SEWER REVENUE BONDS
OF THE CITY OF WEST MONROE, STATE OF LOUISIANA
PUBLIC NOTICE IS HEREBY GIVEN, pursuant to the provisions of an ordinance adopted on July 14, 2009, by the Mayor and Board of Aldermen of the City of West Monroe, State of Louisiana, acting as the governing authority (the "Governing Authority") of the City of West Monroe, State of Louisiana (the "City"), and in accordance with the provisions of Part XIII, Chapter 4, Title 39 of the Louisiana Revised Statutes of 1950, as amended (the "Act"), and other constitutional and statutory authority, that the City does hereby declare its intention to issue not exceeding One Million Five Hundred Thousand Dollars ($1,500,000) of Sewer Revenue Bonds, in one or more series, the proceeds of which will be used to pay the cost of constructing and acquiring additions, extensions and improvements to the sewerage collection and disposal system of the City (the "System"), a work of public improvement for the City.
The Bonds shall be limited and special revenue bonds of the City, shall be secured by and payable in principal, interest and redemption premium, if any, from an irrevocable pledge and dedication of the income and revenues derived or to be derived by the City from the operation of the System, after paying the reasonable and necessary expenses of administration, operation and maintenance of the System. The Bonds shall not be a charge on the other income and revenues of the City as prohibited under the provisions of Article VI, Section 37 of the Louisiana Constitution of 1974, nor shall they constitute an indebtedness or pledge of the general credit of the City.
The Bonds will be issued and authorized by ordinances of the Governing Authority in one or more series and shall bear such dates, mature at such time or times [not to exceed twenty-two (22) years from their date of issuance], bear interest at such rate or rates [not exceeding four per centum (4.00%) per annum], be sold at such price or prices, be in such denomination or denominations, in fully registered form, carry such registration privileges, be payable in such medium of payment and at such place or places, be subject to such terms of redemption and be entitled to such priorities on the income and revenues of the System as the City may provide by ordinances adopted at the time or times of issuance of the Bonds.
The Governing Authority will in such ordinances enter into such covenants with the future owner or owners of the Bonds as to the management and operation of the System, the imposition and collection of rates and charges for the services rendered thereby, the disposition of such fees and revenues, the issuance of future bonds and the creation of future liens and encumbrances against the System and the revenues therefrom, the carrying of insurance, the keeping of books and records, and other pertinent matters as may be deemed proper by the Governing Authority to assure the marketability of the Bonds, consistent with the provisions of the Act. Such ordinances will also include remedies in case of default, provisions for the issuance of parity bonds and such additional covenants, agreements and provisions as are judged advisable or necessary by said Governing Authority for the security of the owners of the Bonds, including sinking funds and reserves for the payment of principal and interest on the Bonds, and an adequate depreciation fund for those repairs, extensions and improvements to the System as may be necessary to assure adequate and efficient service to the public, all as provided by the Act.
The Bonds will be sold at public or private sales, as provided for in the Act and other statutory authority, and the Bonds will, before the delivery thereof, be approved by the State Bond Commission, Baton Rouge, Louisiana.
NOTICE IS HEREBY FURTHER GIVEN that the Governing Authority will meet in open and public session on Tuesday, October 13, 2009, at seven o'clock (7:00) p.m., at the City Hall, West Monroe, Louisiana, to hear any objections to the proposed issuance of the Bonds; provided, however, if at such hearing a petition or petitions duly signed by electors of the City in an aggregate number not less than five percent (5%) of the number of the electors of the City voting in the last special or general election held in the City object to the issuance of the Bonds, then the Bonds shall not be issued until approved by a vote of a majority of the qualified electors of the City who vote at a special election held for that purpose in the manner provided by Chapter 6-A, Title 18 of the Louisiana Revised Statutes of 1950. Any such petition shall be accompanied by a certificate of the Ouachita Parish Registrar of Voters certifying that the signers of the petition(s) are registered electors of the City and the number of signers amounts to not less than five percent (5%) of the registered voters that voted in the last tax election held in the City, all as provided by the Act.

