Treasurer’s Report: The board members reviewed the itemized deposits and disbursements showing the following balance on hand as of April 31, 2007. Travel Plans: It was moved by Sammy Gordy and seconded by Don O’Toole to approve the additional travel plans for June through October 2007 after adding a trip to Baton Rouge on May 29, 2000 by Alana Cooper for the LTPA Executive Planning meetings, and a trip to Bunkie on June 4, 2007 to bid for the Family, Career, and Community Leaders of America. Motion carried by a vote of seven (7) affirmative votes to zero (0) negative votes. Committee Report: Tourism Development Grant Committee: Sammy Gordy, chairman, reported that the Tourism Development Committee met on May 21, 2007 at 3:30 to review final grant payment requests for the following recipients. South Central Regional Music Conference $ 2,875 The Monroe Garden Club, Inc. $ 625 The City of Monroe $10,870 Sammy Gordy reported that the committee’s recommendation is to approve the final grant payment to the South Central Regional Music Conference and The Monroe Garden Club, Inc. Sammy Gordy reported that the City of Monroe is in the process of hiring a Marketing Director for the Monroe Regional Airport and wants to use the funds for the Marketing personnel to market the airport and incidentals. Sammy Gordy reported that the committee’s recommendation is to take no action on the City of Monroe’s request until the Marketing personnel is hired and a marketing plan is in place. It was moved by Sue Edmunds and seconded by Gretchen Kovac to approve the Tourism Development Grant Committee’s recommendations. Motion carried by a vote of seven (7) affirmative votes to zero (0) negative votes. Other Business: Sue Edmunds reported that the Nominating Committee submitted the following slate of officers for the June 2007 through May 2008 term in the May 21, 2007 meeting. Legal Publication: It was moved by Gretchen Kovac and seconded by Sue Edmunds to designate the Ouachita Citizen as the Convention & Visitors Bureau’s official journal for June 2007 through May 2008. Wes Shafto with the firm of Breithaupt, Dunn, DuBose, Shafto & Wolleson, LLC., Attorneys at Law, presented a proposed resolution to the Board requesting preliminary approval and authority to apply to the State Bond Commission using the Monroe-West Monroe Convention & Visitors Bureau as the issuer of NTE $4,500,000 Revenue Bonds with respect to the Emy Lou Biedenharn Foundation’s Museum and Gardens. The resolution is requesting that the Convention and Visitors Bureau agree to be the non-profit, political subdivision or public body agency to use for Conduit financing for the Emy Lou Biedenharn Foundation renovations project. The board requested that Elmer Noah, Board Attorney, give his legal opinion on the proposal and that the executive director contact the Convention & Visitors Bureau Auditor, Rowland Perry, for his opinion on the effect the $4,500,000 if any will have on the Convention & Visitors Bureau’s financial statement. It was moved by Sue Edmunds and seconded by Sammy Gordy to give preliminary approval to The Emy Lou Biedenharn Foundation to use the Convention & Visitors Bureau as the issuer of NTE $4,500,000 Revenue Bonds when applying to the State Bond Commission in respect to the Emy Lou Biedenharn Foundation renovations project. Motion carried by a vote of seven (7) affirmative votes to zero (0) negative votes. Executive Director’s Report: Alana Cooper presented the 2007 Photo Contest winners to the Board. The first, second and third place winners were presented a monetary award for their entry. This plan is an assessment of a delineated area around our listed sources through which contaminants, if present, could migrate and reach our source water. According to the Source Water Assessment Plan, our water system had a susceptibility rating of 'medium'. Picocuries per liter (pCi/L) — picocuries per liter is a measure of the radioactivity in water. Millirems per year (mrem/yr) — measure of radiation absorbed by the body. Million fibers per liter (MFL) — million fibers per liter is a measure of the presence of asbestos fibers that are longer than 10 micrometers. Nephelometric Turbidity Unit (NTU) — nephelometric turbidity unit is a measure of the clarity of water. Turbidity in excess of 5 NTU is just noticeable to the average person. Maximum residual disinfectant level (MRDL) — The highest level of a disinfectant allowed in drinking water. There is convincing evidence that addition of a disinfectant is necessary for control of microbial contaminants. Action level (AL) — the concentration of a contaminant that, if exceeded, triggers treatment or other requirements that a water system must follow. Treatment technique (TT) — a treatment technique is a required process intended to reduce the level of a contaminant in drinking water. Maximum contaminant level (MCL) — the "Maximum Allowed" MCL is the highest level of a contaminant that is allowed in drinking water. MCL's are set as close to the MCLG's as feasible using the best available treatment technology. Maximum contaminant level goal (MCLG) — the "Goal" is the level of a contaminant in drinking water below which there is no known or expected risk to human health. MCLG's allow for a margin of safety. Maximum residual disinfectant level goal (MRDLG) — The level of a drinking water disinfectant below which there is no known or expected risk to health. During the period covered by this report we had the below noted violations of drinking water regulations. **There were no violations during the monitoring period of January 1st to December 31, 2006.