Any manufacturer’s names, trade names, catalogue or model numbers, or other similar material identifying a particular product, of a particular grade of product, are used for descriptive purposes, to establish the standard of quality, design, and performance. However, any substitution or departure proposed must be clearly noted and described. Otherwise, it will be assumed that the Bidder proposed to supply the items as specifically described in these Specifications.
It is understood and agreed that the Bidder, if awarded the subject contract, will protect, defend and hold harmless the Police Jury, its members, agents, and employees, from any claims, suits, or demands. This includes demand for payment for the use of any trade secret that may enter into the design, manufacture, or use of the item or services contracted for. Including any material, device, article or process the use or which is substantially important to the proper and most effective use of the items or services contracted for. Bidder further agrees to indemnify in full the Police Jury, its members, employees and agents for any amounts which they may be required to expend in the defense of such claims, suits of demands, or in settlement thereof, or in satisfaction of any judgement, award or decree resulting therefrom.

Proposals shall be addressed to the West Monroe, and delivered here to the office of the City Clerk, located in the City Hall not later than 10 o’clock a.m. on May 27, 2009. Proposals shall be designated as “Sealed Bid” City of West Monroe, Louisiana – Sewer Rehabilitation Community Development Block Grant Project for Fiscal Year 2009 to be financed by the State of Louisiana CDBG program. All bids must be submitted on the proper bid form. The contractor shall display his contractor’s license number prominently on the outside of the envelope. Any bids received after the specified time and date will not be considered. The sealed bids will be publicly opened and red aloud at 10 o’clock a.m. on May 27, 2009 in the Council Chambers at the West Monroe City Hall located at 2305 North 7th Street, West Monroe, Louisiana. The Information for Bidders, Form of Bid Proposal, Form of Contract, Specifications, Forms of Bid Bond and other contract documents may be examined at the office of the   Engineer  (S. E. Huey Co.)  located at 1111 North 19th Street, Monroe, LA. Copies may be obtained at the office of S. E. Huey Co. located at 1111 North 19th Street, Monroe, Louisiana 71201 upon deposit of $50.00 for each set. Deposits on the first set of documents furnished to bona fide prime bidders will be fully refunded upon return of the bid documents, if returned in good condition and no later than 10 days after receipt of bids. On other sets of documents furnished to bidders, the deposit less the actual cost of reproduction ($25.00) will be refunded upon return of the bid documents, if returned in good condition, and no later than 10 days after receipt of bids.
Each bidder must deposit with his/her bid, security in the amount, form and subject to the conditions provided in the Information for Bidders. Sureties used for obtaining bonds must appear as acceptable on the Department of Treasury Circular 570.
Attention to Bidders is particularly called to the requirements as to conditions of employment to be observed and minimum wage rates to be paid under the Contract, Section 3, Segregated Facilities, Section 109, Executive Order 11246, and all applicable laws and regulations of the Federal Government and State of Louisiana and bonding and insurance requirements.
No bidder may withdraw his/her bid within 60 days after the actual date of the opening thereof.
The Contractor shall begin mobilization of materials within ten (10) working days of the receipt of the Notice to Proceed.
The successful bidder must submit executed copies of certification regarding Equal Employment Opportunity, Section 3 and Segregated Facilities, Section 3 Plan and Certification Concerning Labor Standards.
The successful bidder will be required to execute the Owner’s Standard Form of Agreement/Contract for construction together with the Performance and Payment Bonds within then (10) working days after normal award of contract.

Date and Place: The regular meeting of the Convention & Visitors Bureau Board of Directors was held at the Convention & Visitors Bureau on February 23, 2009 at 4:00 p.m. The Chairman, Gretchen Kovac, presided.
Roll Call: Present