Notice is hereby given that the Ouachita Parish Police Jury will meet as a Board of Review at 6:30 p.m. Monday, September 21, 2009, at the Ouachita Parish Courthouse, Courtroom 3, located at 300 St. John Street, Monroe, Louisiana, to hear any and all protests from taxpayers on their 2009 Assessments.
The Board of Review shall consider the written or oral protests of any taxpayer desiring to be heard who has filed a written appeal (with any supporting documents) by Monday, September 15, 2009, at 5:00 p.m., (seven (7) days prior to the actual Board of Review Hearing date). The successful Bidder shall be required to furnish a Performance and Payment Bond written by a company licensed to do business in Louisiana, in an amount equal to 100% of the Contract amount. Surety must be listed currently on the U.S. Department of Treasury Financial Management Service List (Treasury List) as approved for an amount equal to or greater than the contract amount, or must be an insurance company domiciled in Louisiana or owned by Louisiana residents. If surety is qualified other than by listing on the Treasury list, the contract amount may not exceed fifteen percent of policyholders' surplus as shown by surety's most recent financial statements filed with the Louisiana Department of Insurance and may not exceed the amount of $500,000. However, a Louisiana domiciled insurance company with at least an A- rating in the latest printing of the A.M. R.S. 38:2212(A)(1)(c). No bid may be withdrawn for a period of thirty (30) days after receipt of bids, except under the provisions of LA. R.S. 38:2214.
The Owner reserves the right to reject any and all bids for just cause. In accordance with La. R.S. 38:2212(A)(1)(b), the provisions and requirements of this Section, those stated in the advertisement for bids, and those required on the bid form shall not be considered as informalities and shall not be waived by any public entity.
When this project is financed either partially or entirely with State Bonds, the award of this Contract is contingent upon the granting of lines of credit, or the sale of bonds by the State Bond Commission. A RESOLUTION ORDERING AND CALLING A SPECIAL ELECTION TO BE HELD IN THE PARISH OF OUACHITA, STATE OF LOUISIANA FOR THE POSITION OF CONSTABLE, WARD 9, OUACHITA PARISH; AND FURTHER PROVIDING FOR OTHER MATTERS IN CONNECTION THEREWITH.
WHEREAS, a vacancy exists in the position of Constable, Ward 9, Ouachita Parish, Louisiana; and,
WHEREAS, under the provisions of LSA-R.S. 18:602 E, the Ouachita Parish Police Jury has the obligation to call an election to select a successor.
NOW, THEREFORE:
BE IT RESOLVED by the Ouachita Parish Police Jury in legal and regular session acting as the governing authority of the Parish of Ouachita, State of Louisiana that:
1.  Under the authority conferred by LSA-R.S. 18:602 E, a special election is hereby called and ordered to be held in Ouachita Parish on Saturday, March 27, 2010, between the hours of 6:00 a.m. and 8:00 p.m. for the purpose of electing a Constable from Ward 9, Parish of Ouachita, said post being vacant due to the resignation of Benjamin F. Owens on August 18, 3, 2009.
The qualifying period for this election shall be February 3-5, 2010. This Resolution and Notice of Election shall be published in The Ouachita Citizen, a weekly newspaper of general circulation within the parish published in Monroe, Louisiana, being the official journal of the governing authority for the Parish of Ouachita, on September 3, September 10th, and September 17, 2009.  A copy of this Resolution ordering and calling the special election for the position of Constable, Ward 9, Parish of Ouachita, shall be furnished to the Clerk of Court, Fourth Judicial District Court, Parish of Ouachita, and to the Secretary of State, and Registrar of Voters of the State of Louisiana.

