Ms. Primm indicated that PAWS was proposing to construct a facility for the purpose of spaying and neutering animals with grant funding. WHEREAS, the Company desires to issue, pursuant to the Indenture, not exceeding $11,000,000 aggregate principal amount of Greater Ouachita Water Company Waterworks and Natural Gas System Revenue Bonds, in one or more series (the "Series 2009 Bonds") for the purpose of financing the cost of the upgrade, improvement, addition and/or replacement of the System; and WHEREAS, the Series 2009 Bonds will be secured by the Indenture on a parity with the Prior Bonds; and WHEREAS, the Louisiana State Bond Commission (the "Commission"), by resolution adopted on September 17, 2009, has (i) approved the form of Indenture and (ii) consented to and authorized the issuance, sale and delivery of the Series 2009 Bonds in accordance with the provisions of Section 1405(B) of Title 39 of the Louisiana Revised Statutes of 1950, as amended; and WHEREAS, this Police Jury, which is the elected legislative body of the Parish of Ouachita, State of Louisiana, desires to approve the issuance, sale and delivery of the Series 2009 Bonds 3 NOW, THEREFORE, BE IT RESOLVED by the Ouachita Parish Police Jury, acting as the governing authority of Ouachita Parish, Louisiana that: SECTION 1. The issuance, sale and delivery of the Series 2009 Bonds, by the Company for the purpose of financing the cost of the upgrade, improvement, addition and/or replacement of the System is hereby approved. SECTION 2. This Police Jury shall under no circumstances incur, be liable for or accept any financial obligation in connection with the issuance of the Series 2009 Bonds and the Series 2009 Bonds shall not constitute an indebtedness or pledge of the general credit of the Parish of Ouachita or the State of Louisiana. SECTION 3. The President and Secretary of this Police Jury are hereby authorized and empowered to do all acts, sign any and all instruments or documents, and do all things necessary and proper in order to carry out the purposes of this resolution. SECTION 4. The Police Jury hereby approves the designation of the Series 2009 Bonds as "qualified tax-exempt obligations" within the meaning of Section 265(b)(3) of the Internal Revenue Code of 1986, as amended. In approving such designation, the Police Jury hereby finds, determines and declares that the reasonably anticipated amount of qualified tax-exempt obligations which will be issued by the Police Jury and all subordinate entities, including, without limitation, the Company, if it shall be treated as such, in calendar year 2009 does not exceed $30,000,000. SECTION 5. This resolution shall be effective immediately. Mr. Lazenby spoke regarding the proposed rate increase for West Ouachita Sewer District #5. Mr. Lazenby indicated that it had been a number of years since the last increase and that this increase would allow the district to upgrade their sewerage treatment plant. Discussion ensued. Mr. Jackson indicated that this matter was on his agenda, but was informed by legal counsel that no action was required by the jury on this matter. The president recognized Gary Fontana of GNF Management. Mr. Fontana reported on the status of the current LCDBG grants and projects. The president indicated that this was an item on his agenda and requested to take up the matter at this time. No one objected to addressing the matter at this time. Mr. Fontana indicated that the T-1 canal was included in the proposed application for future funding. Mr. Mitchell stated that the description needed to be corrected to reflect the name on the deeds on the property. A brief discussion ensued. Mr. Cammack stated that the water company was not interested in pursuing the project at this time, and requested that the project be amended to award the $20,000 to the Cheniere Lake Area 3 Bathroom project. WALT CALDWELL, DISTRICT C: Mr. Caldwell asked that the matter regarding Skate Lane be deferred to the October 5th meeting of the jury. Mr. Mitchell spoke and stated that the Public Works department was being proactive in determining where the drainage problems are and how to address them. RUBY BLADE, DISTRICT D: Ms. Blade asked Mr. Mitchell to speak regarding the drainage servitude for Bennett Bayou and the revocation of the existing servitude at the old Guide Plant now the (V-Vehicle Facility). Mr. Mitchell spoke regarding the matter and asked that the old servitude be revoke in favor of the new servitude that would allow for the expansion of the V-Vehicle Facility. Mr. Cammack stated that the jury had previously withdrawn from the Hazard Mitigation Planning Pilot Grant Program in favor of the Hazard Mitigation Plan Update Program. Mr. Cammack indicated that a grant had been awarded in the amount of $67,285 under the new program and recommended approval. ORDINANCE NO. 8940 (INTRODUCTION ONLY) AN ORDINANCE AMENDING CHAPTER 22 OF THE COMPILED ORDINANCES OF OUACHITA PARISH AMENDING SECTION 8 OF SAID CHAPTER, SAID ORDINANCE PROVIDING FOR AN ANNUAL REVENUE FOR THE PARISH OF OUACHITA, STATE OF LOUISIANA, LEVYING ANNUAL TAXES FOR SAID PURPOSES AND FURTHER PROVIDING WITH RESPECT THERETO. 