The Police Jury of the Parish of Ouachita, State of Louisiana met in a regular session in the Ouachita Parish Police Jury Meeting Room, Courthouse Building, Monroe, Louisiana on Monday, August 3, 2009 at 5:32 p.m., and was duly convened by Mr. Shane Smiley, President, who stated that the Police Jury was ready for the transaction of business. WHEREAS, the Ouachita Parish Police Jury owns Cheniere Lake in West Ouachita Parish; WHEREAS, the Ouachita Parish Police Jury owns several riparian parcels (identified as Cheniere Lake “Areas”) around Cheniere Lake upon which the Ouachita Parish Police Jury operates parks that include boat ramps, picnic tables, public restrooms, pavilions, playgrounds, and other recreational facilities; WHEREAS, Section 11-48 of the Compiled Ordinances of Ouachita Parish, Louisiana provides there “shall be no misuse, abuse, nor destruction of property of Ouachita Parish on the Cheniere Lake area by any person or persons at any time;” WHEREAS, Section 11-48 of the Compiled Ordinances of Ouachita Parish, Louisiana presently includes a fine of “not more than fifty dollars ($50.00)” among the penalties for violations thereof; WHEREAS, the maximum $50.00 fine set forth above has been in place, without revision, since 1962; and, WHEREAS, the Ouachita Parish Police Jury finds that given the valuable facilities presently in place at the various Cheniere Lake Areas; the bathroom facility soon to be under construction at Cheniere Lake Area 3; and, the effect of nearly a half century of inflation on the $50.00 fine described above, it is in the interest of the citizens of Ouachita Parish to significantly increase the fine available as penalty for violations of Section 11-48 of the Compiled Ordinances of Ouachita Parish, Louisiana. NOW, THEREFORE: BE IT ORDAINED by the Ouachita Parish Police Jury in legal and regular session that Section 11-48 of the Compiled Ordinances of Ouachita Parish, Louisiana be, and hereby is, amended to increase the maximum fine available for violations thereof from fifty dollars ($50.00) to five hundred dollars ($500.00). WHEREAS, increasing numbers of groups, often made up of minors, have undertaken fundraising activities that involve standing in or entering the road surface of public roads in the unincorporated areas of Ouachita Parish for the purpose of soliciting contributions or sales from motorists stopped at intersections; WHEREAS, the fundraising activities described above target those intersections having the highest traffic counts; WHEREAS, the Ouachita Parish Police Jury finds that such fundraising activities present obvious dangers to the person and property of motorists and pedestrians, cause delays at intersections and interfere with the flow of traffic on the public roads of the unincorporated areas of Ouachita Parish; WHEREAS, the Ouachita Parish Police Jury has the authority to regulate the use of the public Parish roads of Ouachita Parish and may extend the effect of such regulations to adjacent State Highways in the unincorporated area of Ouachita Parish so long as such regulations do not offend State law; and, WHEREAS, the Ouachita Parish Police Jury finds that the prohibition of the fundraising activities described above is in the public interest: NOW, THEREFORE: BE IT ORDAINED by the Ouachita Parish Police Jury in legal and regular session that Chapter 15 of the Compiled Ordinances of Ouachita Parish, Louisiana governing “Offenses – Miscellaneous” be, and hereby is, supplemented and amended to add Section 15-21, to provide as follows: “Sec. 15-21. Fundraising Activities in or upon Public Roads. It shall be unlawful for any person to stand or stay on the road surface of any public road in the unincorporated area of Ouachita Parish, Louisiana for the purpose of soliciting contributions or purchases from motorists in vehicles stopped at intersections. Any person who violates the provisions of this section shall be subject to a fine not to exceed two hundred dollars ($200.00).” The above ordinance was introduced on the 20th day of July 2009. Mr. Harrison spoke regarding the Hazard Mitigation Grant Program Funding for Hurricanes Gustav/Ike Under DR#1786. Mr. Harrison indicated that the parish had been allocated $1,468,380 for projects under the grant program. Discussion ensued. All references to the “District” refer to the Hospital Service District No. 1 of the Parish of Ouachita, State of Louisiana. Charles Marchbanks and Jessica Baxter from Little & Associates presented HSD and Wellness Center financials during their designated time in Executive Session. APPROVAL OF MINUTES OF DISTRICT BOARD MEETINGS HELD ON JULY 21, 2009 After review of the July 21, 2009 Board minutes, a motion was made by Ms. Liner and seconded by Mr. Mulhearn to adopt the minutes as presented and the motion was unanimously approved. APPROVAL OF AMENDMENT OF LIVING WELL FOUNDATION GRANT-MAKING GUIDELINES AND PROCEDURES The following resolution was offered by Mr. Mulhearn, seconded by Mr. Gilley, and unanimously approved by the Board of Commissioners: WHEREAS, Section 2.B(7)(f) of the Cooperative Endeavor Agreement between the Foundation and the District provides that the amendment of the grant-making guidelines and procedures of the