** Our water system tested a minimum of 1 monthly sample(s) in accordance with the Total Coliform Rule for microbiological contaminants. EPA`s standard balances the current understanding of arsenic`s possible health effects against the costs of removing arsenic from drinking water. EPA continues to research the health effects of low levels of arsenic which is a mineral known to cause cancer in humans at high concentrations and is linked to other health effects such as skin damage and circulatory problems. Some people may be more vulnerable to contaminants in drinking water than the general population. Immuno-compromised persons such as persons with cancer undergoing chemotherapy, persons who have undergone organ transplants, people with HIV/AIDS or other immune system disorders, some elderly, and infants can be particularly at risk for infections. These people should seek advice about drinking water from their health care providers. EPA/CDC guidelines on appropriate means to lessen the risk of infection by Cryptosporidium and other microbiological contaminants are available from the Safe Drinking Water Hotline (800-426-4791). SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Section 7-1019 of the Code of Ordinances, City of West Monroe, Louisiana, is hereby enacted, to read as follows: "Sec. 7-1019. Water Rates. ( a ) Residential. The monthly domestic rates for all water supplied by the city to residential consumers shall be as follows: (1) For customers inside the city limits, there shall be a base charge of two dollars and fifty cents ($2.50), plus there shall be an additional charge for all water consumed at the rate of one dollar and forty-five cents ($1.45) per thousand (1,000) gallons. (2) For customers outside the city limits, the rates shall be a base charge of four dollars ($4.00) plus there shall be an additional charge for all water consumed at the rate of one dollar and seventy-two cents ($1.72) per thousand (1,000) gallons. ( b ) Commercial. Water supplied to commercial consumers shall be charged on a monthly basis as follows: (1) For commercial consumers inside the city limits the charges shall be as follows: a. When supplied through a three-quarter-inch meter, there shall be a base charge of five dollars ($5.00), plus there shall be an additional charge of one dollar and fifty-two cents ($1.52) per thousand (1,000) gallons used. b. When supplied through a one-inch meter, there shall be a base charge of six dollars ($6.00), plus there shall be an additional charge of one dollar and fifty-two cents ($1.52) per thousand (1,000) gallons used. c. When supplied through a one and one-half-inch meter, there shall be a base charge of seven dollars and fifty cents ($7.50), plus an additional charge of one dollar and fifty-two cents ($1.52) per thousand (1,000) gallons used. d. When supplied through a two-inch meter there shall be a base charge of ten dollars ($10.00), plus there shall be an additional charge of one dollar and fifty-two cents ($1.52) per thousand (1,000) gallons used. e. When supplied through a three-inch or a four-inch meter, there shall be a base charge of fifteen dollars ($15.00), plus there shall be an additional charge of one dollar and fifty-two cents ($1.52) per thousand (1,000) gallons used. (2) Water supplied to commercial consumers outside the city limits shall be charged on a monthly basis as follows: There shall be a base charge of seven dollars and fifty cents ($7.50), plus there shall be an additional charge of one dollar and eighty-two cents ($1.82) per thousand (1,000) gallons used. ( c ) Re-sale. All water sold by the city for re-sale shall be charged for at the rate of one dollar and seventy-seven cents ($1.77) per thousand (1,000) gallons.Ó SECTION 2. Temporary testing systems: A permit shall not be required for the installation of any temporary system required for the testing or servicing of electrical equipment or apparatus. Gas: 1. Portable heating appliance. 2. Replacement of any minor part that does not alter approval of equipment or make such equipment unsafe. Mechanical: 1. Portable heating appliance. 2. The stopping of leaks in drains, water, soil, waste or vent pipe, provided, however, that if any concealed trap drain pipe, water, soil, waste or vent pipe becomes defective and it becomes necessary to remove and replace the same with new material, such work shall be considered new work and a permit shall be obtained and inspection made as provided in this code. 2. The clearing of stoppages or the repairing of leaks in pipes, valves or fixtures and the removal and reinstallation of water closets, provided such repairs do not involve or require the replacements or rearrangements of valves, pipes or fixtures." The office of mechanical inspector is hereby created and the executive official in charge of that office shall be known as the mechanical inspector. He shall be appointed by the