NOTICE TO BIDDERS
2008 DeltaFest
2009 Twin Cities’ Krewe of Janus Mardi Gras Parade
The Monroe-West Monroe Convention & Visitors Bureau is accepting proposals for an out-of-state advertising package for the 2008 DeltaFest and the 2009 Twin Cities’ Krewe of Janus Mardi Gras Parade in accordance with the provisions of LSA-R.W.33:4712. Sealed bid proposals will be accepted in the office of Alana Cooper, Executive Director, Monroe-West Monroe Convention and Visitors Bureau, 601 Constitution Drive, West Monroe, LA 71292, no later than 10:00 a.m. on Friday, August 08, 2008. After the bid opening the bidders will be requested to make a bid presentation to the bid committee sometime between August 11 and August 15, 2008.
The proposal will be for the maximum amount of advertisement of any configuration at the bidder’s discretion in the out-of-state regional markets of Mississippi and Arkansas plus development of the advertisement from previous footage for a total sum of $20,000 (Twenty Thousand Dollars) per event. The total sum of the advertising package is $40,000 (Forty Thousand Dollars). Advertising dates are available by calling 318-387-5691.
The Monroe-West Monroe Convention and Visitors Bureau reserve the right to reject any and all bids.

MINUTES OF THE REGULAR MEETING OF THE WEST MONROE CITY COUNCIL
JULY 8, 2008
There was a regular meeting of the West Monroe City Council held on Tuesday, July 8, 2008, at 7:00 p.m. in the Council Chambers of the West Monroe City Hall.
Those present were Mayor Dave Norris, Aldermen L. O. Yeager, Alice Pearson, James Bennett, James Brian and Fred Ragland.
The invocation was offered by Mr. L. O. Yeager, Alderman.
There was a motion by Mr. Bennett, seconded by Mrs. Pearson and unanimously carried to approve the minutes of the June 10, 2008, Regular Council Meeting.
There was a motion by Mrs. Pearson, seconded by Mr. Yeager and unanimously carried to approve payment of the June 2008 billings, subject to audit by the Finance Committee.
There was a motion by Mrs. Pearson, seconded by Mr. Brian and unanimously carried to approve the appointment of Mr. James W. Bennett as Mayor Pro Tempore.
There was a motion by Mrs. Pearson, seconded by Mr. Yeager and unanimously carried to table until the August 2008 regular council meeting an ordinance to annex property located at 528 Thomas Road owned by KEL Investment Properties, L.L.C./Hydra Tech Systems, Inc. into the municipal limits of the City of West Monroe, Louisiana. Received a favorable review from the Planning Commission (tabled from June).
There was a motion by Mrs. Pearson, seconded by Mr. Yeager and unanimously carried to table until the August 2008 regular council meeting, an ordinance to re-zone property located at 528 Thomas Road, from an O-L (Open Land) District to an I-1 (Light to Heavy Industrial) District. There was a motion by Mr. Yeager, seconded by Mrs. Pearson and unanimously carried to approve a resolution to adopt Residential Antidisplacement Policy, Section 504 Grievance Procedure and Section 504 Assurance. (LCBG requirement). Resolution 578:
A RESOLUTION ADOPTING A RESIDENTIAL ANTIDISPLACEMENT AND RELOCATION ASSISTANCE PLAN, A SECTION 504 GRIEVANCE PROCEDURE AND AUTHORIZING THE ISSUANCE OF A CERTIFICATION OF COMPLIANCE, AND OTHERWISE PROVIDING WITH RESPECT THERETO.

