BE IT ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the dedication of a portion of Katie Street, being the full extent of the right-of-way of that street known as Katie Street which is within the boundaries of the tract acquired by Frank Allen Swayze, et ux. From Eva Dell Grigsby Stelle in that Cash Deed of record in Conveyance Book 2148, page 566, under DR# 1522245, records of Ouachita parish, Louisiana, but excepting from the revocation and reserving to the City any and all rights-of-way, easements, servitudes and similar rights of record or of use for the installation, repair and maintenance of existing utilities and utility services, of whatever type or nature, owned or maintained by the City, be and that portion of Katie Street described above is hereby forever revokedand set aside.
SECTION 2. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that this Ordinance and its provisions are to be construed to be severable in regards to any of its provisions, portions or parts, and that in the event any part or portion or provision of this Ordinance should be held invalid, then in such event, such invalidity shall not affect any other provisions, portions, or parts which can be given effect without the invalid provision, and this Ordinance hereby is declared severable.

AN ORDINANCE AUTHORIZING THE FILING OF AN APPLICATION OR APPLICATIONS WITH THE LOUISIANA DEPARTMENT OF TRANSPORTATION AND DEVELOPMENT FOR A GRANT UNDER 49 CFR 5311, NON-URBANIZED AREA FORMULA PROGRAM AND/OR 49 CFR 5309, DISCRETIONARY CAPITAL PROGRAM, TO AID IN THE FINANCING OF OPERATING OR CAPITAL ASSISTANCE PROJECTS, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
WHEREAS, the Secretary of Transportation and Development is authorized to make grants for mass transportation;
WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including the provisions by it of the local share of project costs;
WHEREAS, it is required by the Louisiana Department of Transportation and Development in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance that it will comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and
WHEREAS, it is the goal of the Applicant that minority business enterprise be utilized to the fullest extent possible in connection with this project, and that definitive procedures shall be established and administered to ensure that minority businesses shall have the maximum feasible opportunity to compete for contracts when procuring construction contracts, supplies, equipment, or consultant and other services:
NOW, THEREFORE,
SECTION 1. BE IT ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to execute and file an application on behalf of the City of West Monroe, Louisiana, with the Louisiana Department of Transportation and Development, to aid in the financing of operating and/or capital assistance projects pursuant to the Non-Urbanized Area Formula/Rural Public Transit Program, 49 CFR 5311 and/or the Discretionary Capital Program, 49 CFR 5309.
SECTION 2. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to execute and file with such applications an assurance or any other document required by the Louisiana Development of Transportation and Development effectuating the purposes of Title VI of the Civil Rights Act of 1964, as amended.
SECTION 3. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to furnish such additional information as the Louisiana Department of Transportation and Development may require in connection with the application or the project.
SECTION 4. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to set forth and execute affirmative minority business policies in connection with the project’s procurement needs.
SECTION 5. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to execute grant contract agreements on behalf of the City of West Monroe, Louisiana, with the Louisiana Department of Transportation and Development for aid in the financing of the operating or capital assistance projects.
SECTION 6. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that this Ordinance shall be applicable for a period of one year unless revoked by the City of West Monroe, Louisiana, and a copy of the Ordinance of revocation being furnished to the Louisiana Department of Transportation and Development.
SECTION 7. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to take any action or execute any further documents he deems either necessary or proper to carry out the provisions of the foregoing authorization, and that he is specifically authorized to certify, or to cause to be certified, to the grant of authority provided herein on those standardized forms requested by the State of Louisiana, including but not limited to those examples attached hereto.

