected to be the problem. All follow up samples indicated no bacteriological problems. Since being notified of the non-compliance Greater Ouachita has increased chlorine levels, and flushed water lines to distribute the increased chlorine levels. After this corrective action, all the investigative follow samples did not indicate any coliform present. You do not need to boil your water or take other corrective actions. However, if you have specific health concerns, consult your doctor. People with severely compromised immune systems, infants, and some elderly may be at increased risk. These people should seek advice about drinking water from their health care providers. General guidelines on ways to lessen the risk of infection by microbes are available from EPA’s Drinking Water Hotline at (800) 426-4791. This is not an emergency. If it had been you would have been notified immediately. Total coliform bacteria are generally not harmful themselves. Secondary Education Director Randy Hammett presented new guidelines for middle school coaches for consideration addressing unsportsmanlike conduct by middle school coaches. The rules for high school coaches are set by the LHSAA. The LHSAA handbook was used as a guideline for developing the following policy for the middle school coaches: “MIDDLE SCHOOL COACHES POLICY” First Offense - the coach shall receive an official warning/reprimand in writing. Second Offense - the school shall be fined $200; the coach shall be placed on Probation regarding his coaching responsibilities and suspended from coaching the next game. Third Offense - The school shall be fined $300 and the coach will be suspended of his coaching responsibilities for the remainder of the season. *If suspension occurs, coaching supplement will be affected. The middle school principals recommend that the Association Secretary submit in writing to the principal the reason for a coach being ejected from a ballgame. If schools feel they have been unjustly punished, the school has a right to submit this in writing to the officials’ association. On the recommendation of Secondary Education Director Randy Hammett, Susan Spence moved, seconded by John Russell, that the Board adopt the “Middle School Coaches Policy” as presented by Mr. Hammett. Following much discussion, Mr. Robinson called for the question and the Board voted to approve the policy, with Mr. Sims casting the only “no” vote. On the recommendation of Personnel Director Dr. Don Coker, Scott Robinson moved, seconded by Jerry Hicks, that the Board approve the amended Pupil Progression Plan as presented. Upon the recommendation of Purchasing Agent Bobby Jones, Jerry Hicks moved, seconded by Scott Robinson, that the Board waive the liquidated damages of $250.00 for (2-days) delay of the gym floor project at West Ridge Middle School. (According to Mr. Jones, the delay could not be avoided due to the late arrival of the materials and did not interfere with school activity or cost the Board any extra). Motion carried unanimously. Special Projects/Safety Coordinator Kenneth Slusher updated the Board on the ongoing construction projects. He reported that the OPHS field house and Ag building are occupied and almost finished, except for items on their punch lists that are being addressed. The Fire Marshal will be at Claiborne Thursday for final approval of the classroom additions. The 20 acres of land behind Shady Grove has been surveyed and will bring results to the Board to bid the timber cutting and clearing. Mr. Slusher announced that he received a call from someone at Glenwood Medical Center that a partial shipment of flu vaccines will be shipped on November 6 and is not sure how many or when the balance will be coming in, if at all. Originally, 1,000 doses were to be shipped, but that amount was reduced to 500. Now there may be as little as 200 doses due to the Swine Flu (H1N1) outbreak. There is still a question as to how the shots will be dispensed. Mr. Slusher has reserved 1,200 flu shots for next year through another source. Each vial costs $114.00 and contains 10 shots, and the price will not increase but can decrease. According to Mr. Slusher, we are now paying Glenwood $200.00 per vial. In conclusion, Mr. Slusher reported that the stadium is finished at Ouachita Junior; but, the completions on the P.E. boys/girls dressing rooms are moving slowly, while the band and choir are almost finished. The weather has delayed the bus canopy installation at Swartz lower. Before the contractor can begin construction on the Richwood Middle School project, he must have an approved permit application. Therefore, Board attorney Elmer Noah asked the Board’s permission to authorize President Jack White to execute a twenty-year agreement with the City of Monroe and the Ouachita Parish School Board on the board’s behalf, to provide water and sewage services to Richwood middle and high schools at customary rates with two five-year renewal options. Whereby, Carey