Shall Road Lighting District No. Seventeen of the Parish of Ouachita, State of Louisiana (the “District”), through its Governing Authority, be authorized to assess and to adopt a resolution providing for the assessment of an annual service charge of $50.00, plus a collection charge of $2.50 to be paid to the Tax Collector, per parcel of immovable property located wholly or partly within the boundaries of said Road Lighting District for a period of ten (10) years, beginning with the year 2009, and ending with the year 2018, for the purpose of paying utility charges for road lighting and maintaining and operating road lighting facilities and equipment. This Service Charge is to be collected in lieu of the $30.00 Service Charge presently authorized to be collected through 2013. The amount reasonably expected to be collected from the levy of the Service Charge for the first year will be approximately $1,650.00. This Service Charge is to be collected in lieu of the $30.00 Service Charge presently authorized to be collected through 2013. The amount reasonably expected to be collected from the levy of the Service Charge for the first year will be approximately $1,305.00. The Bonds shall be limited and special revenue bonds of the City, shall be secured by and payable in principal, interest and redemption premium, if any, from an irrevocable pledge and dedication of the income and revenues derived or to be derived by the City from the operation of the System, after paying the reasonable and necessary expenses of administration, operation and maintenance of the System. The Bonds shall not be a charge on the other income and revenues of the City as prohibited under the provisions of Article VI, Section 37 of the Louisiana Constitution of 1974, nor shall they constitute an indebtedness or pledge of the general credit of the City. The Bonds will be issued and authorized by ordinances of the Governing Authority in one or more series and shall bear such dates, mature at such time or times [not to exceed twenty-two (22) years from their date of issuance], bear interest at such rate or rates [not exceeding four per centum (4.00%) per annum], be sold at such price or prices, be in such denomination or denominations, in fully registered form, carry such registration privileges, be payable in such medium of payment and at such place or places, be subject to such terms of redemption and be entitled to such priorities on the income and revenues of the System as the City may provide by ordinances adopted at the time or times of issuance of the Bonds. The Governing Authority will in such ordinances enter into such covenants with the future owner or owners of the Bonds as to the management and operation of the System, the imposition and collection of rates and charges for the services rendered thereby, the disposition of such fees and revenues, the issuance of future bonds and the creation of future liens and encumbrances against the System and the revenues therefrom, the carrying of insurance, the keeping of books and records, and other pertinent matters as may be deemed proper by the Governing Authority to assure the marketability of the Bonds, consistent with the provisions of the Act. Such ordinances will also include remedies in case of default, provisions for the issuance of parity bonds and such additional covenants, agreements and provisions as are judged advisable or necessary by said Governing Authority for the security of the owners of the Bonds, including sinking funds and reserves for the payment of principal and interest on the Bonds, and an adequate depreciation fund for those repairs, extensions and improvements to the System as may be necessary to assure adequate and efficient service to the public, all as provided by the Act. The Bonds will be sold at public or private sales, as provided for in the Act and other statutory authority, and the Bonds will, before the delivery thereof, be approved by the State Bond Commission, Baton Rouge, Louisiana. Special Projects/Safety Coordinator Kenneth Slusher reported that the West Monroe High School renovations should be finished by next Friday and can start moving in. The stadium is finished at West Ouachita High, but will be from 6 to 8 months before the building is finished. Jack Hayes should be finished by next Friday and Ouachita Junior will not be ready by the time school starts. The Pinecrest completion date is the first of October, but the enclosed walkway and cafeteria are finished and arrangements have been made to redirect traffic from the front of the building to the west side for bus and parent drop-off. He concluded his report with an announcement that the Richwood Middle School bid opening scheduled today will be delayed until 2:00 p.m. on August 13. The project architect, Cedric Hemphill, gives the reasons below. Cedric Hemphill with Herbert Land Architecture firm explained his position on delaying the bid opening for the new Richwood Middle School project until August 13. For the most part, he feels certain that it will benefit the Board in getting a better price for the project and was not comfortable with the fact that several other large projects were bid in the area today. He explained that many contractors were not able to submit a bid on the RMS project and this delay will allow more time for additional contractors to submit bids. Furthermore, there were some questionable areas in the bid document that did not include equals for some products as required by the bid law. Hemphill feels it is worth the gamble to delay the bid opening at this time so corrections