REMARKS FROM THE CHAIRMAN OF THE DISTRICT None EXECUTIVE SESSION FOR THE PURPOSES OF STRATEGIC PLANNING, INCLUDING DISCUSSION OF THE IASIS TRANSACTION AND RELATED MATTERS, FUTURE OPERATION OF THE WELLNESS CENTER, IMPLEMENTATION OF THE LEASE TERMINATION AGREEMENT, AND OVERSIGHT OF WARD FIVE HEALTHCARE FOUNDATION A motion was made by Ms. Liner seconded by Mr. Spencer and unanimously approved for the Board of Commissioners to go into executive session for the purpose of strategic planning, including discussion of the IASIS transaction and related matters, future operation of The Wellness Center, implementation of the Lease Termination Agreement, and oversight of Ward Five Healthcare Foundation. All present were allowed to remain. A motion was made by Mr. Spencer seconded by Ms. Liner and unanimously approved for the Board of Commissioners to go back into regular session. APPROVAL OF MINUTES OF DISTRICT BOARD MEETINGS HELD ON DECEMBER 20, 2007 A motion was made by Ms. Liner and seconded by Mr. Spencer to approve the minutes of December 20, 2007 and the motion unanimously carried. UPDATE ON RECOMMENDATION TO OUACHITA PARISH POLICE JURY FOR REPLACEMENT FOR W. B. NELSON, JR. Discussion on a replacement for Mr. Nelson was tabled until the next meeting. UPDATE ON SCHEDULE FOR SOLICITATION OF LOCAL BANKING SERVICES Requests for proposals from the local banks will be sent by certified mail with a return receipt requested. Publication of a Notice of Intention of Hospital Service District No. 1 of the Parish of Ouachita, State of Louisiana to Select a Fiscal Agency will be published three (3) times prior to submission deadline of February 8, 2008. UPDATE ON HSD BUDGET The Hospital Service District No. 1 budget for 2008 was presented for discussion and a decision was made to transfer the information into a more formal format before final approval. The 2008 budget will be presented at the next meeting in proper format. REVIEW OF MINUTES OF FOUNDATION BOARD MEETING OF DECEMBER 3, 2007 The Board of Commissioners reviewed the December 3, 2007 minutes of the board of directors of Ward Five Healthcare Foundation. AMENDMENT OF THE AGENDA Mr. Spencer moved, Ms. Liner seconded, and the Board unanimously approved amending the agenda to add the following agenda item: “APPROVAL OF THE WELLNESS CENTER’S INTERIM EXECUTIVE DIRECTOR TITLE AND SALARY ADJUSTMENT” APPROVAL OF THE WELLNESS CENTER’S INTERIM EXECUTIVE DIRECTOR AND TITLE AND SALARY ADJUSTMENT Mr. Spencer offered the following resolution: RESOLVED, that Amanda Adcock is named the Interim Executive Director of the Wellness Center and that her salary shall be adjusted as discussed at the meeting. Ms. Liner seconded the resolution and the Board unanimously approved it. TRANSACTION OF ANY OTHER BUSINESS THAT MAY PROPERLY COME BEFORE THE MEETING It was noted that a next regular meeting of the Hospital Service District is scheduled for Tuesday, February 12, 2008, at 11:30 a.m. at the Wellness Center. Although this incident is not an emergency, as our customers, you have the right to know what happened and what we are doing to correct this situation. The United States Environmental Protection Agency (EPA) and the Louisiana Department of Health and Hospitals (LDHH) set drinking water standards and require the disinfection of drinking water. Where disinfection is used in the treatment of drinking water, disinfectants combine with naturally occurring organic and inorganic matter present in water to form chemicals called disinfection byproducts (DBPs). The EPA and LDHH set standards for controlling the levels of disinfectants and DBPs in drinking water, including trialmethanes (THMs) Some people who drink water containing THMs in excess of the MCL over MANY YEARS may experience problems with liver, kidneys, or central nervous systems, and may have an increased risk of cancer. In December 1998, EPA set enforceable drinking water standard for TTHMs at 80 parts per billion (ppb) to reduce the risk of cancer or other adverse health effects. Compliance with the TTHM standard for all public ground water systems serving less than 10,000.00 individuals initially became effective and enforceable on January 1, 2004. Compliance with the TTHMs standard is determined by calculations a running annual average (RAA) of quarterly TTHMs sample results.Compliance calculations performed during the fourth calendar quarter of 2007, show that the system’s current TTHMs running annual average is 201 ppb thus, the system is currently in violation of the TTHMs standard. Please share this information with all the other people who drink this water, especially those who may not have received this notice directly (for example, people in