Public notice is hereby given, as provided by Section 13, Article III of the Louisiana Constitution and R.S. 47:1907.1, that there will be introduced at the forthcoming session of the Legislature of Louisiana, to be convened on April 30, 2007, a bill relative to increasing the salary of all assessors in the state in various amounts depending on parish population; and to provide for related matters.

NOTICE
The Ouachita Parish School Board met in special session on Tuesday, December 19, 2006 at twelve (12:00) o’clock noon at its regular meeting place, the Ouachita Parish School Board office.
The following members were present: Jack White, Scott Robinson, A. R. Sims, Jerry R. Hicks, John Russell and Phillip Odom. Carey Walker was absent.
Special Projects and Safety Coordinator Kenneth Slusher led the Pledge to the Flag.
Board member A. R. Sims gave the Invocation.
On motion by Jerry Hicks, seconded by A. R. Sims, the Board unanimously approved the Minutes of December 4, 2006 as written.
Upon motion by Phillip Odom, seconded by A. R. Sims, the Board approved the revised Agenda as presented. Motion carried unanimously.
Upon motion by John Russell, seconded by A. R. Sims, the Board approved the amended Personnel Agenda as presented, including the changes since mail-out. Motion carried unanimously.
Abe Pierce, representing the Tri-District Boys and Girls Club, addressed the Board requesting to extend their present lease five (5) additional years from the September 2005 agreement, making it 55 years total. Whereby, John Russell moved, seconded by Scott Robinson, that the Board grant the Tri-District Boys and Girls Club a five-year extension to their present lease for use of the school board property, further stipulating that their board review the matter and consider purchasing the property in the near future.
Mr. Sims offered a substitute motion that the Board delay approval of the five-year lease extension to the Tri-District Boys and Girls Club until further review. Motion failed for lack of a second.
The following roll-call vote on Reverend Russell’s original motion was recorded: A. R. Sims, no; Jack White, yes; John Russell, yes; Jerry Hicks, yes; Phillip Odom, yes; and Scott Robinson, yes. Motion carried, with five (5) “yes” votes and one (1) “no” vote.
Upon the recommendation of Business Manager Richie Garrett, A. R. Sims moved, seconded by Jerry Hicks, to adopt the resolution permitting the Assessor to engage legal council for the Ad Valorem Tax Class Action Suit that challenges the on-going litigation over the assessment and ad valorem taxation of certain pipeline property located in Ouachita Parish. The Assessor of Ouachita Parish is in the process of reassessing the properties for the referenced taxpayers pursuant to Judgment issued by the 19th Judicial District Court. Pipeline companies challenging the Assessor’s reassessed valuation for the years 1994 through 2003 have lodged appeals with the Louisiana Tax Commission. Business Manager Richie Garrett advised that it would be in the Board’s best interest to join the class action suit to hire the experienced attorney on a contingency basis. The attorney’s fee would come from any “additional” taxes collected as a result of the new assessments. The Board’s obligation would not exceed ten (10%) percent of the additional taxes, interest or penalties colleted for its benefit for the payment of said legal fees if we win and cost nothing if we lose. Motion carried, with Scott Robinson casting the only “no” vote.
On motion by Jerry Hicks, seconded by A. R. Sims, the Board granted the matching funds request of West Ridge Middle School in the amount of $4,950.00 for capital expenditures consisting of a fountain and benches. Motion carried unanimously.
Special Projects and Safety Coordinator Kenneth Slusher discussed the possibility of the Board resurfacing and re-striping the parking lot of Edgewood Baptist Church located across the street from West Monroe High School. The parking is constantly used by students and guests during school hours and football games. Mr. Slusher feels that the Board should consider helping this church repair the damage caused by the students. The Board did not feel comfortable considering this request until Board attorney Elmer Noah has time to research their position on the matter.
Phillip Odom moved, seconded by A. R. Sims, that the Board grant permission to bid the following items: (1) Handicap bus [Bid No. 21-07]; (2) Pianos for Piano Lab at West Monroe High School [Bid No. 22-07]; (3) Air Conditioners (chillers) for (A. L. Smith and Central) [Bid No. 23-07]; and (4) Aviation Museum Renovations [Bid No. 24-07]. Motion carried unanimously.
The next scheduled meeting will be held on January 16, 2007 at 6:00 P.M.
There being no further business to be brought before the Board, Jerry Hicks moved, seconded by A. R. Sims, that the meeting adjourn. Motion carried unanimously.

