CHARLES JACKSON, DISTRICT A: Mr. Jackson, seconded by Mr. Caldwell offered the following ordinance for final adoption: ORDINANCE NO. 8941 AN ORDINANCE ESTABLISHING A TEMPORARY SPEED LIMIT AND NO WAKE ZONE FOR WATERCRAFT ON A PORTION OF BAYOU DARBONNE IN OUACHITA PARISH, LOUISIANA; AND FURTHER PROVIDING WITH RESPECT THERETO. WHEREAS, the Ouachita River at Monroe is approaching its flood stage of 40 feet and is expected to crest later this month near or above flood stage WHEREAS, residents along Bayou Darbonne have asked the Ouachita Parish Police Jury to limit boat traffic in the area around their homes in order to minimize the damage to their property and the banks of said Bayou caused by the current potential flood situation; and, WHEREAS, the Ouachita Parish Police Jury finds that while the precedent of past floods indicates that a prohibition of boat traffic on Bayou Darbonne is not warranted by the present river levels, the establishment of a temporary speed limit and “no wake zone” in the more developed areas along Darbonne Bayou does offer an opportunity to reduce flood damage to residential structures and property while imposing only a minimum burden on the boating public; NOW, THEREFORE: BE IT ORDAINED by the Ouachita Parish Police Jury in legal and regular session that all watercraft utilizing Bayou Darbonne from the La. Highway 143 Bridge to the mouth of Darbonne Bayou at the Ouachita River from this date until this Ordinance is rescinded shall be prohibited from traveling faster than idle speed. “Idle speed” shall be defined as a speed producing a wake of less than two inches or five (5) mile per hour, whichever is less; BE IT FURTHER ORDAINED that this Ordinance shall not apply to watercraft operated by emergency personnel in their official capacity, including law enforcement officers and employees of the Louisiana Department of Wildlife and Fisheries; BE IT FURTHER ORDAINED that violations of this Ordinance shall be punished by a fine of not more than Five Hundred and No/100 Dollars ($500.00); BE IT FURTHER ORDAINED that due to the state of potential flooding along the Ouachita River presently existing, and predicted for the immediate future, introduction and Public Hearing of this Ordinance are waived, and this Ordinance shall become effective immediately upon adoption. MR. MACK CALHOUN, DISTRICT B: Mr. Calhoun spoke briefly about the activities within the West Ouachita Recreation District No. 1. No action was taken on this matter. Mr. Calhoun spoke regarding the status of the bridges within the parish. Mr. Calhoun noted that there are a total of 143 bridges in the parish of which 107 located in the western part of the parish. The president recognized Mr. Caldwell, District C. MR. WALT CALDWELL, DISTRICT C: Mr. Caldwell asked Mr. Holtzclaw, Parish Engineer to update the jury of the status of Skate Lane. Mr. Holtzclaw stated that he had nothing to report at this time on this project, but would address the matter at the November 3rd meeting of the jury. Discussion ensued. No other action was taken on this matter. Mr. Caldwell asked Mr. Murray to speak regarding the drainage issues within Frenchman’s Bend. Mr. Murray stated that Public Works was still working on that issue and would have information at the next meeting of the jury. Mr. Caldwell asked that the matter be put back on his agenda for the next meeting. Mr. Caldwell asked Mr. Holtzclaw to speak regarding the drainage issues within Treasure Island. Mr. Holtzclaw spoke regarding the matter and stated that a long term solution needed to be addressed in the near future. Mr. Caldwell noted several visitors in the audience from the subdivision and asked that the president allow them to speak. Stuart Pavilion of 502 Stevenson Drive represented the group from the subdivision and spoke regarding the flooding problems. Hal Thompson former resident of the subdivision spoke regarding the matter. Discussion ensued. Motion offered by Mr. Caldwell, seconded by Mr. Calhoun to allocate approximately $5,000 from the General Fund for the relief of the water within the subdivision. Discussion ensued again. The president recognized Ms. Blade, District D. MS. RUBY BLADE, DISTRICT D: Ms. Blade asked that Mr. Murray update the jury on the Hadley Street Bridge Project. Mr. Murray informed the jury that the Hadley Street Bridge Project is ongoing and the contract will be awarded in June 2010. No other action was taken on this matter. The president expressed thanks to Ms. Blade for her service during the interim. MR. SHANE SMILEY, DISTRICT E: Mr. Smiley, seconded by Mr. Caldwell offered the following ordinance for final adoption. ORDINANCE NO. 8940 (FINAL) AN ORDINANCE AMENDING CHAPTER 22 OF THE COMPILED ORDINANCES OF OUACHITA PARISH AMENDING SECTION 8 OF SAID CHAPTER, SAID ORDINANCE PROVIDING FOR AN ANNUAL REVENUE FOR THE PARISH OF OUACHITA, STATE OF LOUISIANA, LEVYING ANNUAL TAXES FOR SAID PURPOSES AND FURTHER PROVIDING WITH RESPECT THERETO. 