PUBLIC HEARINGS
The Ouachita Parish Police Jury will conduct two (2) public hearings on Friday, September 18, 2009, beginning at 10:00 a.m. in the Conference Room at the Ouachita Parish Police Jury Office.
The purpose of the first public hearing will be to receive comments on the Parish’s performance on its FY 2008 Louisiana Community Development Block Grant (LCDBG) Program (Contract No. 670714) for street improvements. The Parish will submit close-out documents for the aforementioned LCDBG program to the Louisiana Division of Administration within forty-five (45) calendar days of this notice.
The second public hearing, a Fair Housing Informational Hearing, will be conducted following the Performance Hearing. The purpose of this hearing is to discuss fair housing policies, including the Fair Housing Act as Amended (Title 8), and any recommendations for improving fair housing opportunities within the community.
All residents of the Parish, particularly low to moderate income persons, are invited to attend and submit comments. PROCEEDINGS OF THE POLICE JURY, PARISH OF OUACHITA, STATE OF LOUISIANA, TAKEN AT A REGULAR MEETING HELD MONDAY, JUNE 15, 2009 AT 5:33 P.M.
The Police Jury of the Parish of Ouachita, State of Louisiana met in regular and legal session in the Ouachita Parish Police Jury Meeting Room, Courthouse Building, Monroe, Louisiana on Monday, June 15, 2009 at 5:33 p.m., and was duly convened by Mr. Shane Smiley, President, who stated that the Police Jury was ready for the transaction of business.
Members Present (5): Charles Jackson, District A; Mack Calhoun, District B; Walt Caldwell, District C; Shane Smiley, District E; Pat Moore, District F.
Members Absent: (0)
Invocation was given by former juror King Dawson. Pledge of Allegiance to the flag was led by King Dawson.
The president recognized visitor Kevin Crosby of Lazenby & Associates. Mr. Crosby was not present.
The president recognized Howard Fielding of the Louisiana Department of Environmental Quality. Jesse Means of the LA DEQ addressed the jury in the absence of Mr. Fielding. Mr. Means spoke extensively regarding the need for an ordinance to protect the water wells in the parish and asked the jury to consider adopting one. A lengthy discussion ensued. No action was taken on this matter.
SELECTION OF OFFICIAL JOURNAL:
The president spoke regarding the selection of the official journal. Mr. Mitchell stated that proposals had been sent out to the print media in the area soliciting their participation in the process of the selection of the official journal. Mr. Mitchell stated that responses were received from The Ouachita Citizen, The News Star and The Monroe Dispatch and were in accordance with state statue. The results are listed below:

A motion was offered by Mr. Calhoun, seconded by Mr. Caldwell, to select The Ouachita Citizen as the official journal for the year ending June 30, 2010. The motion by Mr. Calhoun, seconded by Mr. Caldwell was amended to select The Ouachita Citizen as the official journal, and The Monroe Dispatch as the alternate journal. Motion passed without any opposition.
PUBLIC HEARING:
The president convened a PUBLIC HEARING on ORDINANCE NO. 8934- An Ordinance creating Road Lighting District No. 39 (Fiddlers Creek) within the Parish of Ouachita, State of Louisiana, and defining and describing the boundaries thereof. No one appeared to speak in favor of or against the ordinance. Motion offered by Mr. Jackson, seconded by Mr. Caldwell to close the public hearing. Motion passed without any opposition.
The president requested a motion to recess the regular meeting and convene as the Finance Committee. Motion offered by Mr. Jackson, seconded by Mr. Calhoun to recess the regular meeting in favor of the Finance Committee Meeting. Motion passed without opposition.
FINANCE COMMITTEE MEETING
The chairman, Mr. Jackson called the Finance committee meeting to order at 6:10 p.m. Mr. Jackson stated that he would defer the first four items listed under his name to a later date. The chairman asked Mr. Cammack to speak regarding the budget planning. Mr. Cammack spoke briefly regarding the budget process. No action was taken on this matter.
Mr. Cammack spoke regarding the claims statement for the period of 5/15/09 through 6/11/09 and recommended approval. Motion offered by Mr. Caldwell, seconded by Mr. Smiley to approve the claims for the period stated. Motion passed without any opposition.
Mr. Cammack asked Ms.Cupit to speak regarding the Jail Operations budget. Ms. Cupit spoke regarding the handout on the Jail Operations budget. Discussion ensued. Warden Newcomer spoke regarding the budget. No action was taken on this matter.
Mr. Cammack spoke regarding the Monthly Exception Report and Budget Variance for the month, which included the Litter/Beautification Fund, West Ouachita Industrial Park and the Governing Body. Discussion ensued. No action was taken on the matter.
Mr. Cammack spoke regarding the request for an increase in compensation to the mental health specialist from $1800 per month to $2200 per month. Discussion ensued. The matter was tabled until the next finance committee meeting.
Mr. Cammack spoke regarding the bid tabulation for Food & Food Products-Green Oaks for the third quarter and recommended that the low bid of Conco in the amount of $21,421.78, be accepted. Motion offered by Ms. Moore, seconded by Mr. Smiley to accept the recommendation of the Treasurer for Food & Food Products for the third quarter. Motion passed without any opposition.
Mr. Cammack spoke regarding the bid tabulation for Bridge Timbers and Piling. Mr. Cammack stated that the vendor (Kennedy Saw Mills, Inc.) awarded the contract for 2008 had sent a letter stating that they would honor current pricing for the year of 2009. Mr. Cammack recommended to the jury to continue the purchasing of such materials under the current contract. Discussion ensued. Motion offered by Mr. Calhoun, second by Ms. Moore to accept the recommendation of the treasurer. Motion passed without opposition.
Motion to adjourn and reconvene the regular meeting was offered by Mr. Jackson, seconded by Ms. Moore. Motion passed without any opposition.