Travel Plans: It was moved by Sammy Gordy and seconded by Jerry Edmondson to approve the additional travel plans for March through May 2009. Motion carried by a vote of nine (9) affirmative votes to zero (0) negative votes.
Committee Report:
Tourism Development Grant Committee – Jerry Edmondson, Chairman of the Tourism Development Grant Committee, reported that the committee met on February 17, 2008 at 4:00 p.m. to review requests for final payments on grant funding for the following organizations.
City of Monroe – Black Bayou $12,500.00
The Children’s Museum $ 2,000.00
It was moved by Jerry Edmondson and seconded by Don O’Toole to approve the final grant payment to the City of Monroe – Black Bayou National Wildlife Refuge Fishing Pier Extension project in the amount of $12,500.00 and the final grant payment for the Children’s Museum 2008 Santa’s Christmas Village out of state advertising in the amount of $2,000.00. Motion carried by a vote of nine (9) affirmative votes to zero (0) negative votes.
Jerry Edmondson reported that the committee met with Bobby Staub to discuss the University of Louisiana Athletic Department request for a Tourism Development Grant in the amount of $500,000.00 toward the purchase of a new scoreboard. He also discussed the sponsorship package request in the amount of $25,000.00, $40,000.00 or $50,000.00 to the University of Louisiana Athletic Foundation.
He reported that Bobby Staub said the grant for a new scoreboard will not be needed. The project has been put on hold because of the bad economy. Bobby Staub informed the committee that if approved of a sponsorship, the Athletic Department will not request anymore grants for the next five (5) years.
Jerry Edmondson reported that after further discussion and the consideration of how important the University of Louisiana at Monroe is to the community, the committee recommended giving the University of Louisiana Athletic Foundation a sponsorship in the amount of $25,000.00 for the next three (3) years.
The committee requested the Executive Director to add a provision to the sponsorship that the Convention & Visitors Bureau is granted the free use of the Athletic Department Facilities for up to two events per year. Also the Convention & Visitors Bureau Marketing Department should evaluate the benefits included in the sponsorship package and renegotiate the reduction in offers according to the needs of the Convention & Visitors Bureau.
It was moved by Jerry Edmondson and seconded by Janet Rutledge to provide a Sponsorship in the amount of $25,000 for the next three (3) years to the University of Louisiana Athletic Foundation. The Executive Director is to request in writing from Bobby Staub, agreeing that the Convention and Visitors Bureau will be granted the use of the Athletic Department sport facilities for two (2) events per year at no cost. Also, the Convention & Visitors Bureau Marketing Department will evaluate the benefits included in the sponsorship package and reduce the offers according to the needs of the Convention & Visitors Bureau. Motion carried by a vote of nine (9) affirmative votes to zero (0) negative votes.
Bid Committee – Janet Rutledge, Chairman of the Bid Committee reported that the committee met on February 23, 2009 at 3:45 p.m. to review bid proposals for the printing of the Convention and Visitors Bureau Visitor’s Guide Brochure. She reported that the following printers submitted bids.

A regular meeting of the Board of Commissioners, Hospital Service District No. 1 of the Parish of Ouachita, State of Louisiana was called to order at 11:40 a.m. in the Wellness Center at 3215 Cypress Street, West Monroe, Louisiana, by Steve Hall, Chairman of the Board of Commissioners. All references to the “District” refer to the Hospital Service District No. 1 of the Parish of Ouachita, State of Louisiana. All references to the “Foundation” refer to the Ward Five Healthcare Foundation, doing business as the Living Well Foundation.