2009 REVENUE LAW SECTION ONE: BE IT ORDAINED by this Police Jury of the Parish of Ouachita, State of Louisiana, in legal and regular session convened that for the calendar year 2009 there is hereby levied an annual tax of 4.18 mills on the dollar of the assessed valuation of all property situated in the Parish of Ouachita, State of Louisiana, outside of the incorporated municipalities of Monroe, West Monroe, Sterlington, and Richwood; said valuation being shown by the assessment rolls for the year 2009 as said rolls are filed in the Office of the Sheriff and Tax Collector and the Clerk of Court of Ouachita Parish. The said tax of 4.18 mills is hereby levied and shall be set apart and dedicated to the use of the General Fund for paying all expenses of the Parish which may arise during the calendar year 2009 according to the estimates of expenditures hereto adopted. SECTION TWO: BE IT FURTHER ORDAINED, that for the calendar year 2009 there is hereby levied a special tax of 2.09 mills on the dollar of the assessed valuation of all property situated within the corporate limits of the City of Monroe, the City of West Monroe, The Town of Sterlington, and the Town of Richwood, not exempt from taxation for General Fund purposes, said valuation being shown by the assessment rolls for the year 2009 as said rolls are filed according to law in the Clerk of Court's Office of the Parish of Ouachita, and in the Office of Sheriff and Tax Collector. SECTION THREE: BE IT FURTHER ORDAINED, for the calendar year 2009 there is hereby levied a special tax of 7.50 mills on the dollar of the assessed valuation of all property situated in the Parish of Ouachita, and not exempt from taxation by the Constitution and Laws of the State of Louisiana for the purpose of providing funds for equipment, supplies, maintenance, operation, construction, acquisition, improvement, renovation and support of the Ouachita Parish Library and its branches, said valuation being shown by the assessment roll for the year 2009 according to the election held in Ouachita Parish, Louisiana, on the 19th day of July, 2003, for the purpose of voting said tax under the provisions of resolution adopted November 18, 1995, and the election held in Ouachita Parish, Louisiana on the 19th day of July, 2003, for the purpose of rededicating the proceeds of said tax under the provisions of resolution adopted April 21, 2003, as said rolls are filed according to the law in the Clerk of Court's Office of the Parish of Ouachita, and in the Office of the Sheriff and Tax Collector. SECTION FOUR: BE IT FURTHER ORDAINED, that for the calendar year 2009 there is hereby levied a special tax of 0.74 mills on the dollar of the assessed valuation of all property subject to taxation in the Parish of Ouachita for the purpose of operating, maintaining, sustaining, and erecting Ouachita Parish Health Units, including rabies and animal control facilities according to the election held on July 17, 2004, resolution adopted April 19, 2004, as said rolls are filed according to law in the Clerk of Court's Office of the Parish of Ouachita, and in the Office of the Sheriff and Tax Collector. SECTION FIVE: BE IT FURTHER ORDAINED by the Ouachita Parish Police Jury, sitting and acting as the Board of Commissioners of the Fire Protection District No. One of the Parish of Ouachita, that for the calendar year 2009 there is hereby levied a special tax of 19.11 mills on the dollar on all property subject to taxation in said District for the purpose of maintaining and operating the Fire Protection Districts fire protection facilities and obtaining water for fire protection purposes; said valuation being shown by the assessment roll for the year 2009, according to the election held on October 15, 2005, resolution adopted July 5, 2005, as said rolls are filed according to law in the Clerk of Court’s office of the Parish of Ouachita, and in the Office of the Sheriff and Tax Collector. SECTION SIX: BE IT FURTHER ORDAINED that for the calendar year 2009 there is hereby levied a special tax of 8.51 mills on all property subject to taxation in the Parish of Ouachita for the purpose of improving, maintaining, operating and equipping the Ouachita Correctional Center; and, there is further levied a special tax of 0.59 mils on all property subject to taxation in said