AN ORDINANCE CREATING ROAD LIGHTING DISTRICT NO. 39 (FIDDLERS CREEK) WITHIN THE PARISH OF OUACHITA, STATE OF LOUISIANA, AND DEFINING AND DESCRIBING THE BOUNDARIES THEREOF.
WHEREAS, Chapter 7, Title 48 of the Louisiana Revised Statutes of 1950, as amended, authorizes parish governing authorities to create road lighting districts; and
WHEREAS, this Police Jury, acting as the governing authority of the Parish of Ouachita, State of Louisiana, now wishes to create a road lighting district within the Parish with such boundaries as are hereinafter set forth;
NOW, THEREFORE:
BE IT ORDAINED by the Police Jury of the Parish of Ouachita, State of Louisiana, that:
SECTION 1: By virtue of the authority conferred by Chapter 7, Title 48 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, a Road Lighting District be and the same is hereby created within the Parish of Ouachita, State of Louisiana, which Road Lighting District shall comprise and embrace all of that territory within Fiddler’s Creek Subdivision, as recorded in the records of Ouachita Parish, Louisiana.
SECTION 2: The Road Lighting District hereby created shall be known and designated as "Road Lighting District No. 39 of the Parish of Ouachita, State of Louisiana" (the "District"), and as thus created shall constitute a public corporation and political subdivision of the State of Louisiana, of which this Police Jury shall be the governing authority, and the District shall have all the rights, powers and privileges granted and conferred by the Constitution and Statutes of the State of Louisiana to such political subdivisions, including the authority to incur debt and to levy taxes.
SECTION 3: The official seal of the Parish of Ouachita, State of Louisiana, be and the same is hereby adopted as the official seal of the District and the official journal of this Police Jury shall be the official journal of the District.

Mr. Jackson asked Mr. Mitchell to speak regarding the creation of a road lighting district in Elsinore Estates. Mr. Mitchell stated that he had talked with the residents and suggested to them that the creation of the road lighting district be addressed at a later date. No other action was taken on this matter.
Mr. Jackson spoke regarding the Energy Efficiency Block Grants. Mr. Cammack spoke regarding the matter and recommended that the jury apply for the grants in the amount of $396,000 before the deadline of June 25, 2009. Discussion ensued. Motion offered by Mr. Jackson, seconded by Mr. Calhoun to authorize the parish treasurer to apply for the Energy Efficiency Block Grants before the deadline of June 25, 2009. Motion passed without opposition.