apartments, nursing homes, schools, and businesses). You can do this by posting this notice in a public place or distributing copies by hand or mail. THIS IS NOT AN EMERGENCY if it had been, you would have been notified immediately. EPA and LDHH do not consider this violation to have any serious adverse health effects on human health as a result of short-term exposure; however, continued long-term exposure to TTHMs levels above the standard (e.g., 20 years of exposure) has the potential to have serious adverse effects on human health. VISITORS: The President recognized the following visitors: Cynthia Stephens LSU Agriculture Extension Service RE: Cooperative Endeavor Agreement and other information: Ms. Stephens questioned the status of the Cooperative Endeavor Agreement and its signage. Mr. Mitchell, Assistant District Attorney stated that last year the Jury voted to provide the funding requested for LSU AgCenter for a 5 year term during the 2007 funding year. He stated that the Jurors did not specifically vote to enter into a Cooperative Endeavor Agreement. He stated that he is reviewing the agreement for future action. Ms. Stephens expressed that according to her recollection the agreement was approved sometime in January 2007. Ms. Golden concurred with Ms. Stephens on the approval, but she believed that it might have been approved midspring. Mr. Mitchell stated he would do some research for clarification. A motion was offered by Mr. Caldwell to carry the item under Mr. Calhoun’s agenda for the next Regular Police Jury meeting. Mr. Calhoun seconded the motion. Motion adopted. No opposition. B. Cathy Agan, LSU Agriculture Extension Service RE: Family Nutrition Program (FMP) Ms. Agan gave a brief update on activities and services provided through the Family Nutrition program with the LSU AgCenter. She stated that their primary focus was in the areas of trying to approve the dietary quality in food safety and budgeting the food dollars for families and individuals in Ouachita Parish. II. DEPARTMENT HEAD REPORTS A. The following Department Heads presented status reports to the Police Jury: 1. CODE ENFORCEMENT: Cpl. Wayne Heckford Cpl. Heckford stated that for the current month 83 Code Enforcement citations had been issued; 598 cases had been brought for environmental hearings with seventy-four percent (74%) of the matters being brought into compliance without further OPPJ action. The environmental hearing officer was averaging approximately 66 cases monthly. 2. FIRE DEPARTMENT: Chief Pat Hemphill, Fire Chief Chief Hemphill reported the Ouachita Parish Fire Department dispatched activity for the month. 3. MOSQUITO CONTROL: Dr. Cole Church, Director Dr. Cole reported that the mosquito count for this time of the year was average throughout the state. 4. WORKFORCE INVESTMENT: Ms. Doretha Bennett, Director Ms. Bennett reported on the status of WIA Certification that is due by December 31, 2007 and that the State department is assisting them with this endeavor. She reported that for the month of September 2007, 2000 job seekers came into the center. III. MOTIONS / ORDINANCES / RESOLUTIONS: Mr. Hargrove, District A: 1. The President noted that Mr. Hargrove, District A was absent. 2. The President made a motion to defer the Minutes of the Public Works Committee meeting held on September 4, 2007. Motion adopted. No opposition. B. Mr. Calhoun, District B: 1. The President recognized Mr. Calhoun, District B. 2. Update on Roofing Repairs: Mr. Calhoun asked Mr. Cammack to provide an update on the roofing repairs to Cheniere Lake Lodge. Mr. Cammack stated that the repairs to the Cheniere Lake Lodge had been completed with the cost ranging from $6,000 to $7,000 and was much less than the $25,000 starting estimate. 3. Update on Road Damage Caused by Pipeline Companies: Mr. Calhoun asked Mr. Harrison to provide an update on the road damage caused by pipeline companies. Mr. Harrison stated that he did not have any additional information to report on at this time. However, he was waiting on responses from the pipeline companies on issues discussed at their last meeting. Mr. Calhoun asked that the status of the “Road Damage Caused By Pipeline Companies” continue to be placed as an agenda item as more information is available. Tidwell Road Improvement Project: Mr. Calhoun stated that the deadline for receiving bids for the Tidwell Road Improvement project is October 15, 2007, and the results of the bids would be reported to the Police Jury at a later date. West Ouachita Industrial District: Mr. Calhoun asked Mr. Jay Mitchell to report on the status of the West Ouachita Industrial District. Mr. Mitchell stated that Mr. Roark, with Tri-State Properties requested