ORDINANCE NO. 3742

AN ORDINANCE AUTHORIZING THE CITY OF WEST MONROE, LOUISIANA TO SELL CERTAIN DESCRIBED IMMOVABLE PROPERTY WHICH IS NOT NEEDED FOR ANY PUBLIC PURPOSE BY THE CITY OF WEST MONROE, LOUISIANA TO KMK PROPERTIES, L.L.C., OR ITS ASSIGNS, FOR THE CASH SUM OF $11,500.00, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
WHEREAS, the City of West Monroe, Louisiana, owns certain immovable property which is not needed for public purposes, and
WHEREAS, the price offered, and the terms and conditions provided for the purchase of that property is fair and reasonable, and the intended sale and development of that immovable property will be beneficial to the City of West Monroe and its residents.
NOW, THEREFORE:
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the City of West Monroe, Louisiana is hereby authorized to sell certain immovable property which is not needed for any public purpose by the City of West Monroe, Louisiana, which property is more particularly described as follows, to-wit:
A certain tract or parcel of land being situated in Lot No 9 of West Monroe Commercial Park Subdivision, situated in Sections 29, 32 & 33, Township 18 North, Range 3 East, Ouachita Parish, Louisiana, recorded in Plat Book 20, Page 108, records of Ouachita Parish, Louisiana, and being more particularly described as follows:
Commence at a1/2” Rebar found marking the Southwest Corner of Lot No. 8 of the Resubdivision of Lots No. 4,5,6, 7 and 8 of West Monroe Commercial Park Subdivision, situated in Sections 29, 32 & 33, Township 18 North, Range 3 East, Ouachita Parish, Louisiana, recorded in Plat Book 20, Page 176, records of Ouachita Parish, Louisiana (said point also being on the East line of Lot No. 9 of West Monroe Commercial Park Subdivision, situated in Sections 29, 32 & 33, Township 18 North, Range 3 East, Ouachita Parish, Louisiana, recorded in Plat Book 19, Page 143, records of Ouachita Parish, Louisiana), for the POINT OF BEGINNING, thence proceed South 00 degrees 17 minutes 44 minutes West, a distance of 67.07 feet, more or less, to a set 5/8” rebar at the northwest corner of Lot 12; thence proceed North 24 degrees 38 minutes 33 seconds West a distance of 301.72 feet, more or less, to the Northeast corner of said Lot No. 9; thence proceed South 31 degrees 20 minutes 15 seconds East along the East line of said Lot No. 9, a distance of 242.56 feet to the
POINT OF BEGINNING, and containing 4,266 Square Feet, more or less, and being subject to all rights of way, easements and servitudes of record and or use. to KMK Properties, L.L.C., or its assigns, for and in consideration of the cash sum of ELEVEN THOUSAND, FIVE HUNDRED AND NO/100 ($11,500.00) DOLLARS, subject to the following conditions:
a) Subject to any and all development restrictions of record, and all rights-of way and/or servitudes of record or of use;
b) City reserves all oil, gas and other fugacious minerals in, on and under the above described property, but City, on behalf of itself, its successors, lessees, and assigns, expressly waives the right to enter upon, utilize or occupy any portion of the above described property for any mineral exploration or development; and
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to execute a Deed on behalf of the City of West Monroe, Louisiana, reflecting the price and terms set forth above, and to take any other action or execute any and all other documents deemed by him either necessary or appropriate in order to transfer the above described immovable property as set forth above, including but not limited to including a provision, whether in the deed or in a supplemental agreement, that limits them nature of the initial construction and operation of the business to be located on that property to certain types of activities for a minimum number of years, that requires the construction to be initiated within a certain time and pursued in a commercially reasonable manner through to completion, together with such other requirement and provisions as he deems appropriate, including a provision that provides for a right and option in favor of the City of West Monroe to re-acquire the property at the same price if such conditions are not timely met or to provide for liquidated damages payable to the City of West Monroe in lieu of such reacquisition, the terms, conditions or provisions of all of such conditions to be as determined appropriate by the Mayor.
SECTION 3. The above ordinance was introduced on June 10, 2008, in regular and legal session convened; notice of this ordinance was published three times in fifteen (15) days, one week apart, as required by R.S. 33:4712; no opposition being filed, it is considered by sections, voted on by yea and nay vote, passed and adopted in legal session convened this 8th day of July, 2008, with the final vote being as follows:

WATKINS, JR., MARY JILL WATKINS BURTNER AND WILLIAM BENTON WATKINS, SAID TERRITORY BEING CONTIGUOUS TO THE EXISTING BOUNDARIES OF THE MUNICIPALITY; TO RETAIN ANY LAWS OR ORDINANCES NOT REPUGNANT HERETO AND NOT SPECIFICALLY REPEALED HEREIN; AND TO PROVIDE THAT IF ANY SUB-SECTION, ARTICLE, CLAUSE, SENTENCE, PHRASE, OR PART, OR APPLICATION OF THIS ORDINANCE FOR ANY REASON SHOULD BE FOUND UNCONSTITUTIONAL OR INVALID, NO OTHER PARTS AND/OR APPLICATIONS THEREOF SHALL BE AFFECTED.
WHEREAS, Louisiana Revised Statutes of 1950, Title 33, Section 171 et seq., as amended, provides for the procedure for annexation of territory into the corporate limits of a municipality; and,
WHEREAS, by Ordinance Number 1646, adopted June 14, 1977, now codified in Sec. 1- 2002 and 1-2003 of the Code of Ordinances of the City of West Monroe, Louisiana adopted by reference the provisions of R.S. 33:171 et seq., as amended from time to time by the Louisiana Legislature, in addition to vesting certain authority pertaining thereto in the Planning Commission of the City of West Monroe, Louisiana; and,
WHEREAS, there has been compliance with the procedure required by R.S. 33:171 et seq., as amended, and Ordinance Number 1646 of the City of West Monroe, including but not limited to the following:
a) A Petition (see Exhibit "1") has been presented to the Mayor and Board of Aldermen of the City of West Monroe, Louisiana by EDWIN M. WATKINS, JR., MARY JILL WATKINS BURTNER and WILLIAM BENTON WATKINS, requesting that property owned by petitioners and located at 1013 Hicks Street, West Monroe, Louisiana, which property is owned by EDWIN M. WATKINS, JR., MARY JILL WATKINS BURTNER and WILLIAM BENTON WATKINS, said property being contiguous to the existing boundaries of the City of West Monroe, Louisiana and consisting of acreage owned by EDWIN M. WATKINS, JR., MARY JILL WATKINS BURTNER and WILLIAM BENTON WATKINS (and more particularly shown by vicinity map attached hereto as Exhibit "2" and more particularly described in Exhibit "3" hereto) be annexed into the corporate limits of the City of West Monroe, Louisiana;
b) A certificate of the Ouachita Parish Assessor is attached hereto as Exhibit "4" certifying that according to assessment for property taxes for 2008 the property described in Exhibit "3" is owned by both a majority of the number of property owners and the owners of more than a majority in value of that property, and the total property tax assessment for parish taxes for 2008 is in the amount of $148.00, of which the amount of $148.00 represents the value of property owned by the persons signing the petition for annexation;
c) A certificate of the Ouachita Parish Registrar of Voters is attached hereto as Exhibit "5" certifying that according to the records of the Registrar of Voters there are no registered voters residing within the territory described in Exhibit "3";
d) Proof of publication of the filing of the petition, as required by R.S.
33:172B, and of a public hearing by the West Monroe Planning Commission concerning that petition of EDWIN M. WATKINS, JR., MARY JILL WATKINS BURTNER and WILLIAM BENTON WATKINS, for annexation is attached hereto as Exhibit "6";
e) Pursuant to notice as evidenced by Exhibit "6", the West Monroe Planning Commission on the 16 day of June, 2008, held a public th hearing regarding said petition for annexation by EDWIN M. WATKINS, JR., MARY JILL WATKINS BURTNER and WILLIAM BENTON WATKINS, resulting in the recommendation to the West Monroe Board of Aldermen that the property described in Exhibit "3" be annexed into the corporate limits of the City of West Monroe, Louisiana;
f) Pursuant to that notice required by law, the West Monroe Board of Aldermen on the 8 day of July, 2008, held a public hearing regarding th said petition for annexation by EDWIN M. WATKINS, JR., MARY JILL WATKINS BURTNER and WILLIAM BENTON WATKINS.
WHEREAS, following said hearing by the Mayor and Board of Aldermen and after careful consideration of all recommendations, comments, and objects made at said hearing the Mayor and West Monroe Board of Aldermen declare that it is in the best interest of the City of West Monroe to annex into the corporate limits of the City of West Monroe the property described in Exhibit "3".
NOW THEREFORE,
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the property owned by EDWIN M. WATKINS, JR., MARY JILL WATKINS BURTNER and WILLIAM BENTON WATKINS, and contiguous to the existing boundaries of the corporate limits and located in the vicinity as shown by the map attached hereto as Exhibit "2" and more particularly described in Exhibit "3" be annexed into the corporate limits of the City of West Monroe, Louisiana.
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the Mayor of the City of West Monroe, Louisiana, or his designee, be and they shall hereby be authorized to take all further actions and execute all further documents, resolutions and/or certifications as are required under R.S. 33:171, et seq., or other applicable law, as are necessary, proper or desirable, particularly including but not limited to the filing of the entire boundary of the municipality as changed in order that the annexation of property set forth above be effected at the earliest possible date.
SECTION 3. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that all Ordinances or parts of Ordinances in conflict herewith hereby are repealed, but this repeal shall be only insofar as such Ordinances conflict and/or are inconsistent with this Ordinance; and all Ordinances or parts of Ordinances not inconsistent herewith shall continue in full force and effect.
SECTION 4. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the
City of West Monroe, Louisiana, in regular and legal session convened, that the articles, paragraphs, sentences, clauses, and phrases of this Ordinances are deemed to be severable, and if any sub-section, article, clause, sentence, phrase, or part of this Ordinance shall be declared to be unconstitutional and/or invalid, such unconstitutionality and/or invalidity shall not affect any of the remaining articles, sentences, paragraphs, clauses or phrases which can be given effect without the unconstitutional and/or invalid provision(s).