Foundation requires, among other things, the approval of the Board of Commissioners of the District; WHEREAS, the Foundation, in order to handle and process grant applications more efficiently and conveniently, desires that all grant applications be submitted to the Foundation electronically, via the internet, using particular grant application software licensed to the Foundation and provided by the Foundation to the user free of charge; WHEREAS, implementation of the foregoing online system for submission of grant applications requires certain minor amendments to the Grant-Making Guidelines and Procedures; RESOLVED, that the amendments to the provisions of the Grant-Making Guidelines and Procedures of the Ward Five Healthcare Foundation (doing business as the Living Well Foundation) indicated on the marked version presented to this meeting are hereby approved, and the corresponding restated Grant-Making Guidelines and Procedures presented to this meeting are hereby approved, with such further ministerial or other non-material changes as may be approved by the Chairman of the District from time to time. APPROVAL OF LIVING WELL FOUNDATION’S REVISED GRANT APPLICATION FORMS After due discussion, Mr. Mulhearn proposed, Mr. Gilley seconded, and the Board of Commissioners unanimously adopted the following resolution: WHEREAS, Section 3.7 of the Bylaws of the Foundation provides that grant application forms of the Foundation require, among other things, the approval of the Board of Commissioners of the District; WHEREAS, implementation of the online system for submission of grant applications desired by the Foundation requires revisions to the Foundation's grant application forms to make them suitable for use with the online system; WHEREAS, drafts of the following revised grant application forms have been presented to this meeting: (1) Applying for a Grant: Tips, Pointers, and Frequently Asked Questions; (2) LOI Page; (3) Application Page; (4) Project Budget Worksheet; (5) Directors & Officers Form; and (6) Conflict of Interest Questionnaire/Disclosure. WHEREAS, in light of financial considerations, the Foundation has proposed a restricted grant cycle for the Fall of 2009 that allows only existing grantees to re-apply for a continuation of existing programs, noting a gap in funding in several of those programs would be detrimental. WHEREAS, further revisions to the draft revised grant application forms are needed to reflect the Foundation's intended restrictions and priorities for the current grant cycle, and the desirability of other revisions may become apparent before or as the online system begins to be used for the first time by the Foundation; RESOLVED, that the Board of Commissioners approves the draft revised grant application forms presented to this meeting, with such further changes as may be approved by the Chairman of the District (i) to reflect a restricted grant cycle for the Fall of 2009 in which only existing grantees may re-apply for a continuation of existing programs, (ii) to give priority to funding those programs where a gap in funding would be detrimental, and (iii) to better implement the change to an online system for submission of grant applications. REVIEW OF MINUTES OF FOUNDATION BOARD OF DIRECTORS ON AUGUST 4, 2009 The Board of Commissioners reviewed the Board of Directors minutes of the Living Well Foundation for August 4, 2009. CHANGE OF DATE OF SEPTEMBER MEETING The following resolution was offered by Ms. Liner, seconded by Mr. Spencer, and unanimously approved by the Board of Commissioners: RESOLVED, that the regular September meeting of the Board of Commissioners is hereby re-scheduled to be held on September 29, 2009, at 11:30 am. AMENDMENT OF AGENDA Mr. Gilley moved to take up the following matter not on the agenda: "Recommendation of Appointment of Commissioners," and stated that the purpose for the addition to the agenda is to address a matter not on the agenda that it is in the best interest of the District to address immediately. Mr. Spencer seconded the motion. The Chairman declared an opportunity for public comment on the motion. There were no public comments. RECOMMENDATION OF APPOINTMENT OF COMMISSIONERS The following resolution was presented by Mr. Hall: WHEREAS, the current terms of Mike Mulhearn as a Commissioner of the District expires on August 18, 2009 and the current term of Violet Liner as a Commissioner of the District will expire on October 6, 2009; WHEREAS, Section 3 of the Coordination Agreement entered into among the District, Glenwood Regional Medical Center (now Glenwood Resolution Authority, Inc.), the Ward Five Healthcare Foundation (now doing business as the Living Well Foundation), and the Ouachita Parish Police Jury, executed on November 17 and 18, 2006 and effective as of January 31, 2007, provides that the Police Jury shall appoint as Commissioners of the District only persons who have been recommended for appointment by a resolution of the District; RESOLVED, that the District recommends each of Mike Mulhearn and Violet Liner for appointment by the Ouachita Parish Police Jury as a Commissioner of the District for another term. Mr. Gilley seconded the motion and the Board unanimously approved the resolution.