Walker moved, seconded by Susan Spence, that the Board authorize President Jack White, on behalf of the Board, to execute the approval of the agreement with the City of Monroe and the Ouachita Parish School Board to provide water and sewage services to Richwood middle and high schools at a customary rate charged by the City for a term of 20 years with two five-year renewal options. This action will allow the contractor to move forward with his approved permit application for the construction of Richwood Middle School. Motion carried unanimously. On the recommendation of Business Manager Richie Garrett, Mr. Sims moved, seconded by Scott Robinson, that the Board reject the bid for greenhouses [Bid No. 13-10] as the only bid received did not meet specifications. Motion carried unanimously. Scott Robinson moved, seconded by Jerry Hicks, that the Board grant permission to bid the following items: (1) copy paper [Bid No. 14-10]; (2) musical instruments [Bid No. 15-10]; (3) office supplies [Bid No. 16-10]; (4) track repair at SHS [Bid No. 17-10]; (5) greenhouses [Bid No. 19-10]; and (6) air-conditioners in auditorium at WMHS [Bid No. 18-10]. Motion carried unanimously. On motion by Scott Robinson, seconded by Jerry Hicks, the Board amended the Agenda to include under Permission to Bid, the resurfacing of the runway leading to the high-jump pit at WMHS as an add alternate on the same bid item for resurfacing the track at Sterlington High School [Bid No. 17-10]. Motion carried unanimously. On motion by Scott Robinson, seconded by Susan Spence, the Board granted permission to bid the high-jump runway resurfacing at WMHS as an add alternate under the same bid-package as the track resurfacing at SHS [Bid No. 17-10]. TUESDAY, OCTOBER 13, 2009 TOWN HALL COUNCIL ROOM CALL TO ORDER/ROLL CALL Mayor Vern Breland called the meeting to order. A quorum was present and acting. Aldermen present: Caesar Velasquez, Cliff Bullock, Ron Hill, and Bonnie Dilmore. Alderman Ladd Williams was absent. INVOCATION AND PLEDGE OF ALLEGIANCE Mayor Breland gave the invocation and led the group in the Pledge of Allegiance. GUESTS Attending the meeting were Al Benson, Reverend Judy Bazer, Melissa Breland, Wes Helbling reporter for North Ouachita Weekly News, Rhonda George, Kimberly, Franchesca, Carmin, and Antonio Velasquez, Jayne Bullock, Donald Duncan, Jay Yarbrough, Muriel D. Wallace, Matilda Parker, Pastor Billy Brown and wife. Town personnel in attendance were Bryan Racer, Todd Newton, Barry Bonner, Alan Spillers, Kevin Willis, Tom Holtzclaw, and Marilyn Dilmore. REPORTS AFLAC INSURANCE Chuck Robbins and Randy Amason talked about their supplemental policies with AFLAC that they would like to offers to the employees of the town. TOWN ENGINEER Tom Holtzclaw went over the quoted we receive on cleaning out the ditches on most all the street in the village area. We received three bids, R.D. Owens $33,966 which is $6 a linear foot, Tyson Construction $22,644 which is $4 a linear foot, and Robinson’s $16.983 which is $3 per linear foot. Mr. Holtzclaw recommended Robinson’s at $16,983. Mayor Breland asked Mr. Holtzclaw since we have established $3 per linear foot do we have to continue to bid out every time we need ditching work done. Mr. Holtzclaw answered back with we need to confirm the $3 per linear foot for the rest of this year and you can utilize that rate. Next year you will need to bid out for another year. Mr. Holtzclaw stated the Mayor asked him to look at the drainage associated with the side walk project. He prepared some estimates to move the sidewalks over some so the necessary drainage work could be done. He said this requires no action tonight. Next month Mr. Holtzclaw will have the road repair list ready for the next meeting. Discussion started on Sharp Lane. Mr. Holtzclaw didn’t think Sharp Lane would score high enough to make the road repair list. Mayor Breland mentioned we have an estimate of $63,800 for 2200 feet to overlay Sharp Lane. Mr. Holtzclaw visited with Pavement Markings who we awarded the street striping to. They are ready to mobilize and can within a couple of weeks. Mayor Breland said to tell them to mobilize as soon as they can if the rain quits.
Mayor Breland informed the council that Tom Holtzclaw has been employed by the Ouachita Parish Police Jury. This will benefit the Town since he is very familiar with what we have going on. ALDERMEN REPORTS Mayor Breland reminded everyone of the Chamber Cruise that will start at six o’clock, and they are calling it “A Taste of Sterlington” ticket is $20 each. PAT MCDONALD SCHOOL The Mayor stated we received $25,000 in grant money from the LA Code Council and GOSHEP that allowed us to send Pat to school to become a CBO (Certified Building Officer). The class is in Baton Rouge December 2 – 7th and then on December 9th he will take to test in Shreveport. UNFINISHED BUSINESS EMERGENCY PREPAREDNESS Discussion was tabled, M/S/C (Caesar Velasquez and Ron