A RESOLUTION STATING THE CITY OF WEST MONROE’S ENDORSEMENT OF AUTO BODY SPECIALIST, INC., AND THEIR PROJECT, EXPANSION OF AUTO BODY SPECIALIST, PROJECT # 20080729, TO PARTICIPATE IN THE BENEFITS OF THE LOUISIANA ENTERPRISE ZONE PROGRAM.
WHEREAS, the Louisiana Enterprise Zone Act of 1981 was established by Act 901 of the 1981 Louisiana State Legislature, and was thereafter amended by Act 337 of the 1982 Legislature and Act 433 of the 1987 legislature, and
WHEREAS, the Louisiana Enterprise Zone Program offers significant incentives for economic development in the City of West Monroe, and
WHEREAS, the Louisiana Department of Economic Development designated CT 58 BG 1 the City of West Monroe as “Enterprise Zone” eligible, based on demographic and economic factors, and
WHEREAS, the attached map is marked showing the location of the business being endorsed, and
WHEREAS, in accordance with the Louisiana Enterprise Zone Program requirements, the City of West Monroe agrees:
1. If approached by an industry who would assume all costs involved, to apply with the U.S. Department of Commerce to have the Enterprise Zone area declared to be a free trade zone.
2. To devise and implement a program to improve police protection within the zone or zones.
3. To give priority to the use in the zone or zones of any UDAG or CETA or CDBG funds received from the federal government.
4. To provide assistance to the Louisiana Department of Economic Development in certifying employers to be eligible for the benefits of this program. This would include verification of the location of the business, number of employees, and other verification that would have to be made at the local level.
5. To refund local sales taxes on the purchase of the material used in the construction of a building, or any addition or improvement thereon, for housing any legitimate business enterprise, and machinery and equipment used in that enterprise. This tax refund would be on materials, construction and equipment purchased for the startup of this project and used by that business permanently on that site.
6. To cooperate with the Department in reviewing certain local regulations which may serve to discourage economic development within the enterprise zone.
7. To assist the Department in evaluating progress made in any enterprise zone within its jurisdiction. This would entail a comparative analysis of conditions in the zone prior to designation (number of workers Exhibit "4" certifying that according to assessment for property taxes for 2008 the property described in Exhibit "3" is owned by both a majority of the number of property owners and the owners of more than a majority in value of that property, and the total property tax assessment for parish taxes for 2008 is in the amount of $148.00, of which the amount of $148.00 represents the value of property owned by the persons signing the petition for annexation;
c) A certificate of the Ouachita Parish Registrar of Voters is attached hereto as Exhibit "5" certifying that according to the records of the Registrar of Voters there are no registered voters residing within the territory described in Exhibit "3";
d) Proof of publication of the filing of the petition, as required by R.S.
33:172B, and of a public hearing by the West Monroe Planning Commission concerning that petition of EDWIN M. WATKINS, JR., MARY JILL WATKINS BURTNER and WILLIAM BENTON WATKINS, for annexation is attached hereto as Exhibit "6";
e) Pursuant to notice as evidenced by Exhibit "6", the West Monroe Planning Commission on the 16 day of June, 2008, held a public th hearing regarding said petition for annexation by EDWIN M. WATKINS, JR., MARY JILL WATKINS BURTNER and WILLIAM BENTON WATKINS, resulting in the recommendation to the West Monroe Board of Aldermen that the property described in Exhibit "3" be annexed into the corporate limits of the City of West Monroe, Louisiana;
f) Pursuant to that notice required by law, the West Monroe Board of Aldermen on the 8 day of July, 2008, held a public hearing regarding th said petition for annexation by EDWIN M. WATKINS, JR., MARY JILL WATKINS BURTNER and WILLIAM BENTON WATKINS.
WHEREAS, following said hearing by the Mayor and Board of Aldermen and after careful consideration of all recommendations, comments, and objects made at said hearing the Mayor and West Monroe Board of Aldermen declare that it is in the best interest of the City of West Monroe to annex into the corporate limits of the City of West Monroe the property described in Exhibit "3".
NOW THEREFORE,
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the property owned by EDWIN M. WATKINS, JR., MARY JILL WATKINS BURTNER and WILLIAM BENTON WATKINS, and contiguous to the existing boundaries of the corporate limits and located in the vicinity as shown by the map attached hereto as Exhibit "2" and more particularly described in Exhibit "3" be annexed into the corporate limits of the City of West Monroe, Louisiana.
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the Mayor of the City of West Monroe, Louisiana, or his designee, be and they shall hereby be authorized to take all further actions and execute all further documents, resolutions and/or certifications as are required under R.S. 33:171, et seq., or other applicable law, as are necessary, proper or desirable, particularly including but not limited to the filing of the entire boundary of the municipality as changed in order that the annexation of property set forth above be effected at the earliest possible date.
SECTION 3. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that all Ordinances or parts of Ordinances in conflict herewith hereby are repealed, but this repeal shall be only insofar as such Ordinances conflict and/or are inconsistent with this Ordinance; and all Ordinances or parts of Ordinances not inconsistent herewith shall continue in full force and effect.
SECTION 4. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the
City of West Monroe, Louisiana, in regular and legal session convened, that the articles, paragraphs, sentences, clauses, and phrases of this Ordinances are deemed to be severable, and if any sub-section, article, clause, sentence, phrase, or part of this Ordinance shall be declared to be unconstitutional and/or invalid, such unconstitutionality and/or invalidity shall not affect any of the remaining articles, sentences, paragraphs, clauses or phrases which can be given effect without the unconstitutional and/or invalid provision(s).

