MINUTES OF THE REGULAR MEETING
OF THE WEST MONROE CITY COUNCIL
MAY 12, 2009
There was a Regular Meeting of the West Monroe City Council held on Tuesday, April 14, 2009 at 7:00 p.m. in the Council Chambers of the West Monroe City Council.
Those present were Mayor Dave Norris, Aldermen L. O. Yeager, Alice Pearson, James Bennett, James Brian and Fred Ragland.
The invocation was offered by Dr. Jerry Edmondson.
There was a motion by Mrs. Pearson, seconded by Mr. Bennett and unanimously carried to approve the minutes of the April 14, 2009, Regular Council Meeting.
There was a motion by Mrs. Pearson, seconded by Mr. Yeager and unanimously carried to approve payment of the April 2009 billings subject to audit by the Finance Committee.
There was a motion by Mr. Yeager, seconded by Mrs. Pearson and unanimously carried to introduce an ordinance to adopt a Utility Fund Budget for the City of West Monroe Utility Fund for the fiscal year of July 1, 2009 to June 30, 2010. Ordinance 3812:
AN ORDINANCE TO ADOPT THE BUDGET FOR THE UTILITY FUND FOR THE FISCAL YEAR OF JULY 1, 2009 THROUGH JUNE 30, 2010 FOR THE CITY OF WEST MONROE, LOUISIANA.
There was a motion by Mrs. Pearson, seconded by Mr. Yeager and unanimously carried to introduce an ordinance to adopt a General Fund and Special Funds budgets for the City of West Monroe for the fiscal year of July 1, 2009 to June 30, 2010. Ordinance 3813:

There was a motion by Mrs. Pearson, seconded by Mr. Yeager and unanimously carried to approve an ordinance to authorize the City to enter into an Agreement for Professional Services with Ford, Bacon & Davis (engineering services). Ordinance 3814:
AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF WEST MONROE LOUISIANA, TO EXECUTE AN AGREEMENT FOR PROFESSIONAL SERVICES WITH FORD, BACON & DAVIS TO PROVIDE ENGINEERING SERVICES, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
There was a motion by Mrs. Pearson, seconded by Mr. Ragland and unanimously carried to table until the June regular meeting, an ordinance to authorize the dedication of additional utility servitudes, revocation of existing utility servitudes, and authorize filing of plat (Lot 1, Constitution Centre, Unit No. 1, bayou Bistro) (tabled from April).
There was a motion by Mr. Bennett, seconded by Mr. Yeager and unanimously carried to approve an ordinance to authorize the City of West Monroe to enter into a lease of tower space with Pinnacle Towers, LLC (updated lease of antenna usage for city use) (tabled from April). Ordinance 3815:

There was a motion by Mrs. Pearson, seconded by Mr. Yeager and unanimously carried to approve an ordinance to authorize the application for and, if awarded, execution of a grant from the Farmers Market Promotion Program. Ordinance 3816:

There was a motion by Mrs. Pearson, seconded by Mr. Ragland and unanimously carried to authorize execution of Articles of Agreement for Utility Relocation with Louisiana Department of Transportation and Development (Downing Pines/Cypress Intersection). Ordinance 3818:

A RESOLUTION AUTHORIZING PRE-APPLICATION TO THE LOUISIANA DEPARTMENT OF ENVIRONMENTAL QUALITY FOR THE PURPOSE OF OBTAINING FUNDING FOR THE SPARTA REUSE DEMONSTRATION PROJECT THROUGH THE STATE REVOLVING FUND LOAN PROGRAM; AND OTHERWISE PROVIDING WITH RESPECT THERETO.
There was a motion by Mrs. Pearson, seconded by Mr. Brian and unanimously carried to condemn and demolish structures located at 1005 Warren Drive (demolition already initiated), Harry Liner, Jeb Liner, Merle Liner.

