All bids must be accompanied by bid security equal to five percent (5%) of the base bid and all additive alternates, and must be in the form of a certified check, cashier’s check or bid bond written by a company licensed to do business in Louisiana, countersigned by a person who is under contract with the surety company or bond issuer as a licensed agent in this State and who is residing in this state. NO Bid Bond indicating an obligation of less than five percent (5%) by any method is acceptable.
The successful Bidder will be required to furnish a performance and payment bond written by a company licensed to do business in Louisiana, and shall be countersigned by a person who is contracted with the surety company or bond issuer as agent of the company or issuer, and who is licensed as an insurance agent in this State, and who is residing in this State, in an amount equal to the 100% of the contract amount.
No bid may be withdrawn for a period of thirty (30) days after receipt of bids, except under the provisions of ACT 111 of 1983.

NOTICE is hereby given by the Mayor and Board of Alderman of the City of West Monroe, Louisiana, in accordance with Louisiana Revised Statutes, Title 33, Section 4712, that the proposed ordinance 3777 attached hereto as Exhibit "A" was introduced at the regular meeting of the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, on the 11th day of November, 2008, and will be considered for adoption at the regular meeting of the Mayor and Board of Aldermen on the 9th day of December, 2008, at 7:00 p.m. City Council Chambers, West Monroe City Hall, 2305 North Seventh Street, West Monroe, Louisiana. AN ORDINANCE AUTHORIZING THE CITY OF WEST MONROE, LOUISIANA TO SELL CERTAIN DESCRIBED IMMOVABLE PROPERTY WHICH IS NOT NEEDED FOR ANY PUBLIC PURPOSE BY THE CITY OF WEST MONROE, LOUISIANA TO DARBONNE SUNRISE ENTERPRISES, INC., FOR THE CASH SUM OF $290,000.00, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
WHEREAS, the City of West Monroe, Louisiana, owns certain immovable property which is not needed for public purposes, and WHEREAS, the price offered, and the terms and conditions provided for the purchase of that property is fair and reasonable, and the sale and development of that immovable property will be beneficial to the City of West Monroe and its residents.
NOW, THEREFORE:
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the City of West Monroe, Louisiana (“CITY”) is hereby authorized to sell certain immovable property which is not needed for any public purpose by the City of West Monroe, Louisiana, which property is more particularly described as follows, to-wit:
Lot 6 of West Monroe Commercial Park Subdivision, of record in Plat Book 19, Page 143, records of Ouachita Parish, Louisiana.
to DARBONNE SUNRISE ENTERPRISES, INC., or its approved successors or assigns, (“BUYER”) for and in consideration of the cash sum of TWO HUNDRED NINETY THOUSAND AND NO/100 ($290,000.00) DOLLARS, under the terms and conditions of that Standard Retail Purchase Contract to be entered into between the City and the Purchaser, and subject to the following conditions:
a) Subject to any and all development restrictions of record, and all rights-ofway
and/or servitudes of record or of use; and
b) CITY reserves and excludes from this conveyance any and all right, title and interest in and to any and all oil, gas and other minerals in, on or under the property, all of such interests being expressly reserved by CITY without any warranty whatsoever from or by BUYER; provided, however, that CITY expressly waives any and all surface rights in and to the Property resulting from this reservation; and CITY may not exercise any rights it may have in and to such oil, gas and other minerals in such a fashion that CITY’s right to the use of the surface of the property is disturbed so as to have a substantial negative impact on the operation of any business located upon the property.
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to execute a Deed on behalf of the City of West Monroe, Louisiana, reflecting the price and terms set forth above, and to take any other action or execute any and all other documents deemed by him either necessary or appropriate in order to transfer the above described immovable property as set forth above, including but not limited to including a provision, whether in the deed or in a supplemental agreement, that limits the nature of the initial construction and operation of the business to be located on that property to certain types of activities that requires the construction to be initiated within a certain time and/or pursued in a commercially reasonable manner through to completion by a certain date, together with such other requirement and provisions as he deems appropriate, including a provision that provides for a right and option in favor of the City of West Monroe to re-acquire the property at the same price if such conditions are not timely met or to provide for liquidated damages or other consideration payable to the City of West Monroe in lieu of such reacquisition, the terms, conditions or provisions of all of such conditions to be as determined appropriate by the Mayor; and is further authorized to obligate the CITY to undertake certain specifically described drainage improvements.
SECTION 3. The above ordinance was introduced on November 11, 2008, in regular and legal session convened; notice of this ordinance was published three times in fifteen (15) days, one week apart, as required by R.S. 33:4712; no opposition being filed, it is considered by sections, voted on by yea and nay vote, passed and adopted in regular and legal session convened this 9th day of December, 2008, with the final vote being as follows:

AN ORDINANCE AUTHORIZING THE CITY OF WEST MONROE, LOUISIANA, TO APPLY FOR AND, IF AWARDED, TO ENTER INTO A GRANT AGREEMENT RELATING TO SPONSORSHIP OF THE NORTHEAST LOUISIANA CELTIC FESTIVAL WITH THE STATE OF LOUISIANA, DEPARTMENT OF CULTURE, RECREATION AND TOURISM, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
WHEREAS, the City of West Monroe, Louisiana, its residents and others in the area will both utilize and benefit from the City’s development, sponsorship and/or promotion of the Northeast Louisiana Celtic Festival, now tentatively planned for October 24-25, 2009 at the Ike Hamilton Expo Center, West Monroe, Louisiana, further recognizing that the effect of such an event will stimulate economic development in Louisiana, and develop and promote local cultural programs and promote our cultural economy.
NOW, THEREFORE,

BE IT ORDAINED by the Mayor and Board of Alderman of the City of West Monroe, Louisiana, in special and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized on behalf of the City of West Monroe, Louisiana, to apply for and, if awarded, to enter into a grant agreement in an amount up to $10,000.00 with the State of Louisiana Department of Culture, Recreation and Tourism under the Competitive Sponsors Program, all according to the terms and provisions required by the award of that grant and/or as to be provided by the terms, conditions and provisions of a formal grant agreement;
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Alderman of the City of West Monroe, Louisiana, in special and legal session convened, that Dave Norris, Mayor, be and he is hereby authorized on behalf of the City of West Monroe, Louisiana, to execute any and all further documents determined by him to either necessary or desirable in connection with the
receipt of the grant and, if awarded, any grant agreement, and to further do and perform any and all other matters and take any and all other actions in order to fulfill the terms and conditions of any grant agreement awarded.

Notice is given that the Mayor and Board of Aldermen will hold a public meeting to discuss the 2009 Budget figures and the 2008 Budget amendments. Both Budgets are available for viewing during normal Town Hall business hours. The public meeting will be held Tuesday, December 16, 2008, at 6:30 p.m. at the Town Hall located at 503 Highway 2, Sterlington, Louisiana. Everyone is urged to attend.
The date for possible adoption of the Budget Ordinance is scheduled for Tuesday, December 30, 2008 at 6:30 p.m. at the Town Hall.

MINUTES OF THE SPECIAL MEETING OF THE WEST MONROE CITY COUNCIL
NOVEMBER 25, 2008
There was a Special Meeting of the West Monroe City Council held on Tuesday, November 25, 2008, at 9:00 a.m. in the Council Chambers of the West Monroe City Hall.
Those present were Mayor Dave Norris, Aldermen L. O. Yeager, Alice Pearson, James Bennett and James Brian. Absent: Fred Ragland.
There was a motion by Mrs. Pearson, seconded by Mr. Bennett and unanimously carried to approve an ordinance to authorize the application for the creation of the West Monroe Cultural District. Ordinance 3779:
AN ORDINANCE IN SUPPORT OF AND AUTHORIZING AN APPLICATION FOR THE CREATION OF THE WEST MONROE CULTURAL DISTRICT, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
There was a motion by Mrs. Pearson, seconded by Mr. Yeager and unanimously carried to approve an ordinance to authorize an application and, if awarded, execution of a grant agreement with the Louisiana Department of Culture, Recreation and Tourism (Northeast Louisiana Celtic Festival). AN ORDINANCE IN SUPPORT OF AND AUTHORIZING AN APPLICATION FOR THE CREATION OF THE WEST MONROE CULTURAL DISTRICT, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
WHEREAS, Act 298 of the 2007 Regular Session of the Louisiana Legislature authorizes Local Governing Authorities to create Cultural Districts as a mechanism for community revitalization through the creation of hubs of cultural activity; and
WHEREAS, the Louisiana Department of Culture, Recreation and Tourism, Office of Cultural Development is authorized to develop standard criteria for cultural districts and to determine whether or not a proposed Cultural District meets those criteria; and
WHEREAS, the Louisiana Department of Culture, Recreation and Tourism, Office of Cultural Development has promulgated administrative rules which set forth the procedure for Local Governing Authorities to submit applications to designate and certify a specified geographic area as a Cultural District; and
WHEREAS, a geographic area within the City of West Monroe, Parish of Ouachita, may meet the criteria for the creation of a Cultural District and which area is generally comprised of the territory within the following boundaries:

WHEREAS, within the boundaries of a state-certified Cultural District, several tax incentives may be available including (1) a sales tax exemption on the sale of certain original works of art, (2) individual income tax credits for eligible expenses incurred during the rehabilitation of certain owner-occupied residential or owner-occupied mixed use structures, and (3) income and corporate franchise tax credits for eligible expenses incurred during the rehabilitation of certain historic structures; and
WHEREAS, only a Local Governing Authority is authorized to submit an application for the designation and certification of a Cultural District; and
WHEREAS, a "Local Governing Authority" is defined by LAC 25:I§1101 as "the governing authority of the parish in which the Cultural District is located unless the district is located in a municipality, in which case "Local Governing Authority" shall mean the governing authority of the municipality; and
WHEREAS, the proposed West Monroe Cultural District is located entirely within the municipality of the City of West Monroe and therefore the City of West Monroe would be the proper entity to submit an application for the certification and designation of the above described geographic area as a Cultural District.
NOW, THEREFORE,
SECTION 1. BE IT ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in special and legal session convened, that the City of West Monroe does hereby does hereby:
1. Support and endorse the submission of an application to the Louisiana Department of Culture, Recreation and Tourism, Office of Cultural Development to designate the West Monroe Cultural District as a state-certified Cultural District, with the following boundaries, to-wit:

2. Authorize the Mayor of the City of West Monroe to submit such application and all supporting documents, reports, and other forms required for the creation,
administration and reporting regarding the proposed West Monroe Cultural District as he determines are required in order to make application and/or to effect the establishment and operation of that Cultural District.
3. Direct all employees of the City of West Monroe to support and cooperate with efforts to compile all necessary information and data required for the application and all subsequent reporting necessary for the administration of the West Monroe Cultural District.
4. Request all affected citizens and businesses to support and promote activities consistent with the purposes of the West Monroe Cultural District.
5. Authorize the Mayor of the City of West Monroe to sign any and all other documents required and to take any and all other actions necessary or desirable for the creation and administration of the West Monroe Cultural District.

OUACHITA PARISH POLICE JURY
FLOODPLAINS NOTICE
NOTICE OF EXPLANATION
The Ouachita Parish Police Jury intends to carry out an action which in part may affect or be affected by the 100 year flood plain and seeks to involve the public in the decision making process. The Parish is implementing an FY 2008 Louisiana Community Development Block Grant for street improvements. A large portion of the project area is located within the 100 Year Flood Plain, and this review is conducted in compliance with Executive Orders 11988 and 11990. It is the judgement of the Parish that the benefits of the project outweigh consideration of the Executive Order 11988 and 11990.
The proposed improvements to the streets conform to all applicable State and Federal floodplain protection standards. The other agency involved in this project is the U.S. Department of Housing and Urban Development. It has been determined that there is no feasible alternative to this project. The Parish has not received comments relative to this proposal during the 15 day comment period following a notice published in this newspaper on October 16, 2008, and therefore the Parish will proceed with the project.
The project file with details available is located at the Ouachita Parish Police Jury, 300 Saint John Street, Monroe, Louisiana. The information may be examined Monday thru Friday from 8:00 a.m. to 2:00 p.m. Comments may be submitted in person or mailed to the Ouachita Parish Police Jury, Post Office Box 3007, Monroe, LA 71210-3007.