Mayor, who may combine this office with the office of building official. The person chosen to fill such office shall possess such executive ability as may be required for the efficient management of such office and shall have the ICC certification as prescribed by the Louisiana State Uniform Construction Code Council. Sec. 12-4022. Heating, air conditioning and refrigeration board. (a) There is hereby created a heating, air conditioning and refrigeration board. The board is to consist of the city building official, or a deputy building official designated by him from time to time, who shall be chairman, and five (5) persons qualified in the heating, air conditioning and refrigeration craft or trade with a minimum of three (3) years experience, each of whom shall be appointed by the Mayor and who shall serve at his pleasure for a term of four (4) years. (b) The duties of the board will be to act as an advising board in matters pertaining to heating, air conditioning and refrigeration as defined in the Louisiana State Uniform Construction Code as it is now adopted and as may hereafter be amended from time to time. c) It shall be the duty of the mechanical inspector to sign and issue all notices and certificates and to pass on all plans submitted; to keep a daily record of his work, including all notices and applications received; violations thereto; and to make any daily, weekly, quarterly or annual reports of his operations required by the Mayor and/or board of aldermen. He shall inspect all buildings in the course of erection, alteration or repair, as often as may be necessary, and shall see that all heating and air conditioning work is done in accordance with the provisions of the Louisiana State Uniform Construction Code as same is now adopted or as may hereafter be amended from time to time. (d) The mechanical inspector shall be and is hereby given police power with authority to enter any and all buildings and places within the city limits for the purpose of inspecting the heating and air conditioning installations already constructed or in the course of construction, repairs or alteration, and in all cases the mechanical inspector finds that the heating, air conditioning and refrigeration Article or other code provisions of the city have been or are being violated, he shall have the authority and it shall be his duty to cause the arrest of the person or persons who shall be dealt with and subject to punishment as herein provided. Sec. 12-4023. Registration, Insurance. (a) Qualifications. No person shall be allowed to do heating, air conditioning and refrigeration work, now or hereafter, within the city limits unless he shall have been registered under this Article. (b) Registration of application. Any person desiring to qualify as a registered contractor under this Article shall each year register his qualifications with the office of the mechanical inspector. (c) Registration Fees. Any person desiring to be registered with the city as a mechanical contractor shall pay $75.00 annually along with providing the city with a one time $200 deposit, refundable upon cancellation of registration. (d) Registration expiration. A contractor registration certificate shall expire on December 31 of the year issued. If registration is not renewed by January 31, all qualifications must be resubmitted. (e) Insurance. Every registered contractor must present evidence to the building inspector that he carries workmen's compensation insurance, commercial/general liability insurance with minimum policy limits of five hundred thousand dollars ($500,000.00) per person per occurrence and property damage insurance with minimum policy limits of five hundred thousand dollars ($500,000.00) per incident. Evidence of insurance must be provided before the registration certificate or the annual renewal certificate will be issued by the building inspector. (f) Authority to install. No person other than a registered contractor or his qualified employee shall be allowed to put in any heating, air conditioning or refrigeration or to make any connections thereto within the city. (g) Contractor's responsibility. No person carrying on the heating, air conditioning and refrigeration business shall allow his name to be used by any other person, directly or indirectly, either to obtain a permit or permits, send in notices, make returns or to do any work under his registration, under penalty of having his registration revoked. Sec. 12-4024. Permits, inspection, etc. (a) Permit to do work. Before starting any work covered by this Article, each person doing business as a heating, air conditioning and refrigeration contractor must obtain a permit from the mechanical inspector to do the work. This permit application shall be filed on forms furnished by the mechanical inspector. (b) Applications for inspection. Applications for inspection must be filed at the office of the mechanical inspector during his normal office hours, by the applicant, on forms furnished by the city. (c) Permits in old buildings. Applications must be made and permits obtained for all extensions, alterations or other work to be done in connection with heating, air conditioning and refrigeration work, and the work shall be done in the same manner and under the