MR. CALHOUN, DISTRICT
Mr. Calhoun asked that the matter regarding West Ouachita Recreation District be deferred until the next meeting of the jury.
Mr. Calhoun spoke regarding the Cheniere Lake Area 3 Bathrooms and asked Mr. Harrison to speak on the matter. Mr. Harrison stated that bids were opened on June 1, 2009. Mr. Harrison stated that Ouachita Builders of West Monroe submitted the low bid of $129,000. Discussion ensued. Motion offered by Mr. Calhoun, seconded by Ms. Moore to accept the low bid of Ouachita Builders for the construction of the Cheniere Lake Area 3 Bathrooms. Motion passed without opposition.
Mr. Calhoun asked Mr. Harrison to speak regarding the emergency back-up generator for Southwest Ouachita Waterworks, Inc. Mr. Harrison stated that the jury had secured an LGAP grant in the amount of $22,000 for the purchase of the generator, but the bid had come in over $32,000. Mr. Harrison stated that Southwest Ouachita Waterworks, Inc., had submitted a letter stating that they would make up the difference. Mr. Harrison recommended to the jury to authorize Southwest Ouachita Waterworks to purchase the generator and that he proceed with securing the reimbursement of the funds from the state. Motion offered by Mr. Calhoun, seconded by Ms. Moore to proceed with the purchase of a generator for Southwest Ouachita Waterworks, Inc. Motion passed without opposition.

The president spoke regarding fund raising activities on parish roads. Discussion ensued. The president asked Mr. Mitchell to look into the legalities concerning these activities and report back to the jury.
The president spoke regarding the funding for the rehabilitation of the Shamblin Street Pump Station. Mr. Harrison stated that the cost to rehab the pump station would be approximately $135,000. Discussion ensued. Motion offered by Mr. Smiley, seconded by Mr. Caldwell to pay one-half of the cost and not to exceed $75,000 to rehab the Shamblin Street Pump Station. Motion passed without opposition.
The president asked Mr. Cammack to speak regarding the funding agreement for WIA Amendment No. 1. Mr. Cammack noted that the amendment was an increase in funding for the WIA Area 81 and recommended approval. Motion offered by Mr. Smiley, seconded by Mr. Caldwell to approve the amendment and authorize the president to sign the necessary documents. Motion passed without opposition.

Mr. Murray requested that the jury waive the agenda to take up the matter of hiring of two equipment operators. Motion offered by Mr. Caldwell, seconded by Mr. Calhoun to waive the agenda to address the hiring of the equipment operators for Public Works. Motion passed unanimously.

Mr. Harrison spoke regarding the FY2009 Pavement Striping Contract. Mr. Harrison stated that bids were opened on June 2, 2009, and that the low bidder was Highway Graphics, Inc., of West Monroe, in the amount of $87,742.50. Mr. Harrison recommended that the pavement-striping contract be awarded to Highway Graphics, Inc. A brief discussion ensued. Motion offered by Mr. Calhoun, seconded by Ms. Moore to accept the recommendation of the engineer and award the contract. Motion passed without opposition.
Mr. Harrison spoke regarding the Railroad Grade Crossing at Booth Street. Discussion ensued. This item was deferred until the July 6, 2009 meeting of the jury.
Mr. Harrison spoke regarding the West Ouachita Road Repairs and asked that the jury accept the project as substantially complete as of May 20, 2009. A brief discussion ensued. Motion offered by Mr. Calhoun, seconded by Mr. Caldwell to approve change order #1 and the project as substantially complete. Motion passed without opposition.

She stated that the Convention & Visitors Bureau will not host the 2nd year of the two (2) year contract. The tournament will return to Hammond, La.
Alana Cooper informed the board members of new committee assignments for the June 2009 through May 2010 period.
Alana Cooper congratulated Angie Jackson-Wilson for been awarded the BPW/LA Esther Terry Nike Award for 2009.
Alana Cooper reported that the 2009 AAU National 9 and under Girls’ Basketball Tournament will begin on June 26 and run through July 1, 2009 at the Fant-Ewing Coliseum.

Mayor Breland reported that we didn’t have enough money to go with the base bid and the alternate bid. The alternate bid is for a filter press that takes the water out of the sludge and turns it to dry cakes. We will have to come back at a later date to rebid the alternate.
M/S/C (Ron Hill, Cliff Bullock) to accept G. D. Womack Trucking, Inc. Base Bid of $1,664,474 as recommended by the Town Engineer, Tom Holtzclaw. Four yea votes, one absent.