AN ORDINANCE AUTHORIZING THE CITY OF WEST MONROE,
LOUISIANA TO SELL CERTAIN DESCRIBED IMMOVABLE PROPERTY WHICH IS NOT NEEDED FOR ANY PUBLIC PURPOSE BY THE CITY OF WEST MONROE, LOUISIANA TO MAYS & CO. REAL ESTATE DEVELOPMENT, L.L.C., FOR THE CASH SUM OF $490,000.00, AND OTHERWISE PROVIDING WITH RESPECT THERETO.
WHEREAS, the City of West Monroe, Louisiana, owns certain immovable property which is not needed for public purposes, and
WHEREAS, the price offered, and the terms and conditions provided for the purchase of that property is fair and reasonable, and the sale and development of that immovable property will be beneficial to the City of West Monroe and its residents.
NOW, THEREFORE:
SECTION 1. BE IT ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that the City of West Monroe, Louisiana is hereby authorized to sell certain immovable property which is not needed for any public purpose by the City of West Monroe, Louisiana, which property is more particularly described as follows, to-wit:
Lot 7 and the southwestern 180 feet of Lot 5 of the West Monroe Commercial Park Subdivision, along with those two(2) 60-ft. by 70-ft. easements across the remaining portion of Lot 5 for the purpose of ingress, egress, and utilities (subject to the existing easements for drainage), all as more particularly set forth on the attached Exhibit A. to MAYS & CO. REAL ESTATE DEVELOPMENT, L.L.C., or its approved successors or assigns, for and in consideration of the cash sum of FOUR HUNDRED NINETY THOUSAND AND NO/100 ($490,000.00) DOLLARS, under the terms and conditions of that Standard Retail Purchase Contract to be entered into between the City and the Purchaser, and subject to the following conditions:
a) Subject to any and all development restrictions of record, and all rights-ofway
and/or servitudes of record or of use; and
b) CITY reserves and excludes from this conveyance any and all right, title and interest in and to any and all oil, gas and other minerals in, on or under the Property, all of such interests being expressly reserved by CITY without any warranty whatsoever from or by BUYER; provided, however, that CITY expressly waives any and all surface rights in and to the Property resulting from this reservation; and CITY may not exercise any rights it may have in and to such oil, gas and other minerals in such a fashion that CITY's right to the use of the surface of the Property is disturbed so as to substantially negatively impact the operation of any business upon the Property.
SECTION 2. BE IT FURTHER ORDAINED by the Mayor and Board of Aldermen of the City of West Monroe, Louisiana, in regular and legal session convened, that Dave Norris, Mayor of the City of West Monroe, Louisiana, be and he is hereby authorized to execute a Deed on behalf of the City of West Monroe, Louisiana, reflecting the price and terms set forth above, and to take any other action or execute any and all other documents deemed by him either necessary or appropriate in order to transfer the above described immovable property as set forth above, including but not limited to including a provision, whether in the deed or in a supplemental agreement, that limits the nature of the initial construction and operation of the business to be located on that property to certain types of activities that requires the construction to be initiated within a certain time and/or pursued in a commercially reasonable manner through to completion by a certain time, together with such other requirement and provisions as he deems appropriate, including a provision that provides for a right and option in favor of the City of West Monroe to re-acquire the property at the same price if such conditions are not timely met or to provide for liquidated damages or other consideration payable to the City of West Monroe in lieu of such reacquisition, the terms, conditions or provisions of all of such conditions to be as determined appropriate by the Mayor.
SECTION 3. The above ordinance was introduced on January 9, 2007, in special legal session convened; notice of this ordinance was published three times in fifteen (15) days, one week apart, as required by R.S. 33:4712; no opposition being filed, it is considered by sections, voted on by yea and nay vote, passed and adopted in legal session convened this 13th day of February, 2007, with the final vote being as follows:

PROCEEDINGS OF THE POLICE JURY, PARISH OF OUACHITA, STATE OF LOUISIANA, TAKEN AT A SPECIAL MEETING HELD ON THURSDAY, DECEMBER 21, 2006 AT FOUR FIVE (4:05) P.M.
The Police Jury of the Parish of Ouachita, State of Louisiana met in special and legal session in the Ouachita Parish Police Jury Meeting Room, Courthouse Building, Monroe, Louisiana, on Thursday, December 21, 2006 at 4:05 p.m. and was duly convened by Walt Caldwell, President, who stated that the Police Jury was ready for the transaction of business.
Invocation was given by Ms. Kim Golden. Pledge of Allegiance was led by Ms. Kim Golden.

Motion was offered by Mr. Hargrove to adopt Ordinance No. 8861, as amended by removing the originally proposed OCC or Jail Operations Fund from Ordinance No. 8861 and replacing it with Jail Operations Fund Alternate No. 1. Mr. Calhoun seconded the motion.
ORDINANCE NO. 8861
AN ORDINANCE ADOPTING OPERATING BUDGETS OF REVENUE AND EXPENDITURES FOR THE FISCAL YEAR BEGINNING JANUARY 1, 2007 AND ENDING DECEMBER 31, 2007, FOR GENERAL FUND, SPECIAL REVENUE FUNDS, DEBT SERVICE FUNDS, AND CAPITAL PROJECTS FUNDS.
BE IT ORDAINED by the Police Jury of the Parish of Ouachita, convened in regular session on the 20th day of December, 2006, that:
SECTION ONE: The following detailed estimate of revenues and expenditures for the fiscal year beginning January 1, 2007 and ending December 31, 2007, be and the same is hereby adopted to serve as Operating Budgets of Revenues and Expenditures for the Police Jury Governmental Funds during said period.

SECTION TWO: The adoption of this Operating Budget expenditures be and the same is hereby declared to operate as an appropriation of the amount therein set forth within the terms of the budget classifications.
SECTION THREE: Amounts are available for expenditures only to the extent included within the 2007 budgets.
BE IT FURTHER ORDAINED that the Treasurer for the Ouachita Parish Police Jury, be and hereby is authorized and empowered to make line item changes within each Budget classification without approval by the Ouachita Parish Police Jury, as long as such line item changes do not increase the total amount of budgeted expenditures within a departmental classification. Any amendment of the Budgets which would increase departmental classifications in excess of the total amount budgeted for expenditures shall be reserved solely to the Ouachita Parish Police Jury.
The above Ordinance was introduced on December 18, 2006.
The Ordinance was submitted to a rollcall vote, and the vote thereon was as follows:

Motion was offered by Mr. Hargrove, seconded by Ms. Golden that pursuant to the provisions of LSA-R.S. 42:7, which provides that upon approval of two-thirds of the members present, that at a meeting of a public body, the public body may take up a matter NOT on the Agenda, that discussion of preparation of the appropriate paper work to bond the Treasurer be added to the Agenda.
Motion adopted. No opposition.
Motion was offered by Mr. Hargrove, seconded by Mr. Calhoun to authorize the Treasurer, with assistance from Counsel, to prepare the appropriate paper work to be bonded in the amount of $200,000.00 as required by State law.
Motion adopted. No opposition.
Mr. Caldwell opened the meeting for public participation.
Motion was offered by Mr. Hargrove, seconded by Mr. Calhoun to adjourn this meeting.