Hill). RDS OCCUPATIONAL LICENSE AGREEMENT M/S/C (Ron Hill, Caesar Velasquez) to introduce the ordinance to provide for the imposition of the Insurance Occupation License tax. AMENDING ORDINANCE NO. 2008-08 (SEW) M/S/C (Ron Hill, Cliff Bullock) to adopt Ordinance No. 2009-07 (SEW) amending to Ordinance No. 2008-08 (SEW) appointing Caesar Velasquez as a commissioner to represent the Sterlington Consolidated Sewer System Board. NEW BUSINESS STERLINGTON CHAMBER CRUISE SPONSORSHIP M/S/C (Cliff Bullock, Caesar Velasquez) to sponsor the Sterlington Chamber Cruise at the $500 level. RESOLUTION FOR 2009-2010 LGAP GRANT Mayor Breland reported we are wanting to amend this grant application to a tractor for $52,000 so we can mow Highway 165. The grant is for $35,000. The $52,000 for the tractor does not include the mower. The mower is approximately $12,000. The deadline to file the application was October 1st. The application has already been sent in. We need a resolution supporting this application. M/S/C (Ron Hill, Cliff Bullock) to adopt the amended resolution replacing lift stations with a new tractor. Ron Hill mentions we will be about $29K short on the tractor and mower. APARTMENTS BUILT ON PAIGE CIRCLE Mayor Breland stated we have an individual to come in and get a permit to renovate his carport. Now he is through and we actually have two apartments that were built on the side of his mobile home. This is in violation of the subdivision restrictions. The Mayor asked what did the council want to do. Ron Hill mentioned the structured building was not an existing carport. This guy put up poles for a pole barn which was a brand new structure. Then the sides started going up and he was sure it was going to be an out building or shop building. Then almost overnight there were two apartments there. Mr. Hill stated that is zoned for single resident an R-1 zoning. Mayor Breland stated there are several options that are available to us, since he basically didn’t tell us the truth, didn’t get his permits, and didn’t do what he was suppose to. One is we can cut him off the sewer, have Entergy disconnect service to them and maybe have the water shut off. After discussing this a while, it was decided for the Chief to issue him a citation to court for violating the zoning ordinance and the sewer permit ordinance. INVITATION FOR PUBLIC PARTICIPATION Jack Yarbrough stated he lives on Sharp Lane and stated he understands Sharp Lane is considerably low on the road list to get overlaid. He wants to know how that was obtained. Tom Holtzclaw explained how the roads are graded. Caesar Velasquez received a complaint more of a concern about the kids walking to school and the cars are not yielding to the pedestrians. Another complaint is about someone who has a lot of trash in their back yard along with a pool with stagnate water. He will get with the Chief of Police and give the address. Matilda Parker talked to the Council about the rain water not running off Mr. Wilhite’s across from her. She said all that water comes onto her property. Mayor Breland stated in a couple of months the driveway to the second house is crushed and will be replaced. BUDGET M/S/C (Ron Hill, Caesar Velasquez) to approve the budget as typed. TIMOTHY ALLRED CSI SCHOOL Mayor Breland presented Timothy Allred with a Certificate of Recognition for representing the Sterlington High School and the Town of Sterlington in Washington, D.C. Mayor Breland asked Timothy to explain how he got into this. Timothy explained and told a little about himself. Mayor Breland informed the Council that he has sponsors to help pay for some uniforms for his trip. DIXIE LAND DEVELOPMENT This is residential homes to be built on the land behind town hall. Mayor Breland would like this to be included in the Economic Development District. Tom Holtzclaw is working with them now. LETTER TO DOUG LAWRENCE Mayor Breland stated this is in your packets and it is letting you know how the town responded. DOTD LETTER TO JOHBAR This letter is the one the DOTD has sent the Johbar Holdings and they have yet to respond. Someone asked if the tenants know anything about the letter. Mayor Breland said as soon as he received it he took it to each tenant so they would know and could get the owner to respond to them. The State is planning to remove the culverts since it is not the correct size on December 7th. They will not replace the culverts; it will be up to the land owner. STOP WORK ORDER FOR WOMACK ON WASTEWATER TREATMENT Mayor Breland informed the Council, due to the water table Tom Holtzclaw has issued a stop work order to Womack. Every time they dig a hole it fills up with water. Hopefully in a couple of months they can start back. RDS OCCUPATIONAL LICENSE AGREEMENT Mr. Mulkey with LMA was here to answer any questions the Council has. Mr. Mulkey explained how this program got started and what they do. Their fees for collecting and issuing the occupation licenses are 3% of what they collect..
