Toney, Davis map out defense strategies

Under indictment on 21 counts of fraud, identity theft and obstruction of justice, former Ouachita Parish Sheriff Royce Toney will argue he is not guilty of because he was performing his job as sheriff when the alleged offenses occurred, a recent court filing revealed.

In a letter dated June 27, Toney's defense attorney informed Assistant U.S. Attorney Mignonne Griffing that Toney will argue a defense of "the exercise of public authority."

A public authority defense is an affirmative defense that grants the charges are true but denies any wrongdoing because a public official was acting in good faith while exercising his duties as a public official.

Writing on behalf of Toney, attorney Michael Reese Davis said that, at all times mentioned in the Feb. 22 indictment, Toney "acted on behalf of the Ouachita Parish Sheriff's Office in his capacity as the elected sheriff and chief law enforcement officer of Ouachita Parish."