Parish, for the purpose of making major improvements, repairs and/or renovations to the existing Ouachita Correctional Center buildings and structures together with the necessary equipment, furnishings and financing therefore, said valuation being shown by the assessment rolls for the year 2009 according to the election held in Ouachita Parish on July 21, 2007, resolution adopted April 16, 2007, as said rolls are filed according to law in the Clerk of Court’s office of the Parish of Ouachita, and in the office of the Sheriff and Tax Collector. SECTION SEVEN: BE IT FURTHER ORDAINED that for the calendar year 2009 there is hereby levied a special tax of 2.65 mills on the dollar of the assessed valuation on all property subject to taxation in the Parish of Ouachita, for the purpose of improving, maintaining, operating and equipping juvenile detention facilities; and a special tax of 0.30 mills on the dollar of the assessed valuation on all property subject to taxation in the Parish of Ouachita, for the purpose of acquiring, financing, and constructing a building to house juvenile detention alternative programs and related services at the Ouachita Parish Juvenile Detention Center, together with the necessary sites, equipment, and furnishings therefore, according to the election held in Ouachita Parish on July 15, 2006, resolution adopted April 17, 2006, said valuation being shown by the assessment rolls for the year 2009 as said rolls are filed according to law in the Clerk of Court's office in the Parish of Ouachita, and in the office of the Sheriff and Tax Collector. SECTION EIGHT: BE IT FURTHER ORDAINED that for the calendar year 2009, there is hereby levied a special tax of 2.00 mills on the dollar of the assessed valuation on all taxable property situated in Road Lighting District No. 1 of the Parish of Ouachita for the purpose of providing, maintaining, and operating electric lights on the street, roads, highways, alleys, and public places in said District, said valuation being shown by the assessment roll for the year 2009 and a service charge of -0- to be assessed to persons occupying residential and non-residential structures and persons owning unoccupied structures located wholly or partly within the boundaries of the Road Lighting District No. 1, and to persons owning lots wholly or partly within the District upon which no structure is located, pursuant to the provision of the proposition which was approved at an election held on July 21, 2003. SECTION NINE: BE IT FURTHER ORDAINED that for the calendar year 2009 there is hereby levied a special tax of eight cents per acre on all woodlands subject to taxation in the Parish of Ouachita for the purpose of Forest Protection, all as set forth under Act 5 of the 1990 Louisiana Legislature. SECTION TEN: BE IT FURTHER ORDAINED by the Ouachita Parish Police Jury, acting for the Board of Commissioners of the Mosquito Abatement District No. 1 of the Parish of Ouachita, that for the calendar year 2009 there is hereby levied a special tax of 1.99 mills on the dollar of the assessed valuation of all property situated in the Parish of Ouachita, and not exempt from taxation by the Constitution and Laws of the State of Louisiana for the purpose of “the abatement, control, eradication and study of mosquitoes and other arthropods of public health importance and all activities incidental thereto” according to the election held in Ouachita Parish on March 8, 2008, for the purpose of voting said tax under the provisions of resolution adopted November 19, 2007, said valuation being shown by the assessment rolls for the year 2009 as said rolls are filed according to the law in the Clerk of Court's Office of the Parish of Ouachita, and in the Office of the Sheriff and Tax Collector. SECTION ELEVEN: BE IT FURTHER ORDAINED, that all said taxes enumerated herein in the various sections of this Ordinance shall be eligible and collectable on the same day in the manner as provided by existing laws and ordinances of the Police Jury. The Ordinance was submitted to a roll call vote and the vote thereon was as follows: YEAS (6) NAYS (0) ABSTAIN (0) ABSENT (0) The above Ordinance was adopted the 19th day of October 2009. * * * The following resolution was offered for adoption by Mr. Smiley, seconded by Mr. Jackson: RESOLUTION NO. 09-83 A RESOLUTION PROVIDING FOR ANNUAL CERTIFICATION OF COMPLIANCE WITH THE STATE OF LOUISIANA REGARDING THE OFF-SYSTEM BRIDGE REPLACEMENT PROGRAM. WHEREAS, the Code of Federal Regulations as enacted by the United States Congress mandates that all structures defined as bridges located on all public roads shall be inspected, rated