Sims, the Minutes of August 18, 2009 were unanimously approved as written. On motion by Jerry Hicks, seconded by A. R. Sims, the Board unanimously approved the revised Agenda after adding the matching funds request of Ouachita Parish High School under Business Item No. 8, and further moving to approve the revised Personnel Agenda as presented, including the changes since mailout. The Director of the Chennault Aviation & Military Museum, Nell Calloway, introduced children’s author, Dee Scallan to the Board. Scallan’s mission to put art back into schools has become a reality as she works with Ouachita Parish students in a creative way they can learn quicker. Illustrations of Scallan’s work were viewed by the Board as Mrs. Calloway asked the Board for a donation of $5000 to help defray costs in producing materials used in teaching children about military history. At this time, Grant Writer/Supervisor Pam Barton announced that this request fits a program perfectly for grant funds that have already been awarded and will come back to the Board with more information after she reviews the grant requirements. The Board agreed to postpone their consideration of approval until Barton reports back to the Board. On the recommendation of Business Manager Richie Garrett, Susan Spence moved, seconded by A. R. Sims, that the Board approve the Ouachita Parish School Board Fund Balance Policy amended to include the following addendum: “The use of General Fund balance below the established minimum limit of 10 percent shall only be for unanticipated or unforeseen events of a non-recurring nature.” Motion carried unanimously. On the recommendation of Business Manager Richie Garrett, Scott Robinson moved, seconded by Susan Spence, that the Board adopt the changes in the Worker’s Compensation Policy as presented. Motion carried unanimously. According to Special Projects/Safety Coordinator Kenneth Slusher, Worker’s Compensation claims cost the Board around $1 million per year. To potentially avoid accidents and claims, Slusher reminded the Board that a consultant was hired to conduct safety meetings mainly with the maintenance, cafeteria and warehouse employees. Sessions for school bus drivers will also be provided. At present, these respective employees are required to attend these safety meetings to promote awareness in following Safety Policy guidelines. Slusher says that in the past, the administration has been lax in requiring these safety meetings. However, due to the excessive costs paid out by the Board in claim payments during the last few years, he thinks this picture is going to change considerably due to the recent enforced policy requirements and recent mandated safety meetings. On motion by Susan Spence, seconded by John Russell, the Board adopted the Resolution authorizing Superintendent Webber to execute the agreement with State Project No. 737-37-0016, Federal Aid Project No. SRS-3709(511) as recommended by Business Manager Richie Garrett. This specific grant requires a separate Resolution authorizing the Superintendent’s signature regarding sidewalk construction for Shady Grove Elementary School which was drawn up by Board attorney Elmer Noah. Motion carried unanimously. Business Manager Richie Garrett recommended requiring all schools offering band/choir to use the Charms Accounting Software System for Music. The software contains an inventory system that keeps up with the instruments and their repair in addition to monitoring instrument rental payments from parents where applicable. Whereby, Scott Robinson moved, seconded by John Russell, that the Board adopt the policy requiring all schools offering band/choir to use the Charms Software Accounting System for Music. Special Projects/Safety Coordinator Kenneth Slusher reported that the Fire Marshall will come to West Monroe High School tomorrow for inspection of the entire new wing except for the auditorium, the Ag building should be finished by September 16 and the field house at Ouachita Parish High School is held up waiting on the second story hand rails and hope the Fire Marshall will allow occupancy of the bottom floor until the hand rails are installed. The additions at Woodlawn evaluation of bids will be considered today and work is going very well at West Ouachita. Pinecrest should be finished in the next couple of months. The Police Jury of the Parish of Ouachita, State of Louisiana met in a regular session in the Ouachita Parish Police Jury Meeting Room, Courthouse Building, Monroe, Louisiana on Monday, August 17, 2009 at 5:30 p.m., and was duly convened by Mr. Shane Smiley, President, who stated that the Police Jury was ready for the transaction of business. Members Present (6): Charles Jackson, District A; Mack Calhoun, District B; Walt Caldwell, District C; Ruby Blade, District D; Shane Smiley, District E; Pat Moore, District F Members Absent (0) A motion to adopt the Minutes of the Regular Police Jury Meeting including the Committee meetings held on August 3, 2009, with corrections on page 6 and 10 was offered by Mr. Caldwell, seconded by Mr. Jackson. Motion passed without any opposition. VISITORS: The president recognized visitor Francis Huffman, of Luffey, Huffman, Ragsdale & Soignier. Mr. Huffman presented the calendar year 2008 Audit Report. Mr. Huffman stated that the jury had a very good report and had been given an unqualified opinion on the 2008 Audit with only three findings. Mr. Huffman reported that the three findings had been addressed and corrective action was in place at this time. No other action was taken on this matter. Mr. Jackson, seconded by Mr. Calhoun, offered the following resolution: RESOLUTION NO. 09-71 WHEREAS, the Ouachita Parish Police Jury, as a body, has followed a long-standing custom of asking appointees to affirm that they will not be a candidate in the called election for the seat they are being appointed to occupy on an interim basis; WHEREAS, the Ouachita Parish Police Jury follows this custom in order that its appointment will not have even the appearance of unduly influencing the outcome of the upcoming election; WHEREAS, in the case of the vacant seat for Ward 6 Constable several persons contacted the Jury about the interim appointment and then declined to pursue the appointment after being informed they would be expected to NOT be a candidate for the position in the called election; WHEREAS, Mr. William Matheny was likewise