NOTICE
NOTICE is hereby given that, pursuant to article IV, section 21 (D) (1) of the Louisiana Constitution, that on May 18, 2009, Entergy Louisiana, LLC. (“ELL” or the “Company”), an electric public utility having facilities to provide retail electric service to residential, commercial, industrial, and governmental customers in forty-six Parishes of the State of Louisiana, filed with the Louisiana Public Service Commission (“LPSC”) an Application to flow through to retail customers the credits and payments resulting from Federal Energy Regulatory Commission (“FERC”) Opinion Nos. 468 and 468-A and related orders and seeking approval of a base rate rider for that purpose. In this Application, ELL seeks approval to flow through to its LPSC-jurisdictional retail rates, by way of the proposed FERC Interruptible Order Retail Effect Rider (“Rider FIORE”), a refund to its customers of $17.446 million.
The Application requests that the LPSC: (1) authorize and approve the flow through to retail rates of the LPSC-jurisdictional portion of the payments and credits that have been made and received by ELL as a result of the FERC Orders, but that have not yet flowed through to retail rates, including interest from the time payments and credits were recorded until they are flowed through to retail rates; (2) authorize and approve the flow through to retail rates of the LPSC-jurisdictional portion of any future payments and credits that ELL makes and receives as a result of a decision on appeal of the FERC Orders or a ruling on the LPSC’s Protest, including interest from the time payments and credits are recorded until they are flowed through to retail rates; (3) authorize and approve the flow through to retail rates of such payments and credits through the Rider FIORE, together with proposed rate schedules; (4) authorize and approve the implementation of its proposed Rider FIORE tariff to become effective on June 30, 2009, so that the refunds to be flowed through at this time can be reflected in customers’ bills commencing with ELL’s July 2009 billing cycle; and (5) grant all other proper relief to which the Company may be entitled.
Pursuant to the Application, Rider FIORE and Attachment A thereto, the refund to be flowed through at this time as a result of the FERC Orders is going to be implemented through credits spread evenly over the two months of July 2009 and August 2009, the amount of which will be determined by dividing the refund amount by total base revenue for each of those months. Thus, the credit for July 2009 will be 9.3777% and the credit for August 2009 will be 9.2592% of the customers’ bill each month.
Based upon the May 2009 Fuel Adjustment Clause rate, the July 2008 Rough Production Cost Equalization Adjustment Rider, and the July 2008 Non-Fuel Rough Production Cost Equalization Adjustment Rider, a typical July 2009 bill for ELL customers for Residential Service for 1,000 kWh would decrease $4.48 from $88.61 to $84.13. A bill for Small General Service for 50 kW and 12,500 kWh would decrease $64.06 from $1,211.71 to $1,147.65. A bill for Large General Service for 500 kW and 225,000 kWh would decrease $704.54 from $15,995.28 to $15,290.74.
Based upon the May 2009 Fuel Adjustment Clause rate, the August 2008 Rough Production Cost Equalization Adjustment Rider, and the August 2008 Non-Fuel Rough Production Cost Equalization Adjustment Rider, a typical August 2009 bill for ELL customers for Residential Service for 1,000 kWh would decrease $4.42 from $88.66 to $84.24. A bill for Small General Service for 50 kW and 12,500 kWh would decrease $63.25 from $1,212.10 to $1,148.85. A bill for Large General Service for 500 kW and 225,000 kWh would decrease $695.64 from $16,003.07 to $15,307.43.