AN ORDINANCE AMENDING AND RE-ENACTING THE ZONING ORDINANCE OF THE CITY OF WEST MONROE, LOUISIANA, PARTICULARLY THE ZONING MAP ANNEXED TO AND MADE A PART OF ORDINANCE NO. 1501, AS THAT ZONING MAP, AS CODIFIED BY SECTION 12-5011(C) OF THE CODE OF ORDINANCES, CITY OF WEST MONROE, LOUISIANA, HAS BEEN FROM TIME TO TIME AMENDED, AND PARTICULARLY TO AMEND THAT ZONING MAP AS IT PERTAINS TO PROPERTY LOCATED AT 1013 HICKS STREET, AS MORE PARTICULARLY DESCRIBED ON THE ATTACHED EXHIBIT “A”, PURSUANT TO THE APPLICATION OF EDWIN M. WHEREAS, the Mayor and Board of Aldermen of the City of West Monroe have held a public hearing and given public notice to the extent required by law.
NOW, THEREFORE,
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Zoning Ordinance No. 1501, as amended, and as codified in Sections 12-5001 et seq. of the Code of Ordinances, City of West Monroe, Louisiana, particularly the Zoning Map of the City of West Monroe, Louisiana, as that Zoning Map, as codified by Section 12-5011(C) of the Code of Ordinances, City of West Monroe, Louisiana, has been from time to time amended, be further amended and re-enacted to re-zone property located at 1013 Hicks Street, more particularly described on the attached Exhibit "A", from an O-L (Open Land) District to a R-1 (One Family Residential) District, pursuant to the application of Edwin M. Watkins, Jr., Mary Jill Watkins Burtner and William Benton Watkins.
SECTION 2. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the City Engineer of the City of West Monroe, Louisiana, or any person in lieu thereof to be designated by the Mayor, be and he is hereby authorized and directed to do and perform any and all things necessary to carry out the foregoing change, and particularly to note said change on the Zoning Map as herein re-enacted.
SECTION 3. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that this Ordinance and its provisions are to be construed to be severable in regards to any of its provisions, portions or parts, and that in the event any part or portion or provision of this Ordinance should be held invalid, then in such event, such invalidity shall not affect any other provisions, portions, or parts which can be given effect without the invalid provision, and this Ordinance hereby is declared severable.