2009 REVENUE LAW SECTION ONE: BE IT ORDAINED by this Police Jury of the Parish of Ouachita, State of Louisiana, in legal and regular session convened that for the calendar year 2009 there is hereby levied an annual tax of 4.18 mills on the dollar of the assessed valuation of all property situated in the Parish of Ouachita, State of Louisiana, outside of the incorporated municipalities of Monroe, West Monroe, Sterlington, and Richwood; said valuation being shown by the assessment rolls for the year 2009 as said rolls are filed in the Office of the Sheriff and Tax Collector and the Clerk of Court of Ouachita Parish. The said tax of 4.18 mills is hereby levied and shall be set apart and dedicated to the use of the General Fund for paying all expenses of the Parish which may arise during the calendar year 2009 according to the estimates of expenditures hereto adopted. SECTION TWO: BE IT FURTHER ORDAINED, that for the calendar year 2009 there is hereby levied a special tax of 2.09 mills on the dollar of the assessed valuation of all property situated within the corporate limits of the City of Monroe, the City of West Monroe, The Town of Sterlington, and the Town of Richwood, not exempt from taxation for General Fund purposes, said valuation being shown by the assessment rolls for the year 2009 as said rolls are filed according to law in the Clerk of Court's Office of the Parish of Ouachita, and in the Office of Sheriff and Tax Collector. SECTION THREE: BE IT FURTHER ORDAINED, for the calendar year 2009 there is hereby levied a special tax of 7.50 mills on the dollar of the assessed valuation of all property situated in the Parish of Ouachita, and not exempt from taxation by the Constitution and Laws of the State of Louisiana for the purpose of providing funds for equipment, supplies, maintenance, operation, construction, acquisition, improvement, renovation and support of the Ouachita Parish Library and its branches, said valuation being shown by the assessment roll for the year 2009 according to the election held in Ouachita Parish, Louisiana, on the 19th day of July, 2003, for the purpose of voting said tax under the provisions of resolution adopted November 18, 1995, and the election held in Ouachita Parish, Louisiana on the 19th day of July, 2003, for the purpose of rededicating the proceeds of said tax under the provisions of resolution adopted April 21, 2003, as said rolls are filed according to the law in the Clerk of Court's Office of the Parish of Ouachita, and in the Office of the Sheriff and Tax Collector. SECTION FOUR: BE IT FURTHER ORDAINED, that for the calendar year 2009 there is hereby levied a special tax of 0.74 mills on the dollar of the assessed valuation of all property subject to taxation in the Parish of Ouachita for the purpose of operating, maintaining, sustaining, and erecting Ouachita Parish Health Units, including rabies and animal control facilities according to the election held on July 17, 2004, resolution adopted April 19, 2004, as said rolls are filed according to law in the Clerk of Court's Office of the Parish of Ouachita, and in the Office of the Sheriff and Tax Collector. SECTION FIVE: BE IT FURTHER ORDAINED by the Ouachita Parish Police Jury, sitting and acting as the Board of Commissioners of the Fire Protection District No. One of the Parish of Ouachita, that for the calendar year 2008 there is hereby levied a special tax of 19.11 mills on the dollar on all property subject to taxation in said District for the purpose of maintaining and operating the Fire Protection Districts fire protection facilities and obtaining water for fire protection purposes; said valuation being shown by the assessment roll for the year 2008, according to the election held on October 15, 2005, resolution adopted July 5, 2005, as said rolls are filed according to law in the Clerk of Court’s office of the Parish of Ouachita, and in the Office of the Sheriff and Tax Collector. SECTION SIX: BE IT FURTHER ORDAINED that for the calendar year 2009 there is hereby levied a special tax of 8.51 mills on all property subject to taxation in the Parish of Ouachita for the purpose of improving, maintaining, operating and equipping the Ouachita Correctional Center; and, there is further levied a special tax of 0.59 mils on all property subject to taxation in said Parish, for the purpose of making major improvements, repairs and/or renovations to the existing Ouachita Correctional Center buildings and structures