NOTICE
NOTICE is hereby given that, pursuant to article IV, section 21 (D) (1) of the Louisiana Constitution, that on May 11, 2009, Entergy Louisiana, LLC. (“ELL”), an electric public utility having facilities to provide retail electric service to residential, commercial, industrial, and governmental customers in forty-six Parishes of the State of Louisiana, together with Entergy Gulf States Louisiana, L.L.C. (“EGSL”) (collectively, the “Companies”), filed with the Louisiana Public Service Commission (“LPSC”) a Joint Application (“Application”) for recovery in rates of costs related to Hurricanes Gustav and Ike.
With regard to ELL, the Application requests the following: (1) find ELL’s storm restoration costs of $382.9 million in actual costs incurred through February 28, 2009, $8 million in estimated costs relating to projects that are expected to be complete by the end of 2009, and $1.3 million in write-offs of storm-related uncollectibles, to be reasonable and necessary and approve their recovery from customers, with the manner of such recovery to be determined simultaneously with the approval of these costs; (2) approve and issue an order determining that the total amount of LPSC-jurisdictional Hurricanes Gustav and Ike storm restoration costs for which ELL is seeking recovery of $382.9 million, net of the amount ELL funded from the storm escrow fund of $134 million, and taking into account the projected carrying charges through the end of 2009 of $13.0 million, for a total LPSC-jurisdictional recovery request of $261.9 million, is reasonable and necessary and approve its recovery from customers, with the manner of such recovery to be determined simultaneously with the approval of these costs; (3) approve ELL’s request for the reestablishment of a storm reserve in an amount equal to the average amount of total storm costs incurred by ELL over the past five years, or $200 million, with the method to fund this storm reserve to be approved simultaneously with the approval of the re-establishment of a storm reserve in the requested amount; (4) authorize ELL to recover carrying charges on the approved storm restoration costs at its weighted average cost of capital from the date on which the storm restoration costs were incurred until the date that securitization bonds are issued pursuant to a financing order or until the storm restoration costs are otherwise recovered; (5) approve the manner in which the storm restoration costs will be functionalized and allocated to rate classes within ELL’s retail jurisdiction; (6) grant such other relief to which the Companies show themselves to be entitled.
ELL presents two potential allocation methodologies in the Application: (1) an allocation in proportion to each customer class’s contribution to base rate revenues; (2) an allocation based on the method approved by the LPSC in the Financing Orders from Docket No. U-29203 that is currently in use for recovery of storm restoration costs related to Hurricanes Katrina and Rita. If ELL’s proposal were approved as filed, various customer classes would incur the following rate changes due to the monthly surcharges for the next ten years based upon the May 2009 Fuel Adjustment Clause rate.
Under method (1) a typical bill for ELL customers for Residential Service for 1,000 kWh would increase $1.51 from $90.62 to $92.13. A bill for Small General Service for 50 kW and 12,500 kWh would increase $21.57 from $1,237.58 to $1,259.15. A bill for Large General Service for 500 kW and 225,000 kWh would increase $237.23 from $16,429.41 to $16,666.64.
Under method (2) a typical bill for ELL customers for Residential Service for 1,000 kWh would increase $1.67 from $90.62 to $92.29. A bill for Small General Service for 50 kW and 12,500 kWh would increase $23.85 from $1,237.58 to $1,261.43. A bill for Large General Service for 500 kW and 225,000 kWh would increase $262.33 from $16,429.41 to $16,691.74.

NOTICE
The Ouachita Parish School Board met in special session on Tuesday, April 28, 2009 at twelve (12:00) o’clock noon at its regular meeting place, the Ouachita Parish School Board office.
The following members were present: Jack White, Scott Robinson, A. R. Sims, Jerry R. Hicks, John Russell, Carey Walker and Susan Spence. There were none absent.
The Pledge to the Flag was led by Board member Carey Walker.