advised of the Ouachita Parish Police Jury’s custom concerning interim appointments; WHEREAS, the Ouachita Parish Police Jury appointed Mr. William Matheny to serve as the interim Constable for Ward 6 with the understanding that he would NOT be a candidate in the October 17, 2009, election to fill the seat; WHEREAS, Mr. Matheny has nonetheless qualified as a candidate in said election; and, WHEREAS, the Ouachita Parish Police Jury has grave concern that failure to acknowledge and address this situation could have serious repercussions with regard to future interim appointments THEREFORE: BE IT RESOLVED that by this measure the Ouachita Parish Police Jury expresses it's intent that Mr. Matheny would NOT have been appointed the incumbent interim Ward 6 Constable had he expressed an intent to run for the seat at the time the appointment was made. BE IT FURTHER RESOLVED that the Ouachita Parish Police Jury hereby expresses its extreme disappointment that despite this custom being discussed with Mr. Matheny and well and widely reported at the time of his appointment, Mr. Matheny has qualified to run for Ward 6 Constable in the October Special Election. BE IT FURTHER RESOLVED that the Ouachita Parish Police Jury, as a body, hereby reaffirms its desire to avoid influencing other elective offices in the Parish and will continue to require a commitment from future interim appointments the appointee will not be a candidate in the election to fill the office; and, BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to Mr. Matheny. After this corrective action, all the investigative follow samples did not indicate the presents of any coliform bacteria. You do not need to boil your water or take other corrective actions. However, if you have specific health concerns, consult your doctor. People with severely compromised immune systems, infants, and some elderly may be at increased risk. These people should seek advice about drinking water from their health care providers. Committee Report: Ryan Roark reported that a meeting of the Tourism Development Grant Committee was held on August 11, 2009 to discuss the N/E Louisiana Soccer Association Tourism Development Grant dedicated for paving the road leading to the soccer fields and the stipulation to contract with an engineering firm for a soil compaction test and specifications so the work will be warranted. He reported that Alana Cooper received an e-mail from Jay Garrett stating that he has met with Hunter Lancaster (SE Huey) and a soil expert, George Byrd, with Ardeman and Associates. He stated that Mr. Byrd will locate a Geo-tech engineering firm to provide a paving recommendation which would include soil testing. Jay Garrett also reported that the estimated cost for the study will be about $5,000.00. He requested that the Convention & Visitors Bureau fund the study from the $35,000.00 already granted. He stated that the 60 days extension granted by the Convention & Visitors will not be enough time to get the soil testing done, therefore he requested another 60 days extension. It was moved by Ryan Roark and seconded by Jerry Edmondson to grant a sixty (60) days extension and allow NELSA to use $5,000.00 of grant funds to hire a Geo-tech engineering firm to do the SB2 soil testing and up to $12,000.00 to purchase SB2 to fill in pot holes on the road leading to the soccer fields so that the road can be used this season. The committee requested that NELSA reapply for funding next year after the SB2 testing has been done to receive funding to complete the road project. Owens, Jr., on August 18, 2009; and WHEREAS, under LSA-R.S. 18:602, the Ouachita Parish Police Jury has the responsibility to make an interim appointment to the office of Constable of Ward 9, Ouachita Parish to serve until such time as a Constable for Ward 9 can be elected and take office in accordance with law. NOW, THEREFORE: BE IT RESOLVED by the Ouachita Parish Police Jury in legal and special session that TAMMI OWENS, hereby is appointed as Constable, Ward 9, Ouachita Parish, to fill the vacancy created by the resignation of Benjamin F. Owens, Jr., said appointee to serve until the vacancy is filled by the holding of a special election to fill same. The above Resolution was adopted on this 24th day of August 2009. The president spoke regarding the need for a special election to fill the vacant position of Constable, Ward 9. A brief discussion ensued. The following resolution was offered by Mr. Smiley, seconded by Mr. Jackson: RESOLUTION NO. 09-74 A RESOLUTION ORDERING AND CALLING A SPECIAL ELECTION TO BE HELD IN THE PARISH OF OUACHITA, STATE OF LOUISIANA FOR THE POSITION OF CONSTABLE, WARD 9, OUACHITA PARISH; AND FURTHER PROVIDING FOR OTHER MATTERS IN CONNECTION THEREWITH. WHEREAS, a vacancy exists in the position of Constable, Ward 9, Ouachita Parish, Louisiana; and, WHEREAS, under the provisions of LSA-R.S. 18:602 E, the Ouachita Parish Police Jury has the obligation to call an election to select a successor. NOW, THEREFORE: BE IT RESOLVED by the Ouachita Parish Police Jury in legal and regular session acting as the governing authority of the Parish of Ouachita, State of Louisiana that: Under the authority conferred by LSA-R.S. 18:602 E, a special election is hereby called and ordered to be held in Ouachita Parish on Saturday, March 27, 2010, between the hours of 6:00 a.m. and 8:00 p.m. for the purpose of electing a Constable from Ward 9, Parish of Ouachita, said post being vacant due to the resignation of Benjamin F. Owens on August 18, 3, 2009. The qualifying period for this election shall be February 3-5, 2010. This Resolution and Notice of Election shall be published in the Ouachita Citizen, a weekly newspaper of general circulation within the parish published in Monroe, Louisiana, being the official journal of the governing authority for the Parish of Ouachita, on September 3, September 10th, and September 17, 2009. A copy of this Resolution ordering and calling the special election for the position of Constable, Ward 9, Parish of Ouachita, shall be furnished to the Clerk of Court, Fourth Judicial District Court, Parish of Ouachita, and to the Secretary of State, and Registrar of Voters of the State of Louisiana. The above Resolution was adopted on the 24th day of August 2009. There being no other business to come before the jury, a motion to adjourn was offered by Ms. Moore, seconded by Mr. Jackson.