AN ORDINANCE TO ENLARGE THE CORPORATE LIMITS OF THE CITY OF WEST MONROE, LOUISIANA, PURSUANT TO R.S. 33:171 ET SEQ., AND PARTICULARLY R.S. 33:180, BY ANNEXING TERRITORY BELONGING TO THE CITY OF WEST MONROE, LOUISIANA, SAID PROPERTIES BEING ADJACENT AND CONTIGUOUS TO THE EXISTING BOUNDARIES OF THE CITY OF WEST MONROE, LOUISIANA.
WHEREAS, Louisiana Revised Statutes, Title 33:171 et seq., as amended, provides for the procedure for the annexation of property into the corporate limits of a municipality; and
WHEREAS, Louisiana Revised Statutes, Section 33:180 empowers the governing body of any municipality to enlarge the boundaries of the municipality to include territory in which all the land is owned by said municipality; and

AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF WEST MONROE, LOUISIANA, TO EXECUTE AN AGREEMENT FOR SERVICE WITH JOHNSON CONTROLS, INC. TO PROVIDE AIR CONDITIONING AND HEATING MAINTENANCE AND REPAIR SERVICES AT THE IKE HAMILTON EXPO CENTER, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to execute on behalf of the City of West Monroe, Louisiana, a Service Agreement with Johnson Controls, Inc. to provide air conditioning and heating maintenance and repair services at the Ike Hamilton Expo Center, all generally in accordance with the terms and provisions of that Service Agreement which is attached as Exhibit “A”.
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby further authorized to further negotiate the terms and provisions of that Service Agreement regarding the automatic renewal of its term of service, required arbitration, and other provisions not significantly or materially increasing its cost; and to take any and all actions and to execute that Service Agreement and any and all further documents he deems either necessary or proper to carry out the activities arising out of that Service Agreement described above according to its terms and its intent.

