The subject of Agency in Real Estate is one of much confusion with the public. The question often asked by both the buyer and seller in a real estate transaction is, Who is my Agent? Who represents my interest?

There are two types of representation in a real estate transaction involving a real estate agent, they are called Designated Agency in which an agent represents either the buyer or seller and Dual Agency in which the Agent represents both the Buyer and Seller. The controversy really centers around Dual Agency and can a single agent represent both buyer and seller in a fiduciary capacity.
