If you have any questions or comments or wish to communicate with the Board of Pardons please call (225) 342-5421. 3/1, 3/15, 3/22 ______________________________________________________________ NOTICE NOTICE is hereby given that, pursuant to article IV, section 21 (D) (1) of the Louisiana Constitution, on February 28, 2007, as corrected for errata on March 7, 2007, Entergy Louisiana, LLC (“ELL”), an electric public utility having facilities to provide retail electric service to residential, commercial, industrial, and governmental customers in forty-six Parishes of the State of Louisiana, together with Entergy Gulf States, Inc., an electric public utility having facilities to provide retail electric service to residential, commercial, industrial, and governmental customers in eighteen Parishes of the State of Louisiana, (collectively, the “Companies”), filed with the Louisiana Public Service Commission (“LPSC” or the “Commission”) a Second Supplemental and Amending Joint Application for Interim and Permanent Recovery in Rates of Costs Related to Hurricanes Katrina and Rita (“Securitization Application”). With regard to ELL, the Securitization Application supplements and amends the application filed by in December 2005, upon which the LPSC has acted, and the First Supplemental and Amending Joint Application filed July 31, 2006. In the Securitization Application, ELL has requested that the LPSC issue a Financing Order authorizing the securitization of those storm recovery costs and those storm reserves found by the Commission to be appropriately financed by debt secured by storm recovery charges within the meaning of La. R.S. 45:1227 (15). The Securitization Application establishes the amount of storm recovery costs to be securitized of approximately $561 million for ELL, which amount includes carrying costs. ELL also is seeking, in said Financing Order, consent from the Commission regarding the use of proceeds of such funds. In addition, ELL is seeking to securitize approximately $141 million to devote to storm reserves and approximately $8.6 million for certain upfront financing and debt retirement costs. To securitize these costs, ELL proposes to implement Securitized Storm Cost Recovery Rider (Rider “SSCR”) Rates for each of the SSCR rate classes, effective with the first billing cycle of the month following the issuance date of the storm recovery bonds. Based upon a storm recovery bond issuance date of September 27, 2007, Rider SSCR will become effective with the first billing cycle of October 2007. The SSCR Rates, as periodically adjusted, will continue in effect until all storm recovery bonds shall have been paid in full and all financing costs of the storm recovery bonds shall have been recovered in full. Consistent with the LPSC Staff’s recommendation, the calculation of the SSCR Rates will apply to all rate classes, including the Special Contracted Rate customers and will be nonbypassable, which means that all existing and future LPSC-jurisdictional ELL customers will be responsible for these charges. The annual SSCR revenue to be recovered for ELL’s LPSC-jurisdictional operations is estimated to be approximately $62.6 million. These amounts assume a September 27, 2007 issuance of storm recovery bonds. If issuance of storm recovery bonds occurs before September 27, 2007, carrying costs will be reduced resulting in a lower amount to be securitized. Likewise if securitization occurs after September 27, 2007, carrying costs will be increased resulting in a higher amount to be securitized. Any insurance proceeds or governmental grants or aid reflecting permanent recovery of storm costs received before the issuance of the Financing Order would result in a reduction of the amount securitized. Any such funds received after issuance of the Financing Order would not affect the amount securitized. Rather, such funds, together with any interest earnings and any adjustments to the carrying charges associated with those insurance proceeds or governmental grants or aid reflecting permanent recovery of storm costs received after the issuance of the Financing Order will be returned to customers of ELL through the Securitized Storm Cost Offset Rider (Rider “SSCO”). Under ELL’s proposal, other adjustments required to compensate for certain costs or benefits related to the storms, including accumulated deferred income taxes, and certain effects of the securitization of storm recovery costs, including local franchise taxes, will be reflected in the Rider “SSCO.” The annual SSCO effect for ELL is estimated to be a reduction to ELL’s