same rules as work in new buildings. Sec. 12-4025. Suspensions. Any registered contractor who shall neglect or refuse to comply with this Article shall have his registration suspended or revoked by the Office of the Mechanical inspector and may thereafter be denied any permit for doing heating and air conditioning work in the city for such length of time as the mechanical inspector shall deem just and proper and shall also be liable to prosecution under this Article. Sec. 12-4026. Heating, air conditioning at refrigeration permit and inspection fees. Violations; penalties; suspension of registration. (a) Violations of this Article. (1) It shall be unlawful for any person to engage in heating, air conditioning and refrigeration work without being properly licensed to do so under the provisions of this Article. (2) It shall be unlawful for any person to fail to timely obtain all permits required under this Article prior to engaging in heating, air conditioning and refrigeration work. (3) It shall be unlawful for any person to fail to timely request any inspection required under the provisions of this Article. (4) For purposes of this section, heating, air conditioning and refrigeration work shall include any installation, removal, alteration or repair of heating, air conditioning or refrigeration equipment or systems, including related activities. (b) Penalties for violations of this Article. (1) Each violation of any of the violations listed above shall be punishable by a fine of not less than one hundred dollars ($100.00) and not more than five hundred dollars ($500.00), and/or imprisonment for not more than ninety (90) days. (2) If the person shall violate any of the provisions above more than one (1) occurrence within a period of thirty-six (36) months, the applicable penalties shall instead be as follows: (i) For a second offense the violation shall be punishable by a fine of not less than two hundred dollars ($200.00) and not more than five hundred dollars ($500.00), and/or imprisonment for not more than ninety (90) days. (ii) For a third offense the violation shall be punishable by a fine of not less than three hundred dollars ($300.00) and not more than five hundred dollars ($500.00), and/or imprisonment for not more than ninety (90) days. (iii) For a fourth offense the violation shall be punishable by a fine of five hundred dollars ($500.00), and/or imprisonment for not more than ninety (90) days. (c) Suspension of registration. Committee Reports: Nominating Committee: Sue Edmunds reported that the Nominating Committee met on April 16, 2007 at 3:30 p.m. to discuss recommendations of Officers for the June 2007 through May 2008 term. She reported that it is the Committee’s recommendation to present the following Slate of Officers for the June 2007 through May 2008 term. Dr. Jerry Edmondson, Chairman Gretchen Kovac, Vice Chairman Lane Howell, Secretary/Treasurer She reported that the recommendations will be voted on during the May 2007 Board of Directors Meeting. Executive Director’s Report: Alana Cooper reported that she received a letter dated April 13, 2007 from the Office of the Mayor of Monroe requesting that additional time be given to expend the balance of $20,870.00 dedicated to assist in securing a “Small Community Air Service Development Grant”. The City of Monroe is requesting that the remaining $20,870.00 be expended in two parts. $10,000.00 used to satisfy the local match required for the Small Community Air Service Development Grant. The remaining balance to be expended for marketing and media services to promote the services of the Monroe Regional Airport and to promote the Monroe Region as a destination for travel. It was moved by Sue Edmunds and seconded by Don O’Toole to grant the City of Monroe the $10,000.00 to satisfy the local matching funds requirement for the Small Community Air Service Development Grant. Motion carried by a vote of seven (7) affirmative votes to zero (0) negative votes. It was moved by Sue Edmunds and seconded by Don O’Toole that the remaining balance of $10,870.00 goes back to the Tourism Development Grant Committee for review. (Regular meeting) Members present: Fred Hall, Don Leach, Ralph Owens Members absent: None Others present: Jerry Lazenby, Lazenby & Associates, Inc.; Terry Cox, district manager. Commissioner hall called the meeting to order promptly at 11:00 a.m. The first item on the agenda was the financial statements for the seven months ended March 31, 2007. Mr. Cox presented the financial statements to all present. Following a brief review, everyone agreed the district is in sound financial condition. The next item was the proposed duplexes on Lakeside Road. To consist of 12-unit duplex apartment complexes. Mr. Lazenby presented the plans for the complex and reviewed the design with those present. Following the review, Commissioner Owens made a motion to accept the complexes and Commissioner Leach seconded the motion. Mr. Lazenby will notify the owner of the acceptance, upon completion and inspection. The final item was cash disbursements. Mr. Cox presented the disbursements for the month and following a review, Commissioner Leach made a motion to accept them as reasonable and necessary and Commissioner Owens seconded the motion.