that either the vacant land available for sale be cleared, or at least have a topographic survey done so that potential buyers could view the topography. Mr. Mitchell stated that the engineering work for the West Ouachita Industrial District was being done by Dumas & Associates. In their opinion the land was too thick and highly erodible and producing a typographic survey by hand would be too costly. He stated that their recommendation would be to produce a typographic survey by over flight, which would be more cost affective. Mr. Mitchell stated that the advisory board would be meeting on Monday and a topographic over flight cost estimate should be available to be presented at that board meeting. Mr. Calhoun asked for this item to be place on his agenda for the next Regular Police Jury meeting. C. President, Mr. Caldwell, District C: Mr. Caldwell had no items. D. Mr. Blade, District D: The President recognized Mr. Blade, District D. Mr. Blade made a motion to defer the Minutes for the Personnel Committee Meeting held on September 4, 2007 until the next schedule Regular meeting. 3. Introduction of Ordinance for sale of that portion of Lot 8 of the partition of the Beckwith property lying north of Raccoon Bayou to Rick Killen: Mr. Blade offered for introduction only, Ordinance No. 8873 for the sale of that portion of Lot 8 of the partition of the Beckwith property lying north of Raccoon Bayou to Rick Killen at a price of $10,000. 4. Report on Bids for a 100K Generator for Green Oaks Detention Center: Mr. Blade asked for Mr. Cammack to report on the status of the bids for the Detention Center. Mr. Cammack stated that the specs for the bids had been received and is setup for advertisement. The matter relating to bids will be placed on the agenda after the bids have been opened and reviewed. 5. Update on Adjudicated Property: Mr. Blade asked Mr. Mitchell to report on the status of adjudicated property. Mr. Mitchell stated that Mr. Roark’s office had agreed to get involved in handling some clerical work associated with adjudicated property owned by the Parish. He stated that it was likely the Ordinance specifying a method of fixing the prices on all adjudicated properties would need to be modified. Kim Golden, District E: 1. The President recognized Kim Golden, District E. Regional Economic Development Update: Ms. Golden stated that at Mr. Caldwell’s invitation, she attended the Regional Economic Development Conference last Thursday. She stated that she supports the efforts of the RED on an interim bases, and as the 2008 budgets are reviewed by the Jurors, her recommendation would be that the Parish write something to financial support the interim efforts only. She expressed her appreciation to Mr. Caldwell for inviting her to attend the conference. Ms. Golden asked to defer the matter of G. B. Cooley Board appointment(s) until the next Jury meeting. Mr. Blade agreed to assist Ms. Golden with the appointment selection. 4. Cooperative Endeavor Agreement with Greater Ouachita Water Company regarding the Burney Subdivision Sewer System: Ms. Golden asked Mr. Mitchell to report on the status relating to the Burney Subdivision area Sewer Collection System Improvement Project. Mr. Mitchell stated that he had spoken to Mr. Sparks with the Greater Ouachita Water Company. He stated the Mr. Sparks indicated GOWC would be providing the engineering services to get the project application ready. Mr. Mitchell stated that he would keep the Jurors informed on its progress. F. Mr. Dawson, District F: 1. Mr. Dawson was not present at this meeting. 2. Mr. Mitchell reported that Mr. Dawson informed him that he could not attend the meeting due to a prior engagement. Mr. Harrison spoke in regards to the status of the “Safe Routes to School Program” grant for Shady Grove Elementary. He stated that they were in the process of developing a scope for the project. He also informed the Jurors that the grant application deadline had been extended to January 2008. Mr. President asked for this item to be place on Mr. Dawson’s agenda for the next Regular Police Jury meeting. Status of School Based Health Plan: Ms. Golden spoke on this issue in the absence of Mr. Dawson. She stated that Mr. Dawson would be meeting with representatives of the School Boards. V. Beer and Whiskey Licenses: There were no applications filed for Beer and Whiskey licenses for this time period. VI. ADMINISTRATIVE REPORTS: The President called for the Administrative Reports. A. Fiscal – Mr. Brad Cammack, Treasurer: Mr. President recognized Mr. Brad Cammack. 