can be made on the specs, possibly avoiding the risk of another delay due to discrepancies. He assured Reverend Russell that this delay will not affect the date of completion. Following discussion regarding the HVAC system at West Monroe High School with Special Projects/Safety Coordinator Kenneth Slusher, Scott Robinson moved, seconded by Jerry Hicks, that the Board postpone acceptance of the HVAC System bid [Bid No. 68-09] at West Monroe High School until further review. Motion carried unanimously. Business Manager Richie Garrett asked the Board’s permission to allow Purchasing Agent Bobby Jones to delay acceptance of the low responsive bids until Thursday for Fuel Management [Bid No. 1-10] and Band Instruments [Bid No. 4-10] and allow him to open and accept the low bids at that time. Committee Reports: Tourism Development Grant Committee – Jerry Edmondson, Chairman of the Tourism Development Committee, reported that the Committee met on May 18, 2009 at 3:30 p.m. to review requests from the following organizations. City of Monroe – William A Guy, Jr., City of Monroe Grant Writer, made a written request to the committee to reconsider the request that the Ouachita River Scenic Overlook Trail be placed on top of the levee instead of between the levee and the river. He stated four (4) reasons why the trail can’t be placed on top of the levee. He requested that the Committee grant the $5,000.00 for the trail even though the trail will not be on top of the levee. It was moved by Jerry Edmondson and seconded by Lane Howell to approve the City of Monroe request to fund $5,000.00 to construct the Ouachita River Scenic Overlook Trail between the levee and the Ouachita River as designated in the 2008 Tourism Development Grant request. South Central Regional Music Conference – Jerry Edmondson reported that the South Central Regional Music Conference submitted a request for final payment in the amount of $1,625.00 for the 2009 South Central Regional Music Conference. Chennault Aviation & Military Museum – Jerry Edmondson reported that Roy Johns, Chairman of Friends of the Chennault Aviation & Military Museum, attended the Tourism Development Grant Committee Meeting to request that the $5,000.00 2008 Tourism Development Grant be redirected to another project. He reported that the fund-raiser for the electronic sign that was proposed in the 2008 grant did not materialize. He said another fund-raiser for an Aircraft Restoration Project is coming along fairly well. He requested that the funds for the electronic sign be transferred to the Aircraft Restoration Project. It was moved by Jerry Edmondson and seconded by Lane Howell to redirect funds dedicated to the Chennault Aviation & Military Museum in the amount of $5,000.00 approve in the 2008 Tourism Development Grant to the Aircraft Restoration Project. Bond Oversight Committee – Nash Patel reported that Lorraine Slack, Executive Director of the Northeast Louisiana Delta African American Heritage Museum, sent a letter updating the Board of the ongoing progress of the construction plans of the Museum. She stated that they finally got construction documents from Cliff James, Architect on the project. She reported that the cost estimate of $2.6 million was too close to the allocated budget to accept. Mr. Cliff James is to submit several alternates to lower construction costs. She stated that she and several Museum Board Members will travel to Baton Rouge on May 13, to meet with Kevin Clark, Project Director and Cliff James, architect. Nash Patel stated that the Cooperative Endeavor Agreement deadline extended in May 2008 has expired. Therefore he recommended that the Board extend the deadline another year since the Museum is proceeding with due diligence on the project. It was moved by Don O’Toole and seconded by Lane Howell to grant the Northeast Louisiana Delta African American Heritage Museum Cooperative Endeavor Agreement a one (1) year extension with a deadline of May 18, 2010 to get started on the construction of the Museum. She reported the event is held seven (7) days for the High School and three (3) days for the Junior High. Alana Cooper stated that Mr. Profit discussed the possibility of partnering with the Convention & Visitors Bureau to fund Grambling State University Legends Sports Hall of Fame Induction Banquet in the amount of $15,000.00. The banquet will be held at the Monroe Civic Center in July 2009. She reported that she is bringing the matter to the Board to make a decision in which way to address the request. Jerry Edmondson, Chairman of the Tourism Development Grant Committee, stated that he feels that the request should be submitted in the form of a grant during the July 2009 grant period. The alternate bid is for a filter press that takes the water out of the sludge and turns it to dry cakes. We will have to come back at a later date to rebid the alternate. REPORTS LMA MEETING Cliff Bullock reported on the LMA Meeting that was held in Sterlington last night. The Corps of Engineers donated the use of their barge for this meeting. Approximately 230 people attended. It was a very good turn out. TOWN SIGN Cliff Bullock stated the town has been funded for a Welcome to Sterlington sign. He informed where the signs would be located. Alderman Hill stated he has received negative feedback on the sign slogan and graphics. He stated a few of the concerns, but none of these persons offered a suggestion. Discussion went on to see if the High School Art Class would come up with some suggestions. Mayor Breland stated we did get an extension until December 31, 2009.