REMARKS FROM THE CHAIRMAN OF THE DISTRICT
Mr. Hall noted that the Wellness Center continues to make progress with growing membership. The pool has been down, but the problems have been resolved. Renovations are nearing completion.
EXECUTIVE SESSION FOR PURPOSES OF STRATEGIC PLANNING, INCLUDING WITH RESPECT TO THE FUTURE OF THE WELLNESS CENTER AND RELATIONS WITH GRMC, GLENWOOD RESOLUTION AUTHORITY, INC., AND THE WARD FIVE HEALTHCARE FOUNDATION (NOW DBA LIVING WELL FOUNDATION)
A motion was made by Ms. Liner, seconded by Mr. Spencer and unanimously approved for the Board of Commissioners to go into executive session for the purposes of strategic planning, including with respect to the future of the Wellness Center and relations with GRMC, Glenwood Resolution Authority, Inc., and the Ward Five Healthcare Foundation (now dba Living Well Foundation).
Charles Marchbanks and Jessica Baxter from Little & Associates presented HSD and Wellness Center financials during their designated time in Executive Session. Amanda Adcock, Director of the Wellness Center, attended the Executive Session only during the presentation of information concerning the Wellness Center.
A motion was made by Mr. Mulhearn, seconded by Ms. Liner and unanimously approved for the Board of Commissioners to go back into regular session.
APPROVAL OF MINUTES OF DISTRICT BOARD MEETINGS HELD ON FEBRUARY 17, 2009
After review of the February 17, 2009 minutes, a motion was made by Ms. Liner and seconded by Mr. Spencer to adopt the minutes as presented and the motion was unanimously approved.
ELECTION OF VICE CHAIRMAN FOR PROGRAMS/GRANT REVIEW OF LIVING WELL FOUNDATION
The following resolution was offered by Mr. Spencer:
WHEREAS, the resignation of Dr. Jan Corder as Vice Chair for Programs/Grant Review of the Foundation has resulted in a vacancy in such office;
WHEREAS, in accordance with Article VII(4) of the Articles of Incorporation and Section 4.3 of the Bylaws of the Foundation, the Nominating Committee of the Foundation has recommended and the Board of Directors of the Foundation has nominated Susan Hoffmann to serve as the Vice Chair for Programs/Grant Review of the Foundation;
WHEREAS, the Board of Commissioners concurs with the foregoing and considers that the election of Ms. Hoffmann to such position is in the best interests of the District and of the Foundation;
RESOLVED, that Susan Hoffmann is elected to serve as the Vice Chair for Programs/Grant Review of the Foundation, to hold such office until December 31, 2009 and until her successor is elected and has qualified.
Mr. Mulhearn seconded the resolution and the Board voted unanimously to approve it.
ELECTION OF DIRECTOR OF LIVING WELL FOUNDATION
Ms. Liner made the following motion, which was seconded by Mr. Spencer and unanimously approved by the Board:
WHEREAS, the resignation of Dr. Jan Corder as a director of the Foundation has resulted in a vacancy on the Board of Directors of the Foundation;
WHEREAS, Dr. Corder's term of office was to last until December 31, 2009, and until her successor is elected and has qualified;
WHEREAS, in accordance with Article VI(4) of the Articles of Incorporation and Section 2.3 of the Bylaws of the Foundation, the Nominating Committee of the Foundation has recommended and the Board of Directors of the Foundation has nominated Dr. John Shepard, D.D.S. to be a director of the Foundation and to fill the seat vacated by Dr. Jan Corder;
WHEREAS, the Board of Commissioners concurs with the foregoing and considers that the election of Dr. John Shepard, D.D.S. is in the best interest of the District and of the Foundation;

ADVERTISEMENT FOR BIDS
SEPARATE SEALED BIDS for FY 2009 PAVEMENT STRIPING CONTRACT, OUACHITA PARISH, LOUISIANA, will be received by the Ouachita Parish Police Jury at the office of the Secretary-Treasurer in the Parish Courthouse Building, Monroe, Louisiana, until ten (10:00) o'clock A.M. CDST, Tuesday, June 2, 2009. Sealed bids will be publicly opened and read aloud at that time. Any bids received after closing time will be returned to the bidder unopened.
The Contract Documents including complete plans and specifications may be examined and procured at the office of the Engineer, Harrison and Associates, Inc., Consulting Engineers & Land Surveyors, 200 Washington Street, 2nd Floor, Monroe, Louisiana. The Contract Documents will not be issued later than twenty-four (24) hours prior to the time set for opening the bids. A deposit of $20.00 shall be required for each set of Contract Documents. Deposits on the first set of Contract Documents furnished to bona fide prime bidders will be fully refunded upon return of the documents, deposits on all other sets of documents will be refunded less the actual costs of reproduction. Refunds will be made upon return of documents if returned within ten (10) days after the receipt of bids.
Each bid shall be accompanied by a cashier's check, certified check, or acceptable Bid Bond payable to the Ouachita Parish Police Jury in an amount not less than five percent (5%) of the total bid amount as a guarantee that, if awarded the Contract, the Bidder will promptly enter into a contract and execute such bonds as may be required.
The successful Bidder shall be required to furnish a Performance Bond and Labor & Material Payment Bond for the full amount of the Contract in accordance with Article 30 of the General Conditions.
The Owner reserves the right to reject any and all bids, and, waive any and all formalities not required by the Louisiana Public Bid Law (La. R.S. 38:2211-2296).