for safe load capacity and posted in accordance with the National Bridge Inspection Standards, and that an inventory of these bridges be maintained by each State; and, WHEREAS, the responsibility to inspect, rate and load post those bridges under the authority of the Ouachita Parish Police Jury in accordance with those Standards is delegated by the Louisiana Department of Transportation and Development to the Ouachita Parish Police Jury; NOW, THEREFORE: BE IT RESOLVED by the Ouachita Parish Police Jury in legal and regular session that the Ouachita Parish Police Jury (herein referred to as the Parish) does hereby certify to the Louisiana Department of Transportation and Development (herein referred to as the DOTD) that for the period from January 1, 2009 through December 31, 2009: The Parish has performed all interim inspections on all Parish owned or maintained bridges in accordance with the National Bridge Inspection Standards. All bridges owned or maintained by the Parish have been structurally analyzed and rated by the Parish as to the safe load capacity in accordance with AASHTO Manual for Maintenance Inspection of Bridges. The load posting information that has been determined by the LADOTD for all bridges where the maximum legal load under Louisiana State Law exceeds the load permitted under the operating rating as determined above has been critically reviewed by the Parish. Load posting information has been updated by the parish to reflect all structural changes, and obsolete structural ratings or any missing structural ratings. All Parish owned or maintained bridges, which require load posting or closing, are load posted or closed in accordance with the table in the DOTD Engineering Directives and Standards Manual Directive No. 1.1.1.8. All DOTD supplied load-posting information concerning a bridge has been critically reviewed by the Parish Engineer prior to load posting. All bridges owned or maintained by the Parish are shown on the attached list in the format specified by the DOTD. Corrections to data supplied to the Parish by the Parish by the LADOTD are noted. These stipulations are prerequisites to participation by the Parish in the Off-System Bridge Replacement Program. The above resolution was adopted the 19th day of October 2009. * * * The following resolution was offered for adoption by Mr. Smiley, seconded by Ms. Moore: RESOLUTION NO. 09-84 A RESOLUTION URGING THE LOUISIANA CONGRESSIONAL DELEGATION AND THE UNITED STATES HEALTH AND HUMAN SERVICES SECRETARY TO WORK TOGETHER TOWARDS A COMPROMISE CONCERNING LOUISIANA’S FEDERAL MEDICAL ASSISTANCE PERCENTAGES (FMAP), AND TO IMPLEMENT A FREEZE OF LOUISIANA’S FEDERAL MEDICAID RATIOS AT A RATE COMPARABLE TO OUR HISTORIC AVERAGES FOR A PERIOD LONG ENOUGH TO ALLOW THE FORMULA TO NORMALIZE. WHEREAS, the Louisiana Secretary of Health and Hospitals has announced that based on the Federal Medical Assistance Percentages (FMAP), Louisiana will be reduced from an 80 percent stimulus federal match to a 63 percent rate in January 2011; and WHEREAS, this reduction in the FMAP stimulus federal match would reduce Louisiana’s share by an estimated $700 million annually, which would have a potentially devastating impact on the solvency of the Medicaid program in Louisiana; and WHEREAS, the FMAP formula does not recognize Louisiana’s temporary artificial inflation in per capita personal income growth as a result of the increased economic activity resulting from the four major hurricanes which have struck the state in the previous five years; and WHEREAS, twenty-seven percent of Louisiana’s population relies on Medicaid for their health care, including many of the state’s most vulnerable citizens such as children with disabilities and the elderly; and, WHEREAS, a federal funding loss of this magnitude would require the state to make drastic changes to its health delivery programs, including elimination of some or all optional services or programs which would greatly affect residents in Ouachita Parish and in the rest of Louisiana; and WHEREAS, among the fifty states, Louisiana has historically ranked at or near the bottom in health-related statistics, strongly indicating a need for increased medial benefits and health care; NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Ouachita Parish Police Jury, acting as governing authority of said Parish, SECTION 1. That this Police Jury hereby urges the Louisiana Congressional Delegation and United States Health and Human Services Secretary to work together towards a compromise concerning Louisiana’s Federal Medical Assistance Percentages (FMAP), and to implement a freeze on Louisiana’s