A RESOLUTION STATING THE CITY OF WEST MONROE’S ENDORSEMENT OF AUTO BODY SPECIALIST, INC., AND THEIR PROJECT, EXPANSION OF AUTO BODY SPECIALIST, PROJECT # 20080729, TO PARTICIPATE IN THE BENEFITS OF THE LOUISIANA ENTERPRISE ZONE PROGRAM.
WHEREAS, the Louisiana Enterprise Zone Act of 1981 was established by Act 901 of the 1981 Louisiana State Legislature, and was thereafter amended by Act 337 of the 1982 Legislature and Act 433 of the 1987 legislature, and
WHEREAS, the Louisiana Enterprise Zone Program offers significant incentives for economic development in the City of West Monroe, and
WHEREAS, the Louisiana Department of Economic Development designated CT 58 BG 1 the City of West Monroe as “Enterprise Zone” eligible, based on demographic and economic factors, and
WHEREAS, the attached map is marked showing the location of the business being endorsed, and
WHEREAS, in accordance with the Louisiana Enterprise Zone Program requirements, the City of West Monroe agrees:
1. If approached by an industry who would assume all costs involved, to apply with the U.S. Department of Commerce to have the Enterprise Zone area declared to be a free trade zone.
2. To devise and implement a program to improve police protection within the zone or zones.
3. To give priority to the use in the zone or zones of any UDAG or CETA or CDBG funds received from the federal government.
4. To provide assistance to the Louisiana Department of Economic Development in certifying employers to be eligible for the benefits of this program. This would include verification of the location of the business, number of employees, and other verification that would have to be made at the local level.
5. To refund local sales taxes on the purchase of the material used in the construction of a building, or any addition or improvement thereon, for housing any legitimate business enterprise, and machinery and equipment used in that enterprise. This tax refund would be on materials, construction and equipment purchased for the startup of this project and used by that business permanently on that site.
6. To cooperate with the Department in reviewing certain local regulations which may serve to discourage economic development within the enterprise zone.
7. To assist the Department in evaluating progress made in any enterprise zone within its jurisdiction. This would entail a comparative analysis of conditions in the zone prior to designation (number of workers employed there and businesses) and conditions some time after designation (six months or a year, or later).
8. To keep the Department informed whenever changes occur within the zone, i.e., an establishment goes out of business, is destroyed by fire, flood, or is otherwise closed, new development takes place with the infrastructure (streets and similar improvements), changes in local development codes that may affect the zone.
NOW, THEREFORE
SECTION 1. BE IT RESOLVED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Auto Body Specialist, Inc. and their project, Expansion of Auto Body Specialist, Project # 20080729 is endorsed by the City of West Monroe, Louisiana to participate in the Louisiana Enterprise Zone Program.
SECTION 2. BE IT FURTHER RESOLVED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this resolution which can be given effect without the invalid provisions, items or applications and to this end the provisions of this resolution are hereby declared severable.

A RESOLUTION ADOPTING A RESIDENTIAL ANTIDISPLACEMENT AND RELOCATION ASSISTANCE PLAN, A SECTION 504 GRIEVANCE PROCEDURE AND AUTHORIZING THE ISSUANCE OF A CERTIFICATION OF COMPLIANCE, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
WHEREAS, the City of West Monroe has received approval of a Louisiana Community Development Block Grant Program ED for fiscal year FY-2008; and
WHEREAS, the LCDBG Program requires all grant recipients adopt a Residential Antidisplacement and Relocation Assistance Plan, and other requirements, including providing certain certifications.
WHEREAS, the LCDBG Program also requires that all grant recipients adopt a Section 504 Grievance Procedure and provide a Section 504 Assurance that all activities under the grant will be operated in compliance with the requirements of Section 504 of the Rehabilitation Act of 1973, as amended.
NOW, THEREFORE:
SECTION 1. BE IT RESOLVED by the Mayor and Board of Aldermen on the City of West Monroe, Louisiana, in regular and legal session convened, that the City of West Monroe, Louisiana adopts a Residential Antidisplacement and Relocation Assistance Plan under Section 104 (d) of the Housing and Community Development Act of 1974, as amended, all as more fully set forth on the attached Exhibit “A”.
SECTION 2. BE IT FURTHER RESOLVED by the Mayor and Board of Aldermen on the City of West Monroe, Louisiana, in regular and legal session convened, that the City of West Monroe, Louisiana hereby reaffirms its previously adopted Grievance Procedure.
SECTION 3. BE IT FURTHER RESOLVED by the Mayor and Board of Aldermen on the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, be and he is hereby authorized to provide as certification of compliance to the Office of Community Development, Division of Administration that as a recipient of Louisiana Community Development Block Grant funds, all activities of the City of West Monroe with respect to that grant will be operated in compliance with the requirements of Section 504 of the Rehabilitation Act of 1974, and such other requirements as are necessary or appropriate, as amended, such certification to be in a format similar to that attached as Exhibit “B”.