LPSC-jurisdictional customers’ bills of approximately $30.1 million. Using the method of allocation and rate design recommended by the LPSC Staff and based upon the collective charges submitted by ELL in its Securitization Application, currently ELL estimates that the storm recovery charge on the monthly electric bill of one of its LPSC-jurisdictional residential customers through proposed Rider SSCR using 1,000 kWh will be $6.33 per month. ELL estimates that the storm recovery charge on the monthly electric bill through proposed Rider SSCR for one of its LPSC-jurisdictional Small General Service customers using 30 kW and 5,000 kWh will be $27.45 per month and for one of its LPSC-jurisdictional Large General Service customers using 500 kW and 182,500 kWh will be $877.83 per month. ELL proposes that the amount of the storm recovery charge applied to each customer class be calculated based upon the allocation methodology and billing determinants specified in the Commission’s Financing Order as to ELL. Currently ELL estimates that the first year’s Rider SSCO imposed on the monthly electric bill of one of its LPSC-jurisdictional residential customers through proposed Rider SSCO using 1,000 kWh will be a credit of $1.57 per month, the first year’s Rider SSCO imposed on the monthly electric bill of one of its LPSC-jurisdictional Small General Service customers using 30 kW and 5,000 kWh will be a credit of $7.65 per month, and the first year’s Rider SSCO imposed on the monthly bill of one of its LPSC-jurisdictional Large General Service customers using 500 kW and 182,500 kWh will be a credit of $248.20 per month. ELL proposes that the amount of Rider SSCO applied to each customer class be calculated based upon the allocation methodology and billing determinants specified in the Commission’s Financing Order. In addition, contemporaneous with the effective date of Riders SSCR and SSCO, ELL will reduce its Rider FRP to reflect the removal of the amount of interim storm recovery and the amount of storm reserve recovery currently reflected in base rates, but which will be superseded by Riders SSCR and SSCO. Currently, ELL estimates that the reduction in Rider FRP relating to the two aforementioned items will be $2.29 per month for such a residential customer using 1,000 kWhs, $16.64 for a Small General Service customer using 30 kW and 5,000 kWh per month, and $324.46 for a Large General Service customer using 500 kW and 182,500 kWh per month. In sum, the total net effect of Riders SSCR and SSCO and the change in Rider FRP that is storm recovery cost-related to an ELL LPSC-jurisdictional residential customer using 1,000 kWh is estimated to be $2.47 per month. The total net effect of Riders SSCR and SSCO and the change in Rider FRP that is storm recovery cost-related to an ELL LPSC-jurisdictional Small General Service customer using 30 kW and 5,000 kWh is estimated to be $3.16 per month. The total net effect of Riders SSCR and SSCO and the change in Rider FRP that is storm recovery cost-related to an ELL LPSC-jurisdictional Large General Service customer using 500 kW and 182,500 kWh is estimated to be $305.17 per month. Based on rates in effect in February 2006, this equates to an increase of 2.3% for residential customers, 0.5% for Small General Service customers, and 1.7% for Large General Service customers. Members present: Fred Hall, Don Leach, Ralph Owen Members absent: None Others present: Jerry Lazenby, Lazenby & Associates, Inc.; Terry Cox, district manager The first item on the agenda was a corporate endeavor agreement with the City of West Monroe, Ouachita Parish Police Jury, Sewerage District No. 9 and Sewerage District No. 16 concerning a grant for a sewer study. Mr. Lazenby presented the facts of the study and Commissioner Leach made a motion to accept the agreement and Commissioner Hall seconded the motion. Mr. Cox presented the financial statement for the four months ended December 31, 2006. Following a complete review of the statement all agreed that the district is in sound financial condition. Next, was the resolution for ad valorem taxation of pipelines with the district. The original resolution was approved on December 11, 2006 and did not include the 2006 protest by the pipeline companies. The new resolution included these changes and was approved by a motion from Commissioner Hall and seconded by Commissioner Leach. The final item was cash disbursements. Mr. Cox presented the disbursements for the month. Commissioner Leach made a motion to accept them as reasonable and necessary and Commissioner Hall seconded the motion.
