ADVERTISEMENT FOR BIDS
Separate sealed bids for the construction of SPARTA Reuse Demonstration Project Part "D" will be received at the City Council meeting, to be held at 7:00 p.m. on March 13, 2007, and read aloud.
The contract documents may be examined at the following locations:
West Monroe City Hall, West Monroe, Louisiana
S.E. Huey Co., 1111 North 19th Street, Monroe, Louisiana
Copies of the contract documents may be obtained at the office of S.E. Huey Co., located at 1111 North 19th Street, Monroe, Louisiana, upon payment of $50.00 (refundable) for each set.
All bids must be accompanied by a Bid Bond in the amount of five percent (5%) of the Base Bid. No bidder may withdraw his bid withing thirty (30) days after the actual date of opening therof.
The successful bidder will be required to furnish a Performance and Payment Bond written by a company licensed to do business in Louisiana in an amount equal to 100% of the contract amount.
The Owner reserves the right to reject any or all bids within the law.

AN ORDINANCE AUTHORIZING THE CITY OF WEST MONROE, LOUISIANA TO SELL CERTAIN DESCRIBED IMMOVABLE PROPERTY WHICH IS NOT NEEDED FOR ANY PUBLIC PURPOSE BY THE CITY OF WEST MONROE, LOUISIANA TO MAYS & CO. REAL ESTATE DEVELOPMENT, L.L.C., FOR THE CASH SUM OF $490,000.00, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
WHEREAS, the City of West Monroe, Louisiana, owns certain immovable property which is not needed for public purposes, and
WHEREAS, the price offered, and the terms and conditions provided for the purchase of that property is fair and reasonable, and the sale and development of that immovable property will be beneficial to the City of West Monroe and its residents.
NOW, THEREFORE:
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the City of West Monroe, Louisiana is hereby authorized to sell certain immovable property which is not needed for any public purpose by the City of West Monroe, Louisiana, which property is more particularly described as follows, to-wit: Lot 7 and the southwestern 180 feet of Lot 5 of the West Monroe Commercial Park Subdivision, along with those two(2) 60-ft. by 70-ft. easements across the remaining portion of Lot 5 for the purpose of ingress, egress, and utilities (subject to the existing easements for drainage), all as more particularly set forth on the attached Exhibit A. to MAYS & CO. REAL ESTATE DEVELOPMENT, L.L.C., or its approved successors or assigns, for and in consideration of the cash sum of FOUR HUNDRED NINETY THOUSAND AND NO/100 ($490,000.00) DOLLARS, under the terms and conditions of that Standard Retail Purchase Contract to be entered into between the City and the Purchaser, and subject to the following conditions:
a) Subject to any and all development restrictions of record, and all rights-ofway and/or servitudes of record or of use; and
b) CITY reserves and excludes from this conveyance any and all right, title and interest in and to any and all oil, gas and other minerals in, on or under the Property, all of such interests being expressly reserved by CITY without any warranty whatsoever from or by BUYER; provided, however, that CITY expressly waives any and all surface rights in and to the Property resulting from this reservation; and CITY may not exercise any rights it may have in and to such oil, gas and other minerals in such a fashion that CITYÕs right to the use of the surface of the Property is disturbed so as to substantially negatively impact the operation of any business upon the Property.
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the
City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to execute a Deed on behalf of the City of West Monroe, Louisiana, reflecting the price and terms set forth above, and to take any other action or execute any and all other documents deemed by him either necessary or appropriate in order to transfer the above described immovable property as set forth above, including but not limited to including a provision, whether in the deed or in a supplemental agreement, that limits the nature of the initial construction and operation of the business to be located on that property to certain types of activities that requires the construction to be initiated within a certain time and/or pursued in a commercially reasonable manner through to completion by a certain time, together with such other requirement and provisions as he deems appropriate, including a provision that provides for a right and option in favor of the City of West Monroe to re-acquire the property at the same price if such conditions are not timely met or to provide for liquidated damages or other consideration payable to the City of West Monroe in lieu of such reacquisition, the terms, conditions or provisions of all of such conditions to be as determined appropriate by the Mayor.
SECTION 3. The above ordinance was introduced on January 9, 2007, in special legal session convened; notice of this ordinance was published three times in fifteen (15) days, one week apart, as required by R.S. 33:4712; no opposition being filed, it is considered by sections, voted on by yea and nay vote, passed and adopted in legal session convened this 13th day of February, 2007, with the final vote being as follows:

AN ORDINANCE REVOKING PORTIONS OF UNUTILIZED UTILITY SERVITUDES IN THE CITY OF WEST MONROE, LOUISIANA, BEING UTILITY SERVITUDES EARLIER DEDICATED TO THE CITY IN UNIT NO. 1, CONSTITUTION CENTRE, A COMMERCIAL SUBDIVISION, ET AL., WHICH HAVE BEEN SUPPLANTED BY THOSE UTILITY SERVITUDES DEDICATED IN THE PLAT OF THE RESUBDIVISION OF LOT 1, UNIT NO. 1, CONSTITUTION CENTRE, A COMMERCIAL SUBDIVISION, AND FURTHER PROVIDING WITH RESPECT THERETO.
WHEREAS, certain utility servitudes were dedicated for the benefit of the City of West Monroe, Louisiana, in the formation of Unit No. 1, Constitution Centre, a Commercial Subdivision, the plat of which is of record in Plat Book 18, page 86, records of Ouachita Parish, Louisiana and in the Transfer of Sewage and Water Facilities and Grant of Sewage and Water Easements of record in Conveyance Book 1380, page 247, under DR# 940399, records of Ouachita Parish, Louisiana.
WHEREAS, the subsequent commercial development within portions of that subdivision required the relocation of certain servitudes or portions of servitudes, and the dedication of additional utility servitudes, all of which are more fully set forth on the plat of the Resubdivision of Lot 1, Unit No. 1, Constitution Centre, a Commercial Subdivision, of record in Plat Book 19, page 102, records of Ouachita Parish, Louisiana (hereinafter "Resubdivision"); and
WHEREAS, as it has been the intent of the City of West Monroe, Louisiana to formally revoke the dedication of those unused and unneeded servitudes previously established, all of which are reflected by the designation of "(to be revoked)" on the plat of the Resubdivision, a copy of which is attached hereto with those portions to be revoked indicated in yellow, and the owner of that property has now requested the City take that action;
NOW, THEREFORE,
SECTION 1. BE IT ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that those portions of the utility servitudes indicated as "(to be revoked)" and indicated in yellow on the attached copy of the plat of the Resubdivision of Lot 1, Unit No. 1, Constitution Centre, a Commercial Subdivision, be and they are each hereby forever revoked and set aside.
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana be and he is hereby authorized to take any action or execute any further documents he deems either necessary or proper to carry out the provisions of the foregoing.
SECTION 3. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that this Ordinance and its provisions are to be construed to be severable in regards to any of its provisions, portions or parts, and that in the event any part or portion or provision of this Ordinance should be held invalid, then in such event, such invalidity shall not affect any other provisions, portions, or parts which can be given effect without the invalid provision, and this Ordinance hereby is declared severable.

AN ORDINANCE AMENDING SECTION 12-4019(e) OF THE CODE OF ORDINANCES, CITY OF WEST MONROE, LOUISIANA, RELATIVE TO FEES FOR PLAN REVIEW, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Section 12-4019(e) of the Code of Ordinances, City of West Monroe, Louisiana, is hereby amended, to read as follows:
Sec. 12-4019. Permit fees.

(e). When the valuation of the proposed construction exceeds one thousand dollars ($1,000.00) a plan is required to be submitted for review. A plan-checking fee shall be paid at the time of submitting plans and specifications. The amount of the planchecking fee for construction not requiring separate review by the Office of State Fire Marshal shall be $250.00. The amount of the plan-checking fee for all construction requiring separate review by the Office of the State Fire Marshal shall be as established in the Louisiana State Uniform Construction Code Plan Review Fee Schedule, as promulgated from time-to-time by the Louisiana Department of Public Safety and Corrections, Office of the State Fire Marshal, and if plan-checking is to be provided by the Office of the State Fire Marshal (as from time-to-time determined by the city), such plan-checking fee shall be paid directly to the Office of the State Fire Marshal at the time those plans are submitted.Ó
SECTION 2. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, that this Ordinance and its provisions are to be construed to be severable in regards to any of its provisions, portions or parts, and that in the event any part or portion or provision of this Ordinance should be held invalid, then in such event, such invalidity shall not affect any other provisions, portions, or parts which can be given effect without the invalid provision, and this Ordinance and the provisions of the Section above are hereby declared severable.
SECTION 3. BE IT FURTHER ORDAINED by the Mayor and Board of ldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that for cause determined to be in the best interests of the City of West Monroe and its citizens, this amendment shall be effective on and after February 14, 2007.

AN ORDINANCE APPOINTING A SUCCESSOR TRUSTEE FOR THE MONROE-WEST MONROE (OUACHITA PARISH) PUBLIC TRUST FINANCING AUTHORITY TO REPLACE THAT TRUSTEE WHOSE TERM EXPIRED FEBRUARY 28, 2007, THE TRUSTEE HEREIN BEING APPOINTED TO SERVE TILL FEBRUARY 28, 2012.
WHEREAS, the Monroe-West Monroe (Ouachita Parish) Public Trust Financing Authority, a public trust created pursuant to the provisions of Chapter 2-A of Title 9 of the Louisiana Revised Statutes of 1950, as amended, was established on February 28, 1979; and
WHEREAS, Dave N. Norris was reappointed Trustee of that Trust for a term of five years expiring February 28, 2007; and
WHEREAS, the service of Dave N. Norris in that position has been exemplary in that he has expended and sacrificed his time and effort in the establishment of the Trust Authority and its continued functioning;
NOW THEREFORE, BE IT ORDAINED, by the City Council of the City of West Monroe, Louisiana, in legal session convened, that Dave N. Norris, whose mailing address is 2305 N. 7th Street, West Monroe, Louisiana 71291-5278, hereby is appointed as a trustee of the Monroe-West Monroe (Ouachita Parish) Public Trust Financing Authority for the term of that Trustee which expired February 28, 2007, Dave N. Norris to serve in that position until February 28, 2012.
BE IT FURTHER ORDAINED, that the appointment of Dave N. Norris as stated hereinabove, is contingent and subject to his appointment to this position by the governing authorityof the City of Monroe, Louisiana, as required by Article VI of the Trust Indenture of the Monroe-West Monroe (Ouachita Parish) Public Trust Financing Authority.