2. State Office Building Request for work in the parking lot: Mr. Cammack reported on a second request for additional work to the parking lot at the State Office Building. The request included the installation of 63 bollards and chain at $40 each totaling $2,520. The State received the bid from Randal Taylor Construction and Electric Inc. who overlaid the parking lot initially. Discussion ensued. Mr. President asked that the request for the installation of bollard and chain for the State parking lot be deferred to next Regular Police Jury meeting. 3. George Welch Elementary School PTA request for placement of a memorial for fallen soldiers on the courthouse square: Mr. Cammack updated the Jurors of the request from George Welch PTA in regards of granting them permission to place a memorial for fallen soldiers on the riverside of the courthouse grounds. At this time, the PTA was not sure what type of monument they would be purchasing due to not having all contributions obligated, nor where the memorial would be placed. Discussion ensued. The President stated that more information was needed from the PTA and his recommendation would be to have Mr. Hargrove to meet with the group before any action was taken. Renovation of Extension Service Building: Mr. Cammack presented a request from the LSU AgCenter Extension Service Building regarding the renovation/installation of a handicap ramp. The estimated cost for the ramp was as follows: (1) materials - $3,650 and (2) labor - $6,424.60 with a total of $10,074.60. The renovations would require the use of equipment such as dump trucks, backhoes and concrete saws from the Ouachita Parish Public Works Department. Ms. Stephens, from the LSU AgCenter stated that the renovation would be done on the south entrance (Veteran’s end) of the office building, and would take some of the space that is currently used for parking. She stated that a few people had fallen in the past and a handicap ramp would be very beneficial to the safety of the consumers. Based on the recommendation from Mr. Cammack, a motion was offered by Mr. Walt Caldwell to approve the appropriate renovation for an addition of a handicap ramp for the Extension Service Building, as requested by the LSU AgCenter at the estimated amount of $10,000. Mr. Calhoun seconded the motion. Motion adopted. No opposition. Substantial Completion – Re-Roofing Project of the Main Branch of the Ouachita Parish Public Library: Mr. Cammack presented a certificate of substantial completion received from Architect Bill Land, just before the meeting that required a signature by the President regarding the re-roofing project of the Main Branch of the Library. A motion was offered by Mr. Caldwell, seconded by Mr. Calhoun that pursuant to the provisions of LSA-R.S. 42:7, which provides that upon approval of two-thirds of the members present, that at a meeting of a public body, the public body may take up a matter NOT on the Agenda, that discussion/action of the substantial completion of the re-roofing project of the Main Branch of the Library be added to the Agenda. Two-thirds of the members were present and it was unanimously approved to take action on this matter. Motion adopted. No opposition. Discussion ensued. Mr. President asked that the substantial completion for the re-roofing project of the Main Branch of the Library be deferred to the next Regular Police Jury meeting under Mr. Blade’s agenda. B. Legal – Mr. Jay Mitchell, Assistant Director Attorney: There were no legal report items to be discussed by Mr. Jay Mitchell at this time. C. Public Works – Mr. John Tom Murray, Director: 1. The President recognized Mr. Murray from the Public Works Department. Purchase of copier for Building Code office from the State Building Code grant: Mr. Murray distributed a handout regarding a quote from the State contract for purchasing a copying machine for the Permit Office. Mr. Cammack stated that funds were available to purchase the copier through grant funds received totaling approximately $326,000. His recommendation was to purchase the copier instead of leasing it. He stated that a quarterly preventive maintenance fee per copy amount would have to be paid. Based on the recommendation of Mr. Cammack, a motion was offered by Ms. Golden to approve the purchase of a copying machine for the Permit office. Mr. Blade seconded the motion. Motion adopted. No opposition. VII. OTHER BUSINESS / INVITATION FOR PUBLIC PARTICIPATION: A. Application for Homeland Security Director Position: Ms. Golden asked if applications and resumes for the Homeland Security Director’s position was made available to members of the Homeland Security Civil Defense Council. Mr. Cammack reported that LaTanya Harper, HR Coordinator was sending updates to the Council weekly, and that a meeting would be setup very soon for interviews.