together with the necessary equipment, furnishings and financing therefore, said valuation being shown by the assessment rolls for the year 2009 according to the election held in Ouachita Parish on July 21, 2007, resolution adopted April 16, 2007, as said rolls are filed according to law in the Clerk of Court’s office of the Parish of Ouachita, and in the office of the Sheriff and Tax Collector. SECTION SEVEN: BE IT FURTHER ORDAINED that for the calendar year 2009 there is hereby levied a special tax of 2.65 mills on the dollar of the assessed valuation on all property subject to taxation in the Parish of Ouachita, for the purpose of improving, maintaining, operating and equipping juvenile detention facilities; and a special tax of 0.30 mills on the dollar of the assessed valuation on all property subject to taxation in the Parish of Ouachita, for the purpose of acquiring, financing, and constructing a building to house juvenile detention alternative programs and related services at the Ouachita Parish Juvenile Detention Center, together with the necessary sites, equipment, and furnishings therefore, according to the election held in Ouachita Parish on July 15, 2006, resolution adopted April 17, 2006, said valuation being shown by the assessment rolls for the year 2009 as said rolls are filed according to law in the Clerk of Court's office in the Parish of Ouachita, and in the office of the Sheriff and Tax Collector. SECTION EIGHT: BE IT FURTHER ORDAINED that for the calendar year 2009, there is hereby levied a special tax of 2.00 mills on the dollar of the assessed valuation on all taxable property situated in Road Lighting District No. 1 of the Parish of Ouachita for the purpose of providing, maintaining, and operating electric lights on the street, roads, highways, alleys, and public places in said District, said valuation being shown by the assessment roll for the year 2009 and a service charge of -0- to be assessed to persons occupying residential and non-residential structures and persons owning unoccupied structures located wholly or partly within the boundaries of the Road Lighting District No. 1, and to persons owning lots wholly or partly within the District upon which no structure is located, pursuant to the provision of the proposition which was approved at an election held on July 21, 2003. SECTION NINE: BE IT FURTHER ORDAINED that for the calendar year 2009 there is hereby levied a special tax of eight cents per acre on all woodlands subject to taxation in the Parish of Ouachita for the purpose of Forest Protection, all as set forth under Act 5 of the 1990 Louisiana Legislature. SECTION TEN: BE IT FURTHER ORDAINED by the Ouachita Parish Police Jury, acting for the Board of Commissioners of the Mosquito Abatement District No. 1 of the Parish of Ouachita, that for the calendar year 2009 there is hereby levied a special tax of 1.99 mills on the dollar of the assessed valuation of all property situated in the Parish of Ouachita, and not exempt from taxation by the Constitution and Laws of the State of Louisiana for the purpose of “the abatement, control, eradication and study of mosquitoes and other arthropods of public health importance and all activities incidental thereto” according to the election held in Ouachita Parish on March 8, 2008, for the purpose of voting said tax under the provisions of resolution adopted November 19, 2007, said valuation being shown by the assessment rolls for the year 2009 as said rolls are filed according to the law in the Clerk of Court's Office of the Parish of Ouachita, and in the Office of the Sheriff and Tax Collector. SECTION ELEVEN: BE IT FURTHER ORDAINED, that all said taxes enumerated herein in the various sections of this Ordinance shall be eligible and collectable on the same day in the manner as provided by existing laws and ordinances of the Police Jury. * * * The president recognized Ms. Moore, District F. Mr. Cammack stated that the parish has been awarded grant monies by the Office of Natural Resources in the amount of $62,000, to divided among the municipalities within the parish. Mr. Cammack stated that he coordinate a meeting with the municipalities and Mr. Jackson and Calhoun regarding the grant. Mr. Cammack presented the following budgets for 2010-Eagle Lake Road Improvements, Eastern Forest Sewer, FEMA Property Maintenance Fund, General Liability Insurance, Workmen’s Comp Insurance Fund, and the Administrative Fund. Mr. Cammack stated that Green Oaks, 911, Mosquito Abatement, Health Unit, Library, and a preliminary draft of the Jail Operations budgets were ready to be reviewed. Motion offered by Mr. Calhoun, seconded by Mr. Caldwell that the T-1A Canal be included in the state hazard fund as well as the FEMA Disaster Recovery Fund due to the flooding of 14 houses in the past.