AN ORDINANCE AUTHORIZING THE CITY OF WEST MONROE, LOUISIANA TO ENTER INTO A JOINT FUNDING AGREEMENT FOR WATER RESOURCE INVESTIGATIONS WITH THE GEOLOGICAL SURVEY, UNITED STATES DEPARTMENT OF THE INTERIOR RELATING TO THE INSTALLATION AND OPERATION OF A STATION AT MONROE, LOUISIANA.
Section 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the City of West Monroe, Louisiana, be and it is hereby authorized to enter into that Joint Funding Agreement for Water Resource Investigation with the Geological Survey, United States Department of the Interior relating to the installation and operation of a surface-water gaging on the Ouachita River at Monroe, LA to monitor discharge, which is attached hereto as Exhibit A, according to all terms, conditions and provisions as set forth therein.
Section 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana be and he is hereby authorized to execute that Joint Funding Agreement on behalf of the City of West Monroe, Louisiana, and to take any and all other action deemed by him either necessary or appropriate to effectuate execution of that Joint Funding Agreement for Water Resource Investigation with the Geological Survey, United States Department of the Interior.

WHEREAS, the City of West Monroe, Louisiana, through the “Keep West Monroe Beautiful” Board wishes to apply for a grant from Keep Louisiana Beautiful, Inc. in order to create and implement a cigarette litter prevention program for West Monroe, Louisiana; and
WHEREAS, the City of West Monroe, Louisiana strongly commits to supporting the mission of Keeping Louisiana Beautiful, Inc. and believes that this program will provide a valuable service to this community; and

AN ORDINANCE AMENDING SECTION 10-1004.1 OF THE CODE OF ORDINANCES, CITY OF WEST MONROE, LOUISIANA, RELATING TO ACTIVITIES NOT REQUIRING AN OCCUPATIONAL LICENSE, TO REFLECT THAT ALL QUALIFIED ACTIVITIES ON OR AT CITY OWNED FACILITIES OR RECREATIONAL AREAS ARE INTENDED TO BE EXEMPT, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Section 10-1004.1 of the Code of Ordinances, City of West Monroe, Louisiana, is hereby amended, to read as follows:
Sec. 10-1004.1. Activities not requiring an occupational license.
Notwithstanding any other provision of this chapter, activities with a duration of five (5) days or less and which are conducted at or upon the grounds of any city facility or recreational area, including but not limited to the Ike Hamilton Expo Center, the West Monroe Convention Center, the West Monroe Recreational Complex, Kiroli Park and Lazarre Point Recreation Area, and which involve either conducting an event, or which involve an activity operating in conjunction with a larger event, which event has rented or leased all or a portion of either of such facilities or areas shall be considered as an activity which is not required to obtain an occupational license for activities within the city during such time period.
SECTION 2. BE IT FURTHER ORDAINED, by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, that this Ordinance and its provisions are to be construed to be severable in regards to any of its provisions, portions or parts, and that in the event any part or portion or provision of this Ordinance should be held invalid, then in such event, such invalidity shall not affect any other provisions, portions, or parts which can be given effect without the invalid provision, and this Ordinance and the provisions of the Section above are hereby declared severable.
SECTION 3. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that for cause determined to be in the best interests of the City of West Monroe and its citizens, this amendment shall be effective on and after February 14, 2007.

The first item on the agenda was the audit report for the year ended August 31, 2006. Mr. Huffman presented the audit report to all present and following a complete review all present agreed the district is in sound financial condition. Commissioner Leach made a motion to accept the audit and Commissioner Hall seconded the motion. (audit report on file at the office of the district)
The next item was the Louisiana Compliance Questionnaire (for audit engagement of government entities). It was completed by the secretary of the commissioners and was accepted by a motion from Commissioner Leach and seconded by Commissioner Hall.
The next item was a scheduling conflict for the March meeting. The new date for the meeting will be March 5, 2007.
Next, Mr. Hammons of Lazenby and Associates presented the only bid that was received for the surge tank for the Kiroli Lift Station. Following an extensive discussion, Commissioner Leach made a motion to accept the bid and Commissioner Hall seconded the motion.
The final item was cash disbursements. Mr. Cox presented the disbursements and following a review, Commissioner Leach made a motion to accept the disbursements as reasonable and necessary and Commissioner Hall seconded the motion.
No further business being presented, the meeting adjourned at 12:10 p.m.

The jury box and the General Venire Box were then locked and sealed and delivered to the custody of the Clerk of said Court, subject to the orders of Court.