AN ORDINANCE AUTHORIZING THE CITY OF WEST MONROE, LOUISIANA TO SELL CERTAIN DESCRIBED MOVABLE PROPERTY WHICH IS NOT NEEDED FOR ANY PUBLIC PURPOSE BY THE CITY OF WEST MONROE, LOUISIANA TO THORNTON, MUSSO AND BELLEMIN COMPANY, INC., AND OTHERWISE PROVIDING WITH RESPECT THERETO.
WHEREAS, the City of West Monroe, Louisiana, owns certain movable property which is not needed for public purposes, and
WHEREAS, Thornton, Musso and Bellemin Company, Inc. wishes to acquire such item for a price which is fair and reasonable, and which sale would be beneficial to the City of West Monroe and its residents.
NOW, THEREFORE:
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the City of West Monroe, Louisiana is hereby authorized to sell certain movable property which is not needed for any public purpose by the City of West Monroe, Louisiana, which property is more particularly described as follows, towit: used, shop built clarifier, previously utilized in a pilot study in approximately 1995- 1996
(The above in “as is” condition) to Thornton, Musso and Bellemin Company, Inc. for the cash sum of TWO HUNDRED AND NO/100 ($200.00) DOLLARS or the costs of required prohibition in order to authorize this sale, whichever is greater, plus any and all costs to dismantle and transport (FOB site).
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to execute a Bill of Sale on behalf of the City of West Monroe, Louisiana, reflecting the price and terms set forth above, and to take any other action or execute any and all other documents deemed by him either necessary or appropriate in order to transfer the above described movable property, all as set forth above.
SECTION 3. AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A COOPERATIVE ENDEAVOR AGREEMENT WITH THE DEPARTMENT OF THE TREASURY, STATE OF LOUISIANA, WITH RESPECT TO THE RECEIPT OF A LINE ITEM APPROPRIATION IN THE AMOUNT OF $50,000.00 FOR DOWNTOWN DEVELOPMENT, AUTHORIZING EXECUTION OF THAT COOPERATIVE ENDEAVOR AGREEMENT, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
WHEREAS, the City of West Monroe is the recipient of a Line Item Appropriate contained in Act 19 in the 2008 Regular Session, the General Appropriations Act of the State of Louisiana, in the amount of $50,000.00; and
WHEREAS, it is required that a comprehensive Cooperative Endeavor Agreement be executed in order to receive funding from that Line Item Appropriation; and
WHEREAS, the monies must be expended for the purpose “Downtown Development”, and the receipt and expenditure of these funds will be beneficial to the City of West Monroe, Louisiana, and its residents.
NOW, THEREFORE:
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, be and he is hereby authorized to enter into a Line Item Appropriation Cooperative Endeavor Agreement by and between the Department of the Treasury, State of Louisiana and the City of West Monroe, Louisiana in order to obtain appropriated funds in the amount of $50,000.00 for the purpose of Downtown Development, the general terms, conditions and provisions of that agreement to be as more fully set forth on the attached Exhibit “A”.
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to take any action or execute any further documents he deems either necessary or proper to carry out the provisions of the foregoing, and to further agree to any modification, clarification or amendment of that Cooperative Endeavor Agreement which is attached as long as any changes are not material or significant variations from the provisions now set out in that agreement.

“Sec. 12-5018. O-L Districts: Open land districts. These districts are composed mainly of large open unsubdivided lands that are vacant or in agricultural or forestry uses. The regulations are designed to protect the essentially open character of the districts, until such time as plans for development are prepared, by prohibiting the establishment of scattered residential, business, industrial and other uses that are unrelated to any general plan of development and that might inhibit the best future urban utilization of the land. It is intended that land in these districts will be reclassified to its appropriate residential, commercial or industrial category in accordance with the amendment procedure set forth herein whenever such land is subdivided into urban building sites.
(a) Permitted uses. In O-L Districts only the following uses are permitted.
(1) Uses by right. The uses listed below are permitted subject to the conditions specified:

The uses listed below are permitted upon approval of the location and site plan thereof by the planning commission as being appropriate with regard to transportation and access, water supply, waste disposal, fire and police protection, and other public facilities, as not causing undue traffic congestion or creating a traffic hazard, and as being in harmony with the orderly and appropriate development of the district in which the use is located:

AN ORDINANCE AUTHORIZING THE EXECUTION OF A SUPPLEMENTAL AGREEMENT NO. 4 BY AND BETWEEN THE STATE OF LOUISIANA DEPARTMENT OF TRANSPORTATION AND DEVELOPMENT AND THE CITY OF WEST MONROE, RELATIVE TO THE TWIN CITIES GATEWAY PROJECT, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
WHEREAS, West Monroe has now received a Supplemental Agreement No. 4 for that grant referred to as the “Twin Cities Gateway Project” (sometimes “Grant”), a joint project and undertaking of the Cities of West Monroe and Monroe; and
WHEREAS, this Supplemental Agreement No. 4 and its proposed improvements are very beneficial to both the City of West Monroe and the City of Monroe, in increasing the grant amount of the project, which provides a positive image to both residents and visitors who enter the cities via the Gateway locations; and
WHEREAS, the Supplemental Agreement No. 4 has certain monetary and other obligations which need to be reaffirmed by West Monroe, and which obligations must be met on a timely basis by West Monroe in order to properly fulfill the provisions of the agreement, a copy of which is attached hereto as Exhibit “A”.
NOW, THEREFORE:
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor, be and he is hereby authorized and empowered to execute said Supplement Agreement No. 4, and to take any action or execute any further documents he deems either necessary or appropriate to carry out the provisions of the foregoing authorization.

AN ORDINANCE AMENDING SECTION 11-4015 OF THE CODE OF ORDINANCES, CITY OF WEST MONROE, LOUISIANA, RELATING TO THE CRIME OF RESISTING AN OFFICER; TO ESTABLISH AN EFFECTIVE DATE FOR SUCH REVISIONS; AND TO OTHERWISE PROVIDE WITH RESPECT THERETO.
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Section 11-4015 of the Code of Ordinances, City of West Monroe, Louisiana, is hereby amended to read as follows:
“Sec. 11-4015. Resisting an officer.
A. The crime of resisting an officer is the intentional interference with, opposition or resistance to, or obstructions of an individual acting in his official capacity and authorized by law to make a lawful arrest, lawful detention, or seizure of property or to serve any lawful process or court order when the offender knows or has reason to know that the person arresting, detaining, seizing property, or serving process is acting in his official capacity.
B. (1) The phrase “obstruction of” as used herein shall, in addition to its common meaning, signification, and connotation mean the following:
(a) Flight by one sought to be arrested before the arresting officer can restrain him and after notice is given that he is under arrest.
(b) Any violence toward or any resistance or opposition to the arresting officer after the arrested party is actually placed under arrest and before he is incarcerated at jail.
(c) Refusal by the arrested or detained party to give his name and make his identity known to the arresting or detaining officer or providing false information regarding the identity of such party to the officer.
(d) Congregation with others on a public street and refusal to move on when order by the officer.
(2) The word “officer” as used herein means any peace officer, as defined in R.S. 40:2402, and includes deputy sheriffs, municipal police officers, probation and parole officers, city marshals and deputies, and wildlife enforcement agents.
C. Whoever commits the crime of resisting an officer shall be fined not more than five hundred dollars or be imprisoned for not more than six months, or both.”
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that for good cause and in the best interests of the City of West Monroe and its residents, this amendment shall be effective on the date following the adoption of this ordinance, i.e., effective December 10, 2008.

CITY SEEKS PARTICIPANTS FOR $450,000.000 BROWNFIELDS CLEANUP REVOLVING LOAN FUND
WEST MONROE, LA, DECEMBER 16, 2008: The City of West Monroe is seeking qualified borrowers to participate in the Brownfields Redevelopment Project. Brownfields are underutilized commercial properties that have great potential, but are held back by environmental issues. The properties may require environmental clean up prior to re-use or development. Sites located within the City can qualify for funding through the U.S. Environmental Protection Agency and the City’s Brownfields Office. Specifically, the City is seeking qualified borrowers to tap into the $450,000.00 Revolving Loan Fund available for environmental remediation of petroleum-contaminated sites.
