Toney wants prosecutors' notes

Ouachita Parish Sheriff Royce Toney wants federal prosecutors to turn over notes and communications among FBI agents, prosecutors and certain staff members of the Ouachita Parish Sheriff's Office.

That request surfaced last week when Toney's attorney, Michael R. Davis, filed a motion in U.S. District Court to compel discovery in the government's case against the embattled sheriff. Toney was indicted and arrested on Feb. 24 on 21 counts of identity theft, fraud and obstruction of justice.

Toney's motion contends the defense needs notes and other information about a Feb. 24 meeting among federal prosecutors, FBI agents and Sheriff's Office employees. That information is critical to demonstrating that evidence gathered from Toney's office, safe and automobile was gathered during an illegal search.
"This meeting occurred on the same day as the arrest and initial appearance of Sheriff Toney and directly led to the warrantless searches in question," Davis wrote in the motion.