LMA MEETING
Cliff Bullock reported on the LMA Meeting that was held in Sterlington last night. The Corps of Engineers donated the use of their barge for this meeting. Approximately 230 people attended. It was a very good turn out.

Cliff Bullock stated the town has been funded for a Welcome to Sterlington sign. He informed where the signs would be located. Alderman Hill stated he has received negative feedback on the sign slogan and graphics. He stated a few of the concerns, but none of these persons offered a suggestion. Discussion went on to see if the High School Art Class would come up with some suggestions.
Mayor Breland stated we did get an extension until December 31, 2009.

Jean Bonner mentioned the town is digging the ditches and they are real deep. She went on to say they are up in age now and the deep ditches are hard to mow. Mrs. Bonner asked if they don’t mow the ditches will the town do it. Mayor Breland said the town will mow it.

TOWN HALL COUNCIL ROOM
CALL TO ORDER/ROLL CALL
Mayor Vern Breland called the meeting to order. A quorum was present and acting. Aldermen present: Caesar Velasquez, Cliff Bullock, Ron Hill, Ladd Williams, and Bonnie Dilmore.
INVOCATION AND PLEDGE OF ALLEGIANCE
Mayor Breland gave the invocation and led the group in the Pledge of Allegiance.
GUESTS
Attending the meeting were Mr. & Mrs. Bruce Bonner, Kimberly Velasquez and children, and Ty Puckett.
Town personnel in attendance were Katy Balsamo, Todd Newton, Bryan Racer, Kevin Willis, and Lunar New.
Kevin Willis asked the Mayor id he could address the Mayor and Council. Mayor Breland gave him the floor. Kevin Willis stated he has been told that the Council has heard where he said something. He apologized to the Mayor and Council, but he did not realize he offended them.

HIRING POLICE OFFICER
M/S/C (MOVED, SECONDED, AND CARRIED) to remove this item from the agenda.
POSITION PROMOTIONS FOR POLICE OFFICERS
M/S/C (Caesar Velasquez, Cliff Bullock) based on Chief Bonner’s recommendation to promote Captain Todd Newton to Assistant Chief with a salary increase to $26,000 base pay.
M/S/C (Ron Hill, Ladd Williams) based on Chief Bonner’s recommendation to promote Jerre Hurst to Sergeant with a salary increase to $22,500 base pay.
M/S/C (Ladd Williams, Caesar Velasquez) based on Chief Bonner’s recommendation to promote Kevin Willis to Captain with a salary increase to $23,500 base pay.
M/S/C (Ron Hill, Caesar Velasquez) to increase Jacob Greer’s base salary to $20,000.
NEW BUSINESS
AWARD BID FOR PARKING LOT
Mayor Breland reported we received two bids on the parking lot, one from Charles Heard with Asphalt Maintenance bided $78,130.80, and the second bid was from Amethyst Construction at $73,684.50. Mayor Breland mentioned the 2007 LGAP grant is for $35,000 and the House Bill 1 grant is for $20,000, this will mean the town will have to come up with about $18,000.
Mayor Breland asked if the Council wanted to award the bid and talk to the lowest bidder on cutting back on things that could be cut to lower the bid.
M/S/C (Cliff Bullock, Ladd Williams) to table until Tom Holtzclaw could be here next Tuesday.
SANITARY SEWER COLLECTION BIDS
We receive only one bid from JaBar who bided 2.3 million on the sewer collection project and our budget is only about one million. It was M/S/C (Ron Hill, Ladd Williams) to reject the bid from JaBar and see if our engineer can scale the project down and rebid it.
INVITATION FOR PUBLIC PARTICIPATION
Mayor Breland gave an update on the town sign issue. He talked to Dr. Dunn at ULM who has an advertising marketing class that will start this fall and they are going to work on the Sterlington Town sign to come up with a new concept. He also talked to the Art Director at the high school and the art students are going to come up with a design also. He talked to an architect from Las Vegas who has relatives that live here and he is also going to come up with a design. The Mayor talked to his son Rusty who is a good artist about him drawing a design too.
Mayor Breland stated hopefully in September we can get all these designs and see what we like. He also mentioned Caesar’s daughter Whitley turned in a lot of good ideas too.