federal Medicaid ratios at a rate comparable to our historic averages for a period long enough to allow the formula to normalize. SECTION 2. That the Recording Secretary is hereby requested and authorized to send a certified copy of this resolution to the Secretary of the U. S. Department of Health and Human Services, 200 Independence Avenue, S.W., Washington, D. C. 20201; to the Secretary of the Louisiana Department of Health and Hospitals, P. O. Box 629, Baton Rouge, Louisiana 70821-0629; to the Hon. Bobby Jindal, Governor of the State of Louisiana, P. O. Box 94004, Baton Rouge, LA 70804-9004; and to the members of the Louisiana Delegation to the United States Congress. HOMELAND SECURITY Mr. Butch Beckham Mr. Beckham stated that Jake Halley, Administrative Assistant had resigned, and that he needed to open that position. Motion offered by Mr. Jackson, seconded by Mr. Caldwell to approve the opening of the position of Administrative Assistant in the Homeland Security Office subject to the approval of the security council. FISCAL: Mr. Brad Cammack, Treasurer Mr. Cammack informed the jury that River Styx and Chauvin Pump Stations are up and running at a cost of $1,000 per day. Mr. Cammack stated that the General Fund will be impacted by this cost. Discussion ensued. No action was taken on this matter The president recognized Chief Hemphill, Fire Department. FIRE: Chief Pat Hemphill, Fire Department The chief expressed thanks to Ms. Blade for her service as interim juror, congratulated Dr. Ollibeth Reddix as new juror, and thanked the jury for their support of the fire tax issue. The president recognized Mr. Mitchell, Legal Counsel. LEGAL: Mr. Jay B. Mitchell, Assistant District Attorney Mr. Mitchell spoke regarding the Road Lighting District Elections. Mr. Mitchell noted that all had passed except four, and that the results would be canvassed at the special meeting schedule on Tuesday, October 20, 2009, at 5:30 p.m. Mr. Mitchell stated that at that time the jury could address those districts that did not pass, those being Road Lighting Districts No. 14, No. 18, No. 28 and No. 37. Mr. Mitchell asked that the jury amend the agenda to take up the matter of the request from the proprietor (Wayne Franklin) of Broken Promises Lounge on Smith Street. Mr. Mitchell indicated that Mr. Franklin had applied for a 2009 liquor license, but now would not be opening the lounge during this year due to remodeling. Mr. Mitchell stated that Mr. Franklin asked that he be allowed to withdraw his 2009 application and thereafter apply for a 2010 license. Motion offered by Mr. Calhoun, seconded by Ms. Blade to amend the agenda to take up this matter. Motion passed without opposition. Mr. Mitchell stated that Dr. Willis was requesting that the road be hard surfaced, and indicated that the paving lien process would be used for this task. Mr. Mitchell stated that according to records most of the property along the road belongs to the Myles Estate. Mr. Mitchell stated additional information is needed, and asked that the matter be deferred to the November 3rd meeting. Mr. Murray spoke regarding the resubdivision of Lots 4, 5, 6 and 7 of Frenchmen’s Bend, Unit 10 (District E). Mr. Holtzclaw indicated that he had no problem with the resubdivision and recommended approval. Motion offered by Mr. Caldwell, seconded by Mr. Jackson to approve the resubdivision of lots 4,5, 6 and 7 of Frenchmen’s Bend, Unit 10. Motion passed without opposition. ROADS & DRAINAGE: Mr. Tom Holtzclaw, Engineer Mr. Holtzclaw passed out some preliminary information for potential LCDBG Projects, and noted that the main focus was around New Natchitoches Rd and the Jonesboro Highway. Mr. Holtclaw stated that LCDBG grants fund in the amount of $600,000 could be used to upgrade or rehabilitate roads in this area. Mr. Holtzclaw updated the jury on various oncoming projects, which included Vancil Road, Good Hope Road, Cheniere Lake Bathrooms, Shamblin Street, Green Springs, White Oaks Landfill, and Tanglewood Flood Control. The Board priority, which will be the focus of the grants for this cycle, will be Access to Healthcare. As defined by the Living Well Foundation Community Plan, improving access to healthcare is assisting to establish “a network of resources, services and volunteers that will provide accessible, affordable healthcare for target groups to include persons with low income, the working poor, and/or children without health insurance coverage”. The Board will give primary consideration to those Foundation grants already in progress but will also review new applications with the specific focus of improving access to healthcare.