Upon motion by Mr. Sims, seconded by Susan Spence, the Board approved the amended Personnel Agenda as submitted, including the personnel changes since mailed out. Motion carried unanimously.
Director of Secondary Programs Randy Hammett presented the following football academic awards to four students in recognition of their academic/football achievements throughout high school: Robert Jenkins (OPHS); Dillon Davis and Colton Walker (WMHS); and Sagan Ezell (WOHS). Each student maintained a 4.0 grade point average throughout high school while playing football for their respective school. In January, they were acknowledged in Baton Rouge with an honorary “football patch” for their achievements.
On motion by Jerry Hicks, seconded by A. R. Sims, the Board adopted the Proclamation as presented by Special Projects/Safety Coordinator Kenneth Slusher designating May 6, 2009 as “School Nurse Day” in the state of Louisiana. Motion carried unanimously.
On the recommendation of Child Nutrition Director, JoLynne Correro, Susan Spence moved, seconded by John Russell, to continue the Child Nutrition Purchasing Co-Operative Agreement amended to extend the duration of the contract from five years to a ten-year period beginning July 1, 2008, and ending July 30, 2018. Mrs. Correro commented that the articles of the agreement state that participating parishes have the option to withdraw from the purchasing co-operative at any time with Board approval. Motion carried unanimously.
Special Projects/Safety Coordinator Kenneth Slusher reported that the Ag building and the field house construction projects at Ouachita High School and the last construction phase at West Monroe High School are on schedule. All construction projects are up and going and there are two more to bid and evaluate later today. Mr. Slusher reminded the Board that the ground breaking ceremony for the new Sterlington elementary school will be at Marion State Bank at 9 A.M. Thursday.
On the recommendation of Special Projects/Safety Coordinator Kenneth Slusher, A. R. Sims moved, seconded by Scott Robinson, that the Board accept the low base bid including Add Alternate No. 1 from Armstrong Builders for a total amount of $324,223 (Base Bid - $241,223/ Add Alt. No. 1 - $83,000) for renovations at Pinecrest School [Bid No. 43-09]. Motion carried unanimously.
On motion by Jerry Hicks, seconded by A. R. Sims, the Board accepted Mr. Slusher’s recommendation and approved Unisource as the qualifying bidder according to the “Louisiana Preference” law for copy paper in the amount of $27.03 per case [Bid No. 47-09]. Motion carried unanimously.
Upon motion by Scott Robinson, seconded by Jerry Hicks, the Board accepted the recommendation of Special Projects/Safety Coordinator Kenneth Slusher and approved the low bid of K & K Electric in the amount of $381,700 for electrical upgrades at the Ouachita Parish Alternative Center [Bid No. 50-09]. Motion carried unanimously.
On the recommendation of Special Projects/Safety Coordinator Kenneth Slusher, Jerry Hicks moved, seconded by A. R. Sims, that the Board grant permission to bid the following items: (1) School Buses {2- regular & 2- Sp. Ed.} to be paid with General Funds [Bid No. 55-09]; (2) Replace gym floor at WRMS to be paid with M&O funds [Bid No. 58-09]; (3) Copy paper to be paid with General Funds [Bid No. 59-09]; (4) Oil/Grease to be paid with General Funds [Bid No.60-09]; (5) Garbage Collection to be paid with General Funds [Bid No. 61-09]; (6) Tork Paper to be paid with General Funds [Bid No. 62-09]; (7) Toilet Paper to be paid with General Funds [Bid No. 63-09]; (8) Band Uniforms for (RHS) to be paid with General Funds (Bid No. 64-09]. Motion carried unanimously.

Proceedings of the Board of Commissioners of the West Ouachita Sewerage District No. 5, Ouachita Parish, Louisiana. Taken at the office of the district, 327 Wallace Road, West Monroe, LA, Monday, May 18, 2009. (regular meeting).
Members present: Fred Hall, Don Leach, Ralph Owens
Members absent: None
Others present: Jerry Lazenby, Lazenby & Associates, Inc.; Jason Thornhill, Lazenby & Associates, Inc.; and Terry Cox, district manager.
Commissioner Hall called the meeting promptly to order at 11:00 a.m.
Motion was made by Commissioner Leach to authorize the West Ouachita Sewerage District No. 5 (WOSD No. 5) to accept the backwash water from Greater Ouachita Water Company's (GOWC) West Ridge Water Treatment facilities and the domestic wastewater from the West Ridge Middle School since both entities are public entities that are in serious need of adequate wastewater treatment and are unable to consistently meet the current Louisiana Department of Environmental Quality (LDEQ) discharge requirements; and to authorize Terry Cox, district manager, and Jerry Lazenby, P.E., to review and/or develop all necessary details of the proposed wastewater collection system additions and to review and present all required plans, specifications and related documents, sewer use fees and other required documents to Fred Hall, president of the board of commissioners for final review and execution as necessary for the collection and treatment of the wastewater generated by these two public entities. The cost of all required sewer collection system facilities necessary to deliver the sewer flows from these two public entities to be paid for by the respective public entity and to meet the requirements of the WOSD No. 5 for quality. Each respective entity to be responsible for the payment of monthly sewer use fees and any impact fees and/or franchise fees imposed by the WOSD No. 5. Following a detailed discussion, the motion was seconded by Commissioner Owens.
Motion by Commissioner Leach to approve the plan's submittal of the proposed Dr. Sanson Medical Clinic at 2315 Arkansas Road as recommended by WOSD No. 5 district manager and district's engineer and to authorize the facility to connect to the existing sewer tap on the South side of Arkansas Road on property currently owned by the Sansons. Following a discussion and review of the proposed plans, Commissioner Owens seconded the motion.
The final item on the agenda was cash disbursements. Mr. Cox presented the disbursements for the month and following a brief discussion, Commissioner Leach made a motion to accept them as reasonable and necessary. Commissioner Owens seconded the motion.
No further business being presented, the meeting adjourned at 12:10 p.m.