COMMUNITY AFFAIRS
Ladd Williams reported on community leaders getting involved with the poverty in the surrounding area. He also informed the Council of Bob Lupton coming to speak to the Monroe Chamber on May 8th to speak about his efforts to transform inner city Atlanta, Georgia. Mr. Lupton is a Christian community developer, an entrepreneur who brings together communities of resource with communities of need.
Alderman Williams also reported that Ben Marshall emailed him an article from the Ouachita Citizen concerning a new I-530 connector, connecting Crossett to Little Rock and having the potential to come right through here to connect to the I-20. Ben Marshall has more or less challenged our local politicians to stand up and get involved. Mr. Williams is trying to contact Mr. Smith, who is the Crossett Economic Development Director, so as to invite him to attend the Sterlington Chamber of Commerce meeting.
HOUSE BILL 1050
Mayor Breland reported House Bill 1050 never made it out of the committee.
THE RIVER CHURCH
Pastor Jerry Grant introduced himself and his sister Diane Sharp from Winnsboro. Brother Grant is currently residing in Crossett, Arkansas, but planning to move to the Sterlington area. He stated this upcoming Sunday will be the third Sunday they have been in the church.
Mayor Breland and the Council welcomed him to Sterlington.
SAFE ROUTES TO SCHOOL
Mayor Breland reported he had a meeting with the program coordinator last Thursday. The coordinator asked Tom Holtzclaw and Mayor Breland to speak at a seminar in Ruston sometime in November to talk about the Safe Routes Grant.
UNFINISHED BUSINESS
TOWN WEBSITE
Ron Hill stated he sent a proposal to Total-e-Service Web Company proposing $500 a month for three months, mostly for routine maintenance and a few minor design issues. He wants to add a town council page to post the minutes and agendas.

NEW BUSINESS
TOWN POLICY AND PROCEDURE MANUAL
Mayor Breland stated the only change he made to the manual was to add email regulations.

Mayor Breland reported that Rheo Stewart resigned. He will discuss next month which way he wants to go.
GRASS ORDINANCE
M/S/C (Ron Hill, Ronny Lowery) to introduce the proposed grass ordinance with the 18” grass height going back to 24” grass height.
INVITATION FOR PUBLIC PARTICIPATION
Ms. Mavis Williams stated she had someone grass her extra lot which is 18-24 inches tall and she is waiting for the seeds to drop, before she mows it. Ms. Williams wants to know if it is okay. Mayor Breland told her she was okay for now, because we had not really got into the full swing of the mowing season yet.

SAFE ROUTES TO SCHOOL
Mayor Breland reported he had the meeting with the program coordinator and we had a couple of amendments to make. On the non-infrastructure side, we amended it to where the kids could participate in competitions, for example: whoever walks or rides their bikes to school the most. The prizes will be bikes, helmets, etc. Right now, Mayor Breland is waiting to get the contract back.

EXECUTIVE SESSION

RECONVENE MEETING
The meeting reconvened at 7:27 p.m. The Council directed Todd Newman to talk to Attorney Paul Hurd about what is going on with the annexation, and report back next meeting.
RESIGNATION OF ALDERMAN
Ronny Lowery announced his resignation as Alderman effective June 10, 2008. He is moving to Jackson Parish to his wife’s old home place. Everyone stated they hated to see him leave, although everyone understood.
PUBLIC WORKS
Mayor Breland reported he hired Carroll Andrepont when Rheo Stewart resigned. Mr. Andrepont, according to Pat McDonald, works hard, knows how the do the needed things, and can work the big equipment. Mayor Breland wants to make him full-time at the next meeting.

Pat McDonald made the recommendation to hire Carroll Andrepont “Kajun” full-time and increase his hourly pay to $10, and he is entitled to the employee benefit.

TRADE-IN SILVER DURANGO
Mayor Breland informed the Council that the Durango drinks a lot of gas and would they want to consider going to something more economical. It has 79,000 miles on it. Mayor Breland was told to work up some figures and they will look at them next month.
ANNEXATION
Trey Jay, Inc. is looking to annex Cottonwood #6 into the city limits. At the next meeting, the Mayor will probably have the paperwork needed to proceed annexing.
